Capital investment by big Japanese companies is expected to hit a record 31.9 trillion yen ($213 billion) in fiscal 2023 ending next March, shattering the record for the second year running, a Nikkei survey finds.

Spending on plant and equipment is forecast to rise 17.3% from the previous year overall, driven by the demand for electric vehicle (EV) production[not gonna end well that part for sure]and data centers as artificial intelligence (AI) becomes widespread.

The semiannual survey collected revised plans for domestic and overseas capital investment as of the end of October from 874 listed companies and others with capital of 100 million yen or more. Year-on-year growth in spending is likely to be the fastest since fiscal 2000. The Japanese currency's depreciation in the foreign exchange market has pushed up the value of overseas capital investment in yen terms-see cap 2 for the YE strength-

Manufacturing industries increased planned investment 21.0% and nonmanufacturing industries 11.5%.

By industry, only four sectors - paper and pulp, real estate, construction, and mining foresee less capital spending than the previous year. Automakers are beefing up production capacity for EVs and car batteries, both domestically and abroad.

Toyota Motor increased its investment 5.9% to 1.97 trillion yen from its initial plan for the current fiscal year, which was already a record. A SpaceX Falcon Heavy rocket is poised to launch the X-37B space plane for the U.S. Space Force on tonight (Dec. 11) after a one-day delay due to weather, and you can likely watch the action live.

Liftoff of the Falcon Heavy is scheduled to occur from Launch Complex-39A at NASA's Kennedy Space Center in Florida, during a 10-minute window that opens at 8:14 p.m. EST (0114 GMT Dec. 12). If, as expected, SpaceX webcasts the liftoff, you can watch it live here at Space.com. SpaceX announced its delay of the flight by 24 hours early Sunday.

"Now targeting Monday, December 11 for Falcon Heavy’s launch of the USSF-52 mission, with weather conditions forecasted to improve to 70% favorable for liftoff on Monday night," SpaceX wrote on X (formerly Twitter). "The team will use the time to complete additional pre-launch check outs."

The upcoming launch will be the seventh launch to date for the reusable X-37B space plane its first-ever ride on a Falcon Heavy, which could have consequences for its coming orbital mission.

Five of the six X-37B launches to date have employed United Launch Alliance Atlas V rockets, with one other using a SpaceX Falcon 9. Former President Donald Trump has several viable avenues to have the Supreme Court throw out federal charges he’s facing for his efforts to challenge the results of the 2020 election, several lawyers and Constitution experts told The Epoch Times.

His best case is that the charges encroach on his First Amendment rights, but he might also successfully assert presidential immunity or argue the law was impermissibly stretched by prosecutors, the experts said.

President Trump was charged by Special Counsel Jack Smith on Aug. 1 with obstructing electoral vote counting by Congress on Jan. 6 and conspiring to do so in order to stay in power. The conspiracy was allegedly carried out by spreading false claims that fraud and illegalities swayed the election outcome and using those false claims in attempts to convince various officials to overturn the results. President Trump’s lawyers have launched a barrage of motions to have the charges dismissed on constitutional grounds, statutory grounds, due to presidential immunity, and for malicious prosecution. While some of the claims are weak at best, others appear persuasive, according to the experts.

In practice, however, President Trump’s arguments will need to convince his judge, the appeals court, or, in the final instance, the Supreme Court. The experts predict that the District of Columbia federal judge on the case, Tanya Chutkan, will almost certainly deny all the motions to dismiss. Trump's Washington Election Trial Must Be Televised, Media Coalition Argues

A coalition of media outlets wrote Friday that the 2020 election trial for former President Trump should be broadcast.

A coalition of mainstream media outlets argued that the 2020 election trial against Republican presidential frontrunner Donald Trump should be televised live to bolster "public trust" and that the U.S. Constitution mandates it.

"Of all trials conducted throughout American history, this one needs the public trust that only a televised proceeding can foster. Because the Constitution allows—indeed requires—such access here, the Federal Rules cannot prohibit it," the lawyers for media organizations including the New York Times, CNN, and The Associated Press wrote on Friday in a court filing.

The coalition's lawyers wrote the media outlets are acting on "behalf of millions of Americans who have an unprecedented interest in observing—for themselves—the prosecution of former President Donald Trump" during the trial, which is scheduled to start in March 2024.

Federal rules have long stipulated that courts bar cameras from being inside courtrooms. During President Trump's arraignment in the Washington case, no cameras were allowed inside the building.

The media outlets' lawyers also appeared to criticize President Trump after he "characterized this action as bearing 'all the unfortunate badges of a trial in an authoritarian regime, lacking legitimacy or due process.'" The lawyers then claimed that this comment goes against "the very legitimacy of this proceeding" and "only underscores" the need for the American public to watch the trial.
