Kavanaugh cites landmark gay rights cases in argument about abortion restrictions

Supreme Court Justice Brett Kavanaugh seemed to suggest earlier this week that landmark LGBTQ cases could support overturning federal abortion rights.

The Supreme Court heard 90 minutes of oral arguments Wednesday concerning a Mississippi law that would ban almost all abortions in the state after 15 weeks of pregnancy.

A majority of the court’s conservative justices appeared prepared to uphold the law and possibly overturn Roe v. Wade, the 1973 landmark decision holding that women have a constitutional right to have an abortion before fetal viability, usually around 24 weeks.

The crux of Wednesday’s oral arguments centered around whether the justices should preserve or walk back on precedent, a court decision that is considered authority for subsequent cases involving similar or identical circumstances. The court’s liberal justices warned that reversing a decades-old ruling would politicize the country’s highest court.

However, citing two landmark gay rights cases — Lawrence v. Texas, which struck down state laws criminalizing consensual same-sex activity in 2003, and Obergefell v. Hodges, which resulted in the legalization of same-sex marriage across the United States in 2015 — Kavanaugh suggested that overruling the court’s previous opinions was standard procedure.

“If you think about some of the most important cases, the most consequential cases in this court’s history, there’s a string of them where the cases overruled precedent,” Kavanaugh said. “If we think that the prior precedents are seriously wrong, if that, why then doesn’t the history of this court’s practice with respect to those cases tell us that the right answer is actually a return to the position of neutrality and — and not stick with those precedents in the same way that all those other cases didn’t?”

The lawyers who argued in favor of gay rights in the landmark LGBTQ cases offered differing views on the validity of the argument by Kavanaugh, who was appointed in 2018 by then-President Donald Trump.

Mary Bonauto, who argued on behalf of same-sex couples in Obergefell v. Hodges and now serves as the Civil Rights Project director at GLBTQ Legal Advocates & Defenders, or GLAD, challenged Kavanaugh’s analogy.

“It’s a pretty thin interpretation of a reversal,” she told NBC News. “The reversals that Justice Kavanaugh is citing were about righting wrongs. They were centered on the rights of individuals and expanding constitutional protections to more individuals, not about taking rights away.”

When the court ruled in favor of same-sex couples in Obergefell v. Hodges, it effectively overturned its prior decision in Baker v. Nelson. That ruling centered on Jack Baker and Mike McConnell, who in 1970 were blocked from obtaining a marriage license. The high court rejected the men's case in 1972 without ever hearing oral arguments.

Bonauto argued against Kavanaugh’s comparison of reversing Baker v. Nelson to the potential reversal of Roe v. Wade.

“There was no briefing, there was no argument. They just essentially utterly dismissed the case for basically: ‘There’s no way same-sex couples seeking to marry have claim under the Constitution.’ The end,” she said.

LGBTQ advocates largely agreed with Bonauto, saying that the landmark gay rights decisions in Obergefell v. Hodges and Lawrence v. Texas “reflected the growing societal understanding of our common humanity.”

“To that we say, NOT IN OUR NAME,” Sharon McGowan, legal director of the LGBTQ advocacy group Lambda Legal, said of Kavanaugh’s argument in a statement Wednesday. “Those landmark LGBTQ decisions EXPANDED individual liberty, not the opposite.”

But during the oral arguments, Justice Sonia Sotomayor raised the question of whether overruling Roe v. Wade could open the floodgates for the court’s 6-3 conservative majority to overrule a broad swath of previous opinions it does not agree with.

The Jan. 6 Committee Is Promising It Has the Goods. We’re About to Find Out

The House Select Committee to Investigate the Jan. 6 Attack on the U.S. Capitol has been busy.

In the five months since the probe was launched, the committee has issued dozens of subpoenas to high-profile members of former President Trump’s circle, as well as a smattering of other MAGA-affiliated figures involved in the effort to overturn the results of the 2020 election. The process has been fraught for a number of reasons, but revelations that have emerged from Rolling Stone’s conversations with cooperating sources indicate the committee could be sitting on a mountain of material — material that could clarify what happened on Jan. 6, and who’s to blame for it.

“We are making rapid progress,” the committee’s vice chair said at a House Rules Committee hearing on Thursday. “We anticipate next year, we will be conducting multiple weeks of public hearings, setting out for the American people in vivid color exactly what happened, every minute of the day on January 6th, here at the Capitol and at the White House, and what led to that violent attack.”

Cheney’s announcement signals a new phase of the investigation, in which the committee will push the machinations behind what happened on Jan. 6 into public view. The makeup of these forthcoming hearings is unclear, but the fact that they’re public and will last for “several weeks” should cement Jan. 6 as a key issue throughout the 2022 campaign season.

One figure of interest who seems open to testifying publicly is Bernard Kerik, the former New York City police commissioner and pal to Rudy Giuliani who allegedly participated in the now-infamous Jan. 5 meeting at the Willard Hotel. At that meeting, Giuliani, Steve Bannon, John Eastman, and others discussed how to overturn the election results. Politico reported on Thursday that Kerik won’t provide documents unless he’s allowed to testify publicly. He’d previously said he’d comply with his subpoena but demanded the committee apologized to him for making “false statements.”

Alex Jones, the conspiracy theorist who reportedly helped plan the rally at the Ellipse, and Jeffrey Clark, a former Justice Department official whom the committee on Wednesday night recommended be charged with contempt for defying his subpoena, have also indicated they’d be open to testifying publicly. The committee probably won’t be interested, though. Public testimony makes it easier for witnesses to coordinate their stories, which would make it more difficult for the committee to piece together what actually happened on Jan. 6, rather than what a bunch of Trump allies want people to think happened.

Signaling a willingness to testify publicly makes it seem like a witness want to comply, but it doesn’t mean they aren’t effectively obeying Trump’s directive to stonewall the committee. Trump has done so himself through his likely doomed effort to prevent the committee from getting ahold of White House documents from the National Archives. Bannon did so extremely publicly in refusing to show up for his deposition and was subsequently charged with criminal contempt. Mark Meadows has agreed to cooperate, reaching an agreement with the committee this week after first refusing to comply. It’s unclear to what extent Stephen Miller, Michael Flynn, Roger Stone, and other high-profile Trump allies will play ball, but it wouldn’t be surprising if many of them follow Trump and do what they can to stick it to the committee.

It’s easy to focus only on the big names and what they’re doing to make the committee’s work more difficult, but Cheney promising weeks of “vivid color” recounting of what happened is a reminder that the committee has been in touch with an untold number of other figures who were swirling around Trump’s efforts to overturn the election. Chairman Bennie Thompson (R-Miss.) said on Thursday that they’ve interviewed 250 people, most of which have cooperated voluntarily. The committee seems confident they’ve already drawn enough to paint a clear picture of why, how, and at whose direction hundreds of Trump supporters were able to break into the Capitol in a violent attempt to overthrow American democracy. We’ll see next year.

A top State Department official urged a key senator earlier this year to tamp down the language in a bill meant to prevent the importation of goods from China that are made using Uyghur forced labor, according to a new report.

The Washington Post, citing Biden administration officials, reported Thursday that Deputy Secretary of State Wendy Sherman told Sen. Jeff Merkley (D-Ore.) — a co-sponsor of the bill — in October that the White House wanted lawmakers to take “a more targeted and deliberative approach” to determining which items would be barred from the US.

Versions of the bill, known as the Uyghur Forced Labor Prevention Act, passed the House of Representatives in September 2020 and the Senate by a unanimous vote in July this year. The House is expected to vote on its version of the bill again sometime next week.

The measure includes a provision requiring importers to prove that goods originating in the Chinese province of Xinjiang were not manufactured using forced labor. The Washington Post reported that Sherman objected to that provision, which has also been criticized by major corporations.

Upon arriving from Cairo, Egypt, Biden apparently told Israel to offer “unilateral withdrawals from areas with no strategic importance” in the West Bank and Gaza, according to an Israeli memo from the time.

Biden cited talks in Cairo in which Egyptian officials had accepted “Israel’s military superiority,” the Times of Israel reported.

His advice apparently did not impress Meir and Syria and Egypt attacked Israel less than six weeks later. The memo described the young Biden as being full of respect for Meir, but having “made comments that signaled his lack of diplomatic experience.”

The memo notes that Biden felt it was “impossible to have a real debate in the Senate about the Middle East as senators were fearful of saying things unpopular with Jewish voters.”

Biden was also reportedly critical of the Nixon administration for being “dragged by Israel.” The president has seemingly left such hesitation in the dust in recent years, describing himself as a “Zionist” in 2007.

His Open Society Foundations have invested an estimated $17 million into STF in 2020.

Pierre Omidyar, an Iranian immigrant, currently the richest man in Hawaii, is a Big Tech billionaire born to wealthy foreign students in Paris, who brought him here as a child. His mother, a Berkeley academic, heads a pro-Iran group financed by her son’s fortune.

Omidyar injected an estimated $45 million into an STF fund.

The billionaires handled their own initiatives related to this past election.

Omidyar finances both Black Lives Matter and Never Trumpers. The eBay billionaire is the hidden hand behind the fake “Facebook whistleblower” advocating censoring conservatives. He has a project to “reimagine capitalism” while funding The Intercept which openly touts Marxism.

Meta, the new name for Facebook Inc., has co-developed a platform that asks people to submit their intimate photos and videos in order to prevent them from being used as ‘revenge porn’ on Facebook or Instagram.

The special hashtags, or “digital fingerprints,” are then assigned to those materials by the tool, and can be used to instantly detect and curb attempts to upload them online by the perpetrators.

Meta said that the system had been developed “with privacy and security at every step.” Only the hashtags are being shared with StopNCII.org and the tech platforms participating in the project, while the explicit images and clips never leave the user’s device and remain “securely in the possession of the owner,” it assured.

The new tool represents “a sea-change in the way those affected by intimate image abuse can protect themselves,” Revenge Porn Helpline manager Sophie Mortimer insisted.

Police: Man of ‘Possible Middle Eastern Origin’ Tried to ‘Buy’ Woman’s Daughter Outside School

A mother in Sheffield, South Yorkshire, was left alarmed and horrified when a man of “possible Middle Eastern origin” approached her as she walked her young daughter to school and attempted to “buy” her.

The incident in the multicultural city took place on the morning of December 1st, with the male — one of a group of three, it is believed — described as looking like he was in his late thirties or early forties and wearing a grey hooded top and dirty navy bottoms, with his face partly obscured by a head warmer.

“At approximately 8.20 a.m. on December 1st, a local resident was walking her daughter to Lower Meadow School along Batemoor Road. The shocking incident follows similar events in Doncaster, another urban centre in South Yorkshire, earlier in November, when another woman was followed through a Primark store in the city centre and offered a “good price” for her daughter.

South Yorkshire Police — who initially denied they had received reports of the incident — later announced an investigation, saying that “It was reported that on the 12th of November at around 4 p.m., a woman and young girl were in Primark where they believed they were being followed by a group of men” and that “The men made them feel uncomfortable and allegedly made inappropriate comments towards the young girl.”

While the police offered no descriptions of the suspects beyond referencing their sex, the mother of the girl said in a social media post quoted by local media that they were “Four foreign men”.

“[They] surrounded us in the women’s clothes section so I asked what they was doing and why they kept following us!” she recalled.

“They said she is such a beautiful girl – good price.

“Never have I felt so sick to my stomach !!! PLEASE keep an eye out!!” she warned.

Yorkshire has been exposed a hotbed of so-called grooming gang activity in recent years, with a large number of mostly-South Asian background men raping and pimping mostly white working-class girls and young women in locations including Huddersfield, Rochdale, and Rotherham, with police and social services repeatedly failing to intervene even when they were aware of the abuse.

Facebook unbans Kyle Rittenhouse… exec who called Rittenhouse mass murderer ‘coincidentally’ leaves company…

Facebook has lifted restrictions on users praising or searching for the name of Kyle Rittenhouse after he was acquitted of all charges for fatally shooting two people and injuring another in Kenosha, Wis., last year amid a wave of protests against police violence.

It shifts a policy implemented days after the Aug. 25, 2020, shootings, when the company said it had removed Rittenhouse’s accounts on both Facebook and Instagram, in addition to “removing praise and support of the shooter” and blocking “searches of his name on our platforms.”

“After the verdict in Kenosha we rolled back the restrictions we had in place that limited search results from returning content related to key terms including Kyle Rittenhouse,” Andy Stone, spokesman for parent company Meta, said in a statement. “While we will still remove content that celebrates the death of the individuals killed in Kenosha, we will no longer remove content containing praise or support of Rittenhouse.”

Rittenhouse will be allowed to rejoin the platforms either through creating new accounts or by asking for his previously removed accounts to be restored, but will be subject to their terms of service, Stone said.

The company’s reversal on the search-blocking policy was first reported by the BBC.

Rittenhouse’s case became a partisan pain point, with conservative leaders accusing Facebook and other social media companies of implementing policies that revealed prejudice in the case, which ignited a polarizing national debate over guns, race and self-defense.

Facebook faced particular blowback after Brian Fishman, the company’s former policy director for counterterrorism and dangerous organizations, publicly said the company designated the shooting as a “mass murder” in August 2020.

Sen. Josh Hawley (R-Mo.), an outspoken critic of Facebook and other social media giants, said in a statement last month that tech companies “made up their minds on this case months ago, sought to deny Kyle Rittenhouse the presumption of innocence and censored those who disagreed.”

Fishman announced on Oct. 28 that he had “decided to leave Facebook to pursue other opportunities.” Fishman said his last day was Nov. 19, the day the jury rendered a ruling in Rittenhouse’s case.

In a pair of tweets Wednesday, Fishman said he had “relayed a Facebook internal decision using the term of art used by the company” when he called the shooting a “mass murder.” He said the timing of his departure aligning with the verdict was “entirely coincidental.”
