Federal judge orders 32 Florida counties to print sample ballots in Spanish for Puerto Rican voters
A federal judge issued a 27-page ruling Friday that requires elections officials in 32 Florida counties to provide Spanish-language sample ballots for the November general election, according to published reports.
A coalition of voting rights advocacy organizations filed a lawsuit against the state in August, arguing that Florida Secretary of State Kenneth Detzner is failing “to protect the rights of Spanish-speaking Puerto Ricans to vote stateside.”
Where does it stand?
U.S. District Judge Mark Walker partially sided with plaintiffs, but indicated there is not enough time to order more extensive steps, according to reports.
The case potentially impacts more than 36,500 Puerto Ricans living in one of the 32 counties, according to reports. The figure does not include islanders who moved to the mainland after the devastating 2017 hurricane.
Since the election is less than two months away, Walker considered concerns from county elections supervisors who indicated it would be difficult to make sweeping changes at this late date.
He also stated that Defendant Detzner is Florida’s chief election officer and must uphold the enforcement of election laws.
Detzner previously argued that he has no relevant power over the county supervisors of elections, the report stated.
“Puerto Ricans are American citizens,” Walker stated. “Unique among Americans, they are not educated primarily in English — and do not need to be. But, like all American citizens, they possess the fundamental right to vote.
He also wrote: “Voting in a language you do not understand is like asking this Court [to] decide the winner of the Nobel Prize for Chemistry — ineffective, in other words. Courts have long held that the right to vote includes not only the right to physically enter a polling place and fill out a ballot but also the right to comprehend and understand what is on that ballot.”
He continued: “It is remarkable that it takes a coalition of voting rights organizations and individuals to sue in federal court to seek minimal compliance with the plain language of a venerable 53-year-old law.”
Walker did not address every demand. For example, he did not include provisions to have counties “create official Spanish-language ballots, absentee and early voting applications and ballots, voter registration forms or to hire certified translators,” according to NPR.
What did plaintiffs say?
Stuart Naifeh, senior counsel at Demos, one of several groups that filed the motion for the preliminary injunction, told NPR: “Today’s decision affirms what we have said in this case—that Puerto Rican citizens must be given full and equal access to the franchise. Individuals who are still dealing with devastating losses from Hurricane Maria should not also have to contend with discrimination at the polls.”
While the preliminary injunction is not a final ruling on the case, it suggests Walker is likely to side with the plaintiffs, according to NPR.

Ana Franklin is making history as the first woman to run for sheriff of Morgan County.
Franklin, 45, is running for the Republican nomination against two-term incumbent Greg Bartlett and contender Noel Mayfield, a former Decatur police officer.
Franklin was an investigator for the sheriff's office before retiring in December, when she went into business buying Family Fitness Center.
Franklin said that, if elected, she would run a transparent sheriff's office.
"I think the sheriff's office is probably one of the biggest responsibilities there is in Morgan County," Franklin said. "There are so many opportunities to do good in that office. We need to look at the things that are good and keep them, and we need to look at things that are not and change those."
Franklin said sheriff's office financial records for such funds as the pistol permit and inmate food would be available for citizen inspection if she were elected.
"I'll work hard and I will do it with integrity," she said.
Franklin said she would immediately apply for grants to help pay for putting resource officers in the county's school system.
"Community awareness through education is critical," she said. "We don't have any resource officers in our county schools and there are grants that can be obtained to put them there. I would get the funding because it's needed."
In addition to working at the sheriff's office, Franklin also was a volunteer in Limestone County Sheriff Mike Blakley's office and a volunteer and founding member of the North Alabama Search Dog Association.
"(Blakely) told me there was no bigger responsibility than to be a law enforcement officer, and that's what I believe," she said.
In the Morgan County Sheriff's Office, Franklin was lead investigator for the sex offenders unit.
She was named the 2007 Morgan County Law Enforcement Officer of the year because she had the highest number of arrests in the county.
She was the first woman assigned to the county's drug task force and worked vice and narcotics, where she saw first-hand the dangers of crystal meth.
"I am the only candidate who is certified in meth labs, and I made hundreds of meth arrests," she said. "I didn't come after everything was over. I suited up and was one of the first to go through the doors, pulling samples."
She told The Decatur Daily that law enforcement is more than making arrests.
"Sure, we want to arrest those who break the law, but we also need to do prevention through educational sources," she said. "That's why I feel we should start when they're young in school teaching them about meth and crime."

Mayor Eric Garcetti's office claims that the Mayor was "unaware" of the arrangement until July, when new LAPD Chief Michel Moore shut the program down. Garcetti recently came under fire for a similar taxpayer funded security detail which his political action committee, the Democratic Midterm Victory Fund, has agreed pay for. This has left some to wonder if a similar entity will reimburse the city for her roving police shadow.
"We're asking whether or not that same sort of arrangement might apply here, where somebody affiliated with Kamala Harris' campaign or her Political Action Committees might consider reimbursing LA City taxpayers for the money, which now is nearing $50,000 by our amateur accounting," reports Eric Leonard of NBC LA.
Mayor Eric Garcetti's office said the Mayor was, "unaware," of this unusual arrangement until July, when it was shut down by new LAPD Chief Michel Moore.
"It was not until Chief Moore was sworn in, conducted a new assessment of the threat, determined that this arrangement was no longer needed, and informed Mayor Garcetti, that the mayor became aware of the state-wide detail," Garcetti spokesman Alex Comisar wrote in an email Wednesday.
Garcetti said former LAPD Chief Charlie Beck was solely responsible for the program. -NBC LA
"Chief of Police Charlie Beck assigned a security detail for US Senator Kamala Harris shortly before she was sworn into office in 2017, based on a threat assessment he believed to be credible," said LAPD spokesman Josh Rubenstein. "Funding for the detail was provided by the Department budget."
Former Chief Beck's signature can be found on several LAPD documents authorizing the excursions, including one in which two officers flew to Oakland with Harris to a "retirement event" for a CA DOJ official - just 10 days after she was sworn-in to the Senate.
Meanwhile, records reveal that Harris flew to San Francisco at least seven times between January 2017 and July 2018, including an April 2017 trip in which Harris gave television interviews, and a March 2018 speech at a YMCA event. Also included were a June 2018 police escort to the San Francisco Pride Parade, where LAPD officers can be seen flanking the Senator.
LAPD officers have also traveled to Fresno, Sacramento and San Diego for Harris - whose communications director Lily Adams told NBC: "Since she became a protectee more than a decade ago, Senator Harris has always deferred to public safety experts on procedures, protocols and determinations," adding "Our office did not request or question LAPD's decision to provide protection and we are grateful for the ongoing work of officers in Los Angeles and across the state who risk their lives to keep all Californians safe."
Chief Moore canceled the program right around the time the Los Angeles Times filed a lawsuit demanding that Mayor Garcetti turn over records on his own taxpayer-funded security detail while traveling out of state, following the refusal by both City Hall and the LAPD to provide the documents through a California Public Records Act request.
"Unfortunately we are not able to give out this information, as it could potentially undermine the Mayor's safety and security," LAPD spokesman Rubenstein wrote in an email to the Los Angeles Times that was cited in the newspaper's lawsuit.
The LA Times says in their lawsuit that the records are not exempt from public disclosure - noting that the US Secret Service have provided security detail costs for both Presidents Trump and Obama, while the cities of Seattle, Baltimore and Chicago have all produced similar mayoral expense records to the public.

The Federal Emergency Management Agency (FEMA), in coordination with the Federal Communications Commission (FCC), will conduct a nationwide test of the Emergency Alert System (EAS) and Wireless Emergency Alerts (WEA) on September 20, 2018. The WEA portion of the test commences at 2:18 p.m. EDT, and the EAS portion follows at 2:20 p.m. EDT. The test will assess the operational readiness of the infrastructure for distribution of a national message and determine whether improvements are needed.
The WEA test message will be sent to cell phones that are connected to wireless providers participating in WEA. This is the fourth EAS nationwide test and the first national WEA test. Previous EAS national tests were conducted in September 2011, 2016 and 2017 in collaboration with the FCC, broadcasters, and emergency management officials in recognition of FEMA’s National Preparedness Month.
The EAS is a national public warning system that provides the President with the communications capability to address the nation during a national emergency. The test is made available to EAS participants (i.e., radio and television broadcasters, cable systems, satellite radio and television providers, and wireline video providers) and is scheduled to last approximately one minute. The test message will be similar to regular monthly EAS test messages with which the public is familiar. The EAS message will include a reference to the WEA test:
“THIS IS A TEST of the National Emergency Alert System. This system was developed by broadcast and cable operators in voluntary cooperation with the Federal Emergency Management Agency, the Federal Communications Commission, and local authorities to keep you informed in the event of an emergency. If this had been an actual emergency an official message would have followed the tone alert you heard at the start of this message. Some cell phones will not receive the test message, and cell phones should only receive the message once. The WEA test message will have a header that reads "Presidential Alert" and text that says:

The WEA system is used to warn the public about dangerous weather, missing children, and other critical situations through alerts on cell phones. A deadly fire underneath a wealthy hacker's Maryland home has exposed a bizarre underground nuclear bunker project that claimed the life of a young man he hired over the internet to dig tunnels, Askia Khafra, reports the Associated Press.
Maryland prosecutors portray Beckwitt, a 27-year-old millionaire, as a paranoid computer hacker who recklessly endangered Khafra’s life. In May, they secured Beckwitt’s indictment on charges of second-degree murder and involuntary manslaughter. -AP
Prosecutors say Beckwitt had a "paranoid fixation" about a possible nuclear attack by North Korea.
27-year-old millionaire Daniel Beckwitt took elaborate steps to conceal the tunnels, which begin 20 feet underground and extend approximately 200 feet out from from the property - going so far as to hide the location of his house from the 21-year-old Khafra, who lost his life in a Setpember 10, 2017 fire in Beckwitt's basement.
A police report said Beckwitt told investigators how he tried to preserve his project’s secrecy when he took Khafra there. Beckwitt said he would rent a car, pick Khafra up and drive him to Manassas, Virginia, where he had the younger man don “blackout glasses” before driving him around for about an hour. Khafra spent days at a time working, eating and sleeping in the tunnels. He had his cellphone with him, but Beckwitt used internet “spoofing” to make it appear he was in Virginia, according to Montgomery County prosecutor Douglas Wink.

Investigators found the younger Khafra’s charred body in the basement of Beckwitt’s Bethesda home. A hole in the concrete basement floor led to a shaft that dropped down 20 feet (6 meters) into tunnels that branched out roughly 200 feet (60 meters) in length. -AP
“These are the lengths the defendant went through in order to hide the truth from Askia Khafra as to where he was and to maintain the secrecy of these tunnels,” Wink said during a May 31 hearing.
Khafra met Beckwitt online and agreed to dig the tunnels in exchange for an investment in an internet company the younger man was launching.
Beckwitt lived alone in what are described as "extreme hoarder conditions," which forced he and Khafra to navigate through a maze of junk and trash, according to Wink. The tunnel dig had lights, an air circulation system and a heater which were supplied by a "haphazard daisy chain" of power strips which created a fire risk, according to the prosecutor.
Several hours before the deadly fire, Khafra texted Beckwitt to notify him of a smoke smell in the tunnels. Beckwitt responded by flipping a breaker that turned off the lights, however he turned the power back on when Khafra said he could not see. Prosecutors say Beckwitt ignored "obvious signs" of danger.
"I always feared something dangerous would happen to him" said Khafra's father, 69-year-old Dia Khafra, who says his son was impressed by Beckwitt's wealth.
“I think Askia was very trusting,” he said. “He believed in the guy.”
Dia Khafra said he only met Beckwitt once, when he dropped off his son at their home. He seemed shy.
“He said he made his money off bitcoins,” Khafra recalled. -AP
Beckwitt's attorney describes him as a successful "day trader" who has made millions trading stocks, and compared his client's concerns to "the days of the Cuban missile crisis."
According to AP, Beckwitt lived with his parents at the Bethesda house until he left for college at the University of Illinois, where he was arrested by campus police in 2013 for charges including computer fraud. Authorities suspected him of installing keystroke loggers on the Urbana school's computers. Beckwitt pleaded guilty and was sentenced to two years probation.
The conviction did not steer Beckwitt away from computers after he moved back to Maryland. In 2016, he spoke at a hacker convention using the alias “3AlarmLampscooter” while wearing a fire-resistant suit and visor that obscured his face.
Wink said Beckwitt was teaching his audience how to make thermite bombs to destroy computer data “to get away with hacking”.

Doctors prescribed this shit like candy, I remember getting prescribed it when I had my wisdom teeth extracted, appendix removed, etc. It was getting prescribed over abundantly for routine surgeries/pains (not sure if that's still the norm). I wouldn't take it, was fine with advil, but most people don't think about it and just take it as prescribed in these minor pain situations and they end up getting addicted. It happened to my brother. Addiction killed him, he fought it for years, but eventually succumbed. He was a very smart person, was not an addict by choice and fought valiantly. Thomas Andrews Drake (born 1957) is a former senior executive of the U.S. National Security Agency (NSA), a decorated United States Air Force and United States Navy veteran, and a whistleblower. I will say that about Lietenant Conference Call. Dude turned everything into a conference call with the whole damned detachment E-4+, but we were all expected to be his warrant officers and I do have him to thank for being able to wear the Type 3 back when it was limited by command. For better or for worse.
