Jim Jordan Criminally Refers Jack Smith to DOJ For Prosecution

House Judiciary Chairman Jim Jordan (R-OH) on Wednesday criminally referred former special counsel Jack Smith to the Justice Department for prosecution.

In a letter to Acting Attorney General Todd Blanche, Chairman Jordan said Jack Smith’s testimony included “intentionally false statements designed to obstruct the Committee’s oversight.”

Former Biden special counsel Jack Smith could face potential criminal prosecution after Republicans accused the ex-prosecutor of misleading Congress about the scope of his investigation into President Donald Trump.

House Judiciary Committee Chairman Jim Jordan, R-Ohio, issued a criminal referral of Smith on Wednesday, arguing newly released records contradict Smith’s testimony to his committee that he did not obtain or review lawmakers’ text messages during his multiple probes into President Donald Trump.

“All individuals have an obligation to comply with a duly authorized congressional inquiry. Mr. Smith, a former public servant, is no different,” Jordan wrote in a letter to acting Attorney General Todd Blanche on Wednesday. “Yet his testimony included intentionally false statements designed to obstruct the Committee’s oversight.”

“His conduct can only be understood as an effort to thwart the Committee’s inquiry by intentionally making false statements and representations before Congress,” Jordan continued, adding that the Justice Department should examine whether Smith’s actions warrant criminal charges.

Senate Judiciary Chairman Chuck Grassley last Tuesday revealed that Jack Smith spied on 44 members of Congress and actually read their text messages.

It was previously reported that Jack Smith obtained “toll records” or ‘call logs’ of members of Congress

In fact, Jack Smith said under oath that he did not read any text messages – but this is not true.

Jack Smith sat down for a deposition last December. Members of Congress asked him questions about his Arctic Frost investigation under oath.

Jack Smith lied under oath when asked if the records he requested included the contents of calls and texts.

“Did the records that you requested – the toll records from the members of Congress include the content of text messages?” the investigator asked.

“No,” Jack Smith said.

Todd Blanche suggested he will prosecute Jack Smith for lying under oath.

“Have you thought about investigating Jack Smith for perjury?” Senator Hawley asked Todd Blanche during last week’s confirmation hearing.

“We take testimony in front of this body very seriously. Yes,” Blanche said.

“Good. I think he absolutely should be investigated. I hope that you prosecute him,” Hawley said.

“Yes, Senator,” Blanche said.

House approves bill restricting lawmakers’ ability to purchase and sell stocks

Democrats said the bill was “corrupted” with the add-on of a provision from the controversial SAVE America Act.

The House passed a bill Wednesday that would restrict the ability of members of Congress and their families to buy and sell stocks, splitting Democrats over concerns that the language didn’t go far enough.

The Stop Insider Trading Act, the first congressional stock trading ban bill that has received a House floor vote, passed 232-198, with 13 Democrats supporting the legislation.

The legislation had only two Democratic co-sponsors, out of 93 total lawmakers that signed on to the bill. A separate bill that restricted congressional stock trading even further by requiring members and their families to divest from current individually held stock had more significant bipartisan support, but will not be put on the House floor.

Most Democrats say the measure that passed doesn’t go far enough, because it does not include a sell-back requirement.

Rep. Bryan Steil (R-Wis.), the lead sponsor of the bill, said Wednesday ahead of the vote that “it’s time we ban members of Congress from being able to buy individual companies’ shares of stock. Doing so removes even the appearance of impropriety.”

Steil also said the roll-call vote allows every American to know where their member stands on congressional stock trading.

However, a large number of Democrats may have been deterred from supporting the bill after a voter ID requirement was added ahead of the vote. The added provision was part of the SAVE America Act, a controversial bill heavily supported by President Donald Trump that would mandate proof of citizenship to register to vote in federal elections and would impose strict photo ID requirements.

Rep. Joseph Morelle (D-N.Y.), the top Democrat on the House Administration Committee, called the voter ID provision a “poison pill.”

“Republicans have corrupted their so-called stock trading bill with a decaying piece of the SAVE American Act corpse,” Morelle said during debate on the legislation.

Senate action on congressional stock trading is uncertain. The chamber has not scheduled a vote on its own version of the legislation, which seeks to prevent not only members of Congress and their families but also the president and vice president and their families from owning and trading individual stocks.

Sen. Josh Hawley’s Halting Ownership and Non-Ethical Stock Transactions Act has bipartisan support but goes further than the House’s bill.
