The Daily Wire appears to be the lead plaintiff in challenging Democrat President Joe Biden’s vaccine mandate after the Ohio-based 6th US Circuit Court of Appeals was chosen to take on the issue following a ping-pong ball lottery. The Daily Wire was the first plaintiff to file a challenge to the mandate in the 6th circuit.
The case challenges the Biden administration’s mandate, which is enacted through OSHA, that forces employers with more than 100 employees to have their employees vaccinated or to conduct regular coronavirus testing.

The 6th Circuit Court of Appeals has won the lottery to hear legal challenges to the Biden administration's vaccine rule that affects some 84 million workers.
The lottery was announced after multiple lawsuits against the administration were filed in several federal appeals courts. In a process resembling a Powerball drawing, a dozen ping pong balls, each representing one court, were placed into a wooden drum on Tuesday. The winning ball was drawn in Washington, D.C., by a selector from a judicial panel that oversees multidistrict litigation.
The Biden administration rule was formally issued on Nov. 5 by the Occupational Safety and Health Administration. It requires employers with 100 or more workers to ensure their workers are vaccinated against COVID-19 or undergo weekly testing starting Jan. 4.
Lawsuits were filed in all 12 regional circuit courts
Lawsuits challenging the rule came in quick succession. Within 10 days, 34 lawsuits were filed, covering all 12 regional circuit courts and giving each of those courts one entry into the lottery.
The 6th Circuit Court of Appeals, based in Cincinnati, Ohio, is known to lean conservative, with most of its judges appointed by Republican presidents. Wyoming coal plant chosen for Gates-backed advanced nuclear reactor project
WASHINGTON (Reuters) - An advanced nuclear power venture founded by billionaire Bill Gates said on Tuesday it has chosen a town in Wyoming as the site to build a $4 billion demonstration plant that will get half its funding from the U.S. government.
TerraPower's Natrium plant will be built in Kemmerer, a remote western Wyoming town where the Naughton coal plant is due to shut in 2025. Pending permits, the 345 megawatt plant will open in 2028, which is the timeline mandated by Congress.
The project will get about $1.9 billion from the federal government including $1.5 billion from the bipartisan infrastructure bill that President Joe Biden signed this week. The bill included about $2.5 billion for advanced nuclear reactors.
"It's a very serious government grant," said Chris Levesque, president and CEO of TerraPower, which is partnering with GE Hitachi Nuclear Energy. "This was necessary because the U.S. government and the U.S. nuclear industry was falling behind," he told reporters.

Former Labor MP Craig Thomson charged over alleged migration fraud
Former federal Labor MP Craig Thomson has been charged over his alleged involvement in a multi-million-dollar migration fraud.
Australian Federal Police (AFP) officers arrested Mr Thomson, 57, at his Terrigal home on the NSW Central Coast this morning.
It's alleged he was the "prime facilitator" of the scheme.
Mr Thomson was charged with two offences, including providing false documents relating to non-citizens.
If convicted, he faces a maximum 10 years behind bars.
The former member for Dobell allegedly facilitated more than 130 fraudulent visa applications, focusing on food service employees and regional farm workers, over four years.
It's alleged Mr Thomson gained more than $2 million from the scheme.
Police claim the scheme was designed to defraud legitimate visa programs.
The charges were triggered by an Australian Border Force (ABF) investigation into allegations of significant visa and migration fraud, dating back to August 2019.
A total of nine search warrants were executed, including at premises in the Sydney suburbs of Revesby and Rockdale.
ABF Assistant Commissioner Erin Dale said authorities were determined to clamp down on so-called "cash for visa" schemes.
"This investigation demonstrates the unwavering resolve of the ABF and AFP in preventing the exploitation of foreign workers in Australia," she said.
"Cash for visa schemes as they are often known target vulnerable visa holders who may not be aware of Australian laws and workplace entitlements."
Mr Thomson is expected to face Gosford Local Court today.

Immediately following the release of the OSHA rule, The Daily Wire was the first major company to file a lawsuit against the Biden administration, as the company noted in a report earlier this month:
The lawsuit does not take a position on whether someone should receive the vaccine or not, only against Biden’s mandate, announced earlier this year and unveiled on Thursday morning. The mandate applies to all companies with 100 or more employees and forces those businesses to police the vaccine status of their employees. The Daily Wire, with over 100 employees, falls under the mandate.
The Daily Wire’s lawsuit seeks to overturn Biden’s executive action, arguing that the order is unconstitutional and that the Biden administration violated federal law in drafting it.
Jeremy Boreing, co-founder and co-CEO of The Daily Wire, explained the company’s decision, saying, “We’re not the enforcement arm of the federal government.”
“Forcing Americans to choose between their livelihoods and their freedom is a grotesque abuse of power and we won’t be a party to it,” Boreing added. “We will not incur the cost of implementing this testing regime. We will not incur the liability of inserting ourselves into the private health decisions and information of our employees. Our company was founded to stand against tyranny, and we will.”

The Sixth Circuit’s roster of active and senior status judges includes 20 judges appointed by Republicans and six appointed by Democrats, tilting the odds towards a GOP majority panel and potentially giving the shot-or-test rule’s opponents an advantage. About a third of the circuit’s active status judges were tapped by the Trump administration.
Republican-appointed judges are generally expected to be more skeptical of the emergency regulation, given partisan differences in views on administrative agency power and the need for vaccine mandates, legal observers said.
An all-GOP, three-judge Fifth Circuit panel in New Orleans trashed the rule—calling it unlawful and probably unconstitutional—in an opinion last week that upheld a stay on the standard. That decision revealed how hostile some Republican-appointed judges are to the regulation. Two of those three judges were appointed by the Trump administration.
The Occupational Safety and Health Administration finalized its contentious rule earlier this month, which it issued under its power to set temporary regulations necessary to address workplace hazards that present a “grave danger.” The rule applies to employers with at least 100 workers.
Republican attorneys general, employers, unions, and other organizations filed 34 petitions seeking review of the OSHA rule in 12 different circuit courts, according to the U.S. Judicial Panel on Multidistrict Litigation. Unions sued in an apparent—and ultimately unsuccessful—attempt to steer the litigation to one of the circuits that may have been more inclined to uphold the regulation.
Although the Fifth Circuit temporarily halted the rule before the case was transferred, the Sixth Circuit will have the authority to modify or lift that order.
The case eventually will be assigned to a three-judge panel, meaning the Republican-appointed judge majority in the entire circuit doesn’t guarantee the panel will havethe same majority.

David addressed how sometimes we see the present without seeing the past and Israel is made to look bad because the world doesn’t know the full story.
According to David there are three reasons that Israel is made to look bad.
He says that the outlet that many anti-Semites have is through hatred of Israel.
David also says that people are afraid of anything pro-Israel. In countries such as Paris, Denmark and certain cities in Germany, Jewish people are afraid to wear yamakahs because they are afraid of being attacked by Arabs.
There is also the notion of double standards. He said that if the US or NATO as superpowers do something for example, killing Osama Bin Laden, it is fine. But, if Israel had been the country to do it there would be a huge backlash.
David talked about the political and security issues in Israel in his presentation entitled, “Israel is in the Eye of the Storm.” Currently there is no “left wing” in Israel. David said that in order for there to be a “left” there needs to be a country to negotiate with. Currently, Israel does not have a country to negotiate with.
The event was free and open to the public. At the end of the presentation audience members were able to ask David questions about Israel and the current situation in the Middle East.
An audience member asked David about his thoughts on retaliation by Al Qaeda due to the death of Bin Laden since Bin Laden was outspokenly anti-Jewish and anti-Israel. David responded by saying that he thought the main target would be the United States because Al Qaeda is generally against the West.
On May 8, David was the keynote speaker at the “Day of Remembrance” event at the Harry & Rose Samson Family Jewish Community Center (LINK http://www.jccmilwaukee.org/).
The Mossad (LINK http://www.mossad.gov.il/Eng/AboutUs.aspx) was appointed by the State of Israel to collect information, analyze intelligence, and perform special covert operations beyond Israel’s borders.

Maryland Mayor Arrested On 50 Counts Of Distributing Revenge Porn On Reddit
A Maryland mayor was arrested and charged with 50 counts of distributing revenge porn, Maryland State Prosecutor Charlton T. Howard III announced Monday.
Charges were filed against Andrew Bradshaw, the mayor of Cambridge, in the Circuit Court for Dorchester County, according to a statement from Howard’s office.
Bradshaw allegedly created multiple accounts on the public Internet forum Reddit using variations of the name and birthday of a victim with whom he had a previous romantic relationship, according to court documents.
The mayor is accused of having posted nude photographs of the victim to various Reddit and subreddit forums related to sexual activity, humiliation, degradation, race, and other topics, alongside racial slurs and sexually explicit language without her consent or knowledge and with the intent to harm her.
As per court documents, the victim, who is in her 20s, contacted law enforcement on or around May 14, 2020 when she discovered that the nude photographs of her had been posted to Reddit without her consent.
The victim told officers that she had only shared the photographs in question with one person, Bradshaw, when they were in an intimate relationship, but had not given him consent to share them.
His alleged actions are in violation of Maryland’s Revenge Porn Statute, the state prosecutor said.
Under Maryland’s Revenge Porn Statute, an individual may not distribute private images, video footage, or any reproduction of the image of another person that reveals their identity while exposing their intimate body parts or displays them engaged in sexual activity, without their consent and with the intent to harm them.
If convicted, Bradshaw would face a maximum penalty of two years’ in jail and a $5,000 fine for each count.
“Using someone’s private images without their consent is a serious breach of trust and invasion of privacy, and the power and breadth of the Internet makes such a violation even more egregious,” said State Prosecutor Howard.
“Our office is committed to protecting victims from those who abuse their positions of power and trust.”
In a statement posted to Cambridge’s website, the city said it is “aware of the matter involving the Mayor” but that “the business of the City is unaffected.”
“The City is currently gathering information and will cooperate fully with the Maryland State Police and the Office of the State Prosecutor,” the statement said. “As this is an active legal matter, no further comments will be made at this time.”

Here at this blog we do a lot of research of fake deaths, and on the surface, Denver’s had all the earmarks. He died at an appropriate age (53, 5+3 = 8, Spook marker*), and the circumstances of his death are completely hinky. He is said to have been struggling with the fuel tank switch in his Long EZ, a second-hand home-assembled model he bought and flew even as he could easily afford something new, something factory built. It doesn’t read well. Denver, a smart man and accomplished pilot with hundreds of hours of flight time, was not going to perish in an act of idiocy.
Other markers of fake death are present as well. Denver’s once-prolific output had dwindled, his more current offerings were just not very good. As with Elvis, Karen Carpenter, John Lennon and most recently Prince, faking death is a business decision that maximizes the monetary value of the body of work. Denver’s Greatest Hits, along with his cutting room debris, have all been repackaged and resold to the tune of millions of dollars, as with the others who fake their deaths.
I’ve been working on this issue for months now, off and on, and am convinced now that John Denver did not die that day. Too many things are wrong with the picture. And yet, I don’t think I will ever be able to prove beyond reasonable doubt that he didn’t. While the people who planned the charade were sloppy and while the whole day of his death seems a cheap and contrived detective novel, there is enough “evidence” to keep the myth alive. There is a fingerprint match, probably facilitated by Monterey Sheriff Norman G. Hicks, and the absence of two toes on the corpse, said to be a link to the real Denver, but probably contrived and circular. While I cannot disprove these two pieces of evidence, I will cast doubt.

Below is a screen grab of a known video of Denver in 1993:
Several things jump out at us. One, in side view close-ups in the New Zealand video, Denver has pronounced crows-feet and other facial wrinkles, where in the image above his eyes and face are still youthful and unwrinkled. Of course, that could be makeup and the poor quality of video available in 1993, as the latter is a stage performance. So that is not conclusive. In 1993, Denver was 49 years old. Tough call. In 2009, he was 65. The crow’s feet and lines below look more like 65 than 49.
The other matter however is a bigger tell, and that is the quality of the video. A member of the team that shot the video in 1993 claimed it was done on Sony Betacam 1/2 inch tape. Tyrone, a writer on this blog who has seen the above video and has good knowledge on such matters, says it is entirely plausible that it was shot in 1993 when Denver was still a big deal and high-technology films would be made of his performance. The question is, why? The conversion to video is slick and contains high production values. In 2009, putting it on YouTube does not generate a revenue stream. They basically kept it in the can for all the years it had maximum value (1998 especially), and then cut it loose for nothing.

The Dan O'Donnell Show has revealed that Jump Kick Man is a 40-year-old black male from Kenosha, Wisconsin. His name has been withheld "as he has not been criminally charged in connection with the Rittenhouse case," according to the radio show host.
"Sources indicate that he contacted prosecutors and offered to testify, but in exchange requested immunity from an ongoing drunk driving and domestic abuse case with which he was charged in June," according to O'Donnell.
At the time of the shootings, the man was reportedly out on probation following a conviction for domestic violence battery. He originally faced a jail sentence of nine months, but accepted a plea deal less than two months before the August 25 incident.
That plea deal gave the man 12 months probation instead of jail time. He reportedly violated that plea deal the following year, and was sentenced to seven months in jail.

If Republican presidential candidate Donald Trump wins the election, he might have to fill more than just Antonin Scalia’s seat on the Supreme Court.
“I can’t imagine what this place would be I can’t imagine what the country would be with Donald Trump as our president," said Supreme Court Associate Justice Ruth Bader Ginsburg
In an interview with The New York Times, Supreme Court Associate Justice Ruth Bader Ginsburg shared her concerns about a Trump presidency:
“I can’t imagine what this place would be ― I can’t imagine what the country would be ― with Donald Trump as our president. For the country, it could be four years. For the court, it could be ― I don’t even want to contemplate that.”
Then, she added that her late husband would have joked, “Now it’s time for us to move to New Zealand.”
Kidding aside, Ginsburg reportedly has no plans to step down from the bench “as long as I can do it full steam.” But, she noted that she was not the only aging member of the court so whoever was elected in November could end up filling a number of vacancies.
Her latest comments echoed those she made in an interview with The Associated Press last week, when she also indicated she wasn’t looking forward to the possibility of Trump moving into the White House.
“I don’t want to think about that possibility,” she said.
In the Times interview, Ginsburg expanded on her thoughts about the future of the court and said the Senate should take action on Judge Merrick B. Garland, President Barack Obama’s nominee to replace Scalia.
“That’s their job,” Ginsburg said. “There’s nothing in the Constitution that says the president stops being president in his last year.”

The discovery of the vials prompted a lockdown of the facility, which has since been lifted. The FBI and CDC launched investigations, which remain ongoing.
The CDC will arrive on site tomorrow to take custody of the vials and transport them to another facility for testing, the alert notes. No personnel were reportedly exposed to the material.

Stowaway bird found in moving van after four-day journey from Las Vegas to Maine
WESTBROOK, Maine —
A man moving from Las Vegas to Maine ended up finding a stowaway roadrunner in his rented moving van.
The Avian Haven got a call from the driver after he arrived at a Westbrook storage facility at the end of his four-day journey from Las Vegas. The man had found the bird hiding in the storage area of the van.
Staff sent over a Portland, Maine-based volunteer, and with the driver's help, they were able to coax the bird out of the back of the van and into a net. Two other volunteers helped relay the bird up to Avian Haven bird sanctuary in Freedom.
Haven staff was able to identify it as a Greater Roadrunner, native to the American Southwest. The bird was in remarkably good shape for having gone four days without food, but is now recovering in a makeshift heated habitat.
Experts at the Haven will work with Maine's Department of Inland Fisheries and Wildlife, as well as its Nevada counterpart to coordinate the bird's return to its native lands.

An interesting dig if someone has the time.
Many years ago, early 90's, I used to come home on Friday night, order a pizza and salad, and watch TV with my hina.
One of the shows I watched was Unsolved Mysteries. This was back in the day when I used to subscribe to Popular Mechanics and someone ran a classified ad entitled "Hypersonic Spyplane landing at Top Secret Base". I sent the 15 bucks. 6 months later, I got my check back citing "Technical Difficulties" as the reason they could not ship my video. This was back in the Glenn "DesertRat" days.
So I am watching Unsolved Mysteries. The show has something about UFOs in it. In the last 30 seconds of the show, I saw what looked to be a short, fat, wide SR-71-looking craft at this really lush green base on an overcast day.
That, my frens, was in the peak of the Aurora hype train. The site was Machrinhanish (sp- who cares) and that was our new Mach 5 splyplane.
Shortly thereafter, we heard about a whole bunch of bird colonels dying in a helicopter crash in Scotland. The rumor mill said the chopper crossed her wake too close when she was taking off.
We have seen a humongous vapor belch off the coast of Oxnard which is very much in the flightline of the pacific test range.
She used to cross over El Segundo at 10:00AM every Thursday on the way home back in 1996-1997.
There is proof of that bird out there. She is elusive but she can be found and she is badder than fuck.
In the last 10 years, they have built a lot of different stuff. Think 60 degree planform that flies like a harrier. I have seen it once. They flew it up Miller Canyon on a pitch black moonlit weeknight, louder than hell, she turned over the ridge line and I could see her glowing white hot ducts and inward-canted tailfins.
They also have some 60 degree planform drones that literally hover. They make no noise. You can hear the turbo fans spool up with they move it horizontally but when it is hovering verically, you literally cannot hear it. Think BAE systems. Think the old March airfield. All of the infrastructure is there to run a program.
It is all right here in the southwest.

Smallpox, a disease caused by the variola virus, is considered so deadly that only two labs in the world are authorized to store samples of the virus, including one in Russia and the other at the CDC in Atlanta.
