N.H.’s ballot-counting machines are two decades old, with no replacement in sight

Experienced New Hampshire voters will see something quite familiar when they cast their primary ballots Tuesday: A vote-counting machine that hasn’t changed in more than two decades.
The AccuVote optical reader has been part of Granite State elections since the early 1990s, when it was first accepted by the Secretary of State’s office.
It’s a 14-pound box that looks like an oversized laptop computer sitting on top of a collection bin. As each voter leaves the polling place, poll workers slip their ballot into the AccuVote slot and the machine bounces light off the paper. Sensors tally filled-in circles next to candidates’ names and then the ballot falls into the bin below the reader.
After polls close, the reader prints out the results, with all the paper ballots available for a recount.
Other technologies have come and gone over the years but AccuVote has remained, and today is still the state’s only legal ballot-counting technology. On primary day it will be used in 118 towns and 73 city wards, leaving the other 100 or so towns in the state, including several in the Concord area, to count ballots on election night by hand.
That long record is a comforting sign of reliability in the wake of the Iowa caucus failure caused by a new, untested app. The AccuVote readers have been involved in thousands of elections, giving polling officials experience in its operation, and in hundreds of recounts, giving experience in its reliability.
It’s also disconnected from the internet or other networks, making it very difficult to hack. For example, each election’s software update, telling the machine which races are in which place on the ballot, gets loaded into each machine separately from thumb drives sent to each community.
But old technology can be worrisome, too. The software for the AccuVote reader runs on WindowsXP, an operating system that hasn’t been supported by Microsoft since 2014, making it vulnerable to crashes. The machines themselves aren’t made anymore, so the provider has to buy old ones and cannibalize them for parts when repairs are needed.
That’s why the state has been looking for a replacement for more than a year, including a one-day trade show in the State House last February, at which four firms tried to convince the state to buy their updated machines which tally results from paper ballots. (Paper ballots are required under New Hampshire law.)
It turns out, however, that updating a 1990s technology can be hard because so many other things have been developed around it, which is why the state has not chosen a successor technology.
“After reviewing the products of those machines, they are quite involved, to the point that there is not a replacement that we can go out and approve and put into service that is like the (one) we use now,” said Dave Scalan, New Hampshire’s Deputy Secretary of State.
The main complication, he said, is all these new systems depend upon their own style of paper ballot which means that all elections in New Hampshire, including local ones, would have to adopt the machines.
“They would have to be compatible with what the state does, or the voters are going to be bouncing back and forth between different types of voting systems, which would be confusing,” he said.
The modern systems can do a lot more than the current system, such as flag uncertain votes for instant visual inspection by poll workers, but that’s because they are a lot more complex.
“The more software that is contained, the more suspicious people become of their ability to properly count ballots,” Scanlan said. “We would probably have to come up with some kind of system to audit ballots after the fact.”
Regular audits after elections is a hot topic in New Hampshire. The Secretary of State’s office has long opposed them as an unnecessary expense but some advocates say they can help instill confidence in the election system. A bill before the House would allow voters in any AccuVote community to request a post-election audit, a request currently limited to when results are very close or somehow contested.
Scanlan said the office is continuing to look into the future of vote-counting machines, but is also working on other modernization of the election process.
That includes electronic polling books to replace the written records still kept by virtually all checklist supervisors – Derry and Milford are testing electronic versions – as well as the possibility of online voter registration or automatic voter registration, both of which are the subject of bills being considered by the Legislature.
“If those bills pass, our resources are going to be diverted in that direction,” said Scanlan

Vermont voting machines do not use Smartmatic software, Winters says

Vermont uses Dominion voting machines but does not use Smartmatic software, Deputy Secretary of State Chris Winters told Vermont Daily this week.
Earlier this week, Winters confirmed that Vermont uses Dominion voting machines, “a much older model than those being called into question by the conspiracy theorists.” Yesterday Vermont Daily posed a follow-up question: “What software is used to tabulate the votes? Is it Smartmatic?” Winters’ response is printed verbatim below.
“Our tabulators do not use Smartmatic software.
“It may also be of interest to you and your readers to know a bit more about the process we use to ensure votes are counted accurately and securely:
“Approximately 155 towns use tabulators. The rest are hand count towns. All towns in Vermont use Accuvote Optical Scanner vote tabulators. This is an older model that has not been newly manufactured for many years. We are still using them because they have been well-maintained and do not see a large volume of ballots like in other states (low mileage). These employ basic optical scanning technology that reads the ovals marked on paper ballot by the voter. They do not create an image of the ballot like many newer models. There is no weighted or fractional voting option on these machines.
“The tabulators are never connected to the internet or to each other. The results from the tabulators do not pass through a corporation or third party. The tabulators produce a paper printout of the results. The data is transferred from the tabulator tape printout, by hand, by the clerk, into our election management system for the purpose of results reporting.
“In the 48 hours after the election, the clerks do a very careful matching of the voter entry checklist and the number of votes counted to ensure they match and confirm their results.
“After the election, the Secretary of State’s Office conducts a random audit of at least six towns where we pull all of their paper ballots and rerun them through different machine provided by a separate, independent auditing company. We have been doing this for many years and have found that the tabulators we use are more accurate than hand counting. In those audits, we have never found more than a few vote difference, often caused by the human transcribing of the results and not the machine itself. These machines are highly accurate and trustworthy based on that experience and if you ask a town clerk, they will tell you the same.
“The other states being called into question in the presidential election also have paper ballot backups and do similar post-election audits.
“People are right to ask questions. However, wild accusations without at least some evidence to back it up simply undermines faith in our elections and has in fact resulted in death threats to good, hard-working election officials of both parties. Press conferences, online videos and tweets are not evidence. Looking to the court cases, we have yet to see these same allegations of widespread fraud presented under oath and with admissible evidence.”

Who owns Dominion Voting Machines?
Dominion Voting Machines was founded by John Poulos and James Hoover back in the early 2000s. Poulos serves as the company's CEO. In 2018, the company was acquired by Staple Street Capital, which is a private equity firm.
The board of directors for Dominion isn't fully available, but one member of the Staple Street Capital's board is William E Kennard. He was nominated as ambassador to the European Union by former President Barack Obama in November 2009, according to his biography on Yale's website.

Remove connectivity. Voting machines should not be connected to the internet as it leaves them open to hacking.
Voters should be able to read their ballots. Digital “ballot-marking” voting machines that encode voters’ selections in an unreadable barcode present another vector of attack, since voters can’t know if the choices they believe they have made are the ones that actually have been recorded.
Use Hand-Marked Paper Ballots – preventing the possibility of errors due to machine malfunction, mis-calibration, or hacking. Paper ballots are reliable and let voters vote even if power is lost and machines fail.
Optical Scanner Voting Machines (Opscans) – quickly count hand-marked paper ballots, tally election results and retain digital images of the paper ballots to facilitate recounts, audits, and adjudication.

The big picture

What we’re watching today
After some worry and a long legal fight, ranked-choice voting made no difference in the outcomes of Maine elections. In the two races on Maine’s ballot to use the voting method, U.S. Sen. Susan Collins, a Republican, emerged with a clear majority of votes. A polarized Maine also handed outright majorities to Democratic presidential nominee Joe Biden statewide and in the 1st Congressional District and to Trump in the 2nd District.
It came after Collins, who took the victory after trailing House Speaker Sara Gideon, D-Freeport, in polls all year, joined others in her party to criticize the voting method, which was seen as favoring Gideon because progressive candidate Lisa Savage had the biggest share of independent support. By the end, the senator did not have to worry about it.
State Republicans put hundreds of thousands of dollars behind a people’s veto effort to repeal the 2019 law extending the method to presidential elections that was eventually disqualified from the ballot over signature issues. But the first-in-the-nation experiment ended with a yawn as third-party hopefuls barely registered here with a collective 3 percent of votes.
Voters elsewhere were wary of the method. While Maine has supported ranked-choice voting twice at the ballot box, liberal Massachusetts shied away from adopting it on Tuesday after Republican Gov. Charlie Baker campaigned against it. In Alaska, a wider-ranging referendum to create a single primary election for each public office while sending the top four vote-getters to a general election decided by ranked choice also failed.

ake Waramaug, a private, tree-lined lake surrounded by tony homes in Litchfield, Conn., has earned an apt new nickname amid a recent real estate renaissance — one that’s scandalizing its more affluent, proud and humorless denizens.
“No one calls it that,” sniffed longtime local Ken Stiles when asked his opinion on the nickname “Lake Goldman” — a name the lake has earned following a recent influx of real estate investors from the finance industry.
Stiles has lived in the lakeside community for almost a decade, and runs By Request, a local concierge service.
“It’s a total misnomer,” he told The Post.
But less sensitive locals swear that Waramaug’s increasingly popular nom de guerre is now on the tips of the tongues of the cognoscenti.
“I’ve heard plenty of people use that nickname,” laughed another homeowner who weekends on the lake. “It’s meant affectionately.”
Although just two partners of the great vampire squid are known to own properties on the lake, a swarm of financial types — fleeing the city and the woes of the COVID-19 pandemic — and soaring home prices have given old-timers the distinct impression that Lake Waramaug is somewhere down by Wall Street.
“It’s a very New England way of life, understated, very much a low-key, quiet existence,” said Louis Lemieux — a former private equity staffer who now runs Blueprint, an interiors store in the area — of the area’s appeal to Wall Street tycoons.
Peter Klemm, a former hedge funder who now runs the pre-eminent real estate firm in the area, alongside his mother, Carolyn, agreed. Many of Klemm’s clients are colleagues from his former career, who struck gold on Wall Street starting in the 1990s.
But more recently, the financial influence on the lake has reached a boiling point.
Between March and July, there were 14 million-dollar home sales around Lake Waramaug, double the previous year, according to Realtor.com data. Prices in September 2020 were 14.6 percent higher over the same period and the median listing price is nearly double that of Connecticut at large.
Cost, of course, for these leviathans of lending is no barrier. What drives bankers to live on Goldman pond is, above all, exclusivity.
There are roughly a dozen waterfront homes on the lake but they rarely come up for sale, and when they do, they are often quietly traded among longtime locals, Klemm said. New development is discouraged by local zoning. Lack of parking discourages casual visitors and each of the four former inns on the water have now been repurposed as private homes. Except for rowing crews from nearby private schools, only lucky waterfront homeowners can access the lake by boat.
More than anything, though, the new wave of buyers sees the lake as an anti-Hamptons — an exclusive enclave where the wolves of Wall Street can become country mice.
“Our county, at least in my experience, tends to draw people who are interested in being interested versus interesting,” said Lemieux.
And a name like “Lake Goldman” is far too interesting for anyone to be interested.

HARTFORD, Conn. (AP) - The Connecticut Supreme Court ruled Thursday that many of Gov. Ned Lamont’s shutdown orders related to the coronavirus pandemic are constitutional, thwarting a challenge from a pub owner.
Justices upheld a lower court judge’s decision in September that rejected claims the Democratic governor was exceeding his legal authority in ordering the closing of bars and restricting certain other business activities in efforts to curb the spread of the virus. Superior Court Judge Barbara Bellis had also denied a request to block the orders, which also was upheld by the Supreme Court.
Kristine Casey, who runs Casey’s Irish Pub in Milford, sued Lamont in June, saying he exceeded his authority under the public health and civil preparedness emergencies he declared in March and that remain in effect until Feb. 9.
The Supreme Court disagreed with Casey on Thursday.
“Although the plaintiffs raise important questions regarding the governor’s authority in a pandemic, our analysis of the pertinent law and relevant facts leads us to conclude that the governor’s challenged actions to date have been constitutional,” the court said.

Massachusetts lawmakers eligible for 6.46% pay raise; Gov. Baker, Lt. Gov. Polito say they will forgo raises

Massachusetts lawmakers are in store for another pay raise.
Two years after Gov. Charlie Baker certified a raise of 5.93 percent for the 200 members of the House and Senate for the 2019-2020 session, the governor in a letter to Treasurer Deb Goldberg on Wednesday advised her that a 6.46 percent increase is warranted in the base pay of legislators.
The raise in the base pay for legislators last session increased it by $3,709 to $66,256. A 6.46 percent increase works out to a $4,280 raise to $70,536.
In early 2017, legislators ignited an uproar by voting through a generous package of pay raises for themselves and other public officials, outside of the changes in compensation that the governor is required to make every two years. The adjustments in legislative base pay are required biennially under the state constitution, based on changes in the median household income statewide. Lawmakers got a 4.2 percent raise at the start of the 2017-2018 session.
The 2017 law raised the pay for constitutional officers and stipends for legislative leaders and committee chairs. That law also awarded office and travel expense budgets of between $15,000 and $20,000 for every lawmaker, based on how far they live from the State House, and called for all of that compensation to be adjusted every two years based on wage and salary changes over two years as reported by the Bureau of Economic Analysis in the Department of Commerce.
The latest raises are being authorized as Massachusetts copes with the COVID-19 pandemic, which has wreaked havoc on the economy and jobs, with some areas like restaurant, travel, retail and entertainment hit especially hard and demands on the unemployment system rising to record levels.
Accepting or rejecting the raises is up to individual lawmakers and constitutional officers.
A spokesman for Gov. Charlie Baker and Lt. Gov. Karyn Polito told the News Service Thursday they will not accept raises authorized under the 2017 law.

As the rest of the world is celebrating the arrival of 2021, a Massachusetts World War II veteran from Lowell is marking his 105th birthday.
Henry Naruszweicz was born in 1916, the fourth of 10 children born to Polish immigrant parents.
Signs went up Friday morning around his Lowell neighborhood, celebrating Naruszweicz's milestone.
Approximately 75 cars rolled by the home that he designed and built back in 1955, and still lives in today.
Naruszweicz and his two older brothers were sworn in to serve our country in World War II. Naruszweicz served under General George Patton during the Battle of the Bulge.
In his wildest imagination, he never thought he'd still be here today.
"When I retired in 1980, I figured I'd probably go another 10 years or so," Naruszweicz said. "So I bought a new car and I figured it would outlast me. It didn't."
The retired auto mechanic still gets to see his only daughter every day. She says her father remains independent, doing his own laundry each day, as well as other activities.
As far as a secret to living that long? "I don't know, I don't know, moderate living I'd say, don't do anything to excess," Naruszweicz said.
Naruszweicz says he still drives the Buick he bought in 2007 and still retains an active Massachusetts driver's license, good for four more years.
Naruszweicz says when he's 109, he'll give it up.

Not true. What makes an old operating system like WinXP susceptible to crashes is installing and attempting to run newer applications or drivers expected to run on a newer OS or hardware platform. As long as the dedicated machine is only running software compiled to work reliably with the original OS - in this case XP, there is no reason for it to crash. It will remain secure as long as it is not connected to a network where vulnerabilities to the the OS have since been discovered. I have access to an old 80286 machine running MS-DOS that still performs flawlessly.

"Snowbegone Kenobi, reporting for duty." Imagine hearing that over a dispatch radio. Guess what? It's a real name, for a real snow plow in Scotland, because the Scots clearly know how to have more fun with things – this is from the country that gave us Boaty McBoatface, after all.
On Friday, social media began picking up on the fact Scotland names its whole snow plow fleet and a map of the current active plows began pushing into viral status. On first glance, some of the names may not make sense to people in the US, but note the country calls these vehicles "gritters." That makes "Gritney Spears" make much more sense.

Then there's "Fred." Oh, Fred. What happened there, little dude? Imagine being on that Scottish gritter crew, when your pals get to plow through the dreaded snow in machines named "Han Snow-Lo" and "Ready Spready Go." At least Fred has a couple other toned-down (possibly Simpsons-related) names to run with, like "Mr. Plow" and "Snowball."
The BBC reports the practice of naming the plows goes back to 2006 when the Scottish Transport Ministry encouraged wee school children to come up with funny monikers for them. It launched its online tracker in 2016.

As a Yankee with a working XP desktop, New Hampshire's use of 20-year old voting machines reflects innate New England values.
We live in 200-year old homes and traverse the very roads as those who fought the Revolution. Our values revere our history. We were never going to buy into the Steve Jobs business model of engineered obsolescence.
Silicon Valley will mock New Hampshire's 20-year old election hardware, and yet will never acknowledge the vulnerabilities in the technology of modern voting machines.
New Hampshire voters can be confident that the machines used in their elections were not connected to a network because of the old tech. The election in New Hampshire may have posted the most honest result of any state in the nation by virtue of the use of the old-school machines that could not be networked.

It really bothered e that Bill Belichick would turn down the opportunity to receive the Medal of Freedom. But after seeing this story about the GOAT mascot from the Naval Academy died, I believe that was a threat to him. If you are from New England you know who the G.O.A.T.s are TB12 and Bill Belichick. Massachusetts Rescinds Flu Vaccine Mandate
The Massachusetts Department of Public Health (DPH) Friday rescinded a flu vaccine mandate that would have required all children over the age of 6 months attending Massachusetts childcare, pre-school, kindergarten, K-12 or college to get the flu vaccine by Feb. 28.
The reversal came on the same date — Jan. 15 — the DPH was due to respond in court to a request for a preliminary injunction that would have prevented the mandate from being enacted.
The injunction was filed in conjunction with a lawsuit alleging the mandate was unlawful and therefore unenforceable. The lawsuit, filed in December 2020, in Massachusetts Superior Court by a Massachusetts mother on behalf of her graduate student daughter was funded by Informed Consent Action Network (ICAN).
