5-4 Supreme Court Rules Pipeline Company Can Use Eminent Domain to Seize Land in NJ
The U.S. Supreme Court ruled in a 5-4 decision that federal eminent domain powers can be used to seize land to construct the PennEast Pipeline in New Jersey.
The ruling, announced Tuesday (pdf), did not fall along the typical ideological lines. Republican appointees Chief Justice John Roberts, Justice Samuel Alito, and Justice Brett Kavanaugh voted in the majority along with Democrat-appointed Justices Stephen Breyer and Sonia Sotomayor.
Justices Neil Gorsuch and Amy Coney Barrett, who were appointed by former President Donald Trump, dissented in the ruling. Justice Clarence Thomas, one of the most conservative justices, and Democrat appointee Elena Kagan joined them.
The majority ruled that PennEast has the power to seize state-owned and protected lands to construct its 120-mile-long natural gas pipeline between New Jersey and Pennsylvania. The decision upheld a precedent that energy firms have previously used to build pipelines around the United States.
Their ruling also reversed a September 2019 decision handed down by a federal appeals court that had blocked PennEast from seizing lands from New Jersey.
The pipeline would link Marcellus Shale dry gas production with markets in New Jersey, New York, and Pennsylvania. Some 1 billion cubic feet of natural gas will be transported per day from Pennsylvania to New Jersey, according to PennEast.
Paul Clement, an attorney for PennEast, argued in front of the Supreme Court that New Jersey’s claim of sovereign immunity doesn’t apply because the pipeline firm was acting on behalf of the federal government when the federal Federal Energy Regulatory Commission granted approval for the project.
“If we lose this case, then this pipeline will not be built in anything like its current configuration,” Clement had said. “I don’t think there is a way to reroute this pipeline in a way that doesn’t in some way impact New Jersey land.”
New Jersey attorneys argued that a private entity like PennEast cannot file a lawsuit against a sovereign state to acquire the property, saying only the federal government has that ability. The Supreme Court’s majority rejected that argument.

Progressive group launches $7 million effort to elect Democratic secretaries of state and attorneys general
A left-leaning group plans to spend $7 million to help elect Democratic secretaries of state and attorneys general in key battlegrounds – a big investment in down-ballot races that loom large in voting rights battles around the country.
End Citizens United/Let America Vote on Tuesday will endorse six Democratic incumbents as part of its new "democracy defender" program, shared first with CNN. The group is backing Nevada Attorney General Aaron Ford, Wisconsin Attorney General Josh Kaul, Michigan Attorney General Dana Nessel, Colorado Secretary of State Jena Griswold, Michigan Secretary of State Jocelyn Benson, and Minnesota Secretary of State Steve Simon.
It also intends to engage in races in Florida, Texas, Georgia and Arizona – states where Republican-controlled legislatures also have passed or advanced bills that reduce access to the ballot or seek to seize power from election officials and put it in the hands of lawmakers or administrators of their choice.
The GOP's legislative moves mean voting rights advocates "must more vociferously fight to protect every American's voice and vote," Tiffany Muller, the president of End Citizens United and Let America Vote, said in a statement. She said the incumbents her group is endorsing "consistently stood up to corruption, protected voting rights, and are holding the line to ensure our elections are safe, fair and accessible."
The organization has not disclosed how it intends to spend the $7 million, but it typically uses a mix of mailers, digital and traditional advertising and grassroots outreach in its campaigns.
Attorneys general and secretaries of state are on the ballot in more than two dozen states next year.
State election chiefs from both parties have faced verbal abuse and threats, following the 2020 election – as former President Donald Trump spread falsehoods of a "rigged" election. Although there's no evidence of widespread wrongdoing that could have changed the election's results, Republicans lawmakers in key swing states have raced ahead with laws they say will shore up election integrity.
Democrats and voting rights groups say the measures are aimed at suppressing votes in 2022. Additionally, they argue that bills seeking to curb the power of secretaries of state and other election officials could lead to partisan meddling when it's time to count votes and certify results.
The States United Democracy Center, a bipartisan group founded to advance fair elections, has tallied at least 216 bills in 41 states that would criminalize the actions of election officials, give legislators more power over the running of elections or otherwise interfere. Two dozen have become law to date.
Last week, GOP lawmakers who control Arizona's Legislature voted to strip Democratic Secretary of State Katie Hobbs of her authority to oversee election-related lawsuits and gave that power to the state's Republican attorney general.
The ban would expire on January 2, 2023, when the offices of secretary of state and attorney general could switch party control after the 2022 election. Hobbs is running for governor; Attorney General Mark Brnovich is running for the US Senate.
Hobbs has sharply criticized a GOP-ordered and problem-ridden "audit" of the 2.1 million votes cast in Maricopa County, Arizona.
In Michigan, meanwhile, a Republican lawmaker has introduced a bill that calls for an audit of 2020 results in the state – despite the secretary of state concluding that no fraud or foul play occurred in last year's election. Last week, the Republican-led state Senate Oversight Committee affirmed there was "no evidence of widespread or systematic fraud" in that election.
In a statement about the endorsement, Benson pledged to "continue fighting so every American knows the truth: The 2020 election was the safest and most secure in our state and nation's history."

SEC Names N.J. Attorney General as Enforcement Director
New Jersey Attorney General Gurbir Grewal will lead the U.S. Securities and Exchange Commission’s enforcement division, putting a well-known former prosecutor in charge of the unit that polices Wall Street.
SEC Chair Gary Gensler announced the pick on Tuesday, touting his experience at state and federal levels. Gensler’s first pick, Alex Oh, resigned within days of taking the job after a federal judge questioned her conduct in a case she was working on in private practice.
As New Jersey’s attorney general since 2018, Grewal, 48, has worked on a range of issues including gun violence and the opioid epidemic. During his tenure, the state also proposed tougher rules for investment advisers and joined other states in suing financial firms. Earlier in his career, Grewal served as a federal prosecutor leading a unit that investigated white-collar crime. “He has the ideal combination of experience, values, and leadership ability to helm the enforcement division at this critical time,” Gensler said in a statement. “I look forward to working closely with him to protect investors and root out wrongdoing in our markets.”Grewal, who was the first Sikh American to serve as a state attorney general, said he was “excited to get to work with the talented team of public servants to uncover and prosecute misconduct and protect investors.” He will start July 26.
Gensler, who took the helm of the SEC in April, is expected to take a much harder line in pursuing misconduct than his predecessors did during the Trump administration. He frequently sparred with finance executives and imposed aggressive new rules on swaps trading when he lead the Commodity Futures Trading Commission during the Obama administration.

Tom Brady, Gisele Bundchen to pick up stake in crypto exchange FTX
National Football League quarterback Tom Brady and his supermodel wife, Gisele Bundchen, will each take an undisclosed equity stake in U.S. crypto exchange platform FTX Trading Ltd, the company said on Tuesday.
Under the deal, Brady will also become an FTX ambassador and Bundchen will take the role of environmental and social initiatives adviser. Both will receive an unspecified amount of cryptocurrency, the company said. Founded and led by Sam Bankman-Fried, a 29-year-old crypto veteran billionaire, FTX is in talks to raise $1 billion at a valuation of $20 billion, according to media reports. Brady, a seven-time Super Bowl champion, has long been an advocate of cryptocurrencies. Last month, he edited his Twitter profile photo to one with a “laser eyes” meme - a popular internet fad among supporters of cryptocurrency.
Earlier this year, Brady also said he would launch a Non-Fungible Token (NFT) platform called Autograph that will bring together iconic brands from sports, entertainment, fashion and pop culture to create digital collectibles.

Why the Technocratic Mindset Produces Only Misery and Failure
It has the most fundamental aspect reality backwards
Saw this article come across, come across my news alert for “Transhumanism”. In it Dr. David Eagleman talks about how not only can we augment human senses with fantastic new abilities (like to “see” heat and electromagnetic patterns), but how we’ll even be able to build machines that think too.
There is a line in his thinking that one can glean from the article: on one side of the line are enhancements and augmentations to the human experience which are startling and amazing and which will transform our societies: even more radical life extension will be in the cards quite soon (for those who can afford it).
Like I told Steve Bannon when we talked Transhumanism: For all intents and purposes we already have radical life extension. In the years of the Roman Empire, average life expectancy was between 18 and 25 and most people would die before age 11, from something like diarrhea. This was just normal and nobody thought it would ever change.
Where Eagleman crosses into technocratic thinking is when he veers into the idea of being able to build thinking machines. The logic is that because we’ll be able to increasingly bioengineer our own living bodies, it means we should also be able to bioengineer a mind into machines using the same principles.
I think this is wrong and it’s the same theoretical mistake that leads directly to technocratically inspired catastrophes.
Yes, we continue to build on technological advancements, but we also commit a lot of unforced errors that inflict incalculable misery on humanity. These errors may manifest as policy blunders, economic crises and worse. Most recently, for example, we seem to have gotten ourselves into a global pandemic because a bunch of technocrats funded some gain-of-function experiments in hopes of preempting the next pandemic. Do you see the dynamic here?
Over the years a lot of thinkers have pointed out that technoractic policy tracks, devised by centralized groups of experts within an elite managerial class, often bring about the very conditions they were impaneled to obviate. Raising minimum wages increases unemployment, holding interest rates to zero creates economic instability and increases wealth inequality, forcing green energy initiatives creates systems with lower energy efficiency and higher carbon footprints
Banning guns increases gun violence, censoring “hate” speech fosters more hatred and polarization. It’s almost as if the managerial class has no awareness of second-order effects. When they inexorably come to pass they are often blamed on the very people who were counselling against the initial policy in the first place.
Thus, financial meltdowns are blamed on runaway free markets and capitalism gone wild. Global warming (if it truly plays out along prognosticated lines) is blamed on industries who are most rapidly transitioning toward greener energy anyway (like Bitcoin mining).
Climate change is another theme that exemplifies the technocratic dynamic: As a society we’re going to transition off of fossil fuels no matter what anybody thinks about the environment because we’re already past peak oil, and peak demand will probably flatline around 100M bpd and start coming down from there in a secular downtrend, for a variety of reasons (prolonged economic malaise and the ascent of green energy).

The Weird, Creepy Media Blackout On Recent Assange Revelations
As of this writing, it has been three days since the Icelandic newspaper Stundin broke the story that a key witness in the US government’s case against Julian Assange had fabricated allegations against the WikiLeaks founder. And yet, somehow, Assange is still in prison.
Weirder still, not one major western media outlet outside of Iceland has reported on this massive and entirely legitimate news story. A search brings up coverage by Icelandic media, by Russian media, and by smaller western outlets like Democracy Now, World Socialist Website, Consortium News, Zero Hedge and some others, but as of this writing this story has been completely ignored by all major outlets who are ostensibly responsible for informing the public in the western world.
It’s not that those outlets have been ignoring Assange altogether these last few days either. Reuters recently published an interview with Assange’s fiance Stella Moris. Evening Standard has a recent article out on Assange’s plans to marry Moris in Belmarsh, as does Deutsche Welle. It’s just this one story in particular that they’ve been blacking out completely.
And it’s not that the mainstream press are unaware of this story. Mainstream western reporters spend a lot of time on Twitter, and Assange’s name was trending in the United States after the Stundin story broke. Tweets about the article by high-profile accounts like WikiLeaks and Edward Snowden have many thousands of shares each. They’ve all seen the article. They all know it’s newsworthy. They’re just choosing not to report on it.
It reminds me of the blanket media blackout that occurred while the Organisation for the Prohibition of Chemical Weapons was hemorrhaging leaks revealing a US government-tied coverup in the alleged chlorine gas incident in Douma, Syria. Immensely newsworthy stories were breaking every few days on a major international scandal, yet not a peep was made about it by the mainstream press.
We got some insight into what happens in mainstream newsrooms during such bizarre circumstances when journalist Tareq Haddad leaked the emails from his editors at Newsweek refusing him permission to write about the unfolding OPCW scandal. Haddad’s pitch was rejected by editor Dimi Reider on the basis that other bigger outlets hadn’t written about it.
“Leak has been out since weekend,” Reider wrote. “It’s certainly no scoop. Yet despite the days that passed, not a single respected media outlet — many of whom boast far greater regional expertise, resources on the ground and in newsroom than Newsweek does — have taken the leak remotely seriously. Which already yesterday made my wonder how we could or why we should.”
Reider was supported by Newsweek’s digital director Laura Davis, who told Haddad his pitch was being rejected because “the leak found zero to no traction among publications which are highly resourced and experienced on Syria.”
And that’s just pretty darn convenient for the powerful, is it not? Assuming other mainstream news outlets feel the same, this means they’re all generally following the lead of just a handful of top-tier publications like The New York Times, The Washington Post, The Wall Street Journal and The Guardian. If just those few outlets decide to ignore a major news story that’s inconvenient for the powerful (either by persuasion, infiltration or by their own initiative), then no one else will either. As far as the media-consuming public is concerned, it’s like the major news story never happened at all.
And that’s really, really creepy.

The discovery of a new type of supernova illuminates a medieval mystery
first convincing evidence for a new type of stellar explosion—an electron-capture supernova. While they have been theorized for 40 years, real-world examples have been elusive. They are thought to arise from the explosions of massive super-asymptotic giant branch (SAGB) stars, for which there has also been scant evidence. The discovery, published in Nature Astronomy, also sheds new light on the thousand-year mystery of the supernova from A.D. 1054 that was visible all over the world in the daytime, before eventually becoming the Crab Nebula.
Historically, supernovae have fallen into two main types: thermonuclear and iron-core collapse. A thermonuclear supernova is the explosion of a white dwarf star after it gains matter in a binary star system. These white dwarfs are the dense cores of ash that remain after a low-mass star (one up to about 8 times the mass of the sun) reaches the end of its life. An iron core-collapse supernova occurs when a massive star—one more than about 10 times the mass of the sun—runs out of nuclear fuel and its iron core collapses, creating a black hole or neutron star. Between these two main types of supernovae are electron-capture supernovae. These stars stop fusion when their cores are made of oxygen, neon and magnesium; they aren't massive enough to create iron.

The bitcoin pioneer, who was believed to own over $1 billion in the world’s No. 1 crypto, making him, at the time, one of the asset’s larger single-holders, died off the coast of Costa Rica, according to a Spanish-language publication, Teletica.com, which reported last week that a foreigner had drowned at Playa Hermosa de Garabito, Puntarenas, in Costa Rica, describing the victim as a 41-year-old “of Polish origin.” However, Popescu is a well-knowned name in Romania and he has been described on some sites as a Romanian entrepreneur and blogger.
Popescu was viewed as a pioneer in digital assets and one of the earliest adopters. An article in Bitcoin Magazine written by Pete Rizzo said that Popescu was known for starting MPEx, a bitcoin securities exchange, around the same time as Coinbase Global launched.
At its mid-April peak this year, Popescu’s bitcoin holdings would have been worth nearly $2 billion.

Arizona Audit: Boxes Rechecked at Center – Spreadsheets Undergo Review – Tabulators Moved Onto Floor
The Arizona Audit continues with quality control checks, recounting boxes, and reviewing the re-count spreadsheets.

Tabulation machineswere also moved into the far corral seen above, from the designated storage area seen on camera 1 at azaudit.org.
Camera two is the only camera streaming now.
Pallets of completed boxes have been moved to one side of the stadium and are organized in numerical order. The pallets have also been organized in the same sequence as they were delivered, with the same boxes. All ballots have an accurate chain of custody.

The completed corral is open for recounting boxes and the previously empty corral is now full of tabulation machines.
Volunteers are recounting boxes with an observer in order to guarantee 100% accuracy and a flawless process. There absolutely will be a legal fight when the results come out.
On one side of the coliseum, more volunteers were trained to review recount spreadsheets.
They are doing these extra checks to ensure that data entry was accurate and corresponds to tally sheets.
Karen Fann insists that they are not in a rush to release any information. The full forensic audit is about accuracy.
Christina Bobb said that it would be easy for them to deliver a report that says the election was accurate, but ‘not accurate’ is a harder statement. She does hope to see something from the Senate early this week.
Spokesperson Randy Pullen told TGP’s Jordan Conradson that they should be finished today after they complete their spot checks and data reconciliation.
These results will not be easy to present to the public because we all know this was NOT a secure election.
As the Senate finishes passing the budget and new election integrity bills, we hope to hear a statement from the Arizona Senate in the near future.
