Today, I have signed into law H.R. 748, the “Coronavirus Aid, Relief, and Economic Security Act” or the “CARES” Act (the “Act”). The Act makes emergency supplemental appropriations and other changes to law to help the Nation respond to the coronavirus outbreak. I note, however, that the Act includes several provisions that raise constitutional concerns.

Section 15010(c)(3)(B) of Division B of the Act purports to require the Chairperson of the Council of the Inspectors General on Integrity and Efficiency to consult with members of the Congress regarding the selection of the Executive Director and Deputy Executive Director for the newly formed Pandemic Response Accountability Committee. The Committee is an executive branch entity charged with conducting and coordinating oversight of the Federal Government’s response to the coronavirus outbreak. I anticipate that the Chairperson will be able to consult with members of the Congress with respect to these hiring decisions and will welcome their input. But a requirement to consult with the Congress regarding executive decision-making, including with respect to the President’s Article II authority to oversee executive branch operations, violates the separation of powers by intruding upon the President’s power and duty to supervise the staffing of the executive branch under Article II, section 1 (vesting the President with the “executive Power”) and Article II, section 3 (instructing the President to “take Care” that the laws are faithfully executed). Accordingly, my Administration will treat this provision as hortatory but not mandatory.

Section 4018 of Division A of the Act establishes a new Special Inspector General for Pandemic Recovery (SIGPR) within the Department of the Treasury to manage audits and investigations of loans and investments made by the Secretary of the Treasury under the Act. Section 4018(e)(4)(B) of the Act authorizes the SIGPR to request information from other government agencies and requires the SIGPR to report to the Congress “without delay” any refusal of such a request that “in the judgment of the Special Inspector General” is unreasonable. I do not understand, and my Administration will not treat, this provision as permitting the SIGPR to issue reports to the Congress without the presidential supervision required by the Take Care Clause, Article II, section 3.

Certain other provisions (such as sections 20001, 21007, and 21010 of Division B of the Act) purport to condition the authority of officers to spend or reallocate funds upon consultation with, or the approval of, one or more congressional committees. These provisions are impermissible forms of congressional aggrandizement with respect to the execution of the laws. The Congress may affect the execution of the laws only by enacting a new statute in accordance with the requirements of bicameralism and presentment prescribed in Article I, section 7. My Administration will make appropriate efforts to notify the relevant committees before taking the specified actions and will accord the recommendations of such committees all appropriate and serious consideration, but it will not treat spending decisions as dependent on prior consultation with or the approval of congressional committees.

Finally, several provisions (such as sections 3511(d)(4) and 3862 (creating section 744N(d)(1) of the Federal Food, Drug, and Cosmetic Act) of Division A of the Act) purport to require recommendations regarding legislation to the Congress. Because Article II, section 3 gives the President the authority to recommend only “such Measures as he shall judge necessary and expedient,” my Administration will continue the practice of treating provisions like these as advisory and non-binding.

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the National Emergencies Act (50 U.S.C. 1601 et seq.), and in furtherance of Proclamation 9994 of March 13, 2020 (Declaring a National Emergency Concerning the Novel Coronavirus Disease (COVID-19) Outbreak), which declared a national emergency by reason of the threat that the novel (new) coronavirus known as SARS-CoV-2 poses to our Nation’s healthcare systems, I hereby order as follows:

Section 1. Emergency Authority. To provide additional authority to the Secretaries of Defense and Homeland Security to respond to the national emergency declared by Proclamation 9994, the authorities under section 12302 of title 10, United States Code, and sections 2127, 2308, 2314, and 3735 of title 14, United States Code, are invoked and made available, according to their terms, to the Secretaries of Defense and Homeland Security. The Secretaries of the Army, Navy, and Air Force, at the direction of the Secretary of Defense, and the Secretary of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy, are authorized to order to active duty not to exceed24 consecutive months, such units, and individual members of the Ready Reserve under the jurisdiction of the Secretary concerned, not to exceed 1,000,000 members on active duty at any one time, as the Secretary of Defense and, with respect to the Coast Guard when it is not operating as a service in the Navy, the Secretary of Homeland Security consider necessary. The Secretary of Defense or the Secretary of Homeland Security, as applicable, will ensure appropriate consultation is undertaken with relevant state officials with respect to the utilization of National Guard Reserve Component units activated under this authority.

Sec. 2. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

COVID-19: World’s biggest condom producer warns of global shortage

A global shortage of condoms is looming, the world’s biggest producer said, after a coronavirus lockdown forced it to shut down production.

Malaysia’s Karex Bhd makes one in every five condoms globally. It has not produced a single condom from its three Malaysian factories for more than a week due to a lockdown imposed by the government to halt the spread of the virus.

That’s already a shortfall of 100 million condoms, normally marketed internationally by brands such as Durex, supplied to state healthcare systems such as Britain’s NHS or distributed by aid programs such as the UN Population Fund.

The company was given permission to restart production on Friday, but with only 50 per cent of its workforce, under a special exemption for critical industries.

Fed Set to Dial Back Pace of QE Treasury Buying Next Thursday

Says it will trim Treasury purchases to $60 billion April 2-3. The Federal Reserve will slow the pace at which it buys Treasuries under its unlimited quantitative easing program.

The U.S. central bank, which has been aggressively purchasing Treasuries for the past two weeks in a bid to offset the economic and market fallout from the coronavirus pandemic, on Friday said that it would dial back the daily pace of buying to $60 billion next Thursday and Friday. It will continue purchasing at the existing pace of $75 billion a day for the first three days of next week.The central bank announced its return to quantitative easing earlier this month as virus concerns ripped through global markets and the prospects for the global economy cratered. And this past Monday it declared that it would purchase assets “in the amounts needed to support the smooth functioning of markets.” It has bought Treasuries at a steady clip of $75 billion a day since then, although there was some talk in the market that the monetary authority might look to ease back.

At this pace the Fed will have bought almost $1 trillion dollars of Treasuries by end of next week.

Effective March 23, 2020, the Federal Open Market Committee (FOMC) directed the Open Market Trading Desk (the Desk) at the Federal Reserve Bank of New York to increase the System Open Market Account (SOMA) holdings of agency mortgage-backed securities in the amounts needed to support smooth market functioning. The FOMC directed the Desk to include purchases of agency commercial mortgage-backed securities (agency CMBS) in such purchases.

The Desk will conduct its first purchase of agency CMBS on Friday March 27, 2020 with a deadline to submit offers to its investment manager at 11:00 am ET.

In this operation, the Desk will purchase up to $1 billion of fixed rate Fannie Mae Delegated Underwriting and Servicing (FNMA DUS) pools, with a 10 year loan term, a yield maintenance protection term of 9.5 years (FNMA DUS 10/9.5), and a weighted average life greater than or equal to 7 years. The Desk, through its investment manager, will solicit offers from primary dealers and will purchase up to $1 billion in total, subject to reasonable market prices. The minimum lot size per CUSIP for this operation is $5 million in current face value.

Next week, the Desk anticipates three operations on Tuesday March 31, 2020, Thursday April 2, 2020, and Friday April 3, 2020 for a tentative total purchase amount of approximately $3 billion. Purchases will be made across fixed-rate FNMA DUS pools, fixed-rate Freddie Mac K-series Deals, and Ginnie Mae Project Loan pools. The details for each operation will be disclosed one day prior to the operation. The term sheet for agency CMBS purchases can be found here.

The Desk will continue to adjust the schedule, size, and composition of purchases as appropriate to support smooth market functioning of agency CMBS markets.

Ex-Venezuelan General Indicted in Narco-Terrorism Case Surrenders to DEA Agents

A former Venezuelan general has surrendered to the US Drug Enforcement Administration (DEA) just a day after being indicted by US federal prosecutors and having a $10 million reward posted for his capture.

On Friday, Clíver Antonio Alcalá Cordones, a former major general of the Venezuelan Army, surrendered to Colombia's National Intelligence Directorate in Bogota and is now in the custody of the US DEA, El Tiempo reported, citing unnamed sources.

Alcalá left his position in Venezuela's armed forces in 2013. US federal prosecutors alleged he had been "a leader and manager of the Cartel of the Suns," a supposed drug smuggling ring inside the Venezuelan government the US government has claimed makes leading Venezuelan officials "narco-terrorists." Alongside 13 other Venezuelans, Alcalá was indicted in the Southern District Court of New York on Thursday on narco-terrorism charges and the State Department placed a $10 million bounty on his head.

Incidentally, Alcalá was already making headlines this week: when Colombian authorities seized an arms shipment on Wednesday, Alcalá admitted he had been plotting a coup d'etat against Venezuelan President Nicolas Maduro on behalf of self-proclaimed interim president Juan Guaido, who is backed by both Washington and Bogota but enjoys no support in Venezuela.

SpaceX cargo craft will soon reach much farther out into the final frontier, if all goes according to plan.

The California-based company already flies cargo missions to and from the International Space Station (ISS) for NASA. Now, SpaceX has scored a contract to supply Gateway, the moon-orbiting space station that the agency aims to start building in 2022, agency officials announced Friday (March 27).

Gateway is a key part of NASA's Artemis exploration program, which seeks to establish a sustainable, long-term human presence on and around the moon by the late 2020s. The small space station will serve as a jumping-off point for sorties, both crewed and uncrewed, to the lunar surface.

SpaceX will help to keep the Gateway supplied, delivering scientific experiments and a variety of other gear to the outpost, NASA officials said. The company is guaranteed two missions under its newly announced Gateway Logistics Services contract.

SpaceX's robotic ISS resupply runs employ the company's Falcon 9 rocket and Dragon capsule, which can loft 13,200 lbs. (6,000 kilograms, or 6 metric tons) to low-Earth orbit. But SpaceX's Gateway missions will use different hardware: the huge Falcon Heavy rocket and a special capsule variant called Dragon XL. (SpaceX has also developed another Dragon version, Crew Dragon, which will fly astronauts to and from the ISS under yet another NASA contract.)

Dragon XL will be able to carry more than 5 metric tons of cargo to the Gateway, SpaceX representatives said via Twitter Friday.

“Returning to the moon and supporting future space exploration requires affordable delivery of significant amounts of cargo,” SpaceX president and chief operating officer Gwynne Shotwell said in a statement on Friday.

"Through our partnership with NASA, SpaceX has been delivering scientific research and critical supplies to the International Space Station since 2012, and we are honored to continue the work beyond Earth’s orbit and carry Artemis cargo to Gateway," she added.

Dragon cargo missions to the ISS typically last about a month from launch to splashdown. But Dragon XL will likely stay attached to the Gateway for six to 12 months at a time, NASA officials said.

Other companies may end up joining SpaceX in the Gateway resupply game.

"The Gateway Logistics Services contract enables NASA to order missions for as long as 12 years with a 15-year performance period and provides the ability to add new competitive providers," NASA officials wrote in the same statement, adding that the total value of these deals will be capped at $7 billion.

"These missions will support NASA’s plans for sustainable exploration with both international and commercial partners, while developing the experience and capabilities necessary to send humans to Mars," the officials added.

Indeed, collaboration with commercial companies is a key part of NASA's lunar exploration goals. For example, the agency will rely on privately built landers to ferry both scientific experiments and astronauts to the lunar surface from Gateway. (The first crewed missions may not stop over at Gateway, however. NASA has apparently taken Gateway off the "critical path" for its planned 2024 crewed lunar landing, though agency officials have said they remain committed to the space station over the long term.)

Vice President Mike Pence said Tuesday that “the FDA is approving off-label use for the hydroxychloroquine right now” to help coronavirus patients.

Pence made the comment during Fox News’ virtual coronavirus town hall in response to a question from Dr. Mehmet Oz about the drug, which has shown encouraging signs in small, early tests. A similar drug, Chloroquine has also showed positive signs.

Dr. Oz noted that “the FDA appropriately desires randomized critical trials for proof to guide the medical community,” but asked the vice president how the clinical trials can be accelerated “while also satisfying the demand from physicians, front-line doctors, who want to use these pills for their patients and themselves?”

In response, Pence said, “The good news is, the chloroquine medication, we actually deployed in the state of New York resources to be able to be administered to the people.”

New York has reported more than 25,600 confirmed coronavirus cases and 210 deaths, the most in the U.S., according to data compiled by Fox News.

“Doctors can prescribe that medication, which as you know is a perfectly legal and approved malaria medication,” Pence told Dr. Oz, “but doctors can now prescribe chloroquine for that off-label purpose of dealing with the symptoms of coronavirus. We are making that clear across the country.”
