Commercial Real Estate Bankruptcy Legislation Introduced

Two weeks ago we reproted that "in an uprecedented move, Congress proposes taxpayer-funded bailout Of $550 billion CMBS industry." And now this: according to Chain Store Age, legislation has been introduced that would make "meaningful" temporary changes to bankruptcy laws, related to commercial real estate.

The bill, introduced by Sen. Thom Tillis (R-NC) and supported by the International Council of Shopping Centers, would allow for the facilitation of commercial tenant rent deferrals and providing additional flexibility for small business tenants that file Chapter 11 bankruptcy.

"The legislation will help businesses struggling with bankruptcy to weather the storm," ICSC president and CEO Tom McGee said. "The bill provides significant relief to small business debtors and landlords. It also reinforces what many landlords have done since spring, as well as encourage deferred deals going forward."

Under current law, rent deferral agreements waiving some or all of the current rent to be repaid in the future can be undone if the commercial tenant later files for bankruptcy. This risk discourages such agreements from happening. Specifically, Bankruptcy Code Section 547 deems the installment payments as “preferences" and commercial landlords can be forced by the court to forfeit such payments.

The Tillis bill would prevent this from happening, providing "certainty" to business landlords, as well as tenants, according to ICSC.

Additionally, the Tillis bill would allow an extra 90 days for commercial tenants in bankruptcy to decide whether to continue with current leases. And for certain small businesses, the bill would give tenants the ability to spread the payment of some post-bankruptcy rent over a longer period. The extra time would provide liquidity to small businesses, preserving jobs and businesses, noted ICSC.

Senator Kamala Harris has been picked by Joe Biden to be his running mate. It’s not much of a surprise, really, though the weakness of the choice will soon be made clear.

Aside from the fact that Harris all but accused Joe Biden of being a racist for his past willingness to work with segregationists to oppose busing, Harris is also on record saying that she believes the women who accused the former vice president of inappropriate touching.

“I believe them and I respect them being able to tell their story and having the courage to do it,” Harris said during a presidential campaign event in Nevada in April 2019 before Biden had officially entered the race.

Biden’s accusers

During the 2008 election cycle, Ally Coll was helping run a reception for about 50 people. After Biden arrived she was introduced to him, and, according to Coll, Biden “leaned in, squeezed her shoulders and delivered a compliment about her smile, holding her ‘for a beat too long.’”

“There’s been a lack of understanding about the way that power can turn something that might seem innocuous into something that can make somebody feel uncomfortable,” said Coll.

The next accuser is Amy Lappos, a Democratic political activist who claimed that during a 2009 political fundraiser in Greenwich, Conn., for U.S. Rep. Jim Himes, then-Vice President Joe Biden touched her inappropriately.

“It wasn’t sexual, but he did grab me by the head,” Lappos told the Hartford Courant last year. “He put his hand around my neck and pulled me in to rub noses with me. When he was pulling me in, I thought he was going to kiss me on the mouth.”

“I never filed a complaint, to be honest, because he was the vice president. I was a nobody,” Lappos explained. “There’s absolutely a line of decency. There’s a line of respect. Crossing that line is not grandfatherly. It’s not cultural. It’s not affection. It’s sexism or misogyny.”

Biden has also been accused by two sexual assault survivors of inappropriate touching.

Four years ago, at the age of 19, Caitlyn Caruso, a survivor of sexual assault, spoke at an event on sexual assault at the University of Las Vegas, which Joe Biden was also attending. Caruso says that after sharing her sexual assault experience, Biden “rested his hand on her thigh — even as she squirmed in her seat to show her discomfort—and hugged her ‘just a little bit too long.’”

“It doesn’t even really cross your mind that such a person would dare perpetuate harm like that,” she said. “These are supposed to be people you can trust.”

In 2016, Sofie Karasek was one of 50 sexual assault survivors who appeared on stage with Lady Gaga at the Oscars. After the ceremony, Karasek shared with Biden a story about a college student who committed suicide after being sexually assaulted, and Biden, according to the Washington Post, “responded by clasping her hands and leaning down to place his forehead against hers.” She says it felt awkward and uncomfortable having their faces mere inches apart and she didn’t know how to respond to it, but she described it as Biden “crossing the boundary into her personal space at a sensitive moment.”

Is Cuomo's COVID Cover-Up Crashing? AP Finally Reports His Nursing Home Death Undercount

The Associated Press finally noticed Andrew Cuomo’s shell game. On Tuesday, the AP ran a report titled, “New York’s true nursing home death toll cloaked in secrecy.” If only someone had noticed before now.

NEW YORK (AP) — Riverdale Nursing Home in the Bronx appears, on paper, to have escaped the worst of the coronavirus pandemic, with an official state count of just four deaths in its 146-bed facility.

The truth, according to the home, is far worse: 21 dead, most transported to hospitals before they succumbed.

“It was a cascading effect,” administrator Emil Fuzayov recalled. “One after the other.”

New York’s coronavirus death toll in nursing homes, already among the highest in the nation, could actually be a significant undercount. Unlike every other state with major outbreaks, New York only counts residents who died on nursing home property and not those who were transported to hospitals and died there.

That statistic could add thousands to the state’s official care home death toll of just over 6,600. But so far the administration of Democratic Gov. Andrew Cuomo has refused to divulge the number, leading to speculation the state is manipulating the figures to make it appear it is doing better than other states and to make a tragic situation less dire.

The AP report says that federal regulators began requiring reports of nursing home deaths from COVID-19 in May that include residents who later died after transport to a hospital. This requirement came after the peak of cases and deaths in New York, allowing Cuomo to dodge a bullet.

Of course, PJ Media’s Matt Margolis has written extensively about Andrew Cuomo’s cover-ups, lies, and culpability around the massive number of nursing home residents who died of coronavirus unnecessarily. Two weeks ago, he wrote:

The first step in the cover-up was to not count the deaths of nursing home residents who died in hospitals in their tallies of nursing home resident deaths. New York was the only state to do this, and, of course, it resulted in a massive undercounting of nursing home deaths.

The New York State Department of Health (NYSDOH) admitted a couple of months ago that they quietly changed their reporting policy around late April/early May so that nursing home and long-term care patients who died from COVID-19 in a hospital were not included as nursing home COVID-19 fatalities.

Biden’s VP will become POTUS if he wins

Democrat POTUS nominee Joe Biden has spent months floating one black woman after another as his VP pick knowing all along his choice was ORDERED by his hidden masters to be Sen. Kamala Harris of California.

The strategy was to put off any official announcement as long as possible in order to subject Harris to as little vetting as possible. This scheme was quite similar to the total lack of vetting of Obama in 2008 who never even presented a valid birth certificate. The 2020 campaign season has been the most intense and competitive in American electoral history so Harris was sure to elicit more scrutiny than any previous VPOTUS candidate in 230 plus years.

Of course, the reason for this extraordinary inquiry into Harris’s background is because she will become President should Biden successfully steal his way to a victory. The only reason why the DNC permitted a Biden nomination was so he could justifiably be replaced with Kamala Harris. As follows:

Candidate Biden has already proven himself to be totally unfit and profoundly debilitated to occupy the Oval Office. Everyone knows this, which means that upon his compelled resignation or obvious incapacitation Harris would become the first female POTUS.
