Interpretação, Instituições e o Conflito que Nunca Terminou

O antigo conflito entre fariseus e saduceus costuma ser tratado como uma disputa religiosa estreita, confinada ao judaísmo do Segundo Templo. Na realidade, ele ilustra uma tensão estrutural que continua a moldar o direito moderno, a governança e o poder cultural. Embora as instituições que abrigaram esse conflito tenham colapsado há muito tempo, as dinâmicas subjacentes não desapareceram. Elas foram absorvidas, reproduzidas e reconstituídas ao longo dos séculos.

Em sua essência, a divisão entre fariseus e saduceus não dizia respeito apenas à doutrina, mas à localização da autoridade. Os saduceus representavam o poder institucional: controlavam o Templo, alinhavam-se à autoridade política, privilegiavam exclusivamente a lei escrita e derivavam legitimidade do cargo e da força de execução. Seu poder era concreto, centralizado e dependente da sobrevivência do Estado. Os fariseus, por outro lado, representavam um modo interpretativo de autoridade: enfatizavam tradição, comentário, debate e a aplicação da lei à vida cotidiana. Sua legitimidade não vinha do cargo, mas do domínio da interpretação e do ensino. Crucialmente, essa autoridade era portátil. Não dependia de um Templo, de um Estado ou do monopólio da força.

Essa distinção se projeta de forma clara nos sistemas jurídicos modernos. O modo saduceu se assemelha ao direito estatutário, à autoridade administrativa e à força do Estado — a lei como texto escrito respaldado por instituições. O modo farisaico se assemelha ao raciocínio do common law, à jurisprudência, aos precedentes e à doutrina jurídica — a lei como interpretação que evolui por meio do debate e da aplicação. Todo sistema jurídico funcional precisa equilibrar esses dois imperativos: estabilidade e adaptabilidade, autoridade e interpretação. O conflito antigo não foi resolvido; ele se tornou estrutural.

Historicamente, o modo farisaico mostrou-se mais durável. Quando o Templo foi destruído no ano 70 d.C. e o Estado judeu colapsou, o poder saduceu desapareceu junto com ele. A resposta institucional a essa ameaça é um padrão conhecido. Uma vez que a autoridade é contestada em sua raiz, os sistemas reagem tentando fixar a interpretação, controlar a memória histórica e deslegitimar leituras alternativas como heresia, desordem ou perigo. O controle da narrativa é o sistema imunológico das instituições. A história não é obscurecida por acidente; ela é estabilizada deliberadamente.

A ironia é que o cristianismo, uma vez institucionalizado, rapidamente reconstruiu ambos os modos que havia desestabilizado. A carne que contém um hormônio de crescimento proibido apareceu na UE, informou uma autoridade holandesa, levando as autoridades polonesas a ordenar inspeções urgentes pelas inspeções relevantes.

Agricultores da UE e vários grupos alertaram que a falta de regulamentações de segurança em uso nos países do Mercosul levaria a tais resultados.

A autoridade holandesa de segurança de alimentos e produtos de consumo anunciou que detectou carne bovina brasileira contaminada com estradiol, um hormônio de crescimento usado para estimular o estro em bovinos que é proibido na União Europeia, Escreve Do Rzezcy.

Quatro carregamentos contaminados, contendo um total de 62.781 quilos de carne, foram importados por duas empresas europeias.

Uma parcela significativa da carne foi distribuída para vários compradores e introduzida no mercado DA UE.

Dois embarques restantes de carne bovina do Brasil (cada um contendo aproximadamente 25 toneladas de carne congelada) foram impedidos pelas autoridades holandesas de serem liberados para distribuição, o Farmer.pl site noticiado nesta segunda-feira.

O site ressaltou que a detecção de importações de carne bovina contaminada pode se tornar mais um argumento para opositores do acordo comercial da UE com o Mercosul, bloco de Países sul-Americanos.

De acordo com a Rádio RMF FM, Os Estados Membros da UE, incluindo a Polônia, foram informados pela Comissão Europeia sobre a distribuição de carne contaminada do Brasil já em 11 de novembro do ano passado. Trump urged to declare national emergency to take power over midterm elections as president pushes for voter ID bill

Attorneys close to Donald Trump are urging the president to declare a national emergency that would allow him to take sweeping powers over the crucial midterm elections.

The president has railed against 'rigged elections' and still refuses to concede the 2020 race to Joe Biden while pushing the SAVE Act to force citizens to show ID at the polls, against the wishes of Congressional Democrats.

Peter Ticktin, who has known Trump since they attended New York Military Academy together and represented him in court,is part of a group of pro-Trump lawyers in communication with the White House over the election plan.

Ticktin and his allies argue in a 17-page draft of a presidential executive order that supposed Chinese interference in the 2020 presidential election allows Trump to declare such an emergency.

'There is now clear and compelling evidence from court cases and forensic analysis that these threats have not been mitigated but instead have intensified,' reads the draft.

'This constitutes an unusual and extraordinary threat to the national security and foreign policy of the United States.'

From each prisoner’s point of view, thinking alone:

“If the other stays silent, I’m better off betraying (I go free instead of 1 year).

If the other betrays, I’m still better off betraying (5 years instead of 10–20).”

So for each person, betraying looks safer no matter what the other does. That makes “defect” the individually “rational” move.
