Gunmaker subpoenas school records of 9 slain Sandy Hook students and educators; families want records sealed

NEWTOWN — A gunmaker being sued by nine families who lost loved ones in the Sandy Hook shootings has subpoenaed the academic, attendance and disciplinary records of five children killed that day. The subpoena included requests for school records of four educators who were killed.

Lawyers for those nine families moved in court Thursday to seal those confidential records of the five slain children and four slain educators because requested by the bankrupted Remington company.

“We have no explanation for why Remington subpoenaed the Newtown Public School District to obtain the kindergarten and first-grade academic, attendance and disciplinary records of these five school children,” said the families’ lead attorney, Josh Koskoff, after filing a motion to change the protection order in state Superior Court in Waterbury. “The records cannot possibly excuse Remington’s egregious marketing conduct, or be of any assistance in estimating the catastrophic damages in this case. The only relevant part of their attendance records is that they were at their desks on December 14, 2012.”

Dec. 14, 2012, was the day a 20-year-old gunman took his mother’s AR-15-style rifle from an unlocked closet and shot his way into a locked Sandy Hook Elementary School, killing 20 first-graders and six educators.

Nine families who lost loved ones sued Remington for wrongful death, claiming the once-powerful gunmaker recklessly marketed a military-grade gun to civilians. Remington argued that it manufactured a legal firearm that was sold lawfully to the gunman’s mother, and that it was the gunman who was responsible for the worst crime in Connecticut history.

In 2016, a state Superior Court judge agreed that Remington was protected under a federal law that shields the gun industry from most liability when its products are misused. In 2019, the state Supreme Court ruled the families had grounds to pursue an unlawful marketing claim under Connecticut’s Unfair Trade Practices Act. Later that year, the United States Supreme Court sent the case back to trial court by refusing to review it.

Since them, Remington has been dissolved in bankruptcy court, and four insurance companies have taken over the former company’s defense.

The battle to keep the private records of the nine Sandy Hook victims confidential comes as both sides prepare for trial in the highest profile lawsuit of its kind in the country. The lawsuit was in national headlines last in July, when two of Remington’s four insurance companies offered each of the nine families a $3.6 million settlement. The families have yet to respond.

A week before that surprise partial settlement offer, Remington raised eyebrows when it was accused of handing over 18,000 “random cartoons” and 15,000 irrelevant pictures of people go-karting and dirt-biking as part of its pretrial data requested by the families.

Attorney General Merrick Garland will release certain declassified documents over the next 6 months.

9/11 family members and first responders who survived the terrorist attack nearly 20 years ago told Joe Biden not to come to the 20th anniversary memorial unless he declassified the documents that likely show links between the Saudi Arabian government and the hijackers.

“When I ran for president, I made a commitment to ensuring transparency regarding the declassification of documents on the September 11, 2001 terrorist attacks on America,’ Biden said in a statement. “As we approach the 20th anniversary of that tragic day, I am honoring that commitment.”

“Today, I signed an executive order directing the Department of Justice and other relevant agencies to oversee a declassification review of documents related to the Federal Bureau of Investigation’s September 11th investigations. Blocking Property With Respect To Specified Harmful Foreign Activities of the Government of the Russian Federation

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.) (NEA), section 212(f) of the Immigration and Nationality Act of 1952 (8 U.S.C. 1182(f)), and section 301 of title 3, United States Code,

I, JOSEPH R. BIDEN JR., President of the United States of America, find that specified harmful foreign activities of the Government of the Russian Federation—in particular, efforts to undermine the conduct of free and fair democratic elections and democratic institutions in the United States and its allies and partners; to engage in and facilitate malicious cyber-enabled activities against the United States and its allies and partners; to foster and use transnational corruption to influence foreign governments; to pursue extraterritorial activities targeting dissidents or journalists; to undermine security in countries and regions important to United States national security; and to violate well-established principles of international law, including respect for the territorial integrity of states—constitute an unusual and extraordinary threat to the national security, foreign policy, and economy of the United States. I hereby declare a national emergency to deal with that threat.

Accordingly, I hereby order:

Section 1. All property and interests in property that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of any United States person of the following persons are blocked and may not be transferred, paid, exported, withdrawn, or otherwise dealt in:

(a) any person determined by the Secretary of the Treasury, in consultation with the Secretary of State, and, with respect to subsection (a)(ii) of this section, in consultation with the Attorney General, or by the Secretary of State, in consultation with the Secretary of the Treasury, and, with respect to subsection (a)(ii) of this section, in consultation with the Attorney General:

(i) to operate or have operated in the technology sector or the defense and related materiel sector of the Russian Federation economy, or any other sector of the Russian Federation economy as may be determined by the Secretary of the Treasury, in consultation with the Secretary of State;

(ii) to be responsible for or complicit in, or to have directly or indirectly engaged or attempted to engage in, any of the following for or on behalf of, or for the benefit of, directly or indirectly, the Government of the Russian Federation:

(A) malicious cyber-enabled activities;

(B) interference in a United States or other foreign government election;

(C) actions or policies that undermine democratic processes or institutions in the United States or abroad;

(E) assassination, murder, or other unlawful killing of, or infliction of other bodily harm against, a United States person or a citizen or national of a United States ally or partner;

(F) activities that undermine the peace, security, political stability, or territorial integrity of the United States, its allies, or its partners; or

(G) deceptive or structured transactions or dealings to circumvent any United States sanctions, including through the use of digital currencies or assets or the use of physical assets;

(iii) to be or have been a leader, official, senior executive officer, or member of the board of directors of:

(A) the Government of the Russian Federation;

(B) an entity that has, or whose members have, engaged in any activity described in subsection (a)(ii) of this section; or

(C) an entity whose property and interests in property are blocked pursuant to this order;

(iv) to be a political subdivision, agency, or instrumentality of the Government of the Russian Federation;

(v) to be a spouse or adult child of any person whose property and interests in property are blocked pursuant to subsection (a)(ii) or (iii) of this section;

(vi) to have materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of:

(A) any activity described in subsection (a)(ii) of this section; or

(B) any person whose property and interests in property are blocked pursuant to this order; or

(vii) to be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, the Government of the Russian Federation or any person whose property and interests in property are blocked pursuant to this order.

(b) any person determined by the Secretary of the Treasury, in consultation with the Secretary of State, to have materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of, a government whose property and interests in property are blocked pursuant to chapter V of title 31 of the Code of Federal Regulations or another Executive Order, and to be:

(i) a citizen or national of the Russian Federation;

(ii) an entity organized under the laws of the Russian Federation or any jurisdiction within the Russian Federation (including foreign branches); or

(iii) a person ordinarily resident in the Russian Federation.

(c) any person determined by the Secretary of State, in consultation with the Secretary of the Treasury, to be responsible for or complicit in, or to have directly or indirectly engaged in or attempted to engage in, cutting or disrupting gas or energy supplies to Europe, the Caucasus, or Asia, and to be:

(i) an individual who is a citizen or national of the Russian Federation; or

(ii) an entity organized under the laws of the Russian Federation or any jurisdiction within the Russian Federation (including foreign branches).

(d) The prohibitions in subsections (a), (b), and (c) of this section apply except to the extent provided by statutes, or in regulations, orders, directives, or licenses that may be issued pursuant to this order, and notwithstanding any contract entered into or any license or permit granted before the date of this order.

Sec. 2. The prohibitions in section 1 of this order include:Start Printed Page 20251

(a) the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to this order; and

(b) the receipt of any contribution or provision of funds, goods, or services from any such person.

Sec. 3. (a) The unrestricted immigrant and nonimmigrant entry into the United States of noncitizens determined to meet one or more of the criteria in section 1 of this order would be detrimental to the interests of the United States, and the entry of such persons into the United States, as immigrants or nonimmigrants, is hereby suspended, except when the Secretary of State or the Secretary of Homeland Security, as appropriate, determines that the person's entry would not be contrary to the interests of the United States, including when the Secretary of State or the Secretary of Homeland Security, as appropriate, so determines, based on a recommendation of the Attorney General, that the person's entry would further important United States law enforcement objectives.

(b) The Secretary of State shall implement this authority as it applies to visas pursuant to such procedures as the Secretary of State, in consultation with the Secretary of Homeland Security, may establish.

(c) The Secretary of Homeland Security shall implement this order as it applies to the entry of noncitizens pursuant to such procedures as the Secretary of Homeland Security, in consultation with the Secretary of State, may establish.

(d) Such persons shall be treated by this section in the same manner as persons covered by section 1 of Proclamation 8693 of July 24, 2011 (Suspension of Entry of Aliens Subject to United Nations Security Council Travel Bans and International Emergency Economic Powers Act Sanctions).

Sec. 4. (a) Any transaction that evades or avoids, has the purpose of evading or avoiding, causes a violation of, or attempts to violate any of the prohibitions set forth in this order is prohibited.

(b) Any conspiracy formed to violate any of the prohibitions set forth in this order is prohibited.

Sec. 5. I hereby determine that the making of donations of the types of articles specified in section 203(b)(2) of IEEPA (50 U.S.C. 1702(b)(2)) by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to this order would seriously impair my ability to deal with the national emergency declared in this order, and I hereby prohibit such donations as provided by section 1 of this order.

Sec. 6. For the purposes of this order:

(a) the term “entity” means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization;

(b) the term “Government of the Russian Federation” means the Government of the Russian Federation, any political subdivision, agency, or instrumentality thereof, including the Central Bank of the Russian Federation, and any person owned, controlled, or directed by, or acting for or on behalf of, the Government of the Russian Federation;

(c) the term “noncitizen” means any person who is not a citizen or noncitizen national of the United States;

(d) the term “person” means an individual or entity; and

(e) the term “United States person” means any United States citizen, lawful permanent resident, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States.

Sec. 7. For those persons whose property and interests in property are blocked pursuant to this order who might have a constitutional presence in the United States, I find that because of the ability to transfer funds or other assets instantaneously, prior notice to such persons of measures to be taken pursuant to this order would render those measures ineffectual. Start Printed Page 20252I therefore determine that for these measures to be effective in addressing the national emergency declared in this order, there need be no prior notice of a listing or determination made pursuant to section 1 of this order.

Sec. 8. The Secretary of the Treasury, in consultation with the Secretary of State, is hereby authorized to take such actions, including the promulgation of rules and regulations, and to employ all powers granted to the President by IEEPA, as may be necessary to carry out the purposes of this order. The Secretary of the Treasury may, consistent with applicable law, redelegate any of these functions within the Department of the Treasury. All departments and agencies of the United States shall take all appropriate measures within their authority to carry out the provisions of this order.

Sec. 9. Nothing in this order shall prohibit transactions for the conduct of the official business of the Federal Government or the United Nations (including its specialized agencies, programs, funds, and related organizations) by employees, grantees, and contractors thereof.

Sec. 10. The Secretary of the Treasury, in consultation with the Secretary of State, is hereby authorized to submit recurring and final reports to the Congress on the national emergency declared in this order, consistent with section 401(c) of the NEA (50 U.S.C. 1641(c)) and section 204(c) of IEEPA (50 U.S.C. 1703(c)).

Sec. 11. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Rep. Matt Gaetz (R-FL) sent a brutal message to Speaker of the House Nancy Pelosi (D-CA) this week as he fired back at her House committee investigating the January 6 Capitol riot after it moved to have his phone and computer records preserved.

Gaetz hit back by saying that he’ll get revenge on Pelosi by seizing her phone records if Republicans take back the House in 2022, according to Raw Story.

“The reason Nancy Pelosi is doing this is because they want to cast this cloud of criminality,” Gaetz said. “Nancy Pelosi better be careful what she wishes for because if the new tradition when one party gains power in the House of Representatives is that you investigate the personal records and the personal lives of the people who are out of power, well then 2022 and 2023 are going to be very difficult years for the Democrats.”

“Maybe we ought to look at Nancy Pelosi’s phone records with her husband, who benefited millions of dollars off of stock trades and technology bills that were moving through the legislative process,” he continued.

Not stopping there, Gaetz proceeded to list other Democratic lawmakers who could have their records seized next year, including Rep. Eric Swalwell (D-CA) and members of Rep. Alexandria Ocasio Cortez’s (D-NY) radically liberal Squad.

“This is unprecedented, this is Marxist and I look forward to standing up against it,” Gaetz added. “Resist these efforts to really weaponize the Congress against its own members and elected representatives.”

This comes after House Minority Leader Kevin McCarthy (D-CA) said that companies that cooperate with Pelosi’s January 6 commission will be punished under a GOP majority, warning that “a Republican majority will not forget.”

McCarthy specifically called out Pelosi as well as Rep. Adam Schiff (D-CA) and Rep. Bennie Thompson (D-MI) for what he called “attempts to strong-arm private companies to turn over individuals’ private data.” The House Minority Leader claimed that such a forfeiture of information would “put every American with a phone or computer in the crosshairs of a surveillance state run by Democrat politicians,” according to Politico.

“If these companies comply with the Democrat order to turn over private information, they are in violation of federal law and subject to losing their ability to operate in the United States,” McCarthy said. “If companies still choose to violate federal law, a Republican majority will not forget and will stand with Americans to hold them fully accountable under the law.”

Schiff responded by claiming that McCarthy’s threat was “premised on a falsehood.”

“He’s scared. And I think his boss is scared,” Schiff said. “They didn’t want this commission and this select committee to go forward. They certainly didn’t want it to go forward as it is on a bipartisan basis, and they don’t want the country to know exactly what they were involved in.

“And Kevin McCarthy lives to do whatever Trump wants,” he added. “But he is trying to threaten these companies, and it shows yet again why this man, Kevin McCarthy, can never be allowed to go anywhere near the speaker’s office.”

And the witch hunt against Republicans continues. If Pelosi and her fellow Democrats don’t watch themselves, however, this will not end well for them.

His final warning to Americans about accepting vaccine mandates is powerful. “But if you got the vaccine, out of fear. Be careful. You are slowly giving up the freedoms that so many have fought for,” he said and encouraged people to “to look deep down and decide if you’re going to fall in line as sheep, or if you’re going to stand up for the rights that we have for the short time, we still have them,” the brave officer told his viewers.

Californians will pay highest Labor Day weekend gas prices ever

Drivers in California will pay more this Labor Day weekend for gasoline than they ever have in the past for this time of year, according to numbers from the Automobile Club of California.

According to the Automobile Club of America (AAA) affiliate, the current $4.39 per gallon price of regular gas in California is a new record high for the Labor Day weekend, up from $3.23 a year ago. The current national average is at $3.184. Jeffrey Spring, a spokesman for the Automobile Club of California told FOX Business that the prior highest average price for regular on a Labor Day Weekend was in 2012, when it was at $4.16. "That year there were a few refinery fires on the West Coast that crimped supply in addition to high oil prices," he recalled.

Spring said he expects the pain at the pump for Californians to ease soon due to an expected decline in demand after the summer travel season ends. Prices might also drop, he said, when California gas stations switch to their winter blend of gas at the start of November, which is around 8-10 cents less expensive per gallon than the summer blend. The average price of gas in the U.S. has continued to climb since the beginning of last year, and deadly Hurricane Ida hitting the critical refinery areas of the Gulf Coast in recent days sparked concerns that shortages could drive prices even higher. Prices have edged up nationally by an average of roughly 5 cents over the past week.

AN RAF pilot could become the first non-American to fly the President of the United States on Air Force One. The plans represent the "symbolic culmination of a four-decades-old and deep-rooted exchange programme between the USAF and RAF founded on trust", a senior source said last night. Both air forces have been exchanging personnel since 1971 in a move designed to maximise the Special Relatuonship. As it grew, it has led to RAF pilots flying, co-piloting and crewing classified American U2 and B2 Spirit stealth bombers , capable of carrying 16 2,400lb B83 nuclear bombs. Now, an RAF Wing Commander has been earmarked to join the elite cadre of military aviators which fly the US’ Commander-in-Chief and his most senior officials.

There are also converted 757s used by senior members of the cabinet such as the Secretary of State, two smaller converted 737s and seven Gulfstreams. All have been modified to incorporate specialised communications and flight equipment and VIP staterooms. Apart from Air Force One, a presidential visit may involve a 757 to carry journalists and a C-17 Globemaster transport plane tasked with flying the president’s motorcade. The fleet is run by 89th Airlift Wing, based at Andrews Air Force Base in Camp Springs, Maryland, which employs 80 handpicked pilots and 89 flight attendants. Pilots must have at least 2,500 hours of flight time and be experienced in flying fighter jets or other military aircraft to be considered.

Sources say the officer, who has not been named, will begin his attachment by flying or co-piloting some of the other aircraft in the fleet before being placed on the reserve list for Air Force One. The presidential planes carry two reserve pilots on board at all times, in case the flight crew become incapacitated.
