General Mills Removes ‘100% Natural’ Label from Nature Valley Granola Bars after Glyphosate Lawsuit

Three U.S. NGOs jointly announced Thursday that they have resolved a consumer-protection action filed by the groups against General Mills in 2016, concerning General Mills’ labeling of its Nature Valley Granola Bars as “Made with 100% Natural Whole Grain Oats.”

The complaint stated that the granola bars, which carry the label “Made with 100% Natural Whole Grain Oats,” contain glyphosate, the world’s most used weedkiller and known carcinogen.

According to the complaint, tests from an independent laboratory found the level of glyphosate in Nature Valley Granola Bars was 450 parts per billion (ppb).

“No reasonable consumer, seeing these representations, would expect that the oats or any ingredients in the Products to contain something that is unnatural,” an excerpt of the complaint read.

The NGOs, which were represented by Brooklyn, N.Y- and Washington, D.C-based Richman Law Group, were able to resolve the claims without going to trial. At a time specified by the agreement, packaging for General Mills Nature Valley Granola bars will no longer bear the term “100% Natural Whole Grain Oats.”

General Mills spokesman Mike Siemienas said the company chose to settle to “avoid the cost and distraction of litigation”.

The complaint was filed by three NGOs: The Organic Consumers Association, Moms Across America and Beyond Pesticides.

“Agreements like the one with General Mills is just the first step,” Katherine Paul, Associate Director of the Organic Consumers Association, said in a statement. “We still have to push for a long-term solution to the problem of using the word ‘natural’ in ways that mislead consumers.”

Trump picks 9th Circuit nominee for Arizona seat

President Trump will nominate Arizona Magistrate Judge Bridget Shelton Bade for an open position on the 9th Circuit Court of Appeals, the White House said Monday.

Trump has largely avoided the 9th Circuit so far in his bid to reshape the judiciary because the Western district includes several states with two Democratic senators who could try to block his choice. In other parts of the country, he’s filled dozens of circuit court vacancies in states with Republican senators.

Arizona’s Republican senators, the late Sen. John McCain, who died Saturday, and Sen. Jeff Flake, have a history of clashes with Trump, but a White House official --- who was not authorized to speak on the record — said Monday that Bade was recommended by the senators’ judicial selection committee and isn’t expected to face opposition.

Flake’s office did not immediately return an email seeking comment on Bade. Flake serves on the Senate Judiciary Committee.

Bade was picked to be a magistrate judge for the U.S. District Court of Arizona in 2012. A magistrate judge is appointed to help U.S. district court judges with their normal duties and are generally responsible for setting bail and other administrative duties. They are not appointed by the president and do not serve life terms.

She previously worked as assistant U.S. attorney for the district of Arizona and in private practice. Bade is a graduate of Arizona State University’s Sandra Day O’Connor College of Law.

The Arizona seat on the 9th Circuit has been empty since Judge Barry Silverman took a reduced workload in October 2016.

About two-thirds of the remaining appeals court vacancies nationwide are on the 9th Circuit, and at some point Trump will turn his attention westward and take on vacancies in states with Democratic senators.

Trump’s nominee in Idaho, Ryan D. Nelson, has the support of the state’s Republican senators and is expected to move quickly.

The remaining five 9th Circuit seats could be a bigger battle.

Three of the open seats are in California, and negotiations with Sens. Dianne Feinstein and Kamala Harris have effectively stalled until after the midterm elections.

Trump nominated a judge over the objections of the Democratic home state senators in Washington, and that nomination is moving forward.

CA Gov. Jerry Brown Pardons Anti-ICE Activist Facing Deportation

Governor Jerry Brown has pardoned an anti-ICE activist facing deportation who helped advance the effort to turn California into a so-called "sanctuary state."

Phal Sok was among three Cambodian refugees with criminal records who recently had their past crimes absolved by the state’s top executive. Although Sok has been lawfully present in this country since his arrival in the early 1980s, his rap sheet included three felony convictions that made him a deportation target.

According to the San Francisco Chronicle, the pardons “wipe the crimes off the California Department of Justice and FBI books.”

Brown said Sok is currently under removal proceedings. However, the pardon could eliminate the federal government’s justification for deporting him.

Sok came to the U.S. at three months old and has lived in the United States legally for 37 years. He was convicted and sentenced in Los Angeles County in 2000 for robbery with the use of a firearm, according to the Governor’s Office. He served 15 years in prison and was discharged in August 2017.

Brown said he works at a nonprofit “dedicated to criminal justice reform,” adding that those who know Sok describe him as a “tireless advocate for immigrants, particularly refugee children and youth,” and a “true American.”

Sok says he was released from an immigration detention facility last year after “the community” paid his bond. Since then, he became an organizer for the Youth Justice Coalition (YJC). The Los Angeles-based group routinely aligns with Black Lives Matter, the ACLU, and California Democratic lawmakers seeking to reform the state’s criminal justice system, oftentimes while impeding federal immigration enforcement. Sok spoke at rallies promoting the passage of the ‘sanctuary state’ bill -- also known as the California Values Act - which Gov. Brown would sign into law last October.

Russian Military Warns of an Impending ‘False Flag’ Chemical Attack in Syria
