Hong Kong: Protestor known as ‘Captain America’ jailed under CCP-imposed ‘national security law’

Hong Kong’s self-styled ‘Captain America’ was sentenced to nearly 6 years in prison on charges of inciting secession under Hong Kong’s national security law by chanting pro-independence slogans at protests.

Adam Ma Chun, 31, who had worked as a food delivery boy and called himself “second-generation Captain America,” was sentenced Thursday, Nov. 11, by a District Court to 5 years and 9 months in prison for holding separatist demonstrations on 20 occasions from Aug. 15 to Nov. 22, 2020, according to the Daily Mail.

Judge Stanley Chan Kwong-chi who handed down the sentence said the defendant intentionally wanted to incite secession and showed no remorse, so he believed the sentence was deserved, as he “wantonly denigrated the national security law.”

“The defendant did not commit the offence out of momentary impulse. He always came prepared and advocated his stance aloud. He even posed as a ‘second-generation’ Captain America. The gratification of doing all these was written all over his face,” the judge said.

As it transpired, the young man had dubbed himself “second-generation Captain America” in reference to a prominent protester dressed as the superhero during the 2014 Occupy movement and the Mong Kok riot in 2016 as the SCMP informed.

The Oklahoma National Guard rejected the Department of Defense's vaccine mandate Thursday, telling the troops they will not be penalized or punished for not getting vaccinated against COVID-19.

The order handed down from Brig. Gen. Thomas Mancino, who was appointed earlier this week by Oklahoma's Republican Gov. Kevin Stitt, is in contrast to the prior adjutant who had advocated for all soldiers and airmen to be vaccinated. However, a spokeswoman for the governor told the Associated Press that the change in leadership had nothing to do with the mandate.

Stitt, who is against a federal vaccine mandate, wrote a letter to Secretary of Defense Lloyd Austin requesting a suspension of the vaccine mandate for Oklahoma's National Guard.

"This mandate violates the personal freedoms of many Oklahomans, as it asks them to potentially sacrifice their personal beliefs in order to not lose their jobs," Stitt said in the letter. "All of our National Guardsmen take this calling very seriously. These are patriotic citizens who are willing to put their lives on the line to protect others in our communities during times of greatest need."

Stitt added that it was irresponsible to require a vaccine mandate that would limit the number of people he could call upon in times of state emergencies.

The Pentagon did not appear receptive to Stitt's request.

"We will respond appropriately," John Kirby, a Pentagon spokesman, told the Washington Post. "That said, Secretary Austin believes that a vaccinated force is a more ready force. That is why he has ordered mandatory vaccines for the total force, and that includes our National Guard, who contribute significantly to national missions at home and abroad."

More than 800 guard members have not received the vaccine, which the governor claims is 10% of the force, Stitt's letter said.

The National Guard is usually controlled by the state, but the president has the power to federalize the guards at any time, which would require the guards to receive the vaccine. Because President Joe Biden has not federalized the guards in Oklahoma, the state mandate stands.

National Guard members account for 28% of the 75 COVID-19 related deaths in the military, the highest death toll among the armed forces, according to Pentagon data reviewed by the Washington Post.

COP26: Negotiators in Glasgow Finalize Historic Agreement to Combat Climate Change

At the COP26 summit, international negotiators have approved a climate agreement that aims to reduce the use of coal and other fossil fuels and transition the industries of the planet to renewable and sustainable energy sources.

The agreement, known as the Glasgow Climate Pact, was reached on Saturday and is the first of its kind in the 25 years that the United Nations have held climate talks.

Another key feature of the agreement is a call for wealthy industrialized nations, beginning in 2025, to double their financial support for adaptation efforts in the developing world - starting from $100 billion each year. circular from SEBI on perpetual bonds in the second week of March set off tensions between the Finance Ministry and the market regulator and sent debt mutual fund investors into a tizzy once again. While the circular intended the changes to take effect from April 1, 2021, SEBI has now decided to give funds time until April 2023 to fall in line with the valuation rules.

What is it?

Perpetual bonds are fund-raising instruments that do not carry any maturity date as bonds usually do. Instead, they offer to pay their buyers a coupon or interest at a fixed date for perpetuity. While a variety of entities may issue perpetual bonds, the most common ones in India are issued by banks to meet their Basel III capital norms and are called Additional Tier 1 or AT-1 bonds. In the case of bank AT-1 bonds, banks can write off the principal in addition to not paying interest if they run short of capital or face bankruptcy. For an investor, this feature and the eternal nature of these bonds add to the risk; but they usually fetch higher yields than other debt instruments.

While the principal amount in such bonds is never really due for repayment, issuers do attach a call option. So, at the end of a specific term, say five or 10 years from the issue date, the issuers can buy back the bonds from the investors. Investors can also use the secondary market as a means of exit in the case of traded perpetual bonds.

Given the higher risk appetite required for such instruments, SEBI has restricted the purchase of such bonds to institutions. Debt mutual funds with retail investors in them however own such bonds. After the recent write-off of AT-1 bonds of YES Bank and its consequent effect on debt mutual funds, SEBI, in March, decided to further protect retail investors in debt funds by setting a 10 per cent limit for a debt fund’s investment in such bonds. It also laid down that funds need to value these bonds as if they were 100-year bonds and, if illiquid, to reflect their true risk.

Why is it important?

Bonds are valued by discounting the future interest receipts and principal repayments to present value. Today, fund houses value perpetual bonds assuming that their issuers will exercise their call options five or 10 years from the issue date. But SEBI wants fund houses to value them as if the principal will be returned only a 100 years later. Following this tweak in norms, perpetual bonds not traded frequently may see a sharp fall in value.

Not only will this change in valuation norm lead to significant volatility in the NAVs of several debt schemes, but the calculation can itself be cumbersome. Take the case of non-traded or thinly traded perpetual bonds. SEBI classifies debt securities with a trading volume of less than ₹5 crore in a calendar month as thinly traded. Perpetual bonds that fall into this category may need to build a risk-free benchmark and identifying a 100-year benchmark can be tough. The Finance Ministry appears worried about the circular because with stiffer valuation norms and the 10 per cent limit on debt scheme exposures, public sector banks may find it tougher to raise capital through this route.

Why should I care?

While the fund houses have their work cut out, investors in debt schemes may have their troubles too if they own schemes with large perpetual bond exposures as their returns may get more volatile. Prices of perpetual bonds in the market have already tanked sharply in the last couple of weeks after the SEBI circular. Since the circular mandates the valuation to be updated by April 1, debt schemes that have higher exposure to thinly traded perpetual bonds may need to wind down this exposure or revalue these bonds causing NAV blips. A CRISIL Research report has found that 36 debt schemes from 13 fund houses held more than the SEBI-mandated limit of 10 per cent in perpetual bonds.

The bottomline

Their name may be bond, but perpetual instruments are almost as risky as stocks.

The financial markets are a cult controlled apparatus for harvesting the resources of the world.

MIT professor emeritus and political activist Noam Chomsky said he believes that while unvaccinated people have the right to refuse a COVID jab, they should “have the decency to isolate” from the community for the safety of others.

Chomsky was asked in an interview whether the COVID vaccine should be required when he made the remark. A clip of his response has garnered 1.9 million views on Twitter and been met with mixed reactions.

“People who refuse to accept vaccines, I think the right response for them is not to force them to, but rather to insist that they be isolated. If people decide, ‘I am willing to be a danger to the community by refusing to vaccinate,’ they should say then, ‘Well, I also have the decency to isolate myself. I don’t want a vaccine, but I don’t have the right to run around harming people.’ That should be a convention,” said Chomsky.

“Enforcing is a different question. It should be understood, and we should try to get it to be understood. If it really reaches the point where they are severely endangering people, then of course you have to do something about it,” he added.

Background

The trial centered on a Mafia-run enterprise that involved processing heroin in Sicily, morphine purchased from Turkey and Southwest Asia, as well as cocaine from South America, for final distribution of the drugs in the United States through independently owned pizza parlor fronts as the money was laundered through several banks and brokerages in the United States and overseas.[7] The enterprise was estimated to have imported US$1.65 billion of heroin to the United States, namely the Northeast and the Midwest, between 1975 and 1984.[2][7]

For about a year, the prosecution, consisting of Richard A. Martin, Louis J. Freeh, Robert Stewart, Robert B. Bucknam and Andrew C. McCarthy, gathered hundreds of witnesses, wiretaps, and thousands of documents, which cost several million dollars to complete.[5] Arrests of conspirators were coordinated in the United States, Italy, Switzerland and Spain on April 8, 1984, following the capture of Gaetano Badalamenti and his son Vito Badalamenti together with Pietro Alfano in Madrid, Spain;[2][8] on November 15, they were extradited to the United States.[9] Badalamenti was formerly on the Sicilian Mafia Commission.[10][11] A day later, the Federal Bureau of Investigation arrested nearly 30 people in New York City, seizing weapons and drugs.[7]

One of these witnesses was Sicilian Mafia pentito Tommaso Buscetta, who had already revealed information to Italian magistrate Giovanni Falcone to prepare for the Maxi Trial, was extradited in December 1984 to the United States where he received a new identity from the government, American citizenship and placement in the Witness Protection Program in exchange for new revelations against the American Mafia in the Pizza Connection Trial.[12][13][3][14]

Another witness was Sicilian Mafia pentito Salvatore Contorno, who followed the example of Buscetta, and began collaborating in October 1984, and also testified at the Maxi Trial.[15][16][17]

Former undercover FBI agent Joseph D. Pistone, who infiltrated the Bonanno crime family between 1976 and 1981 using the alias "Donnie Brasco", also testified at the trial.[18]

The Dark Overlord (also known as the TDO) is an international hacker organization which garners significant publicity through cybercrime extortion of high-profile targets and public demands for ransom to prevent the release of confidential or potentially embarrassing documents.[1]

The group gained its initial notoriety through the sale of stolen medical records on TheRealDeal, a darkweb marketplace.[2][3] Major targets for the group included the extortion of Netflix, which resulted in the leak of unreleased episodes of the series Orange Is the New Black,[4] and Disney.[5]

In 2017, the group broke its trend of hacking and extortion, and began a series of terror-based attacks starting with the Columbia Falls school district in Montana.[6][7] The group sent life-threatening text messages to students and their parents, demanding payment to prevent the murder of children.[8] These attacks forced the closure of more than 30 schools across multiple school districts, resulting in more than 15,000 students being home from school for an entire week. During a senate committee hearing Senator Steve Daines (MO) referred to these attacks as "unprecedented".

On December 31, 2018, TDO announced the Lloyd's of London and Silverstein Properties "9/11 Papers" hack on Twitter, with thousands of incriminating documents[9][10][11] to be released in stages unless US$2,000.000 in bitcoin were paid.[12] TDOL was subsequently banned from many social media platforms including Twitter, Reddit, Pastebin and Steemit.[citation needed] Platforms unrelated to TDOL such as www.hpub.org also had their social media accounts eliminated or followers deleted for serving as mirrors of TDOL hacked documents.[13] As of January 12, 2019, the bitcoin blockchain explorer revealed that less than 1% of the ransom had been paid and the payment sources may have been 9/11 researchers, not the targets of the hack. As a result, TDOL continues to release encrypted files and their private keys to the public in stages. It remains to be seen whether the documents contain anything that could challenge the official account of 9/11.[14][15]

Nathan Wyatt, a member of The Dark Overlord hacking group was extradited from the UK to the US in December 2019 to face charges in St. Louis for his involvement in the group.[16][17] According to the charges, Wyatt "conspired to steal sensitive personally identifying information from victim companies and release those records on criminal marketplaces unless victims paid Bitcoin ransoms.[18]

In 2020, the group members became the feature of Hunting Cyber Criminals, a non-fiction book by cybersecurity author Vinny Troia (Wiley Books). In the book, Troia suggest the remaining group members are still at large and living in Calgary, Canada.[19] He also claimed that members of The Dark Overlord became part of ShinyHunters and GnosticPlayers.[20]

Buscetta provided no direct connection between the defendants and drugs.[20] Contorno testified that defendant Frank Castronovo, cousin of Carlo Castronovo in Sicily, used pizza parlors as fronts in the United States.[20] Contorno also testified that he had a meeting in 1980 in Bagheria about heroin and had seen Castronovo there with three other defendants—Salvatore Catalano, Gaetano Mazzara, and Salvatore Greco.[20] Pistone testified that he was told that a Bonanno faction headed by Dominick Napolitano had formed an alliance with a Sicilian faction, which involved Salvatore Catalano.[18]

Verdicts

Over the course of the trial, Gaetano Mazzara was murdered and Pietro Alfano was seriously wounded,[21] and on March 2, 1987, two of the 22 men pleaded guilty to lesser currency violations,[7][5][6] while 18 of the remaining 19 defendants were convicted of running an international drug ring.[5][6] Vito Badalamenti was the only defendant acquitted.[22][23] Sentences were handed down on by judge Pierre Leval on June 22, 1987.[21] Five of the defendants were sentenced to 45 years in prison, while the 13 other defendants faced maximum sentences between 15 to 40 years in prison for their convictions on charges of participating in the drug conspiracy.[21] Gaetano Badalamenti was sentenced to 45 years in prison and fined $125,000, and since he was extradited from Spain with the provision that he serve no more than 30 years, he was ordered to be released after 30 years should he live that long.[23][21] Salvatore Catalano was also was sentenced to 45 years in prison but fined $1.15 million and ordered to pay $1 million in restitution; Salvatore Mazzurco was sentenced to 35 years in prison and fined $50,000 and ordered to pay $500,000 in restitution; Salvatore Lamberti was sentenced to 20 years in prison and fined $50,000 and ordered to pay $500,000 in restitution; and Giuseppe Lamberti was sentenced to 35 years in prison and fined $150,000 and ordered to pay $500,000 in restitution.[21]
