'Falsified Data': Pfizer Vaccine Trial Had Major Flaws, Whistleblower Tells Peer-Reviewed Journal

A whistleblower involved in Pfizer's pivotal phase III Covid-19 vaccine trial has leaked evidence to a notable peer-reviewed medical publication that poor practices at the contract research company she worked for raise questions about data integrity and regulatory oversight.

Brook Jackson, a now-fired regional director at Ventavia Research Group, revealed to The BMJ that vaccine trials at several sites in Texas last year had major problems - including falsified data, broke fundamental rules, and were 'slow' to report adverse reactions.

When she notified superiors of the issues she found, they fired her.

A regional director who was employed at the research organisation Ventavia Research Group has told The BMJ that the company falsified data, unblinded patients, employed inadequately trained vaccinators, and was slow to follow up on adverse events reported in Pfizer’s pivotal phase III trial. Staff who conducted quality control checks were overwhelmed by the volume of problems they were finding. After repeatedly notifying Ventavia of these problems, the regional director, Brook Jackson, emailed a complaint to the US Food and Drug Administration (FDA). Ventavia fired her later the same day. Jackson has provided The BMJ with dozens of internal company documents, photos, audio recordings, and emails. -The BMJ

Poor laboratory management

Jackson, a trained clinical trial auditor with more than 15 years' experience, says she repeatedly warned her superiors of poor laboratory management, patient safety concerns, and data integrity issues. After she was ignored, she started documenting problems with the camera on her mobile phone.

One photo, provided to The BMJ, showed needles discarded in a plastic biohazard bag instead of a sharps container box. Another showed vaccine packaging materials with trial participants’ identification numbers written on them left out in the open, potentially unblinding participants. Ventavia executives later questioned Jackson for taking the photos.

The unblinding was potentially far more severe as well. Per the trial's design, unblinded staff prepared and administered either Pfizer's Covid-19 vaccine or a placebo. This was done to preserve the blinding of trial participants and other staff - including the principal investigator. At Ventavia, however, Jackson says that drug assignments were left in participants' charts and accessible to blinded personnel. The breach was corrected last September, two months into the trial at which point there were around 1,000 participants already enrolled.

Jackson recorded a September 2020 meeting with two Ventavia directors, at which an executive can be heard saying that the company couldn't quantify the types and number of errors with their testing.

"In my mind, it's something new every day," they said, adding "We know that it's significant."

According to the report, Ventavia also failed to keep up with data entry - as a Sept. 2020 email from Pfizer partner ICON reveals.

"The expectation for this study is that all queries are addressed within 24hrs.” ICON then highlighted over 100 outstanding queries older than three days in yellow. Examples included two individuals for which “Subject has reported with Severe symptoms/reactions … Per protocol, subjects experiencing Grade 3 local reactions should be contacted. Please confirm if an UNPLANNED CONTACT was made and update the corresponding form as appropriate.” According to the trial protocol a telephone contact should have occurred “to ascertain further details and determine whether a site visit is clinically indicated.”

FDA Inspection woes

Other documents provided to The BMJ reveal that Ventavia officials were worried about three employees . In an email in early August 2020, an executive identified three site staff members with whom they need to "Go over e-diary issue/falsifying data, etc."

One of the employees was "verbally counseled for changing data and not noting late entry," a note reveals.

French Shipper CMA CGM Near a Deal to Buy California Terminal Operator

CMA CGM SA, one of the world’s largest shipping companies, is nearing a deal to buy Fenix Marine Services, which operates a container terminal in the Port of Los Angeles, according to people with knowledge of the matter.

CMA CGM, which already owns a 10% stake in the Fenix terminal, is in advanced discussions with EQT Infrastructure, the people said. The arm of alternative-asset manager EQT AB owns the other 90% of Fenix. The shipper beat out offers from other bidders including infrastructure funds, some of the people said. A deal is yet to be finalized and it’s possible talks could fall apart.

EQT had been working with Rothschild & Co. to solicit interest in its stake in the San Pedro, California-based terminal from potential suitors, Bloomberg News reported in September. Terms of the CMA CGM purchase couldn’t immediately be learned. A deal could value the terminal at $2 billion or more, including debt, Bloomberg reported.

Representatives for EQT and CMA CGM didn’t immediately have comments. A Rothschild spokesman declined to comment.

EQT, which acquired Fenix in 2017, invested more than $130 million on technology, new equipment such as cranes and reconfiguration of the terminal, according to a document sent to prospective suitors reviewed by Bloomberg. The terminal operates on a concession from the Port of Los Angeles expiring in 2043. Fenix, which spans 292 acres (118 hectares), has a long-term off-take agreement with Ocean Alliance, which includes Cosco Shipping Lines, CMA CGM, Evergreen Line and Orient Overseas Container Line Ltd. Supreme Court Rejects Bid for Public Access to Rulings From Secretive FISA Court

An attempt to gain access to decisions made by a secretive court has been denied by the Supreme Court.

The American Civil Liberties Union and a coalition of other groups had argued that the Constitution’s First Amendment requires the Foreign Intelligence Surveillance Court (FISC) to make available all “novel or significant interpretations” of law issued between Sept. 11, 2001, and mid-2015.

The court was required by Congress with the passage of the USA Freedom Act to release significant opinions for public dissemination, but the government has refused to release any such opinions issued prior to June 2015.

FISC, which was created by the Foreign Intelligence Surveillance Act, and its court of review both ruled against the civil liberties group. The courts asserted that they lacked the authority to consider granting the access sought. That set up a writ of certiorari, or an appeal, to the nation’s top court, which denied the writ on Nov. 1.

The majority didn’t detail the rationale for their decision, but Justices Neil Gorsuch and Sonia Sotomayor said they would have taken up the case.

“The government does not merely argue that the lower court rulings should be left undisturbed because they are correct. The government also presses the extraordinary claim that this Court is powerless to review the lower court decisions even if they are mistaken. On the government’s view, literally no court in this country has the power to decide whether citizens possess a First Amendment right of access to the work of our national security courts,” Gorsuch, a Trump appointee, wrote in a dissenting opinion (pdf), joined by Obama appointee Sotomayor.

Gorsuch said he feels that the case presents questions about the right of the public to access judicial proceedings “of grave national importance.”

“Maybe even more fundamentally, this case involves a governmental challenge to the power of this Court to review the work of Article III judges in a subordinate court. If these matters are not worthy of our time, what is?” he said.

Patrick Toomey, senior staff attorney at the American Civil Liberties Union’s National Security Project, also expressed disappointment regarding the high court’s decision.

“By turning away this case, the Supreme Court has failed to bring badly needed transparency to the surveillance court and to rulings that impact millions of Americans. Secret court decisions are corrosive in a democracy, especially when they so often hand the government the power to peer into our digital lives,” Toomey said in a statement.

The ruling highlights the need to end laws that enable the government to operate in secret, Sen. Ron Wyden (D-Ore.) added.
