Twitter hires former FBI lawyer James Baker to join legal team

Twitter has tapped former FBI general counsel James Baker, a central player in the Russia collusion investigation, to serve as counsel to the tech giant.

“Thrilled to welcome @thejimbaker to @Twitter as Deputy General Counsel,” Twitter’s chief legal officer, Sean Edgett, posted Monday.

Edgett continued, “Jim is committed to our core principles of an open internet and freedom of expression, and brings experience navigating complex, global issues with a principled approach.”

Baker responded to the welcoming message in kind, writing, “Thanks @edgett!! I’m very excited to join such a great team @Twitter doing such important work. Glad to be on board.”

Despite having left Washington behind, Baker is joining the social media company at a notable political moment.

Twitter has been engaged in an ongoing feud with President Trump and his conservative allies since May, when the site took the unprecedented step of labeling two tweets from the commander-in-chief as promoting misinformation.

The warnings are attached to missives Trump fired off in which he claimed that mail-in ballots are fraudulent and will lead to a “rigged election” in November.

The move marked the first time the social media had annotated tweets from the president of the United States — arguably Twitter’s most prolific user, who frequently airs grievances to his 80 million followers.

In response, Trump issued an executive order curtailing liability protections for social media companies just two days later.

“We’re here today to defend free speech from one of the greatest dangers it has faced in American history had unchecked power to censure, restrict, edit, shape, hide, alter virtually any form of communication between private citizens or large public audiences,” the president said at the time.

“This censorship and bias is a threat to freedom itself. Imagine if your phone company silenced or edited your conversation. Social media companies have vastly more power in the United States than newspapers, they’re by far more rich than any other traditional forms of communication,” he added.

Baker, for his part, will likely be involved in defending the company using protections provided under Section 230 of the Communications Decency Act, which provides those legal safeguards to platforms that allow anyone to publish content from lawsuits regarding that content.

During his time with the FBI, Baker found himself involved with the early stages of the investigation into Russian interference in the 2016 election, specifically the Foreign Intelligence Surveillance Act (FISA) warrant application against Carter Page.

Page was a campaign aide to Trump in 2016, when federal agents used the unverified Trump dossier compiled by former British spy Christopher Steele to convince the FISA court to grant them a warrant to spy on Page.

That warrant, as well as the circumstances surrounding it, are being looked at by US Attorney John Durham, who was appointed by Attorney General William Barr to review federal surveillance abuses.

Baker has stood by his conduct during his time at the FBI and with regard to the Russia probe.

Speaking to Yahoo News in May 2019, the former general counsel said he would “welcome scrutiny” of his conduct.

“I plan to fully cooperate with the department to help them figure out what happened. Because I believe what happened was lawful, at least based on every piece of information that I have,” he said at the time.

Elon Musk Loses Bid To Throw Out 2018 SEC Consent Decree And Quash Recent SEC Subpoena

Elon Musk has lost his motion to throw out his settlement with the SEC that he agreed to in 2018, Bloomberg reported on Wednesday morning. The report said that a judge in New York on Wednesday also denied Musk's efforts to block an SEC subpoena regarding Tesla's public disclosure controls.

Recall, just a couple weeks ago, the SEC told a federal judge that Musk should not be allowed out of the agreement with the regulator that his Twitter account be monitored. The U.S. Securities and Exchange Commission said Musk had not met the "high burden" necessary to throw out the 2018 consent decree he is under. Musk found compliance "less convenient than he had hoped," the SEC argued, adding that "when it comes to civil settlements, a deal is a deal, absent far more compelling circumstances than are here presented."

Recall, in early March, Musk had asked a federal judge to throw out his settlement with the SEC. Musk's lawyers argued that the settlement, which famously required Musk to run his Tweets past a "Twitter sitter"as a consequence of faking an $80 billion buyout for Tesla, "has become unworkable".

And in a sign that the SEC was a fly in Musk's ointment, his lawyers said that the regulator was using the settlement to make “round after round of demands for voluminous, costly document productions, with no signs of abatement.” Additionally, Musk called into question the SEC's original claims that he defrauded shareholders in 2018. “I never lied to shareholders. I would never lie to shareholders. I entered the consent decree for the survival of Tesla, for the sake of its shareholders,” Musk said, claiming he felt "pressured" to settle with the SEC and put the matter behind him.

Donna Nagy, a law professor at Indiana University, told the WSJ: “It is exceedingly difficult to convince a federal court to terminate a consent decree. The showing required is very high and there is very recent precedent in an analogous area.” Earlier this year, we wrote that the SEC was probing Musk and his brother, Kimbal, over trades they executed in November 2021. The investigation began one day after Kimbal Musk sold $108 million in stock - which occurred one day before the Tesla CEO polled his Twitter users, on November 7 - just as the Russell and cryptos peaked - asking whether or not he should sell 10% of his stake in the company. That vote then set Musk in motion to sell far in excess of $10 billion in stock, representing about 10% of his stake in Tesla. The Tesla CEO claimed the sale was a way to cover taxes for potential new capital gains laws. After Elon started selling stock, Tesla's stock price fell 33%. Regulators are reportedly probing whether or not Elon may have told his brother Kimbal about his planned Tweet and, if so, if Kimbal knowingly traded ahead of the event.

Kimbal's trading might "violate rules that generally prohibit employees and board members from trading on material nonpublic information", the Journal reported. Kimbal's shares were not sold pursuant to a 10b5-1 plan, which would have dictated that he could sell at a predetermined interval.

In June, the FBI got a warrant to hunt through the Google accounts of Abedemi Rufai, a Nigerian state government official.

What they found, they said in a sworn affidavit, was all the ingredients for a "massive" cyberfraud on U.S. government benefits: stolen bank, credit card and tax information of Americans. Money transfers. And emails showing dozens of false unemployment claims in seven states that paid out $350,000.

Rufai was arrested in May at John F. Kennedy International Airport in New York as he prepared to fly first class back to Nigeria, according to court records. He is being held without bail in Washington state, where he has pleaded not guilty to five counts of wire fraud.

Rufai's case offers a small window into what law enforcement officials and private experts say is the biggest fraud ever perpetrated against the U.S., a significant part of it carried out by foreigners.

Russian mobsters, Chinese hackers and Nigerian scammers have used stolen identities to plunder tens of billions of dollars in Covid benefits, spiriting the money overseas in a massive transfer of wealth from U.S. taxpayers, officials and experts say. And they say it is still happening.

Among the ripest targets for the cybertheft have been jobless programs. The federal government cannot say for sure how much of the more than $900 billion in pandemic-related unemployment relief has been stolen, but credible estimates range from $87 billion to $400 billion — at least half of which went to foreign criminals, law enforcement officials say.

Those staggering sums dwarf, even on the low end, what the federal government spends every year on intelligence collection, food stamps or K-12 education.

"This is perhaps the single biggest organized fraud heist we've ever seen," said security researcher Armen Najarian of the firm RSA, who tracked a Nigerian fraud ring as it allegedly siphoned millions of dollars out of more than a dozen states.

Jeremy Sheridan, who directs the office of investigations at the Secret Service, called it "the largest fraud scheme that I've ever encountered."

"Due to the volume and pace at which these funds were made available and a lot of the requirements that were lifted in order to release them, criminals seized on that opportunity and were very, very successful — and continue to be successful," he said.

While the enormous scope of Covid relief fraud has been clear for some time, scant attention has been paid to the role of organized foreign criminal groups, who move taxpayer money overseas via laundering schemes involving payment apps and "money mules," law enforcement officials said.

"This is like letting people just walk right into Fort Knox and take the gold, and nobody even asked any questions," said Blake Hall, the CEO of ID.me, which has contracts with 27 states to verify identities.

Officials and analysts say both domestic and foreign fraudsters took advantage of an already weak system of unemployment verification maintained by the states, which has been flagged for years by federal watchdogs. Adding to the vulnerability, states made it easier to apply for Covid benefits online during the pandemic, and officials felt pressure to expedite processing. The federal government also rolled out new benefits for contractors and gig workers that required no employer verification.

In that environment, crooks were easily able to impersonate jobless Americans using stolen identity information for sale in bulk in the dark corners of the internet. The data — birthdates, Social Security numbers, addresses and other private information — have accumulated online for years through huge data breaches, including hacks of Yahoo, LinkedIn, Facebook, Marriott and Experian.

At home, prison inmates and drug gangs got in on the action. But experts say the best-organized efforts came from abroad, with criminals from nearly every country swooping in to steal on an industrial scale...

WASHINGTON — United States prosecutors say they've offered a plea deal to the Montreal-area woman accused of mailing poison to former president Donald Trump.

The deal would include the three charges Ferrier faces related to a letter containing ricin that was mailed to the White House in 2020, as well as 16 federal charges she faces in Texas, where she is alleged to have mailed poison to several law enforcement officials.

Federal prosecutor Michael Friedman said during a brief court appearance today that Ferrier will have until the end of June to decide whether to accept the offer, the details of which were not disclosed.

Friedman says the deal is complex and the charges Ferrier faces are serious, adding that eight of the Texas charges carry a possible life sentence.

Ferrier was found fit to stand trial in March.

She is scheduled to be back in court June 30.

LOS ANGELES (CNS) — A self-described "comically terrible spy" who is believed to have worked with federal authorities investigating the activities of Deutsche Bank and its ties with former President Donald Trump was found dead east of Lincoln Park, police said Tuesday.

Valentin Broeksmit, 45, was found about 7 a.m. Monday in the 4500 block of Multnomah Street, according to the Los Angeles County coroner's office. An autopsy was pending to determine his cause of death.

Sheridan, whose purview at the Secret Service includes financial crimes, pointed out that the stolen sums far exceed the annual cost of ransomware, a problem estimated to cost the economy $20 billion a year, which has commanded outsize media attention.

The windfall for criminal groups will fuel other types of crime, including drug and human trafficking, he said.

"These groups that are profiting so greatly from these types of schemes, they engage in a host of other crimes," he said. "Drug trade, crimes against children, more sophisticated cyber-related fraud. And this money is basically an investment to them to conduct more extensive criminal operations ... some of which include crimes that will compromise national security."

Missed opportunities

By the time states recognized the extent of the criminality, the spigot of cash had been gushing for months.

"Nobody really understood how big the problem was until it was playing out," said Najarian, the RSA security researcher. "We all accepted that there was fraud taking place, organized fraud and local fraud. But what we didn't realize ... was that the organized fraud was very aggressive and very efficient and moving very, very large sums of money offshore."

The investigative journalism site ProPublica calculated last month that from March to December 2020, the number of jobless claims added up to about two-thirds of the country's labor force, when the actual unemployment rate was 23 percent. Although some people lose jobs more than once in a given year, that alone could not account for the vast disparity.

The thievery continues. Maryland, for example, in June detected more than half a million potentially fraudulent unemployment claims in May and June alone. Most of the attempts were blocked, but experts say that nationwide, many are still getting through.

The Biden administration has acknowledged the problem and blamed it on the Trump administration.

"There is perhaps no oversight issue inherited by my Administration that is as serious as the exploitation of relief programs by criminal syndicates using stolen identities to steal government benefits," Biden said in a statement in May as the government announced a Justice Department Covid fraud task force.

The Biden administration has allocated $2 billionto shore up state unemployment systems. That appears to be badly needed, because states have failed to take basic steps to improve identity verification, according to the Labor Department's inspector general.

In a memo in February, the inspector general reported that as of December, 22 of 54 state and territorial workforce agencies were still not following its repeated recommendationto join a national data exchange to check Social Security numbers. And in July, the inspector general reported that the national association of state workforce agencies had not been sharing fraud data as required by federal regulations.

Twenty states failed to perform all the required database identity checks, and 44 states did not perform all recommended ones, the inspector general found.

"The states have been chronically underfunded for years — they're running 1980s technology," Hall said.

Not a victimless crime

Along with the huge losses inflicted on the U.S. Treasury, the criminals also hurt tens of thousands of people, many of whom suffered delays in getting much-needed benefits.
