CHP can ban protests at California Capitol, federal judge rules

A federal judge has rejected a request that he scuttle the California Highway Patrol’s temporary ban on protests at the state Capitol, saying the state’s emergency powers during the coronavirus pandemic give it the authority to order a halt to such gatherings.

U.S. District Judge John A. Mendez issued the 24-page order Friday afternoon following two hours of argument a day earlier in federal court in Sacramento during which two Sacramento residents were seeking a temporary restraining order against the CHP’s protest ban.

Mendez cited a 1905 U.S. Supreme Court ruling that found “a community has the right to protect itself against an epidemic of disease which threatens the safety of its members.”

“The Supreme Court penned those words over a hundred years ago, but they remain relevant today,” Mendez wrote, noting the danger the state’s citizens face from the spread of COVID-19.

“In this case it is uncontroverted that the State’s stay-at-home order bears a real and substantial relation to public health,” the judge wrote. “Here in California, as of May 6, 2020, COVID-19 has infected 58,815 and killed 2,412.”

The plaintiffs — a Sacramento gun club employee and a Republican congressional candidate — had both applied for permits to hold separate rallies at the Capitol that were expected to draw between 500 and 1,000 people.

The CHP denied both applications, citing a ban that was put into place the day after an April 20 protest — which was granted a permit — drew hundreds of people who jammed together on the west grounds of Capitol Park in downtown Sacramento without protective masks or gloves.

Activists protesting Gov. Gavin Newsom’s stay-at-home order subsequently began planning additional protests regardless of whether the received a permit. One last Friday ended with a line of CHP officers in riot gear forcing hundreds of demonstrators to back off the Capitol grounds and onto a city sidewalk after a tense standoff. Thirty-two people were detained and cited for creating a public health hazard.

Another demonstration Thursday was thwarted with protesters arriving to find the CHP had ringed the west side of the Capitol property with steel gates and posted hundreds of officers around the perimeter to ensure they could not advance beyond the 10th Street sidewalk. No arrests stemmed from that event.

Mendez has conceded that the plaintiffs’ lawsuit may continue for some time, and has the potential to end up before the U.S. Supreme Court.

But he said in his order that he would not grant a temporary restraining order against the CHP’s ban.

Citing other court rulings, he noted that First Amendment rights are critical and that the state Capitol grounds are a popular spot for citizens to make their opinions known.

“The grounds of the State Capitol building are chief among traditional public fora,” Mendez wrote. “Home to California’s state government, the grounds are ‘especially important locales for communication among the citizenry’ and a place for the citizenry to convey important messages to its lawmakers.”

But he found the CHP is not trying to stop certain protests; instead, the agency is trying to stop all protests to avoid the spread of the virus, a move that he found is within the state’s emergency powers.

“The Court is well aware that the State’s stay at home order being challenged by these Plaintiffs is burdensome, and even devastating, to many,” he wrote. “This pandemic has undoubtedly taken its toll.

“But the sacrifices all California residents are being asked to make to protect the state’s most vulnerable flow from a constitutional executive order. And our willingness to rise to the challenge posed by that order is a true measure of our humanity.”

The metaphors are a little heavy-handed, but the driving is impressive and the timing is impeccable. On the same day CNN reported that the CIA had to withdraw one of its top spies in Russia on fears that President Trump had compromised the spy's identity, former undercover CIA agent Valerie Plame launched her bid for Congress as a Democrat in New Mexico.

If you don't know the story of Plame being outed by then-Vice President Dick Cheney's chief of staff, Scooter Libby — and the coda of Trump pardoning Libby earlier this year — Plame narrates the outline as she speeds backward through the New Mexico desert in an American muscle car (no Aston Martin here, thank you very much).

Is that really Plame driving and peeling out in the dust like a seasoned stuntwoman or, you know, James Bond? She says yes. As in: "Yes, the CIA really does teach us how to drive like this." The slick ad, the sick driving chops, and her call for revenge will probably earn Plame attention in New Mexico (and Washington), but if she wins the Democratic primary to replace Rep. So Spanberger (D-Va.), a proudly apolitical collector of evidence, decided to do something profoundly radical for an ex-spy. She ran for the House of Representatives — and won, upsetting Rep. Dave Brat (R) in Virginia’s 7th District. On Thursday, as the 116th Congress convened, she joined a small vanguard of ex-intelligence officers becoming Instagram-friendly lawmakers.

“Leaving the CIA was the biggest loss of my life. I mourned the agency. I miss it every day,” said Spanberger, 39, one of three former CIA officers serving in the new Congress.

The idea of CIA officers running for national political office would have struck previous generations of agency spies as sacrilegious, said former CIA director Leon E. Panetta, who headed the agency after more than 15 years as a California congressman. For one thing, agency officers, more than others in the intelligence community, usually maintain low profiles, even after they leave Langley. And even if CIA people do take on a modicum of celebrity — television punditry or Hollywood are popular career paths — they typically have avoided Congress, whose oversight of the agency has generated lingering ill will.

“The old Yale guys would say, ‘What the hell is going on? You gotta be secret and anonymous and let the other guys who don’t know what they’re doing play the political game,’ ” Panetta said. “But young people at the CIA now are not particularly tied to the long legacies of the intelligence business and recognize that it’s important to get involved in politics because if they do not, others will distort the work of intelligence agencies.”

Spanberger, who worked for the CIA for eight years, is serving alongside two other former agency officers: Rep. Elissa Slotkin (D-Mich.), 42, an analyst who deployed to Iraq three times and won a seat representing Michigan’s 8th District by beating a Republican incumbent; and Rep. Will Hurd (R-Tex.), 41, who worked undercover in the Middle East and South Asia, and has served Texas’s 23rd District since 2015.

“For so many of us with national security backgrounds, bringing our history of public service without a partisan lens is important — and it’s a skill set,” Spanberger said. “We served the mission under Republican and Democratic presidents.”

While Spanberger and Slotkin have earned attention for being spies turned lawmakers, their paths are not without precedent.

Porter Goss began his CIA career as a clandestine officer in the 1960s, then served in Congress from 1989 to 2004, representing the 14th District in Florida, before returning to Langley as its director. Bob Barr, a former Latin American analyst, represented Georgia in Congress from 1995 to 2003. (Barr ran in 2008 for president as a libertarian; former CIA operations officer Evan McMullin vied for the White House in 2016 as an independent.)

This year’s Congress includes at least 10 others besides Spanberger, Slotkin and Hurd who have worked with classified material in the military or at the National Security Council, according to the public affairs analytics firm Quorum.

Panetta, who served as CIA director from 2009 to 2011 under President Barack Obama, considers President Trump’s attacks against the intelligence community to have emboldened its recent former members to enter the political fray.

Nine days before his inauguration, Trump likened U.S. intelligence agencies to Nazis, after news reports surfaced about his links to Russia. “Are we living in Nazi Germany?” he tweeted.

Trump also has constantly disputed key findings by American spy agencies, including those about North Korea’s nuclear threats, Iran’s adherence to a 2015 nuclear agreement with the United States and Saudi Crown Prince Mohammed bin Salman’s involvement in the killing of Jamal Khashoggi, the Saudi dissident who was a contributing columnist for The Washington Post.

CNN’s Evan Perez, Pamela Brown and Shimon Prokupecz, report that special counsel Robert Mueller’s ever-growing team of investigators, 16 lawyers and counting, are worried they’re going to be sued by those they are investigating:

CNN has learned some of the investigators involved in the probe are buying liability insurance out of concern they could become targets of lawsuits from those who are being investigated, according to one of the people familiar with the probe. The Justice Department covers legal fees for employees sued in the course of their duties, but some of the lawyers want extra protection.

The Justice Department and special counsel’s office both declined to comment on the liability concerns.

Take the report with a grain of salt because it is based on unnamed sources “people familiar with the probe.”

On April 25, 2003, the United States Department of Health and Human Services Centers for Disease Control and Prevention (hereinafter, “CDC”) filed an application for a United States (Application Number US46592703P, subsequently issued as U.S. Patent 7,776,521) entitled “Coronavirus isolated from humans”. Claim 3 –A method of detecting a severe acute respiratory syndrome-associated coronavirus (SARS-CoV) in a sample…; and, Claim 4 - A kit for detecting a severe acute respiratory syndrome-associated coronavirus (SARS-CoV) in a sample…, provided the CDC with a statutory market exclusion right the detection of and sampling for severe acute respiratory syndrome-associated coronavirus (SARS-CoV). Securing this right afforded the CDC exclusive right to research, commercially exploit, or block others from conducting activities involving SARS-CoV. On September 24, 2018, the CDC failed to pay the required maintenance fees on this patent and their rights expired.

From April 2003 until September 2018, the CDC owned SARS-CoV, its ability to be detected and the ability to manufacture kits for its assessment. During this 15-year period, the effect of the grant of this right – ruled unconstitutional in 2013 by the United States Supreme Court in the case of Association for Molecular Pathology et al. v. Myriad Genetics – meant that the commercial exploitation of any research or commercial activity in the United States involving SARS-CoV would constitute an infringement of CDC’s illegal patent.

It appears that, during the period of patent enforcement and after the Supreme Court ruling confirming that patents on genetic material was illegal, the CDC and National Institute of Allergy and Infectious Diseases led by Anthony Fauci (hereinafter “NIAID” and "Dr Fauci", respectively) entered into trade among States (including, but not limited to working with Ecohealth Alliance Inc.) and with foreign nations (specifically, the Wuhan Institute of Virology and the Chinese Academy of Sciences) through the 2014 et seq National Institutes of Health Grant R01AI110964 to exploit their patent rights.

It further appears that, during the period of patent enforcement and after the Supreme Court ruling confirming that patents on genetic material were illegal, the CDC and National Institute of Allergy and Infectious Diseases (hereinafter “NIAID”) entered into trade among States (including, but not limited to working with University of North Carolina, Chapel Hill) and with foreign nations (specifically, the Wuhan Institute of Virology and the Chinese Academy of Sciences represented by Zheng-Li Shi) through U19AI109761 (Ralph S. Baric), U19AI107810 (Ralph S. Baric), and National Natural Science Foundation of China Award 81290341 (Zheng-Li Shi) et al.

It further appears that, during the period of patent enforcement and after the Supreme Court ruling confirming that patents on genetic material was illegal, the CDC and NIAID entered into trade among States (including, but not limited to working with University of North Carolina, Chapel Hill) and with foreign nations to conduct chimeric construction of novel coronavirus material with specific virulence properties prior to, during, and following the determination made by the National Institutes for Health in October 17, 2014 that this work was not sufficiently understood for its biosecurity and safety standards.

In this inquiry, it is presumed that the CDC and its associates were: a) fully aware of the work being performed using their patented technology; b) entered into explicit or implicit agreements including licensing, or other consideration; and, c) willfully engaged one or more foreign interests to carry forward the exploitation of their proprietary technology when the U.S. Supreme Court confirmed that such patents were illegal and when the National Institutes of Health issued a moratorium on such research.

The aforementioned items appear to constitute, “contract, combination in the form of trust or otherwise, or conspiracy,” as defined under 15 US Code § 1.

Under 15 U.S. Code § 1 (the Sherman Antitrust Act) “Every contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce among the several States, or with foreign nations, is declared to be illegal. Every person who shall make any contract or engage in any combination or conspiracy hereby declared to be illegal shall be deemed guilty of a felony, and, on conviction thereof, shall be punished by fine not exceeding $100,000,000 if a corporation, or, if any other person, $1,000,000, or by imprisonment not exceeding 10 years, or by both said punishments, in the discretion of the court.”

Reportedly, in January 2018, the U.S. Embassy in China sent investigators to Wuhan Institute of Virology and found that, “During interactions with scientists at the WIV laboratory, they noted the new lab has a serious shortage of appropriately trained technicians and investigators needed to safely operate this high-containment laboratory.” The Washington Post reported that this information was contained in a cable dated 19 January 2018. Over a year later, in June 2019, the CDC conducted an inspection of Fort Detrick’s U.S. Army Medical Research Institute of Infectious Diseases (hereinafter “USAMRIID”) and ordered it closed after alleging that their inspection found biosafety hazards. A report in the journal Nature in 2003 (423(6936): 103) reported cooperation between CDC and USAMRIID on coronavirus research followed by considerable subsequent collaboration. The CDC, for what appear to be the same type of concern identified in Wuhan, elected to continue work with the Chinese government while closing the U.S. Army facility.

Reportedly, on December 31, 2019, the Chinese government informed the World Health Organization (WHO) that a number of cases of suspected coronavirus-associated SARS cases were being treated in the area of Wuhan. The CDC reported the first case of SARS-CoV like illness in the United States in January 2020 with the CDC’s Epidemic Intelligence Service reporting 650 clinical cases and 210 tests. Given that the suspected pathogen was first implicated in official reports on December 31, 2019, one can only conclude that CDC: a) had the mechanism and wherewithal to conduct tests to confirm the existence of a “novel coronavirus”; or, b) did not have said mechanism and falsely reported the information in January. It tests credulity to suggest that the WHO or the CDC could manufacture and distribute tests for a “novel” pathogen when their own subsequent record on development and deployment of tests has been shown to be without reliability.

Notwithstanding, the CDC and WHO elected to commit to a narrative of a novel coronavirus – exhibiting properties that were anticipated in the U.S. Patent 7,618,802 issued to the University of North Carolina Chapel Hill’s Ralph Baric – and, in the absence of testing protocols, elected to insist that SARS-CoV-2 was the pathogen responsible for conditions that were consistent with moderate to severe acute respiratory syndrome.

On March 4, 2020, California Governor Gavin Newsome appears to have violated the law of the State of California by issuing Executive Order N-33-20 based on the “threat of COVID-19” with no evidence that such threat existed as confirmed by serology or confirmed immunologic evidence. The Government Code sections cited in the Order (Government Code sections 8567, 8627, and 8665) require that criteria be met which do not include the “threat” of any condition but evidence of said condition. At that time, neither the CDC nor the WHO had sufficient testing in place to: a) confirm and isolate “a novel coronavirus” from other coronaviruses; b) California did not have pathology data to suggest that an epidemic was imminent; and, c) the rest of the United States was equally incapable of making any such assessment as a result of the aforementioned conspiring parties actions. Governor Newsome’s Executive Order, followed by numerous other similar orders, all are based on the threat of a thing that may or may not exist.

Around March 12, 2020, in an effort to enrich their own economic interests by way of securing additional funding from both Federal and Foundation actors, the CDC and NIAID’s Dr Fauci elected to suspend testing and classify COVID-19 by capricious symptom presentation alone. Not surprisingly, this was necessitated by the apparent fall in cases that constituted Dr. Fauci’s and others’ criteria for depriving citizens of their 1st Amendment rights. At present, the standard according to the Council of State and Territorial Epidemiologists Interim-20-ID-01 for COVID-19 classification is:

In outpatient or telehealth settings at least two of the following symptoms: fever (measured or subjective), chills, rigors, myalgia, headache, sore throat, new olfactory and taste disorder(s)

OR

at least one of the following symptoms: cough, shortness of breath, or difficulty breathing OR Severe respiratory illness with at least one of the following:

• Clinical or radiographic evidence of pneumonia, or

• Acute respiratory distress syndrome (ARDS).

AND No alternative more likely diagnosis

Laboratory Criteria for Reporting

● Detection of SARS-CoV-2 RNA in a clinical specimen using a molecular amplification detection test.

● Detection of specific antigen in a clinical specimen.

● Detection of specific antibody in serum, plasma, or whole blood indicative of a new or recent infection.* *serologic methods for diagnosis are currently being defined

After inflicting grave harm to the citizens of the United States of America in economic hardships resulting from their allegation of an “epidemic” or “pandemic”, the CDC and the NIAID set forth, and the President of the United States and various Governors in the respective States promulgated, standards for lifting conditions in violation of the 1st Amendment to the Constitution that serve exclusively to enrich them. Both the presence of a vaccine or treatment and, or, the development of testing – both that solely benefit the possible conspiring parties and their co-conspirators – are set as a condition for re-opening the country. This appears to be an unambiguous violation of the Sherman Act and, if so, should be prosecuted immediately to the full extent of the law.

Feds gone wild: DOJ's stunning inability to prosecute its own bad actors

One was caught red-handed engaged in nepotism. Another, a lawyer no less, admitted to shoplifting at a Marine barracks store. A third leaked sealed court information to the news media. And a fourth engaged in fraud by turning a government garage into a personal repair shop.

Four cases, all solved in the past month, with suspects who cost taxpayers hundreds of thousands of dollars and significant breaches of public trust.

But these weren’t your everyday perps.

All were U.S. Department of Justice (DOJ) employees who are supposed to catch other criminals while working for the FBI, the Drug Enforcement Administration (DEA) and U.S. attorneys’ offices. Instead, they broke the law or violated the rules. And all managed to escape prosecution, despite their proven transgressions.

Recent Justice Department disciplinary files tell an undeniable story.

Under the leadership of Inspector General (IG) Michael Horowitz, DOJ’s internal watchdog is doing an outstanding job of policing bad conduct inside America’s premier law enforcement agency.

And DOJ is doing a poor job of punishing its own.

In cases closed in the past month, more than a half-dozen FBI, DEA, U.S. attorney and U.S. marshal officials were allowed to retire, do volunteer work, or keep their jobs as they escaped criminal charges that everyday Americans probably would not.

In most instances, the decisions were made by federal prosecutors who work with the very figures impacted by or committing the bad conduct. In local law enforcement, that go-easy phenomenon is known as the “thin blue line.”

Spokespersons for the Justice Department and FBI did not respond to a request for comment.

The troubling pattern of weak punishment emerges as DOJ heads into one of its most ambitious internal affairs probes in recent history. Attorney General William Barr, Horowitz and special U.S. Attorney John Durham are investigating whether the FBI and other intelligence agencies violated the law with the Trump-Russia investigation.

Even before the recent spate of closed inspector general investigations, questions surfaced about DOJ’s willingness to punish its own. That’s because fired FBI Deputy Director Andrew McCabe was recommended for prosecution more than 15 months ago for lying about news leaks, and so far has faced no criminal charges.

To put that into perspective, it took special counsel Robert Mueller just a few months to bring charges against multiple figures associated with President Trump’s campaign accused of lying or other process crimes.

It’s still possible that McCabe could face prosecution. But the recent spate of fresh wrongdoing inside DOJ doesn’t portray a compelling pattern of enforcement or punishment.

Take, for example, the DEA executive who just this week was found to have engaged in nepotism by routing hundreds of thousands of dollars to contractor jobs for his son and retired colleagues or friends.

Horowitz spared few words for the egregious scheme. “The senior DEA official wasted and misused hundreds of thousands of dollars in taxpayer funds and engaged in misconduct when he took actions to get his son and former colleagues contractor positions and that his actions constituted misconduct in violation of federal ethics regulations, the DEA Standards of Conduct, and the Federal Acquisition Regulation,” he reported this week.

The official also engaged in a “lack of candor,” the investigative file showed.

Despite the established wrongdoing, criminal prosecution “was declined” and “the senior DEA official retired from his position.” In short, he kept his retirement benefits.

Likewise, the inspector general had harsh words for the FBI special agent in charge (SAC) who used the bureau’s official garage to perform repairs on his and other employees’ personal vehicles, calling it, among other things, a “dereliction of supervisory responsibility,” and a misuse of tax dollars for “private gain.”

“The SAC took advantage of the SAC’s official position for personal benefit by arranging to have the SAC’s personal vehicle repaired by an FBI employee in exchange for compensation, in violation of federal regulations regarding standards of conduct for federal employees and FBI policy,” the investigative file concluded. “The OIG also found that the SAC was derelict in the SAC’s supervisory responsibilities by allowing use of the FBI repair facility to conduct repairs and maintenance on personal vehicles belonging to FBI employees.”

And then there was the FBI lawyer who got caught in an embarrassing criminal act at the Marine Corps barracks (MCB) commissary in Quantico, Va.

“The FBI attorney admitted to placing numerous cosmetic items, valued at $257.99 and belonging to the MCB Quantico Exchange, into her purse without the intention to pay for them and did not pay for them before leaving the store. The FBI attorney further admitted that between February 2016 and her arrest in February 2018 she had shoplifted at the MCB Quantico Exchange one to two additional times, and at other private retailers in the area on two to three occasions,” the inspector general reported on May 14.

The investigation concluded her conduct violated federal criminal law and FBI policy regarding unprofessional conduct. But here was the outcome: “Criminal prosecution was deferred pending the FBI attorney’s completion of 125 hours of community service, after which all charges were dismissed.”

A few weeks of community service, and she was still in her job at the time the IG issued its report.

Two weeks ago, another DOJ official, an assistant U.S. attorney, escaped charges even after it was documented that he violated federal laws by possessing, transporting and consuming marijuana-laced edibles that he claimed he needed to treat back pain. He also was caught lying about his wrongdoing and 'fessed up only when his estranged wife threatened him during their divorce proceedings. Nonetheless, “criminal prosecution by federal and state authorities was declined,” the IG reported May 30.

One of the internal affairs cases that stunned members of Congress this month directly grew out of the interwoven Hillary Clinton email and Russia collusion investigations in 2016, during then-FBI Director James Comey’s tenure.

The IG concluded that an FBI deputy assistant director engaged in multiple improper news media leaks while those investigations were ongoing, including one that violated a sealed court order, and accepted an improper gratuity from the news media. But prosecution was declined, yet again. FBI officials say they are considering discipline against the supervisor.

Records I reviewed indicate that more misconduct eerily similar to that already uncovered is being investigated. For example, the IG fraud unit opened a case in March and began interviewing whistleblowers about a new contract fraud matter inside the DEA, emails show.

It used to be that those who were entrusted to enforce the law were held to the highest standards.

Today, however, there is a troubling pattern of officers being held to a lower standard inside a department where critics fear there is a dual system of justice.

SUMMARY

- FBI first contacted Yared in Sept 2015 asking to check on possible nefarious activity. Details were vague, and they found no evidence to corroborate the FBI, except for some phishing emails that never got through the spam filter.

- He had multiple conversations with the FBI agent over the next several months with the FBI eventually requesting 15 gigs of email metadata. FBI agent confirmed that he received info from other unnamed IC operatives.

- The day before they were to turn this material over to the FBI (Apr 28th), the DNC network was subject to its first overt attack looking for user passwords.

- A couple days later on May 1st, the IT team has a call with the DNC CEO and COO and the Perkins Coie legal team, incl. Michael Sussman & Marc Elias. It is at this point that the DNC engages CrowdStrike.

- Yared speaks to his FBi contact a couple days later who tells him that he has spoken with the CrowdStrike project manager and that the DNC is in good hands. All further contact with the FBI is done through CrowdStrike.

- It is CrowdStrike that identifies the Apr 28th attack as coming from “Fancy Bear” (APT-28) and identifies the intrusions that the FBI was noting (but were never discovered by the DNC IT team) as coming from “Cozy Bear” (APT-29). Both are allegedly affiliated with the Russian government.

- Yared addresses the Seth Rich ‘conspiracy theory’ by saying that a complete forensic analysis was done on almost all of the systems & devices and that they found no unauthorized access by DNC personnel. ‘’’CrowdStrike was involved in this process.’’’

- Yared notes that the DNC has “hundreds of” servers and that CrowdStrike identified 38 systems (incl. devices & laptops) that showed evidence of compromise. Out of those, 26 were selected by CS as needing further analysis. Yared mentions here that some or all of these 26 were requested by the FBI and that clones were made and given to CS who provided them to the FBI.

- HOWEVER, Yared mentions later on that ‘only one or two of the systems were cloned’. He states that CS made all the determinations & decisions as to which systems were compromised and which required cloning.

- He was not aware of what was turned over to the FBI, only that the FBI was given everything they asked for.

- Back in Apr 2016 before CS was engaged, FBI Agent gave Yared a script to use that they chose to not to place on the system. If they had, it would have alerted any adversaries that they were onto them.

WHAT’S NOT DISCUSSED ANYWHERE IN THE TESTIMONY - There is zero mention of any data transfers out of the network that would have been required for the published release of the DNC material by WikiLeaks. Like it never happened.

Details, part 1

- IT director for DNC since January 2013 (p. 6)

- Contractor - employed by Management lnformation Systems, lnc (the MIS Department).

- Sept 2015 - received initial call from FBI (p. 7)

- Agent asked if they corroborate specific activities from DNC network that could be nefarious. Specifically asked about web traffic hitting a website ending with **redacted (p. 8)

- Spoke with supervisor Andrew Brown, checked network and found nothing. FBI info was rather vague.

- FBI agent mentioned that the adversaries were referred to as “Dukes”. Agent asked them to be discreet in their searches and they were. Nothing was done on the DNC network.

- Did additional forensic work but found nothing unusual or alarming. (p.10)

- No call to his knowledge from FBI prior to Sept 2015.

- FBI agent called/texted him periodically from Sept-Dec saying they’ve seen similar activity. (p. 12)

- Agent divulged that he was speaking with other IC operatives and that they were getting info that was 3 weeks - 1 month old.

- DNC IT team still didn’t find any evidence of suspicious activity but due to concern, they purchased a new firewall from Palo Alto Networks which arrived in Feb 2016 (p. 13)

- Firewall installed in March in transparency mode (i.e. listens to traffic in/out but does not apply policy).

- Mentions that nothing about the conversations with the FBI were placed on DNC server so as to not tip their hat. Shared everything with his supervisor. (p. 16)

- Yared finds out through personal investigation that Dukes aka APT-29 (advanced persistent threat) aka "Cozy Bear".

- FBI Agent first mentioned Russia in a Nov 2015 phone call. (p. 17)

- Finally met FBI Agent face-to-face in Feb 2016. Agent handed him 4-5 strips of paper with timestamps & redacted IPs .

- Timestamps were very helpful for them to go back through the logs. But they still couldn’t find anything. They did find some phishing emails which never made it through the spam filter.

- In early 2016, FBI requested logs - metadata about emails from the DNC exchange servers - 15 gigs of data.

- At this point Yared went to the DNC COO Lindsey Reynolds and asked for help from DNC legal counsel, Perkins Coie.

- On Apr 29th, they delivered the logs to FBI and the agent confirmed receipt by text.

- Apr 28th was “coincidentally” the 1st time they detected unusual activity on the network - someone was trying to access passwords of users. (p.24)

- This turned out to be an attack from what he calls Fancy Bear or APT-28. Fancy Bear is known to be a separate Russian actor than Cozy Bear. (p. 26)

- Admits that it was CrowdStrike that identified the Cozy Bear (Dukes) attack, the DNC IT team never noticed any nefarious activity in the 7 months of directly engaging with the FBI until the incident on Apr 28th.

Leipold is the founder of Ameritel, a business-to-business telemarketing firm in Neenah, Wis. He also was the past owner of the Rainfair Company, which made protective footwear. He has also been a director of Gaylord Entertainment Company, owner of the Grand Ole Opry in Nashville, Tennessee.[2]

Hockey team ownership

Leipold first was considered a potential owner or investor in the NBA Milwaukee Bucks and Sacramento Kings teams. He attributed this interest to the fact that he knew the sport of basketball well. Democrat questioning (p. 29)

- Yared notified the FBI Agent about the attack on the 28th when he sent over the 15 gigs of metadata on the 29th.

- On Sun, May 1st, conference call btw the DNC IT people, the CEO and COO, and Perkins Coie, including Michael Sussman. Sussman brings in Shawn Henry from CrowdStrike (p. 30).

- Within 10-15 days of working with CrowdStrike, Yared claims that they identified both the Cozy Bear and Fancy Bear presence.

According to Patrick Martin of the World Socialist Web Site, the number of former CIA operatives running as Democrats has “no precedent in U.S. political history.”

The site noted further:

An extraordinary number of former intelligence and military operatives from the CIA, Pentagon, National Security Council and State Department are seeking nomination as Democratic candidates for Congress in the 2018 midterm elections. The potential influx of military-intelligence personnel into the legislature has no precedent in US political history.

If the Democrats capture a majority in the House of Representatives on November 6, as widely predicted, candidates drawn from the military-intelligence apparatus will comprise as many as half of the new Democratic members of Congress. They will hold the balance of power in the lower chamber of Congress.

Of the 102 primary elections to choose the Democratic nominees in these competitive districts, 44 involve candidates with a military-intelligence or State Department background, with 11 districts having two such candidates, and one district having three. In the majority of contests, the military-intelligence candidates seem likely to win the Democratic nomination, and, if the Democrats win in the general election, would enter Congress as new members of the House of Representatives.

Mexican President Andres Manuel Lopez Obrador said his government would send a diplomatic note to Washington for information on the 2009-2011 operation known as ‘Fast and Furious,’ a topic that has resurfaced in recent days amid a debate over historic U.S.-Mexico cooperation on security and possible corruption under previous administrations.

Setting out to stop cross-border gun smuggling, the U.S. scheme allowed people to illegally buy arms in the United States and take them to Mexico so that the weapons could be tracked and lead law enforcement officials to drug cartel bosses. Some weapons were later blamed for gangland slayings in Mexico.

“How could this be? A government that invades in this way, that flagrantly violates sovereignty, international laws,” Lopez Obrador said at his daily news conference.

To avoid a repeat, the matter needed to be cleared up, said Lopez Obrador, who noted that President Donald Trump had last year been “respectful” to Mexico in discussions over joint co-operation following two major security incidents.

Mexican politicians are still arguing over how much its government knew about ‘Fast and Furious’ at the time.

Lopez Obrador brought up the gun-running scheme on Monday when discussing the case of Genaro Garcia Luna, Mexico’s security minister from 2006-12, who was arrested in the United States in December and charged with drug-trafficking offenses. As security minister, Garcia Luna had spearheaded a crackdown on drug gangs, launched under former President Felipe Calderon.

Roberta Jacobson, a former American ambassador to Mexico appointed under U.S. President Barack Obama, had suggested both governments knew about possible corruption by Garcia Luna in an interview with Mexican magazine Proceso published at the weekend.

Lopez Obrador has used the arrest of Garcia Luna to argue that corruption was rampant in past Mexican governments.

But this week he has also asked whether previous U.S. administrations were complicit by working with Garcia Luna, whose period as minister coincided with Obama’s first term in office and the final years of George W. Bush.

Critics of Lopez Obrador contend that he has done Trump a favor by raising questions about Garcia Luna as the U.S president prepares to fight a November election against Joe Biden, who was vice president from 2009 to 2017 under Obama.

Fernando Belaunzaran, co-leader of the opposition Party of the Democratic Revolution, on Twitter called it a “badly-disguised” stunt by Lopez Obrador to curry favor with Trump ahead of a joint meeting the Mexican president has proposed.

Allies of Lopez Obrador reject this, saying instead that he is seeking to put pressure on Calderon, a critic of the president who is building a new political party.

“This (diplomatic) note is about domestic political matters,” said Lorenzo Meyer, a historian at the Colegio de Mexico and longtime supporter of the president. “I don’t think he’s given thought about what this means for the United States.”

On Monday, Lopez Obrador said U.S. officials at the Drug Enforcement Administration (DEA), the Central Intelligence Agency (CIA) and the Federal Bureau of Investigation (FBI) who cooperated with Garcia Luna should be investigated.

The DEA and the CIA declined to comment. The FBI did not immediately respond to a request for comment.

On Thursday, Lopez Obrador again asked for U.S. officials to be investigated for their ties to Garcia Luna, saying “cover-ups” during the era were not the work of just “one government.”

In at least one instance, the CIA’s reaction appears to have led to significant changes in the story that was eventually published in the Times.

THE SPRUNG TRAP

POTUS declared a NATIONAL EMERGENCY after ALL 50 states had declared a state of emergency.

He HAD to wait for ALL states to declare a state of emergency, and when they did, he set the trap.

Remember the drop that reads, "Those who scream the loudest"?

POTUS asked the civilian population to self quarantine for 15 days at first.

Soon as he did that and the 15 days passed who was it still screaming to keep lock-downs in place….mainly NYC and other democrat governors, after all, THEY were the ones screaming the loudest, so he played along…more or less give them more rope to hang themselves with.

POTUS mentioned in one of his pressers that he was leaving it up to the governors to decide because each location was different and could be handled differently. In short, he let the governors do what they thought, (and I say thought because there were some that did do what was right and fair), what was right according to their own mind. Thing is, those governors didn't count on the people to stand up when they pushed to far.

Trap sprung!

NOW POTUS knows which governors to trust, and which ones to round up.

Anybody noticing how governors are starting to be a main topic of the media? Especially the ones that went for the strictest lock-downs, and how some are being ordered to explain the plan for lock-downs now.

FAMILY JEWELS - What's that?

For Reference:

"Family Jewels" is the informal name used to refer to a set of reports that detail activities conducted by the United States Central Intelligence Agency. Considered illegal or inappropriate, these actions were conducted over the span of decades, from the 1950s to the mid-1970s.[1] William Colby, who was the CIA director in the mid-1970s and helped in the compilation of the reports, dubbed them the "skeletons" in the CIA's closet.[1] Most of the documents were publicly released on June 25, 2007, after more than three decades of secrecy.[2][3] The non-governmental National Security Archive had filed a FOIA request fifteen years earlier.[4][2]amily Jewels (Central Intelligence Agency)

The reports describe numerous activities conducted by the CIA during the 1950s to 1970s that violated its charter. According to a briefing provided by CIA Director William Colby to the Justice Department on December 31, 1974, these included 18 issues which were of legal concern:[10]

Confinement of a KGB defector, Yuri Ivanovich Nosenko, that "might be regarded as a violation of the kidnapping laws"

Wiretapping of two syndicated columnists, Robert Allen and Paul Scott (see also Project Mockingbird)[10]

Physical surveillance of investigative journalist and muckraker Jack Anderson and his associates, including Les Whitten of The Washington Post and future Fox News Channel anchor and managing editor Brit Hume. Jack Anderson had written two articles on CIA-backed assassination attempts on Cuban leader Fidel Castro

Physical surveillance of Michael Getler, then a Washington Post reporter, who was later an ombudsman for The Washington Post and PBS

Break-in at the home of a former CIA employee

Break-in at the office of a former defector

Warrantless entry into the apartment of a former CIA employee

Opening of mail to and from the Soviet Union from 1953 to 1973 (including letters associated with actress Jane Fonda) (project SRPOINTER/HTLINGUAL at JFK airport)

Opening of mail to and from the People's Republic of China from 1969 to 1972 (project SRPOINTER/HTLINGUAL at JFK airport – see also Project SHAMROCK by the NSA)

Funding of behavior modification research on unwitting US citizens, including unscientific, non-consensual human experiments[11] (see also Project MKULTRA concerning LSD experiments)

Assassination plots against Cuban President Fidel Castro; DR Congolese leader Patrice Lumumba; President Rafael Trujillo of the Dominican Republic; and René Schneider, Commander-in-chief of the Chilean Army. All of these plots were said to be unsuccessful[12]

US Moves to Pull Chinese Equipment From Its Power Grid

WASHINGTON - An executive order issued last week proposes to “monitor and replace” any U.S. power grid equipment made by the nation’s foreign adversaries.

Analysts said it would mainly affect Chinese-made products like electrical transformers.

President Donald Trump signed an executive order on May 1 prohibiting bulk power system equipment from foreign companies in the U.S. grid, citing security concerns.

The U.S. Department of Energy noted that under the current rules, contracts are awarded to the lowest bidder when it comes to bulk power system procurement, and that creates a "vulnerability that can be exploited by those with malicious intent."

U.S. Secretary of Energy Dan Brouillette said that it is imperative that “the bulk-power system be secured against exploitation and attacks by foreign threats.”

The article points points out that Hillary Clinton, in 2014, played the NUMBER ONE role in allowing Chinese vaccine manufacturers to completely bypass US vaccine testing requirements, and thereby allowing direct from the factory to American children WITH NO QUALITY CONTROL in between.

Syrian Army operation in Daraa ends in decisive victory over militants

BEIRUT, LEBANON (1:10 P.M.) – The Syrian Arab Army’s (SAA) military operation inside the Daraa Governorate this weekend has ended in a decisive victory against the militants that used the area launch attacks against their forces.

According to a field source in the Daraa Governorate, the Syrian Army was able to clear the town of Mazrib after several hours of battle against the group of militants responsible for the killing of nine soldiers earlier in the week.

The source said the Syrian Army made several arrests, while killing and wounding a number of other militants that refused to surrender themselves after being surrounded by the military for many hours on Thursday and Friday.

He would add that some of the militants managed to escape to the nearby town of Tafas, where they are now being pursued by the security forces in the area.

The Syrian Army is now in full control of the town of Mazrib and will maintain close watch over much of this region in the Daraa Governorate.

The Chengdu Institute of Biological Products obtained WHO prequalification for its Japanese encephalitis vaccine after years of wide-ranging technical support from nongovernmental agency PATH, which is funded by the Bill & Melinda Gates Foundation.

The Clinton Health Access Initiative (CHAI) has been working with Chinese suppliers to support their applications for WHO prequalification for several vaccine candidates for the last two years, says Joshua Chu, CHAI’s Director, Vaccines Markets.

The initiative also works with donors and other agencies to implement innovative market-based mechanisms, such as long-term volume guarantees, to make donor funds go further when purchasing vaccines. So far it has established volume guarantees with vaccine manufacturers in India and with other developing countries for other health products.

Arizona: Muslim Students Threaten to Kill Prof for Suggesting Islam Is Violent

This will teach those Islamophobes that Islam is a religion of peace: a professor is facing death threats for suggesting otherwise. Nicholas Damask, Ph.D., has taught political science at Scottsdale Community College in Arizona for 24 years. But now he is facing a barrage of threats, and his family, including his 9-year-old grandson and 85-year-old parents, is in hiding, while College officials are demanding that he apologize – all for the crime of speaking the truth about the motivating ideology behind the threat of Islamic jihad worldwide.

Damask, who has an MA in International Relations from American University in Washington, D.C., and a Ph.D. in Political Science from the University of Cincinnati, says he is “to my knowledge, the only tenured political science faculty currently teaching in Arizona to write a doctoral dissertation on terrorism.” He has taught Scottsdale Community College’s World Politics for each of the 24 years he has worked at the school.

Professor Damask’s troubles began during the current Spring semester, when a student took exception to three quiz questions. The questions were:

Who do terrorists strive to emulate? A. Mohammed

Where is terrorism encouraged in Islamic doctrine and law? A. The Medina verses [i.e., the portion of the Qur’an traditionally understood as having been revealed later in Muhammad’s prophetic career]

Terrorism is ___ in Islam. A. justified within the context of jihad.

Damask explained: “All quiz questions on each of my quizzes, including the ones in question here, are carefully sourced to the reading material. On this quiz, questions were sourced to the Qur’an, the hadiths, and the sira (biography) of Mohammed, and other reputable source material.” And indeed, the three questions reflect basic facts that are readily established by reference to Islamic texts and teachings and numerous statements of terrorists themselves.

Despite this, the student emailed Damask to complain that he was “offended” by these questions, as they were “in distaste of Islam.” Damask recounted: “Until this point, notably, the student had expressed no reservations about the course material and indeed he said he enjoyed the course.”

The US rejected any reference to the WHO in the text of the resolution, and also turned down an alternative that didn't explicitly name the organization - and instead cited the UN's "specialized health agencies," two diplomatic sources told CNN. UN diplomats were surprised by the US move to block the vote Friday. The effort they had been working on for more than six weeks came to a screeching halt, and they fear it will not be revived.

Federal judge gives churches major victory amid strict lockdown restrictions by Dem governor

If it's good enough for Home Depot, it's good enough for churches

A federal judge ruled Friday that all Kentucky churches will be allowed to hold in-person gatherings beginning this weekend so long as congregations abide by social distancing and other health guidelines from the CDC.

Tabernacle Baptist Church in Nicholasville, Kentucky, filed a lawsuit against Gov. Andy Beshear, a Democrat, this week to allow for in-person worship services. The church's attorney said Beshear's order prohibiting in-person services violates the First Amendment.

On Friday, U.S. District Judge Gregory Van Tatenhove agreed — at least for now.

According to the Lexington Herald-Leader, Van Tatenhove granted a temporary restraining order that prevents Beshear from "enforcing the prohibition on mass gatherings with respect to any in-person religious service which adheres to applicable social distancing and hygiene guidelines."

In his court opinion, Van Tatenhove wrote:

Tabernacle Baptist Church wants to gather for corporate worship. They want to freely exercise their deeply held religious belief about what it means to be a faithful Christian. For them, it is "essential" that they do so. And they want to invoke the Constitution's protection on this point.

But the governor, by executive order, has put a stop to that. He can do that, but he must have a compelling reason for using his authority to limit a citizen's right to freely exercise something we value greatly—the right of every American to follow their conscience on matters related to religion. Despite an honest motive, it does not appear at this preliminary stage that reason exists.

The judge also cited how notoriously crowded grocery and hardware stores have been during the coronavirus pandemic. If social distancing is sufficient for those businesses, then it should also be sufficient for places of worship, he said.

"There is ample scientific evidence that COVID-19 is exceptionally contagious. But evidence that the risk of contagion is heightened in a religious setting any more than a secular one is lacking," Van Tatenhove wrote. "If social distancing is good enough for Home Depot and Kroger, it is good enough for in-person religious services which, unlike the foregoing, benefit from constitutional protection."

The ruling applies to all churches and places of worship in Kentucky, WKYT-TV reported.

It’s the very next day, August 16, 2016, before the election when they opened the file on General Flynn.

The day after that they slipped an agent [believed to be Joe Pientka] into the Presidential briefing to spy on General Flynn.

Now thanks to Powell, we know Strzok worked for the FBI and CIA. This allowed the Deep State actor to spy on individuals in the US and in other countries and to perform all the activities that went along with these entities.

We do know that Brennan was in Europe at the same time that Strzok and other members of the “Secret Society” met in England. We also know that Strzok and Page referred to another Brennan CIA operative, Eric Ciaramella, the suspected Ukrainian impeachment scam whistleblower, as Charlie.

We also know Strzok insisted on keeping special authorities for the Mueller investigation. Also, the Deep State intel community refused to confirm the existence of Ciaramella communications with Strzok, Page and McCabe.

It’s suspected that Pientka was not only with the FBI but also with the CIA, which is why his name is rarely mentioned in reporting on his Deep State actions.

D. Manny put together a massive list of actions taken by Pientka during his time involved in the Trump – Russia hoax. In January we found Pientka had been transferred to the San Francisco area and was being protected by the FBI.

We also uncovered that Pientka was at a meeting at 3 PM on June 16, 2016, with Mark Louthan, a CIA detailee and Deputy Director of Security and Counterintelligence for the National Security Council together with two other agents Michael Kreizenbeck and Timothy Tarvin in the Eisenhower Executive Office Building.

Tokyo lodges protest with Beijing over East China Sea incident

NAHA, Japan (Kyodo) - Two China Coast Guard ships have approached and chased a Japanese fishing boat in Japanese territorial waters around the Senkaku Islands in the East China Sea, the Japan Coast Guard said Saturday. The Japanese coast guard ordered the Chinese vessels to leave the waters and deployed a patrol ship to safeguard the fishing boat, whose three crew members were unhurt during Friday's incident. Tokyo lodged a protest with Beijing over the incident via a call Friday to the Chinese Embassy in Tokyo by Shigeki Takizaki, director general of the Japanese Foreign Ministry's Asian and Oceanian Affairs Bureau, and a similar call from the Japanese Embassy in Beijing to the Chinese Foreign Ministry, a Japanese government source said. A total of four China Coast Guard ships were in Japanese waters around the Japanese-controlled islets, claimed by China, for about two hours from 4 p.m. Friday. Two of the four pursued the Japanese boat, which was about 12 km southwest of Uotsuri Island, at around 4:50 p.m.

It was the first encroachment by Chinese ships into Japanese waters around the uninhabited Senkaku Islands since April 17. Two of the four Chinese Coast Guard vessels entered Japanese territorial waters again from around 6 p.m. Saturday, according to the coast guard. Beijing has been sending official vessels close to the islands, known as Diaoyu in China, in an apparent attempt to assert its control of them.

The islets are also claimed by Taiwan, which calls them Tiaoyutai.

Pakistani NGO linked to Turkey spreads fake news about Greek migrant camps

As part of Turkey’s ongoing efforts to undermine its European neighbor, it now seems to be taking the fight against Greece to social media. A Non-Governmental Organisation (NGO) based in Pakistan called “Million Smiles” has been spreading misinformation about the Greek migrant camps.

Million Smiles’ CEO and co-founder is Zeshan Afzal, a Pakistani citizen. The group’s Facebook page, which hasn’t been updated since 2017, claims that Million Smiles is engaged in “working for and promote [sic]upliftment of Spiritual, Physical, Psychological, Social, Cultural and Economical conditions of individuals and reviving Nature.”

Afzal and Million Smiles recently launched the hashtag “#GreeceMistreatingRefugees” on Twitter, which claims to call attention to alleged human rights abuses occurring in the Greek migrant camps in an obvious attempt to support Turkey’s interests. A report by Greek City Times, however, says that much of the information they spread is clearly fake news, as proven by the fact that photos disseminated by the group which are purported to have been taken in the Greek camps clearly display Turkish instead of Greek words (such as “POLİS” on police uniforms rather than the Greek “ΑΣΤΥΝΟΜΙΑ”).

Greek City Times also determined that one Twitter user whose account claimed he was working for Million Smiles posted photos to the hashtag which were in fact taken in 1996 in Cyprus, during an incident when a Greek civilian, Solomos Solomou, was shot dead by Turkish soldiers in the UN’s Buffer Zone. The account has since been deleted.

The majority of the tweets to the hashtag have come from Million Smiles’ own staff members rather than ordinary Twitter users. Many of them were deleted when Greek City Times launched its investigation.

Evidence that the NGO is working with Turkey is not limited to its propaganda, however. Million Smiles also operates a Turkish chapter, and Turkey’s ambassador to Pakistan, Mustafa Yurdakul, has voiced his support for it. The director of Million Smiles Turkey is Mian Waqar Badshah, who is the Chairman of the Pakistan-Turkey Friendship Association, an organisation supported by the Turkish embassy in Pakistan.

The name of the hashtag is actually an error in itself, considering that international refugee law states that one can only hold refugee status in the first safe country that he arrives in; as Turkey is such a safe country, those who attempt to cross into Greece are illegal migrants and not refugees.

Turkey has been ramping up its campaign against Greece this year. In addition to allowing and assisting tens of thousands of illegal migrants to cross its territory to attempt to break through the Greek border, the Turkish armed forces have also been regularly intimidating international border forces in Evros as well as the Greek military, including by firing weapons along the border, as previously reported by Voice of Europe.

PA County Commissioner Slams Governor’s Orders: Stop Running State as a ‘Dictatorship’

Jeff Haste, Pennsylvania’s Dauphin County Board chairman, slammed Gov. Tom Wolf (D) in a letter on Friday for keeping a bulk of businesses closed, particularly in his county, and bluntly called on Wolf to “return our state to the people (as prescribed by our Constitution) and not run it as a dictatorship.”

Twenty-four counties — Bradford, Cameron, Centre, Clarion, Clearfield, Clinton, Crawford, Elk, Erie, Forest, Jefferson, Lawrence, Lycoming, McKean, Mercer, Montour, Northumberland, Potter, Snyder, Sullivan, Tioga, Union, Venango, and Warren — moved to the “yellow” phase of reopening on Friday. The “yellow” phase, while still restrictive, allows limited nonessential retail operations but keeps a restaurant’s dine-in services, as well as salons and fitness centers, closed.

While the state closed to “minimize the 54,238 positive cases, more than 1,793,200 Pennsylvanians have lost their jobs,” Haste wrote in the letter.

“This decision has ruined the livelihood of millions of hard-working Pennsylvanians in exchange for 0.4 percent of our population,” he continued.

He expressed “great sympathy for those who have lost loved ones to COVID-19” but added that he holds “great concern for the families that now have to struggle with financial concerns, mental health stress, addiction and more because of the shutdown.”

“Again, our governor has pitted groups of Pennsylvanians against one another,” he continued.

“For centuries, our people and businesses have shown they can adapt to changes to survive and prosper,” he said. “They cannot, however, do a thing when a dictator and an unelected secretary place them in lockdown.”

He continued:

I trust and have faith in the great people and businesses of Pennsylvania to operate in a manner that protects those of our population in harm’s way and allows our residents to go back to work, enjoy their communities, and have a quality of life. I, however, have no faith in Gov. Wolf and Secretary Levine’s ability to do the right thing,

“Open the state and return our Commonwealth to the people,” he added. “Enough is enough.”

Wolf on Friday said 13 additional counties will be able to move to the “yellow” phase of reopening next week, but Dauphin County was not included. Similarly, Pennsylvania’s Beaver County Commissioner Chairman Dan Camp ripped the governor on Friday for refusing to allow the county to move into the next phase of reopening alongside its neighboring counties.

“The governor’s double-talk means that Beaver County finds itself singled-out as the only Western Pennsylvania county in his administration’s red category, surrounded by a sea of yellow counties,” he said on Friday.

“Our business owners and residents cannot become prisoners of our county because of this unwarranted double-talk,” he continued, stating that the Board of Commissioners will “stand behind our District Attorney in his decision not to prosecute any case against a business that chooses to open following the mandated guidelines as laid out in the yellow phase of reopening PA.”

Wolf’s stay-at-home order, which extends to counties that remain in the “red” phase, has been extended to June 4.

UK Education Office Argues Christians Should Limit Their Beliefs to Church

The United Kingdom’s Office for Standards in Education, Children’s Services and Skills (Ofsted) argued before the High Court that Christian groups should not allow their religious beliefs to influence their professional activities.

After an inspection and review in March 2019, Ofsted, a non-ministerial department of the British government, downgraded the Christian-run Cornerstone Adoption and Fostering Service from “good” to “requires improvement” because it only places children with married Evangelical Christian couples.

Challenged by Cornerstone before the High Court, Ofsted lawyer Sir James Eadie said that Ofsted “does not prevent Cornerstone and their carers manifesting their religious beliefs as they wish – outside the professional sphere,” adding that fostering “is essentially a secular act.”

An unpublished brief by Ofsted allegedly demanded that Cornerstone abandon its religious ethos.

In response, Cornerstone lawyer Mr Aidan O’Neill asked whether the regulator was claiming that “religious acts only happen in your place of worship and as soon as you come into the public square it cannot be categorised as a religious act.”

“They are failing in their duty of neutrality,” Mr O’Neill continued, “not appreciating that evangelical Christianity in particular, which founds itself on scripture passages, includes the injunction to feed the hungry, and carry out in practice what you believe.”

“So don’t say to me fostering is a secular act,” O’Neill said. “When carried out by Cornerstone it is the fulfilment of a religious duty.”

In failing in its duty as a state body to be neutral as regards the expression of religious belief, in relation to Cornerstone “Ofsted has acted unlawfully,” he argued.

O’Neill also told the Court that Ofsted had misapplied equality law and abused its regulatory function in issuing its report, suggesting that the regulator had “invented” discrimination by Cornerstone in order to fabricate a case against it.

“This is a hypothetical dispute in which there are no actual victims,” O’Neill said, since Ofsted has “not identified any individuals who face discrimination under Cornerstone’s work.”

“You cannot set up straw men and say ‘if they were to do this to them then this would be unlawful.’” He noted.

The Nationwide Association of Fostering Providers (NAFP) came out in support of Cornerstone. Following the hearing, NAFP chief executive Harvey Gallagher said he has “no reason to doubt Cornerstone NE’s ethical base. In fact, I have found the agency to be open-minded and accepting.”

“The contribution and commitment that I have seen them make to fostering (and adoption) is important and meets a particular need. If they were to be lost to the sector, this would be a real loss for children,” Gallagher said.

1% holds water

Gen. Leslie Groves set up the concept of compartmentalization of security during WW2's Manhattan Project. This has carried forward to today's operations where CIA operates in 'compartments' that are mostly autonomous.

The original reason was to keep any 1 person from knowing the entire picture and thus compromising the operation. In this way, even Truman didn't know about the A-bomb until after FDR died.

It's within this framework that all rogue cells operate within the CIA, FBI, NSA, etc. You see this in movies where someone has to be "read in" to a project and why the security designation of TS/SCI exists.
