Ukraine investigators open case into Joe Biden's role in firing of top prosecutor

Ukrainian investigators have begun an inquiry into then-Vice President Joe Biden over allegations that he pressured officials into firing a top prosecutor in 2016. A case revolving around Biden, now a Democratic candidate for president, was opened by the State Bureau of Investigations on a court order following a January appeal for action by Viktor Shokin, the dismissed prosecutor general's lawyer, Oleksandr Teleshetsky, told the Washington Post. “They need to investigate this. They have no other alternative. They are required to do this by the decision of the court. If they don't, then they violate a whole string of procedural norms,” Teleshetsky said. The State Bureau of Investigations confirmed an inquiry was opened. The case mentions only a U.S. citizen and does not refer to Biden by name.

Daria Kaleniuk, director of Ukraine’s Anti-Corruption Action Center, downplayed the significance of the matter, saying that Ukrainian law requires state investigators to open a case on a court order even if they don't believe there is enough evidence. “If I was a SBI investigator, I would close that case immediately,” she said.

Shokin, who was dismissed in March 2016 after about a year in office by then-President Petro Poroshenko, claims he was ousted because he wanted to investigate the lucrative role Hunter Biden, the son of Joe Biden, had on the board of Ukrainian energy company Burisma Holdings. President Trump, his personal lawyer Rudy Giuliani, and other allies also claim Biden improperly used his position as vice president to pressure Ukraine to fire Shokin to protect his son from an investigation into Burisma. The elder Biden threatened to withhold $1 billion in U.S. loan guarantees if Ukraine did not fire its top prosecutor, who was criticized by the West for not doing enough to crack down on corruption. The European Union, the International Monetary Fund, and other allies had the same objective, and Biden was repeating U.S. policy that had been set out by Washington’s ambassador to Kyiv in the preceding months and was briefed by White House staff just ahead of the trip.

Biden says there is no "credibility" to the claims of corruption, but his critics have seized on video of a statement the former vice president made in January 2018, where he boasted to members of a panel hosted by the Council of Foreign Relations that he ordered the Ukrainian government to fire Shokin or the White House would renege on a commitment to provide aid. “I looked at them and said: ‘I’m leaving in six hours. If the prosecutor is not fired, you’re not getting the money.’ Well, son of a bitch. He got fired," Biden said.

The matter got wrapped up into the impeachment saga after Trump pressed Ukrainian President Volodymyr Zelensky to investigate the Bidens and other Democrats in a July 25 phone call in which he also appeared to praise Shokin and call his removal "unfair," according to a transcript released by the White House. Democrats cried foul over what they interpreted to be a "quid pro quo." At issue was whether the president improperly pressured Ukraine to announce investigations by withholding military aid and dangling the possibility of a White House meeting between the Trump and Zelensky. Trump was impeached by the Democratic-controlled House on charges of abuse of power and obstruction of Congress, but he was acquitted by the GOP-led Senate earlier this month. Zelensky himself has repeatedly stated that he felt no pressure from Trump to open an investigation into the Bidens

Earlier this month, Zelensky fired his chief of staff and replaced him with Andriy Yermak, an aide who met with Giuliani, who also met with Shokin as far back as late 2018 as he sought political dirt on the Bidens.

it's a tough situation because Christian charity compels anons to have sympathy for the crippled and to want to help them out

of course hotwheels has made himself rather unlovable to to anons. His behavior has been disgusting, but then again who wouldn't be fucked up in the mind after living like he has been forced to do

Mexico confirms first 2 cases of coronavirus

MEXICO CITY (AP) — Mexico’s assistant health secretary announced Friday that the country now has two confirmed cases of the new coronavirus.

Hugo Lopez-Gatell said one of the patients is in Mexico City and the other in the northern state of Sinaloa. While a second test is still pending on that case, he said, “We are treating this as confirmed.” Neither is seriously ill; one is in isolation at a hospital, the other is isolated at a hotel.

At least five family contacts of the first patient have been placed in isolation. He said the men had traveled to the northern Italian region where there has been an outbreak and had returned to Mexico between last Friday and Saturday.

Vatican confirms Pope Francis and two aides test positive for Coronavirus

The Vatican has confirmed in a statement that Pope Francis and two of his aides have tested positive for the novel Coronavirus.

The three new cases add up to the over 400 cases confirmed in Italy under a week.

Pope Francis missed a planned Mass with clergy in Rome yesterday after showing Coronavirus-like symptoms.

The Vatican had earlier said the pontiff, 83, had a slight indisposition and could proceed with the rest of his planned work today.

Reuters) - Harvey Weinstein is sitting under guard in a cinderblock room at a New York City hospital days after his conviction for sexual assault and rape, and at times "can go stir crazy just staring at the emptiness," according to a spokesman.

The former Hollywood producer was admitted late on Monday to a Bellevue Hospital unit for inmates, hours after a Manhattan jury found him guilty of sexually assaulting former production assistant Mimi Haleyi in 2006 and raping former aspiring actress Jessica Mann in 2013.

"It's scaring him," Engelmayer said in an interview. "I think he's melancholy. He's very, very low right now."

Swiss authorities file criminal complaint against encryption firm

The Attorney General’s office has received a criminal complaint from the State Secretariat for Economic Affairs (SECO) against Crypto AG, the firm at the centre of a spying scandal that broke last month, the SonntagsZeitung newspaper reports.

SECO, the authority responsible among other things for the licensing of war materiel exports, believes it was misled by the Zug-based company when it filed export applications for its manipulated encryption devices.

For decades Crypto allegedly sold these secretly manipulated devices to more than 100 countries for spying purposes. Until 2018 the company was owned by the United States Central Intelligence Agency (CIA) and the Germany Federal Intelligence Service (BND), both of whom had the ability to decrypt the devices.

SECO says it would not have approved the exports if it had been aware of the large-scale fraud. The department filed the complaint against unknown persons on Tuesday, since it is as yet unclear who at Crypto AG knew about the manipulations, the SonntagsZeitung revealsexternal link. At its peak the company had around 400 employees, only a few of whom would have been aware of the covert spying.

The newspaper says it is likely the complaint was filed under Article 14 of the Goods Control Actexternal link, which states that anyone who provides incorrect or incomplete information in a license application is liable to up to ten years in prison and a maximum fine of CHF5 million ($5.18 million), depending on the severity of the crime.

The Swiss Attorney General’s Office will now decide whether the alleged offences are subject to federal jurisdiction and there are sufficient grounds to pursue criminal charges.

The Federal Council, the executive body, launched an investigation into the Crypto affair on February 11, appointing former federal judge Niklaus Oberholzer to lead the probe. This investigation is now being overseen by the parliamentary control delegation, which is pursuing its own inquiry.

Deep State Mifsud Reportedly Met with FBI Officials But the 302 Report or Any Similar Document Are Unreported and Missing

Joseph Mifsud is connected to the Obama Spygate Scandal after presumably setting up George Papadopoulos and General Flynn in London. He also was close to Hillary Clinton and even dined with her in 2016.

The Mueller gang blamed George Papadopoulos for withholding information that ended up preventing the government from investigating Mifsud leading to their letting him go.

On page 193 of the Mueller report, the Mueller gang claims that Popadopoulus’s false statements impeded the FBI’s investigation into Joseph Mifsud who was interviewed in a hotel lobby a month later on February 10, 2017. The Mueller gang next referred to the Papadopoulos case rather than an FBI 302 in their report. This happens for Mifsud even though for everybody else, there is an FBI 302 created with a description of what was said to the FBI. In fact, the Mueller report never references any FBI302 for Mifsud. And it gets even more interesting….

Not only that but Mifsud is accused of omitting that he drafted messages to Papadopoulos. Everyone else was indicted for lying to the FBI but for some reason Mifsud was protected. Rep. Jim Jordan called this out to Robert Mueller in front of Congress in the summer of 2019 and Mueller wouldn’t answer why: According to investigative journalist Paul Sperry, there never was a FBI 302 created related to the FBI’s interview with Joseph Mifsud in February 2017:

As we noted in February 2019, candidate Trump’s unpaid volunteer George Papadopoulos stated he believes he was spied on by the Deep State through Joseph Mifsud. This is the same Mifsud who dined with Hillary Clinton and a group of Italian socialists prior to the 2016 election.

Last year Italian prosecutors reported the notorious deep state spy Joseph Mifsud was dead after he had gone missing for two years. Then he went missing.

For the past two years Mifsud’s whereabouts have been unknown, many suspected he was dead. We also reported that former and fired FBI Director James Comey and Joseph Mifsud met in Australia. ProDreamer1 reported that Joseph Mifsud and James Comey were both in Australia the week before the George Papadopoulos meeting. Poor Joseph Mifsud is missing and we really don’t know where he is. The daughter of David Rockefeller’s chef was just 7 when driver Luis Oliveira molested her in the living quarters she shared with her mom at Hudson Pines, the sprawling manse in Pocantico Hills, she charges in a Manhattan Supreme Court lawsuit seeking unspecified damages from the famed banking family.

The Rockefellers failed to protect her from Oliveira, says the now 39-year-old Pittsburgh resident, identified only as “C.Q.” in court papers.

“An employer who provides housing for a mother and child has a duty to provide a safe place for that employee and her child to live,” the woman insists in court papers filed under New York’s Child Victims Act, which opened a one-year window to revive old sexual abuse claims.

The grandson of oil tycoon John D. Rockefeller, David Rockefeller helmed Chase Manhattan Bank in the 1970s, lifting it to a global profile. The father of six died in 2017 at age 101, with a reported net worth of approximately $3 billion.

The woman, who is suing David Rockefeller’s estate as well as his five surviving children, “is still haunted by the memories of her abuse and the betrayal she endured,” according to the claim.

The sprawling 11,000-square-foot home, which the family sold in 2018 for $33 million, features 11 bedrooms and 13.5 bathrooms and sits on more than 75 acres.

Oliveira was an undocumented immigrant whom the family allegedly permitted “to have free and unfettered access” to the girl’s living quarters for much of 1988, said the woman, who declined comment on the case.

Every police department in New York state received a memorandum in conjunction with the ‘Green Light Law’ that stated they could no longer share Department of Motor Vehicle records with Immigration and Customs Enforcement (ICE) or Customs and Border Protection (CBP). If they did share information - or chose not to sign the memorandum - the department would be cut off from DMV records entirely. This posed a large threat to every police department, especially those along our northern border, like the Niagara County Sheriff's Department. Now the Niagara County Sheriff and ICE’s NY Field Director are speaking out.''

The acting head of Immigration and Customs Enforcement (ICE) is accusing the state of New York of putting lives at risk by shutting federal immigration authorities out of state Department of Motor Vehicles (DMV) databases - and highlighting that the state is still granting access to that same data to Canadian law enforcement.

“Information is the lifeblood of law enforcement. If we learned anything from 9/11 it’s that information needs to be shared quickly and fully, and what this has done is to roll back the clock,” Acting Immigration and Customs Enforcement (ICE) Director Matt Albence told Fox News in an interview Friday. “This is a pre-9/11 mentality in a post-9/11 world and it’s dangerous.”

The controversial “Green Light Law,” which went into effect in New York in January, primarily grants drivers’ licenses to illegal immigrants. It’s part of a number of laws nationwide designed to integrate illegal immigrants into society, and also protect them from deportation. But, in a crucial step that goes further than similar license laws in other states, New York’s forbids state DMV agencies from sharing data with immigration authorities like ICE and Customs and Border Protection (CBP).

It is this aspect of the law that’s furiously opposed by the Department of Homeland Security (DHS) as well as New York police groups, who say it blinds law enforcement and makes officers less safe. An association of New York sheriffs said it was “offensive” that they had been forced to sign non-disclosure agreements promising not to share info with their federal partners. The law also requires that license holders be told within days when immigration enforcement agencies request DMV data - something law enforcement fears could alert suspects that they are being investigated.

While agencies like ICE deal with immigration, they are also tasked with investigating other crimes such as human smuggling, drug trafficking and narcotics cases. All such investigations can be impacted by the law. Albence noted to Fox News that New York, like many other states, shares DMV data with Canadian law enforcement - including its border authorities - but not American law enforcement authorities like ICE and CBP.

“Drivers' licenses, car registrations, all that is part of the same database and they're frozen out under the Green Light Law,” he said. “All of those are critical and what is unbelievable is that the state of New York continues to give that information to Canadian law enforcement, but they won't share with their own law enforcement in this country."

Obama's trip to India given 20 times as much coverage by networks as Trump's

The three broadcast networks, ABC, CBS and NBC, combined to give Republican President Donald Trump's recent trip to India less than one minute of coverage last week. In contrast, when former Democratic President Barack Obama visited there in 2010, the networks gave him more than 20 times as much coverage (18.5 minutes).

NBC and ABC allotted 13 and 15 seconds to the current president's trip, while extravagant CBS permitted 23 seconds and at least mentioned the president's trade negotiations there.

All three networks provided full-length reports on Obama's trip, with ABC and NBC leading off two nights each with the story. NBC even covered first lady Michelle Obama playing hopscotch with Indian children.

One of the brief reports on the trip of Trump and his wife, Melania, who visited the Taj Mahal, felt it necessary to mention that Trump had once opened a casino with the name Taj Mahal.

Christopher Steele’s company in the UK Orbis Business Intelligence, refuted an article in the UK press that stated that Steele’s dossier was bogus.

Orbis did so in a recent tweet:

In their response, Orbis claimed that three individuals confirmed the Steele dossier. The individuals noted were John Sipher, Chuck Rosenburg and Anthony Ferrante. The fact that Orbis would use these three as support for its dossier is not surprising.

John Sipher, was a member of the CIA’s Senior Intelligence Service. He wrote an article in September 2017 where he claimed the dossier was reliable.

We know that Chuck Rosenburg was disgraced former Jim Comey’s Chief of Staff. He was all over the Russia collusion sham, so no doubt he would claim the Steele dossier was valid, because his innocence in criminal investigations depends on it.

But what about Anthony Ferrante? Who is Anthony Ferrante?

Coke and Pepsi Are Getting Sued for Lying About Recycling: “At this rate, plastic is set to outweigh fish in the ocean by 2050,” the complaint reads.

Coke, Pepsi and several other big plastic polluters are getting sued for lying about their products’ recyclability and clogging up the oceans with millions of tons of waste.

A California-based environmental group, the Earth Island Institute, filed the lawsuit in San Mateo County on Thursday against the companies, arguing that they’ve knowingly polluted the oceans while misleading the public. The lawsuit notes that 8 million to 20 million tons of plastic end up in the world’s oceans every year — and that much of it can be traced back to these few companies.

“At this rate, plastic is set to outweigh fish in the ocean by 2050,” the complaint reads.

The lawsuit calls on these companies to pay to clean up the mess they’ve allegedly made — and to stop labeling their plastic bottles as recyclable. Convincing the public that the solution to plastics pollution is recycling is fundamentally misleading, the complaint argues, because so little plastic actually gets recycled.

Recent studies suggest of the plastic produced since the 1950s, 91% of it hasn’t been recycled. Instead, the scrap winds up in landfills, burned in incinerators, or in the oceans.

Anyone telling you that drag culture is okay for children is downright insane. The American Library Association has forced drag queens into public libraries under the guise of "inclusivity" and it has now devolved into whatever the hell this is (spoiler alert: it's a crime called "corruption of a minor").

Matt Walsh is taking some heat for linking libertarian conservatism to the decline of Western culture, but is he wrong? The libertarians I know have zero concern for the morality of our nation. Some that I know don't believe in any age of consent, nor do they believe pornography is harmful. If libertarian conservatives are against this they should loudly proclaim it and help us stop it immediately. Social conservatives have been sounding the warning bell for years that ignoring cultural decay will bring us into a hell we never imagined. I think we are here.

This little girl is being traumatized by adults who should know better. The "dancing" this drag queen is doing with his bottom hanging out of his shorts is undeniably sexual. The child is sitting in the center of the room as the focus of this display just like any bachelor would sit for a lap dance from a stripper. Her face is a mix of confusion and discomfort while a woman, who I assume is the creature who birthed her, is standing next to her wiggling and giggling while she allows her child to be enticed by a scantily clad man.

I would also like to say that the men sitting there laughing and clapping or watching this disaster without lifting a soy-weakened finger to help that child are not men. They are mere shadows of men with the anatomy and the appearance of males, but lacking the hearts of men whose purpose for being is to protect those weaker than them. They are an embarrassment to their sex, their community, and their Creator.

There aren't enough words to rebuke a culture that would allow this blatant assault on childhood innocence.

Despite their dire warnings earlier this year that President Trump's foreign policy endangered the United States and assured that the 2020 elections would be riddled with foreign election interference, House Democrats have now essentially dropped their investigative efforts into the Trump administration's Ukraine dealings.

The drawdown, which has seen Democrats decline to make new witness requests or file relevant subpoenas since the conclusion of the Senate impeachment trial, could be a tacit acknowledgement that the probes wouldn't be politically helpful as the 2020 presidential field narrows. Amid impeachment proceedings, a Gallup poll found that support for both President Trump and the Republican Party had risen to historic highs.

However, Democrats have insisted that their previous statements still hold true, and that they are merely acceding to legal and political realities.

"There is nothing that Donald Trump can do that would cause [Senate Republicans] to convict him of high crimes and misdemeanors," Rep. Jamie Raskin, D-Md., told Politico. "So that has caused everybody in the House to take a deep breath and figure out what our next steps are."

China’s Non-Manufacturing & Manufacturing PMIs Show to What Unfathomable Extent the Economy Has Collapsed

The charts are brutal.

Purchasing Managers’ Indices (PMIs) are a tally of how executives see their own company – whether business activity at their company rose or fell compared to the prior month, whether new orders rose or fell, whether they added or shed staff, etc. Executives and their companies remain unnamed. A value above 50 means expansion; a value below 50 means contraction. PMIs are an early indication of business conditions – and by extension, of the economy.

And in China, both, the PMI for the non-manufacturing sector and the PMI for the manufacturing sector, released on March 1, have collapsed to unfathomable lows, showing to what extent the measures to impede the spread of the coronavirus have shut down the economy.

Even non-manufacturing activity collapses.

The official Non-Manufacturing PMI, released by the National Bureau of Statistics, collapsed from 54.1 in January (still well into expansion mode) to a previously unthinkable low of 29.6 in February. The horizontal gray line at 50 in the chart indicates stagnation. Below 50 means contraction. Since 2007, China’s non-manufacturing sector has grown every single month. Until February:

The non-manufacturing PMI is broader than just services. It also includes the retail sector and construction. Here are some other standouts:

New orders plunged to 26.5, with export orders plunging to 26.8

Employment, which had already been in contraction in January (48.6) dropped to 37.9

Input prices fell to 49.3 (from 53.3)

Output prices fell to 43.9.

Confidence plunged from 59.6 in January to 40.0 in February.

Manufacturing collapses, but it’s worse than it looks.

The official China Manufacturing PMI, released by China’s National Bureau of Statistics, had already been either in the doldrums or in outright contraction for the past 14 months. In January it was at 50.0, the stagnation point. In February it collapsed to a previously unfathomable 35.7:

But it’s even worse than it looks, as the index was likely distorted to upside, due to the way a sub-index, “supplier delivery times,” is figured into the headline PMI, according to Lu Ting, chief China economist at Nomura Holdings in Hong Kong.

The headline PMI is based on a number of sub-indices. One of them is “supplier delivery times,” which accounts for 15% of the headline PMI. Normally, when supplier delivery times rise, it’s a sign of strengthening conditions in the manufacturing sector: there is a lot of demand, and suppliers are struggling to meet that demand. So longer delivery times add to the headline PMI index value.

But this time, the supplier delivery times rose because the transportation system was partially shut down, travel bans had been imposed, entire cities had been locked down, and many suppliers were shut down. With manufacturers’ supply chains cut to shreds, factories had trouble getting components and supplies.

According to Nomura’s report, if the supplier delivery times index hadn’t surged, but had remained at the same as in January, the headline PMI index would have dropped to 33.

And the sub-index for manufacturing exports orders collapsed to 28.7:

This plunge in the non-manufacturing PMI and the manufacturing PMI shows the mindboggling extent to which China’s economy has been disrupted by the coronavirus-containment methods in February.

And there is something else.

Friday evening, the homepage of the English-language website of the National Bureau of Statistics of China where I normally get the PMI data was still accessible, but the page with the data for the PMIs was not accessible and showed a “502 Bad Gateway” error. And this problem persists as I’m writing this on Saturday evening (Sunday in China). This is a screenshot:

U.S. Accountant Pleads Guilty in Panama Papers Investigation

A Massachusetts-based accountant who was charged along with three others in connection with a decades-long criminal scheme perpetrated by Mossack Fonseca & Co. (Mossack Fonseca), a Panamanian-based global law firm, and its related entities, pleaded guilty today to wire and tax fraud, money laundering, aggravated identity theft and other charges.

Richard Gaffey, aka “Dick Gaffey,” 75, of Medfield, Massachusetts, pleaded guilty to one count of conspiracy to commit tax evasion and to defraud the United States, one count of wire fraud, one count of money laundering conspiracy, four counts of willful failure to file Reports of Foreign Bank and Financial Accounts (Financial Crimes Enforcement Network Reports 114), and one count of aggravated identity theft.

“This defendant worked with the Mossack Fonseca law firm and exploited his role as an accountant to create fraudulent shell companies and defraud the United States of millions of dollars over decades,” said Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division. “Today’s guilty plea reflects the Department’s commitment to prosecute financial professionals and other gatekeepers to the U.S. financial system who abuse the public’s trust.”

“Richard Gaffey went to extraordinary lengths to circumvent U.S. tax laws in order to maintain Harald Joachim von der Goltz’s wealth and hide it from the IRS,” said U.S. Attorney Geoffrey S. Berman of the Southern District of New York. “Using the specialized criminal services of global law firm Mossack Fonseca, Gaffey assisted others in violating U.S. tax laws for decades.”

According to the allegations contained in the indictments, other filings in this case, and statements during court proceedings, including Gaffey’s guilty plea hearing, since at least 2000 through 2018, Gaffey conspired with others to defraud the United States by concealing his clients’ assets and investments, and the income generated by those assets and investments, from the IRS through fraudulent, deceitful, and dishonest means.

Major court ruling 'vindicated' Trump on impeachment, reveals 'abuse' of House Dems

'It reaffirms the historic blunder of the House in rushing this impeachment'

According to constitutional law expert Jonathan Turley, the court's ruling has significant implications on the nature of Democrats' efforts to impeach Trump.

What did the court rule?

The U.S. Court of Appeals for the District of Columbia Circuit ruled in a split 2-1 decision that McGahn could defy subpoenas issued by the House Judiciary Committee.

Essentially, the court ruled that it did not have the constitutional authority to resolve the stalemate between the White House and Congress, urging Congress seek other remedies outside of the judicial system.

"We cannot decide this case without declaring the actions of one [branch of government] or the other unconstitutional," Appellate Judge Thomas Griffith wrote.

"If federal courts were to swoop in to rescue Congress whenever its constitutional tools failed, it would not just supplement the political process; it would replace that process with one in which unelected judges become the perpetual "overseer[s]" of our elected officials. That is not the role of judges in our democracy, and that is why Article III compels us to dismiss this case," he explained.

McGahn was a key witness in Robert Mueller's investigation — in fact, his name was cited more than 150 times in Mueller's report — and House Democrats have been trying since last year to force McGahn to testify about his involvement in the investigation.

McGahn, however, has defied committee subpoenas.

What did Turley say?

The George Washington University Law School professor said the court ruling "vindicated" the White House with regard to the second article of impeachment, which claimed that Trump had obstructed Congress by having officials ignore congressional subpoenas.

"The White House is vindicated in showing that it had valid constitutional arguments to make - arguments ridiculed at the Senate trial," Turley explained.

"I do not agree with the court's analysis but I felt that Trump had a right to seek judicial review. Now that judicial review has shown that the court agrees with his constitutional position. It reaffirms the historic blunder of the House in rushing this impeachment," he continued.

Turley went on to characterize the second article of impeachment, in light of the court's ruling, as "a case of prosecutorial excess, if not abuse."

Democrats have until March 9 to appeal the ruling, where they can request a new hearing before the same panel of judges or an en banc hearing before the entire 11-person D.C. Circuit Court.

A federal judge in Washington DC ruled Sunday that Ken Cuccinelli, the head of US Citizenship and Immigration Services, had not been lawfully appointed to his job and a policy directive speeding up initial screenings of immigrants seeking asylum during his tenure should be voided.

The decision comes months after Cuccinelli was initially tapped to lead USCIS by President Trump, a move that advocates immediately said violated a relatively obscure federal statute governing selections to agency positions. It’s the latest setback in the federal courts for the Trump administration and its efforts to restrict immigration.

The statue cited in Judge Randolph Moss’ decision — the Federal Vacancies Reform Act — allows the president to select certain senior officials to fill Cabinet and agency positions. At USCIS, Cuccinelli’s initial title was created by the administration: principal deputy director. Under the statute, the only way for Cuccinelli to have become eligible to be selected to lead the agency in an interim fashion was to be deemed a “first assistant.”

Moss said the creation of the title did not meet the necessary legal standard.

“On the merits, the Court concludes that Cuccinelli was not lawfully appointed to serve as acting Director and that, as a result, he lacked authority to issue the reduced-time-to-consult and prohibition-on-extensions directives,” Moss wrote.

“Cuccinelli may have the title of Principal Deputy Director, and the Department of Homeland Security’s order of succession may designate the office of the Principal Deputy Director as the “first assistant” to the Director. But labels — without any substance — cannot satisfy the FVRA’s default rule under any plausible reading of the statute.”

Because he wasn't legally appointed, Moss said a directive issued by Cuccinelli in July must be “set aside.” Asylum officers previously had to wait at least 48 hours after an immigrant has been detained for crossing into the US to interview them and hear their case. However, under the July directive issued by Cuccinelli, that window was reduced to one calendar day, according to a policy change released to staffers and obtained by BuzzFeed News.

In an initial screening — called a credible fear interview — immigrants must prove there is a significant possibility that they have a well-founded fear of persecution in their home country. In the time before the interview in custody, immigrants consult with attorneys or others to help them prepare.

The new policy also made it so immigrants could not reschedule their interview unless there are extraordinary circumstances.

The ruling could mean the end of USCIS policies put forward by Cuccinelli, but it won’t have a broader impact on most recent actions by the Trump administration on immigration.

“It’s a significant ruling about the Federal Vacancies Reform Act, but one that may be limited in its broader impact. Although any directives signed only by Cuccinelli are now vulnerable to legal challenge, the ruling won’t affect other policies adopted by those higher on the food chain at DHS,” said Steven Vladeck, a professor at the University of Texas School of Law.

Cuccinelli has since moved on to becoming the second-in-command at DHS but is still listed as the senior official performing the duties of the director at UCIS. Last week, Acting DHS Secretary Chad Wolf selected Joseph Edlow to run USCIS’ day-to-day operations.

USCIS and DHS did not respond to requests for comment on Sunday.

Nonetheless, a degree of clarity is emerging from this report. The median age of the patients was 59 years, with higher morbidity and mortality among the elderly and among those with coexisting conditions (similar to the situation with influenza); 56% of the patients were male. Of note, there were no cases in children younger than 15 years of age. Either children are less likely to become infected, which would have important epidemiologic implications, or their symptoms were so mild that their infection escaped detection, which has implications for the size of the denominator of total community infections…

…If one assumes that the number of asymptomatic or minimally symptomatic cases is several times as high as the number of reported cases, the case fatality rate may be considerably less than 1%. This suggests that the overall clinical consequences of Covid-19 may ultimately be more akin to those of a severe seasonal influenza (which has a case fatality rate of approximately 0.1%) or a pandemic influenza (similar to those in 1957 and 1968) rather than a disease similar to SARS or MERS, which have had case fatality rates of 9 to 10% and 36%, respectively.2

March tournament to be held behind closed doors due to virus

The Spring Grand Sumo Tournament, set to open next weekend, will be held behind closed doors for the first time in history due to the ongoing coronavirus crisis, the sport's governing body said Sunday. The Japan Sumo Association's board of directors made the decision in an extraordinary session in Osaka. Having already ruled out the possibility of staging the 15-day meet under normal conditions, the JSA weighed whether to hold the event at Edion Arena Osaka behind closed doors or call it off completely.

While grand sumo tournaments have been canceled twice in the past, JSA Chairman Hakkaku said the directors agreed to go forward for the fans - even if people would not be able to attend.

"To those many who were looking forward to this, we are sorry for this huge inconvenience," Hakkaku said. "There were various viewpoints, but there was an absolute desire to hold it for the sake of the fans."

"It's going to be very hard for the wrestlers, but they will need to maintain strong wills."

When the tournament opens, the spotlight is set to fall on sekiwake Asanoyama. A good performance in Osaka could earn him promotion to ozeki, the sport's second-highest rank.

"Because there will be no fans, I can't picture it in my head," he said. "But because I believe people will be cheering me on from in front of their TVs, I have to go forward with confidence."

The meet will be televised on Japanese public broadcaster NHK, but the tournament will be canceled if a wrestler is found to have contracted the virus, according to Hakkaku.

The move came after the Japanese government's request on Wednesday to operators of sports and entertainment venues to consider canceling or postponing mass gatherings to help prevent the spread of the new coronavirus.

Sumo's grand tournaments are held every two months. Due to the difficulty of finding a venue and a schedule suitable for all of those involved, the JSA had said it was impossible to postpone the spring tournament, the second meet of this year.

Afghanistan War Enters New Stage as U.S. Military Prepares to Exit

The deal signed on Saturday could have the United States conducting strikes to aid old enemies like the Taliban — or lead to a complete withdrawal from the country.

WASHINGTON — Intelligence briefers regularly present President Trump with a classified map of Afghanistan, usually the only report on the war he examines, displaying the strikes carried out in recent days and, critically, the number of Taliban and other militants killed.

During his presidency, enemy body counts have been the lens through which Mr. Trump has viewed the Afghanistan war — an often meaningless metric in disrepute since the Vietnam War.

Now, America’s de facto war of attrition against the Taliban has, at least theoretically, come to an end. The signing of a deal on Saturday in Doha, Qatar, to start withdrawing United States troops from Afghanistan may not immediately stop the fighting, but it will at least usher in a new era in the 18-year war.

The deal will also begin the process of drawing down the American intelligence presence.

There are many questions about what the role of military forces and intelligence officers will be, but the rough outline of how the mission is likely to shift has become apparent.

Pro-Government Fighters Ambush Turkish-Backed Militants In Syria’s Idlib (18+ Video)

Late on March 1, Syrian pro-government fighters ambushed a group of Turkish-backed militants near the city of Saraqib in the southeastern Idlib countryside. According to activists, 14 militants were killed in the ambush. A T-55 battle tank, which attempted to support the militants during the clashes, was also captured.

Syrian fighters from the so-called Syrian Resistance, a group affiliated with Lebanon’s Hezbollah, carried out the successful ambush. The fighters are reportedly from the Shiite towns of Nubl and al-Zahraa in northern Aleppo.

Earlier this week, Turkish drone strikes on southeast Idlib claimed the lives of nine personnel of Hezbollah. The ambush was apparently carried out to avenge them. Iranian forces in Syria had released a statement, warning Turkey from attacking its troops.

The SAA backed by Iranian forces are now attempting to recapture Saraqib. The eastern part of the city has been fully secured, according to several sources. However, heavy clashes are taking place in the western part.

In Video: Turkish Drones Attack Syrian Army Convoy In Southern Idlib

On March 1, Turkish combat drones attacked a convoy of the Syrian Arab Army (SAA) near the town of Ma’arat Hurmah in the southern Idlib countryside.

The Turkish Ministry of National Defense released a video showing the strikes on the convoy. Four vehicles, including a battle tank and infantry fighting vehicle (IFV), can be seen getting destroyed in the video.

Earlier today, the Syrian Arab Army (SAA) announced the closure of the airspace over northwest Syria. Several Turkish drones, reportedly nine, were shot down by the army’s air-defense systems.

Turkey responded to the Syrian measure by destroying air-defense systems, as it had claimed, and shooting down two Su-24 warplanes of the Syrian Arab Air Force (SyAAF).

In the last few days, Turkish drones strikes inflicted catastrophic losses on the SAA and its allies in Greater Idlib. The strikes allowed Turkish-backed militants to regain momentum and even pushed the army’s positions in southern Idlib to the brink of collapse.

"It's A Betrayal" - ICE Runs Millions Of Facial-Recognition Searches On Maryland Drivers

The real-world use of facial-recognition technology in the justice system is fraught with problems, according to a new report from The Baltimore Sun.

New evidence suggests the US Immigration and Customs Enforcement (ICE) has accessed the Maryland state database of licensed drivers numerous times in the last several years, using facial-recognition software to scan millions of licenses without state or court approval.

The move by ICE has alarmed immigration activists in the state, alleging that the agency has used the database to scan for undocumented immigrants that have received a special driver's license in the last seven years.

ICE can take a photograph of an unknown person and run it through the database, in search of a match.

"It's a betrayal of immigrants' trust for the [state] to turn around and let ICE run warrantless searches on their faces," said Harrison Rudolph, a senior associate at Georgetown University Law School's Center on Privacy and Technology. It's a bait-and-switch. … ICE is using biometric information in the shadows, without government notice or public approval, to hunt down the most vulnerable people."

A new bill backed by state Democrats would force ICE agents to obtain a warrant before running images through the motor vehicle records and driver's license database. The bill would also allow the state to track federal queries into the system.

ICE has used the database to scan for undocumented immigrants, mainly in the Baltimore–Washington metropolitan area.

"We have seen certain cases where they didn't have any sort of criminal record but were targeted," said Lydia Walther-Rodriguez, operations head of Baltimore CASA.

Rodriguez said ICE has used the database to search for immigrants "for years now."

The Washington Post said ICE has also deployed the software in other state databases, such as ones in Utah, Vermont, and Washington.

"They have a wide-open door to be able to search through anything in this database," said Maryland Sen. Clarence K. Lam (D-Howard), who has openly told state officials that there needs to be more oversight on ICE's use of the database. "They've not been forthcoming in their willingness to [stop it] or coming up with solutions."

Rudolph said ICE searches affect everyone, not just immigrants, due in part because of the facial-recognition software can produce errors and misidentify people, leading agents to pursue the wrong person.

"If you're a US citizen and thinking ICE facial-recognition searches don't affect you, you're wrong," he added. "With face recognition, the question is not whether you are an immigrant, but whether an error-prone technology thinks you look like an immigrant."

Facial-recognition software deployed by ICE to track immigrants is something that tyrannies like China are using to control their population.

Law enforcement agencies across the country have also embraced facial recognition and AI surveillance.

Last month, the Chicago Police Department was caught using a controversial facial recognition tool that scans social media platforms to pinpoint the identity of unknown suspects.

There are additional downside risks of AI surveillance and data harvesting; that is, a hacker can steal the treasure trove of data. This is what happened with a Manhattan-based facial recognition company that uses AI to collect data from unsuspecting social media users reported this week that their entire client list was stolen.

Although AI promises to make ICE and other law enforcement agencies more effective in crimefighting, the troubling trend is that the US could be sleepwalking into a technological tyranny, just like China.

Kirk returns to the planet and joins Spock in search for these entities. They find a number of single-celled creatures attached to the walls and ceiling of one building. The creatures fly, and attempt to attack the humans; the landing party finds they are nearly immune to phaser fire.

Returning to the Enterprise, Spock determines that the creatures are part of a hive mind, and apparently indestructible. They recall the ship pilot that claimed he was free before diving into the sun, and suspect the sun's properties may harm the creatures.

Kirk holds a senior staff meeting, asserting they must find a solution before the creatures reach the next inhabited planet, holding over a million people; a solution that doesn't kill the hosts. While using a computer, he realizes that they have not tried visible light as a means to defeat the creatures.

The Enterprise floods the colony with ultraviolet light from an array of satellites, killing the creatures on the planet and purging the parasites from the survivors.

It was also the first appearance in Star Trek for child actor Craig Hundley, who played Peter Kirk.

This left actor Hundley with no lines in the finished episode; the character of Peter Kirk spends the entire show unconscious. It also left the episode with no explanation of what becomes of Peter.

U.S. bank lobby economist predicts global rate cut coming ... this Wednesday

WASHINGTON (Reuters) - Investors battered by the breathtaking drop in global stock markets on coronavirus fears are ever more convinced the world’s big central banks, including the Federal Reserve, will soon step in to try to quell the storm.

Against that, the top economist for the U.S. bank lobby - a former Fed insider - issued a remarkably specific prediction on Sunday that the rescue is nigh.

In a blog titled "Don't keep your powder dry" here, Bill Nelson, chief economist at the Bank Policy Institute who worked on the Fed's responses to the 2007-2008 financial crisis, predicted:** A coordinated global interest rate cut by the top central banks, such as the one executed at the height of the crisis in October 2008 by the Fed and five other central banks. They will possibly include in this action the People's Bank of China and the Hong Kong Monetary Authority, the two banks whose economies have so far suffered most from the outbreak.

** It will happen this Wednesday, March 4. Nelson noted that the previous big coordinated actions in December 2007, October 2008 and November 2011 all occurred on a Wednesday.

** It will happen before the U.S. stock market opens, either 7 a.m. or 8 a.m. ET (1200 or 1300 GMT).

** It will be big: half a percentage point at least. The Fed’s current benchmark lending rate is set in a range of 1.50-1.75%, and rate futures markets are pricing in a cut of at least a quarter percentage point at the Fed’s next scheduled meeting March 17-18. “The only way to get a positive market reaction is to deliver more than expected,” he wrote.

** It will include “forward guidance” - a central bank term for some form of pledge regarding future policy action. Nelson said he would not be surprised to see something aimed at preventing a further erosion of inflation, something the Fed and other central banks have been battling for most of the past decade. His suggestion: The Fed pledges not to raise rates or take other policy tightening actions until its preferred measure of inflation is above its formal target of 2% for six months. Alongside his predictions for a globally coordinated move - something many investors and economists worry could well fall short of what's needed because of depleted tool kits at the world's big central banks - Nelson in a related post here said the Fed could loosen a number of requirements and other regulations on U.S. banks to help keep credit moving.

Regarding the rate cut, however, Nelson does offer one big caveat: “If markets are calm Monday and Tuesday, I’m not sure what will happen.”

Buttigieg exits presidential race ahead of Super Tuesday, cementing collapse following strong Iowa showing

Russia Can't Guarantee Safety of Turkish Aviation in Syria After Damascus Shuts Idlib Airspace – MoD

As tensions run high in Syria’s Idlib amid Thursday's spike in hostilities, the Syrian state news agency SANA reported on Sunday that the "Turkish regime's terrorist forces" downed two aircraft - thought to be fighter jets - belonging to the Damascus forces.

The Russian Defence Ministry announced on Sunday that it could no longer guarantee the safety of Turkish aircraft flying over northern Syria, after Damascus moved to close the airspace over the embattled province of Idlib.

Damascus announced earlier on Sunday that it would treat any aircraft that crosses into the airspace of Syria’s northwest as a hostile target.

This comes amid media reports that two Syrian aircraft were shot down in Idlib. Both pilots survived after ejecting, according to reports.

SANA reported that the "Turkish regime's terrorist forces" struck the planes, without specifying whether they were Turkish troops or Ankara-backed militants.

There were no reports on what aircraft have been hit, but are thought to have been fighter jets. The Syrian military is known to operate Mig-29s, Su-22s, and Su-24s.

A source in the Syrian Defence Ministry revealed that Turkish F-16s had twice in during the day crossed into Syrian airspace, shooting down government forces' planes.

In a separate development on Sunday, Syrian air defences destroyed six Turkish UAVs attacking government forces within the day, the source added.

Deterioration of Situation in Idlib

The recent spike in tensions in northwestern Syria occurred on Thursday, as the Syrian army repelled a large-scale assault by terrorists operating in the area. As a result of a counterattack, 33 Turkish servicemen were killed.

Right after the incident, the Russian Defence Ministry revealed that the dead Turkish troops were mixed with Nusra terrorists who had been present in the province. The ministry also said the Turkish contingent was operating outside observation posts it previously established under the provisions of deals agreed upon by Turkey, Russia and Iran in 2017 in Astana, and again in 2018 in Sochi.

Macron: France Ready to Help Greece, Bulgaria to Cope With Huge Influx of Migrants

France expresses solidarity with Greece and Bulgaria and is ready to offer assistance to protect borders from arriving migrants, French President Emmanuel Macron said on Monday.

On Sunday, Greek government spokesman Stelios Petsas said that the situation with migrants on the country's northeastern border with Turkey presented a threat to the national security. The spokesman added that Greece would stop accepting asylum requests for a month and expedite repatriations of migrants coming to the country illegally.

"Expressing full solidarity with Greece and Bulgaria, France is ready to contribute to the efforts of European countries to provide them with immediate assistance and to protect borders. We must work together to avoid a humanitarian and migration crisis," Macron wrote on Twitter.

The stampede near the northeastern Greek town of Kastanies was triggered by the Turkish announcement on Saturday that it had opened its borders to Europe to Syrian refugees citing the lack of promised assistance as the reason.

On Saturday, Turkish Prime Minister Recep Tayyip Erdogan said Ankara opened borders to Europe, citing lack of aid from Brussels. Tens of thousands of migrants who have recently been in Turkey moved towards the country's border with Greece and Bulgaria. Greece, in its turn, shut its borders and sent military equipment to prevent migrants from entering the country.

Will the fighting end after the elections? - analysis

Like the two previous elections, Netanyahu has made himself once again the focus of this election. It’s all about him.

Israelis already know the drill. Sadly.

After two elections, the most likely scenario based on current polling is that there will again be deadlock, meaning that there is a strong chance Israel will once again head to the polls during or after the summer.

The decision Israeli voters will make on Monday has the potential to determine the future of their state and it is not a simple one. On March 17 the bribery trial of Prime Minister Benjamin Netanyahu will begin and Israel will find itself in a situation it has never been in and never should’ve been in: a sitting Prime Minister standing trial for grave corruption charges.

Despite this, Netanyahu seems to be entering Election Day strong and with positive momentum. In the last week his polling numbers have increased - both in terms of the number of seats Likud will receive but also when it comes to the gap between him and Benny Gantz on the question of who is more suitable to serve as prime minister.

Almost no one talks about his pending trial - what it will mean for Israel, how he will be able to continue running the country while standing trial and what it does to the soul of the nation when it’s leader stays in power and sits on the defendant bench simultaneously.

To some extent, Netanyahu is right that what seems to unite his opponents is simply the desire to remove him from office, what is know as the “Anything but Bibi” camp. On the other hand though, the “Only Bibi” camp is no less cultish in its refusal to recognize reality - this prime minister has been in office already now for more than a decade consecutively and has a trial about to begin which despite his declarations will take up a lot more of his time than just an hour a day.

Cigars and alleged bribery don’t bother these supporters. They talk about Netanyahu being an underdog who is persecuted by the police, the attorney-general and the media. He seems to keep Israel safe so why change anything?

On the other side, there is legitimate criticism of Blue and White and the campaign it has run. There have been mistakes (like the recording that came out last week of his top adviser saying Gantz is weak on Iran) and more. The bottom line is that as impressive as Gantz seems to be he hasn’t swept up the masses and led to a move of votes across camps - from the Likud to Blue and White.

Like the two previous elections, Netanyahu has made himself once again the focus of this election. It’s all about him. None of the attempts to divert the focus - to annexation, Naama Issachar (remember her?) or even Gaza - have worked. It remains a fight between those who want Netanyahu to stay and those who don’t.

What will happen is difficult to predict. Will Netanyahu get the 61 seats on the Right with Avigdor Liberman or will he fall short and then try to get some members of Blue and White to defect over to his side? Will Gantz be willing to form a minority government with Arab support and will Liberman even let him?

On Monday night we will have a better clue where things are headed but the real work will start on Tuesday, the day after elections when the sides will begin to actively recruit defectors.

The voting might come to an end at 10 pm on Monday, but the political bickering is still far from over.

Civil Disivedience at its best, blacks turn their back in Bloomberg in church

Congregants of a historically black church in Selma, Alabama, turned their backs on Democrat presidential hopeful Mike Bloomberg on Sunday as he addressed them.

The protest, which remained silent and peaceful, took place as Bloomberg was giving a speech on the 55th anniversary of “Bloody Sunday,” a day when police attacked black citizens during a civil rights march in the town.

Covington Catholic student will sue New York Times, CBS, ABC, other outlets for publishing falsehoods

Nick Sandmann, the Covington Catholic student who became the center of a national controversy last January, has announced he is suing five additional media outlets.

Last week, Sandmann's attorneys filed a report with the U.S. District Court in Covington that stated their intention to file lawsuits against The New York Times, CBS, ABC, Gannett, and Rolling Stone, WXIX-TV reported.

The lawsuits will be filed sometime before March 9.

The report said:

All of the future defendants listed above have published or republished statements made by Nathan Phillips and others that Nicholas blocked or otherwise restricted Phillips' free movement and would not allow Phillips to retreat at the National Mall on January 18, 2019. Nicholas reserves his right to file complaints in this is Court or any other court against any other potential defendant not listed above, subject to the applicable statute of limitations.

Sandmann has so far filed lawsuits against CNN, the Washington Post, and NBC Universal, all for publishing falsehoods about him in stories related to last year's March For Life controversy. The lawsuits against the Post and NBC are outstanding, while CNN settled its lawsuit with an undisclosed terms in January.

It is not yet clear how much in monetary damages Sandmann will seek in this newest round of lawsuits.

Netanyahu claims his party is now a hair’s breadth away from Knesset majority

PM tells supporters latest data shows Likud and its allies at 59.7 of required 61 seats; petition accuses him of violating campaign laws by disclosing survey results

Prime Minister Benjamin Netanyahu claimed Sunday that his party’s internal polling showed he was a stone’s throw away from a Knesset majority that would allow the formation of a right-wing government.

“Our data from three hours ago shows we are at 59.7 seats,” he told supporters at an election rally outside Tel Aviv, referring to his bloc of right-wing and religious parties. “We are very close to victory.”

He said “this movement [of votes] is a consistent trend of recent days, and we can bring about the formation of secure right-wing government for Israel.”

Polling in the final days before Monday’s election showed support for Likud grow slightly, possibly surpassing its rival Blue and White, though the surveys indicated the party is still several seats short of achieving a 61-seat Knesset majority without the support of Yisrael Beytenu and its leader Avigdor Liberman.

In response to his speech, Attorney Shachar Ben Meir filed a petition against Netanyahu with the Central Elections Committee on Sunday, accusing the prime minister of breaking election laws, which forbid the publication of polling data in the three days before an election.

Ben Meir demanded that Likud be fined for the violation, Haaretz reported.

The Likud party responded in a statement, saying the ban is against broadcasting or publishing polls and that Netanyahu had made “a verbal announcement” rather than publishing the results of survey.

Monday is the nation’s third election in less than a year, after neither Netanyahu nor Blue and White leader Benny Gantz were able to form coalitions in the last two rounds, and talks on a unity government fell through.

The prime minister suffered a setback Sunday evening as the far-right Otzma Yehudit party declared it would not step down — potentially costing the right-wing bloc 1-2 seats.

SINGAPORE (Reuters) - Oil prices pared losses after earlier hitting multi-year lows on Monday as hopes that a bigger than expected production cut from OPEC and stimulus from central banks could offset economic gloom from the coronavirus outbreak. Flight cancellations and travel bans by countries worldwide sparked fears about the global economy, leading to the biggest weekly stock market rout since the 2008 financial crisis last week. China’s factory activity also shrunk at the fastest pace ever in February, underscoring the colossal damage from the coronavirus outbreak on the world’s second-largest economy. Several key members of the Organization of the Petroleum Exporting Countries (OPEC) are mulling an additional production cut of 1 million barrels per day, more than the 600,000 bpd proposed last month, on growing fears that the virus outbreak will hit oil demand badly. OPEC and its allies including Russia, a grouping known as OPEC+, have already been curbing oil output by 1.7 million bpd under a deal that runs to the end of March.

A 'vulture' circles over Twitter

A hedgie, Singer probably would first and foremost be making his decision to hostilely take over Twitter, based on the fact that it must have unrealized profits, something he could force Twitter into making if he gets his men or women on that board with enough power to clean house.

The news accounts cite Twitter's refusal to take political ads in the election cycle, on the pious grounds that they could affect the election, is likely one source of unrealized profits.

But there are plenty more: Twitter's history of capricious censorship against conservatives has got to be driving traffic away from the site, too. For every conservative they ban, they lose money in lost traffic and clicks. Since they do it a lot, and to big players such as actor James Woods, whose pithy comments have delighted millions, they lose millions.

Here's another thing: The company may well have a depressed valuation based on its risk of ligigation and even more important legislation. The site claims to be a public platform and therefore exempt from libel laws, but its policy of censorship of conservatives makes it a highly edited platform. They're likely to be eventually sued for the double standard and it's all their own doing.

Watch Singer get in there and force this social media giant to live up to its promises. That would be good news for conservatives in the short term.

In the long term, it might be even better. Singer's breach of Fortess Social Media with all its monolithic leftist denizens might just be a first step for a conservative long march through the institutions, the cultural takeover that the late Andrew Breitbart dreamed of happening.One hopes more conservative billionaires start getting in on the act and buying up newspapers, educational establishments, television and radio stations and social media companies in following. A giant could tumble.
