Oil tankers stripped of flags for US sanctions breach

Four oil tankers were stripped of their flags following an investigation into allegations that they secretly transported Iranian oil, which would have been a breach of US sanctions.

An NBC News investigation found that the four ships all made secret visits to Iranian waters in 2020, collectively picking up millions of barrels of oil, according to data from maritime research company Tanker Trackers.

A July 31st report from NBC News featured 15 ships. Four of these, the Giessel (IMO 9246279),the Ekaterina (IMO 9196644), the Lerax (IMO 9181194), and the Amfitriti (IMO 9273337), were sailing under the flag of St Kitts & Nevis. Five days after the report was broadcast the St Kitts & Nevis Ship Registry decided it would no longer allow the tankers to fly under its flag.

Vessels that have been stripped of their flag effectively are unable to operate. Ports will not allow entry and the vessels will be uninsurable.

St. Kitts & Nevis International Ship Registry said that the Giessel was de-flagged on August 4th following press reports that it had visited an Iranian port.

A registry spokesman confirmed the three other ships had also been stripped of their flags. Public records from the International Maritime Organization show that the four ships are no longer under the St. Kitts & Nevis flag, with their nationality now listed as “unknown.”

NBC News said that the maritime organization’s records revealed “a complex web of companies responsible for the ownership of each of the ships. But three of the vessels are ultimately under the care of the same firm, an Indian company called Floretta Ship Management. The fourth ship is linked to another Indian company, Ravel Ship Management.”

Marine Traffic lists the Giessel as at sea, having departed Qingdao, China and now off the south-east coast of Malaysia.

It lists the Ekaterina as having departed Qingdao and arrived at Kochi, India, on August 28th.

It lists the Lerax as en route from Sikka, India, to Singapore, with an ETA of August 25th, but as of August 31st, still off the south-east coast of Malaysia.

It lists the Amfitriti as en route from Changxindao, China to “Khawr Fakkan”, which is presumably the port of Khorfakkan in the UAE. As of August 31st it was offshore, between the UAE and Iran.

Spoliation is a legal concept, established in election case law, whereby legitimate evidence that is commingled with illegitimate evidence (or ballots in this case) does not have legal standing

Alito just guaranteed Trump will win because Alito's order to sequester and separate the late mail ballots will not be followed by PA (to prevent discovery or fraud).

This will spoliate all mail-in ballot received after election day in any voting district where election observers were denied access.

The didn't store them separately, so it would be impossible to properly recount, since they were mixed, hence the spoliation of their legal standing.

Everything counted after 8pm in PA and presumably after 11:59pm November 3rd in other states with state law concerning ballots must be received by election day will be ruled illegal and not count.

By defying an order of the Supreme Court to not mix the ballots, Trumps lawyers will prove that Democrats did this on purpose.

Democrats have officers on every level in Philly. Federal employees are helping this fraud. The longer the evidence sits unguarded, the more the election officials tamper with the ballots and mix them, the more it can be fraudulent and worse off they will be when it gets to the Supreme Court.

There are other issues with this election, but the spoliation route has the most expedient legal pathway to bringing about the true result of the election. If the Trump campaign can also prove the electronic voter fraud used by Dominion, it could become an avalanche victory. This is a much more technically difficult case to prove, but it would likely lead to criminal prosecutions.

Spoilation of Evidence

Spoliation “is the destruction or the significant and meaningful alteration of evidence.” The

word comes from the Latin word spoliare, which means “to plunder.” The word has “evil

connotations, and the dictionaries make it synonymous with pillaging, plundering, and robbing.”

A party is responsible for spoliation “when the party has evidence within its control, . . . and fails

to produce the evidence to negate constructive knowledge.” A party also may be responsible for

spoliation even if a third party disposes of the evidence. For example, in American Casualty

Company of Reading, Pennsylvania v. Schafer, a defendant claimed that he stored the key evidence

in a building, but that a tenant in the building later destroyed those documents. The court found the

defendant company could be responsible for spoliation if its owner “caused or contributed to the

loss of the records,” and it reversed summary judgment for the defendant.

Courts are sensitive to spoliation because it seems particularly unfair to let one party profit

by destroying evidence. For example, in Horton v. Eaton, the doctor’s duty turned on the contents

of a requisition form that had “mysteriously disappeared” from the defendant doctor’s files. The

trial court admitted the doctor’s testimony about the form’s typical content, but the appellate court

found the admission erroneous; admitting the testimony would let the doctor “benefit from his

omission of record” by blocking the plaintiff’s efforts to discover the truth and by giving the doctor

“the benefit of an unimpeachable version of the contents” of the document, a version which

“happens to favor” the doctor’s position.

This article will focus on recent judicial developments that expand the remedies for

spoliation and the factors courts should consider in choosing a remedy. It also will discuss the

problematic case in which the evidence is in the possession of a non-party and offer concrete steps

that practitioners can take to protect their clients from spoliation of their key evidence

Another Noble Group Ex-CEO Gets $20 Million After Legal Battle

Noble Group Holdings Ltd., the commodity trader shrunken by years of losses and a multibillion dollar restructuring, has paid $20 million to former Chief Executive Officer Ricardo Leiman.

The payment to Leiman, who left the company in 2011 several years before its 2018 restructuring was disclosed in a presentation accompanying Noble’s third-quarter results on Friday. When the case was first filed in 2012, Leiman’s restricted shares and share options were worth about $59 million, Bloomberg reported at the time. The settlement is a similar size to a roughly $20 million package former co-CEO Jeff Frase received on leaving in 2017, even as Noble slumped to a loss of almost $5 billion. Leiman declined to comment on the terms of the settlement, saying only that he had no outstanding legal cases against Noble. A spokesperson for the company declined to comment. While Noble’s market value once exceeded $10 billion, it has become a shadow of its former self following a restructuring in 2018 that handed control to its creditors. The $20 million payment to Leiman is equal to about 70% of the company’s entire staff bill for the first half of this year, when “human capital costs” totaled $28 million.

Noble’s presentation showed the $20 million payment as a cash outflow during the first half of this year related to the settlement of a legal case involving a former CEO. The size of the payment hadn’t previously been disclosed.
