Court grants cases on DOGE data dispute, prisoners’ rights, and what qualifies as “material support” for terrorism

The Supreme Court on Tuesday added three new cases to its oral argument docket for the 2026-27 term, agreeing to decide, among other things, what kinds of orders trial courts can issue in disputes over access to government information and whether working as a cook in a camp run by violent separatists qualifies as providing “material support” for terrorism under federal immigration law.

President Donald Trump created the U.S. Department of Government Efficiency, also known as DOGE, in January 2025 to advance his agenda by “modernizing Federal technology and software to maximize governmental efficiency and productivity.”Although it is not a cabinet-level department, DOGE was widely involved in Trump’s efforts to reduce the size of the federal government.

The dispute now before the court,U.S. Doge Service v. U.S. District Court for the District of Columbia, began after a government watchdog group, Citizens for Responsibility and Ethics in Washington, filed a request under the Freedom of Information Act for (among other things) communications between the DOGE administrator, Amy Gleason, and DOGE staff, as well as financial disclosures submitted by DOGE personnel.

CREW went to federal court in Washington last year,asking DOGE to disclose documents that it said it wanted before Congress passed a bill to fund the federal government.

CREW also sought to fast-track discovery – the process of exchanging information in litigation – to determine whether DOGE is a federal “agency” that must comply with FOIA. It asked for a list of current and former DOGE employees, a list of employees and positions for which DOGE had recommended termination, a list of government contracts and grants that DOGE had recommended be canceled, and the opportunity to depose Gleason.

U.S. District Judge Christopher Cooper granted most of CREW’s discovery requests, and the U.S. Court of Appeals for the District of Columbia Circuit turned down DOGE’s plea to pause that order.

U.S. Solicitor General D. John Sauer then came to the Supreme Court in May 2025, asking the justices to intervene.He told the justices that the discovery required under Cooper’s order “offends the separation of powers by compromising the ‘necessity’ for confidentiality that allows presidential advisors to provide ‘candid, objective’ advice and communication.”

In a two-page, unsigned order in early June 2025, the court – over the objections of Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson – sent the dispute back to the D.C. Circuit for another look. The majority wrote that the portions of Cooper’s discovery order that required the government to disclose the content of DOGE’s recommendations within the executive branch, as well as whether those recommendations were followed, were too broad. Moreover, it added, concerns about the separation of powers between the branches of government “counsel judicial deference and restraint in the context of discovery regarding internal Executive Branch communications.” The court put Cooper’s discovery orders on hold while the litigation continued.

When the case returned to the lower courts, CREW modified its discovery requests so that it no longer sought information about “recommendations” made by U.S. DOGE employees.The lower courts then declined to block CREW’s requests.

DOGE came to the Supreme Court in March, asking the justices to weigh in. Sauertold the court that the D.C. Circuit “has continued to approve intrusive discovery against a presidential advisory body without adequate consideration for the separation of powers, the FOIA statute, and” the Supreme Court’s order last year on the interim docket. Among other things, he argued, that order “required the courts below to reassess all remaining discovery—not just requests for USDS recommendations—with the ‘deference and restraint’ applicable to presidential advisors under Cheney v. U.S. District Court,” a 2004 case in which the justices held that when considering requests for information directed at the vice-president and other senior executive branch officials, “special considerations” should “control when the Executive Branch’s interests in maintaining the autonomy of its office and safeguarding the confidentiality of its communications are implicated.”

CREW urged the justices to deny review. It argued that in formulating the new discovery order, the D.C. Circuit had “followed this Court’s instructions” in its earlier ruling on the interim docket “to the letter.” Instead, it contended, the government was seeking “to transform this Court’s carefully crafted stay-stage order into a sweeping ruling that Cheneyeffectively forecloses discovery in this case. That is not what this Court said,” CREW insisted, “and, especially after remand, this case looks nothing like Cheney.”

On Tuesday, the court agreed to address the D.C. Circuit’s ruling.

The immigration case granted on Tuesday, Blanche v. Ozurumba, was also brought to the court by the Trump administration. In a petition for review filed in May, Sauer asked the justices to clarify what type of support an immigrant must be shown to have provided to a terrorist organization in order to be “removable and ineligible for various immigration benefits” under a federal immigration law that states that an individual who “affords material support” to such a group is “ineligible to be admitted to the United States.”

Blanche v. Ozurumba involves Izuchukwu Ozurumba, “a native and citizen of Nigeria,” who worked as a cook in a camp run by a separatist organization known as the “Unknown Gunmen” “for about six months” before escaping, according to the government’s petition. He made his way to Venezuela and then the United States, where he applied for asylum, but an immigration judge and then the Board of Immigration Appeals concluded that his work in the camp amounted to “material support” for terrorism and that he was, therefore, ineligible for asylum.

Ozurumba appealed his case to the U.S. Court of Appeals for the 4th Circuit, which held that “the record does not support the conclusion that Ozurumba provided material support” to the Unknown Gunmen. “Cooking meals using food and supplies purchased by the organization may have ‘sustained’ the organization in the broadest possible sense—by converting raw groceries into meals they enjoyed—but provided nothing that the organization could use or readily divert to plan or carry out its terrorist activities,” concluded 4th Circuit Judge James Wynn in the majority opinion.

The Supreme Court will clarify what qualifies as "material support" of a terrorist organization such that an immigrant is ineligible for asylum and removable from the United States.

The justices also granted review on Tuesday in Berry v. United States, on whether a certificate of appealability may be granted to a prisoner whose claim is foreclosed by his own circuit’s precedent but would be allowed to proceed in a different circuit. In his petition for review, Corey Berry emphasized that the federal courts of appeals were split over this question.

Instead of teaching students in Philadelphia — the heart of American history — about American history, Jimenez is using his platform to raise up a generation of pro-Hamas, anti-Israel activists instead.

"When we look at October 7, this didn't happen out of the blue, right?" Jimenez said. "This is generations, right? Of folks who feel like the voice has been denied. Space Force launches Guardian Spark outreach program to inspire students nationwide

The United States Space Force is launching Guardian Spark, a new annual outreach program that connects Guardians with students in grades 3 to 12 to share the mission, people and opportunities behind the nation’s newest military service.

Through classroom presentations, question-and-answer sessions and age-appropriate discussions, Guardians will introduce students to space-related careers, explain how the Space Force contributes to national security and daily life, and inspire interest in the wide range of skills, career paths and opportunities that support its mission.

Through direct engagement with space professionals, the program sparks lifelong curiosity and passion for space exploration, astronomy, space technologies and more.

“Bringing Guardians into classrooms across the country is a meaningful opportunity to engage with students and communities,” said Chief Master Sgt. of the Space Force John Bentivegna.

“Through Guardian Spark, Guardians can share their experiences, demonstrate how space affects everyday life, and inspire young Americans to join the next generation of space leaders, innovators and problem-solvers.”

The inaugural Guardian Spark campaign will run from Nov. 9 through Dec. 20, 2026, culminating with the Space Force’s birthday. Guardians can volunteer to support through Oct. 16, 2026.

The program is designed to reach classrooms nationwide, including Department of War Education Activity school locations overseas. For 2026, the Space Force aims to engage at least 250 classrooms, reach 7,500 students and mobilize 200 volunteer Guardians.

The program will also seek educator feedback and use optional student polls to assess awareness of Space Force roles.

Guardian Spark supports educators and students by creating direct connections with space professionals.

Sessions will be tailored to elementary, middle and high school audiences, with Guardians sharing their experiences and answering students’ questions about space operations, technology and service.

The Guardian Spark program is coordinated by the Secretary of the Air Force Public Affairs Outreach Office.

Participating Guardians will receive standardized talking points and complete required outreach training before engaging with schools. Educators and schools will coordinate classroom logistics and student participation with the program office.

Legendary Fighter Takes Final Flight: Air Force Reserve Delivers F-117A to Smithsonian

Nearly two decades after the Air Force retired the F-117A Nighthawk, one took to the skies again, this time in the cargo hold of a C-5M Super Galaxy.

The historic stealth aircraft will soon join the permanent collection at the Smithsonian Institution's National Air and Space Museum Steven F. Udvar-Hazy Center in Chantilly, Virginia.

The Air Force Reserve's 512th Airlift Wing, based at Dover Air Force Base, Delaware, delivered the aircraft to the Smithsonian team Oct. 6.

The two-day, cross-country mission required precise weight distribution and tight clearances to fit the 29,500-pound load into the C-5M's cargo compartment.

For the 512th Airlift Wing, executing high-consequence, strategic airlift operations was business as usual, even when the payload was a piece of aviation history.

"Growing up in the '90s and 2000s, I remember thinking of the F-117 as the most unique plane," said Air Force Maj. Billy Hafker, a 709th Airlift Squadron instructor pilot and the mission commander.

"Being able to move it to the Smithsonian to preserve it for future generations is an incredible opportunity, and we're all honored to do it."

Hafker said C-5 cargo missions require airmen from several career fields, including flying crew chiefs and pilots. After landing in Palmdale, California, the crew conducted pre-loading operations to stage the aircraft for cargo.

Within two hours of landing, the loadmasters carefully maneuvered and secured the detached Nighthawk wings in the cargo hold, while leaving room for the fuselage.

Loading the fuselage was delayed overnight because the mandatory number of tie-down points required a mechanical team to work through the night to fabricate and install them.

"It was a little difficult to load in, but we got the job done," said Senior Airman Lucas Richard, a loadmaster assigned to the 709th Airlift Squadron. "This is probably one of the coolest pieces of cargo that I've ever seen."

As of January 2021, the Air Force has retained approximately 48 F-117As in its inventory and disposed of approximately four aircraft each year since grounding the fleet in April 2008.

The demilitarization process to deem an aircraft worthy of museum display requires a coordinated effort between the War Department and its industry partners.

"There's a lot of people that participate in a project like this," said Jeff Corbets, program manager at Lockheed Martin Skunk Works, who led the restoration project. "Demilitarization was the most difficult piece, but I think it went really smoothly, all things considered."

The aircraft earned the nickname "The Overachiever" as the only F-117A to fly in all four major conflicts in which Nighthawks served: Operations Just Cause, Desert Storm, Allied Force and Iraqi Freedom.

During its 1991 participation in Iraq, it flew 1,271 sorties, achieving an 80% mission success rate while suffering no battle damage. The jet retired in 2007.

As the historic aircraft takes its place on the museum floor for more than a million visitors each year, the mission itself serves as a victory for the 512th Airlift Wing.

Beyond preserving history, the operation successfully showcased the advantage of the Air Force Reserve in action — delivering unprecedented combat capability and professionalism to the joint force.

The Martian Moons eXploration (MMX) mission is set to launch into space on a H3 rocket from the Tanegashima Space Center at 04:41 JST on 20 October 2026 (20:41 BST / 21:41 CEST on 19 October 2026).

MMX will be the first mission to collect a sample from Mars’s moon Phobos and bring it back to Earth.

MMX is led by the Japan Aerospace Exploration Agency (JAXA), in collaboration with the National Aeronautics and Space Administration (NASA), the French space agency (CNES), the German Aerospace Center (DLR) and the European Space Agency (ESA).

Why the martian moons?

Mars has two moons: Phobos (fear) and Deimos (terror). Despite the large fleet of missions sent to the Red Planet, the moons remain particularly mysterious, with huge open questions about how they formed and what they are made of.

No spacecraft have dwelled near them for long, so we only really know what a few flybys have revealed.

We don’t even know their origin story. They may be asteroids that were captured into Mars orbit, or they may be the remnants of debris thrown into orbit after a giant collision on the surface of Mars. To find out, we need to collect samples.

“The data and samples returned by MMX are a window to study the evolution of Mars and the Solar System,” says Elliot Sefton-Nash, ESA MMX Project Scientist.

Just like Earth, Mars has changed a lot since it formed 4.5 billion years ago. Conditions there may once have been suitable for life.

Digging up this history will also tell us more about how Earth and the rest of the Solar System formed and evolved, and perhaps even rocky planets around other stars.

What’s new?

MMX will be the first spacecraft to orbit Phobos, the first to land on a moon other than our own, and the first to collect samples from this moon's surface.

Special technology has been created to help land, manoeuvre and collect samples robotically in the extremely low gravity at Phobos.
