Judge strikes down DOJ's policy of reviewing state voter rolls, saying it would "run roughshod over longstanding laws" 1/2

A federal judge has struck down the Trump administration's plan to check state voter rolls against federal immigration databases, a blow to the administration's election-related efforts in the run-up to the midterms.

In a 78-pageruling, D.C.-based U.S. District Judge Sparkle Sooknanan wrote Friday that the Justice Department "cannot run roughshod over longstanding laws that were carefully crafted to protect the rights of the American people."

The Trump administration has mounted a nationwide push to obtain complete voter rolls from every state, including sensitive information about registered voters. The Justice Department has argued the information is needed to ensure states are complying with two federal voting laws — the Help America Vote Act and the National Voter Registration Act — which aim to ensure states have programs in place for maintaining accurate voter rolls.

Eighteen states fully cooperated with the Justice Department's request for voter files, Sooknanan said.The department has brought lawsuits against most other states, and has lost almost all of the suits, according to a CBS News analysis. One state settled with the federal government.

The ruling applies to the voter files that the Justice Department has already received, as well as the files it is still litigating over.

Sooknanan rejected the Justice Department's argument that it has legal authority to demand voter lists, compare those lists against citizenship databases and urge states to remove voters who it claims are ineligible to vote. The judge also said the policy violates the Administrative Procedure Act and the Privacy Act, and said the federal databases could contain "inaccuracies."

"Today's decision does not prevent the federal government from taking lawful steps to support states' efforts to maintain accurate voter rolls. Neither does it prevent states from maintaining their own voter rolls. And to state the obvious, the Court's decision does not pave the way for ineligible voters to vote in our elections," Sooknanan wrote.

“Rather, the Court vacates a policy that has removed United States citizens from the voter rolls in their home states and risks disenfranchising many more — a policy that flies in the face of duly enacted laws designed to protect Americans."

She continued: "The challenged policy represents the federal government's attempt to decide who gets to vote. But Congress has left that authority where our Constitution has always placed it: with the states." The legal challenge against the voter roll policy was brought byadvocacy group Common Causeand individual voters.

Common Cause CEO Virginia Kase Solomón called the ruling "a victory for voters and yet another loss for the Department of Justice" in a statement Friday.

A Justice Department spokesperson said the agency is reviewing the decision.

Under the Trump administration, the federal government has sought a larger-than-usual role in elections, which are typically administered by states with some regulation by Congress.

President Trump argues more federal scrutiny is necessary in order to prevent noncitizens from voting and curb fraud —though most election experts say fraud and noncitizen voting are extremely rare.(which is not true, there’s a huge amount of cheating, as proven by the 2020 false election)

The government's push to run state voter rolls through the Department of Homeland Security's Systematic Alien Verification for Entitlements (SAVE) database has faced court setbacks,as more than two dozen judges have denied the Justice Department's requests to compel individual states to share their voter lists.(there are 100s if not 1,000s of judges in the U.S., so 24 judges are not the majority)

Sooknanan also ruled in June that the Trump administration's overhauled SAVE database — which includes data from the Social Security Administration — was created unlawfully. The Supreme Court temporarily paused that ruling last month.

In practice, the impact of recent court rulings on the November midterms could be limited as federal law bars states from systematically removing ineligible voters from their voter registration lists within 90 days of an election.

Another Trump administration policy that set new rules for the U.S. Postal Service's handling of mail-in ballots was also blocked in the courts, with the Supreme Court declining the government's request to allow the rules to take effect.

Evan Gershkovich, the US journalist who spent 16 months in a Russian prison accused of espionage, has revealed the unusual contents of the “recovery kit” he was issued on being freed in a prisoner swap in 2024.

On the flight home to the Andrews military base in Maryland, US, he was handed a small package.

“Typically, it’s the state department who put together the recovery kits, but it was the CIA who put together these recovery kits and, in mine, they put Viagra.

“Maybe it’s a smart thing – a traumatised person comes home and sees his wife for the first time in years or whatever. Or is this what the CIA brings along for its missions abroad? We couldn’t figure it out,” he said.

He had 16 months of therapy to recover after being released and was diagnosed with post-traumatic stress disorder.

Mr Gershkovich was asked whether he was still looking over his shoulder, fearing more unwelcome attention from the FSB. But he said that he had fulfilled his purpose for the Russians as “a useful geopolitical trading chip” and now felt safe.

Koch, mission specialist for Artemis II, was shocked to see distinct yellow shades in the region; she likened the plateau to "a yellow snow-capped mountain," with sunlight-reflecting craters providing the bright "snow." She went on to call the region "a jaundiced cheek of the Moon."

"There are so many colors now," Glover, Artemis II's pilot, added while photographing the area. "There's also a green. I see brown, especially Aristarchus and north toward the north pole. … It kind of flows down from the north in brown streaks."

According to the report authors, these colorful hues "could be associated with orange (titanium-rich) and green (magnesium-rich) glass beads respectively," similar to volcanic glass beads collected by the Apollo 15 and 17 missions on separate parts of the moon.

"Chaos across the entire area"

Another colorful patch of the lunar surface that caught the crew's attention was Orientale Basin — a huge, young and multiringed impact crater that's about three times as wide as Massachusetts, according to NASA.

Straddling the moon's near and far sides, this massive bull's-eye is rarely visible from Earth, but it dominated the crewmembers' field of view as they orbited around the side of the moon.

"It has just created chaos across that entire area," Wiseman, commander for the mission, said at the time.

When flying over this sprawling basin, the crew noted gray, brown, tan and green below.

The largest, outermost ring in the basin contained "almost swamp-like colors," Koch reported, while Glover spotted what looked like "dusted peaks" and "white on the very edges of [the mountains], the spines, the ridgebacks."

Chains of craters parading away from the impact site looked "like bubbles rising from a team of scuba divers below," Koch added.

While these may sound like off-the-cuff observations, the Artemis II crew spent more than two years training to study and describe the moon's geology.

Their regimen included visiting craters on Earth, taking lessons individually and in classrooms, conducting simulated flybys and, according to the report, bringing "self-selected reference materials" into the Orion capsule to read on the way to the moon.

Thanks to this training, the crew's observations provided a wealth of scientific information that no autonomous camera or orbiter could, the report said.

"The Artemis II mission demonstrated the exceptional value of human observation and cognition as scientific assets in planetary exploration," the report authors concluded.

"Unlike cameras, which capture isolated moments and often narrow subsets of a scene, human observers continuously interpret their surroundings, integrating realtime visual perception with contextual understanding."

Or, to put that in Glover's more relatable words to mission control, "It's quite a wicked view."

I asked Trump why he thinks Mamdani can meet respectfully with him to find common ground, but Schumer and Jeffries cannot. “Because they suffer from Trump derangement syndrome,” he told me in a text message. “I have beaten them, at every level, too much.” Why does Mamdani not suffer from TDS? “Confidence in himself,” Trump told me. Imagine how different the past decade of American political life would have been if, after Trump was first elected, Schumer had declared: “I know Donald Trump well. We are both New Yorkers. Where we agree, I will be his ally in Congress. Where we disagree, I will try to change his mind. And where we can’t cut a deal, we will let the democratic process sort it out. But we will find common ground to get things done for the American people.”

Trump would have embraced Schumer just as he has Mamdani. Indeed, Trump reportedly called Schumer the morning after the 2016 election, offering to work with him. But instead of accepting Trump’s outstretched hand, Schumer and his Democratic colleagues shunned the new president — challenging the legitimacy of his victory by pushing the now-disproven conspiracy theory that he had colluded with Russia during the campaign.

Perhaps, as Trump suggests, Schumer did not have the confidence to buck his party’s Trump-deranged base. After Trump’s victory in 2016, the battle cry of the Democratic Party was “Resist!” Maybe he feared a left-wing primary if he cooperated with Trump. Whatever the reason, the strategy of unrelenting resistance and lawfare backfired — pushing Trump to the right in his first term and paving the way for his improbable return in 2024.

The Democrats’ Trump derangement has not abated in the years since. Just look at the response from the party’s base when Jeffries dared to meet with Jared Kushner, Trump’s son-in-law and adviser. If anything, it is Republicans who should have been angry about that meeting, which suggested the administration viewed a Democratic midterm victory as inevitable.

Democrats should have been elated. Instead, they lashed out at Jeffries. Longtime Democratic operative James Carville warned him that “you do not meet with them” and declared that his job was to “drag [Kushner’s] ass” before a congressional committee. Jeffries was forced to backtrack, declaring in a post on X that “no one from the Trump Cartel is getting a pass” and that as House speaker he would “hold the crooks accountable.”

In other words, Democrats appear to have learned nothing from their disastrous handling of Trump’s political rise. If they take power on Capitol Hill this November, expect them to resume their strategy of resistance — focusing on investigation and impeachment and pushing a radical left-wing agenda instead of the bipartisan compromise and cooperation that most Americans want but that seems to be anathema to their voters.

That approach has cost them the presidency twice. It won’t work any better the third time around.
