Money donated to build Obama library being sent on to politically charged Tides group

Millions of dollars sent to Barack Obama’s foundation has ended up being donated to a progressive fund that supported anti-Israel groups, accused of setting up encampments at Ivy League universities, according to public documents.

Donations to the Obama Foundation, set up by the former president to build a 19-acre campus including a museum, athletic facility and fruit and vegetable gardens in Chicago, totaling $2 million were instead sent on to Tides Foundation in 2022 and 2023, according to its latest available federal tax filings.

The cash was earmarked to “support local organizations that are working to reduce violence in communities,” according to the nonprofit’s filings.

Tides Foundation — also funded by Democratic mega-donor George Soros — is a network that operates as a fiscal sponsor for groups that have not registered with the IRS as charities.

The third-party grant-making group is under scrutiny by the House Ways and Means Committee for handling donations for anti-Israel groups such as the Adalah Justice Project, Samidoun and the People’s Forum. Such groups helped set up pro-Palestinian demonstrations and college encampments after the October 7, 2023, Hamas attacks on Israel that left 1,200 Israelis dead.

Tides has also handled donations for Black Lives Matter Global Network Foundation, which sued the group in California Superior Court last year. It alleged “egregious mismanagement” of more than $33 million in its funds, according to court documents. That lawsuit is ongoing.

In addition to sending donations to Tides, the Obama Foundation has sent more than $3 million in 2022 and 2023 in grants to Gofundme.org for undisclosed “grassroots leaders to empower girls through education,” according to the group’s filings.

Meanwhile, the foundation admitted it has so far spent more than $615 million building the Obama Presidential Center, which is scheduled to open in spring 2026, according to its website.

The group, which received just $129,320 in donations in 2022, spent more than $27 million on salaries.

Among the highest-paid board members are Valerie Jarrett, a former senior adviser to President Obama and CEO of the foundation, who raked in more than $750,000 in compensation in 2023.

Robbin Cohen, executive vice president of the Obama Presidential Center, took in nearly $650,000 in 2023, according to the tax filings. Cohen is a former president of the Pritzker Realty Group, founded by Penny Pritzker, a philanthropist who is also on the Obama Foundation board of directors. Pritzker, whose brother, JB Pritzker, is the governor of Illinois, does not draw a salary.

John Adams was watching from the back of the room when James Otis Jr. argued against British writs of assistance in 1761. These were general warrants giving royal officials unlimited authority to search colonial homes and businesses without naming what they were seeking. Adams later called it the first scene of the first act of American opposition to arbitrary government.

Otis lost the case, but he won something more durable: the Fourth Amendment is his argument, encoded into law.

The amendment’s language is deliberate: Persons, houses, papers, and effects are not to be searched or seized without a warrant based on probable cause, issued with particularity. The Founders chose the word “papers” in particular because correspondence, account books, and financial ledgers formed the infrastructure of private life that crown officials had been seizing through general warrants.

The protection that the framers wrote into our Constitution was not a general right to privacy. Rather, it was a specific warrant requirement for specific records — the same records that federal agencies can now reach through administrative subpoenas that require no judge’s signature.

This is because of two key and relatively recent Supreme Court decisions. U.S. v. Miller in 1976and Smith v. Maryland in 1979 replaced the Fourth Amendment’s requirement with a doctrine the Founders never intended. They established that information voluntarily shared with a third party loses Fourth Amendment protection.

In Miller, the court held that a bank depositor has no reasonable expectation of privacy in financial records conveyed to the bank. In Smith, the Court extended that reasoning to numbers dialed from one’s phone. In the digital economy, where every financial relationship runs through institutional intermediaries, the practical consequence is that you have surrendered to the government warrant-free access to your entire financial life.

The “voluntary” framing mischaracterizes the situation. Americans don’t have a choice of participating in a financial system that doesn’t require institutional intermediaries. No such system exists.

Lord Camden’s 1765 ruling in Entick v. Carrington established what the Founders codified: A document’s constitutional protection follows its owner, not its custodian. The third-party doctrine substitutes a theory of government access that the Fourth Amendment was written specifically to foreclose.

Riley v. California in 2014 and Carpenter v. United States in 2018 recently carved out exceptions. There are now warrant requirements for cell phones and historical location data. But both decisions explicitly preserved Miller and Smith. Financial records effectively remain outside the Fourth Amendment.

So your phone now carries more constitutional protection than your brokerage account or your tax returns. That’s not by constitutional design — that is five decades of judicial deference to a doctrine the text doesn’t support.

To add some contemporary relevance, consider the FBI’s Arctic Frost investigation, opened April 2022. It produced 197 subpoenas targeting at least 430 Republican organizations and individuals. It swept up phone metadata from nine sitting U.S. senators and one House member and resulted in the physical seizure of Rep. Scott Perry’s (R-Pa.) cell phone.

Verizon complied with Special Counsel Jack Smith’s subpoenas; AT&T refused and produced nothing. None of the metadata collection required a warrant because the third-party doctrine covered it.

Federal agencies are also purchasing financial and location data from commercial brokersdirectly— a parallel warrant-free channel that Arctic Frost used alongside its subpoena authority.

None of these reforms requires a constitutional amendment. All of them require Congress to treat the gap between the amendment’s text and its current enforcement as a problem worth closing.

I advise families with high net-worth. Without exception,their financial lives run through dozens of institutional third parties, which hold records carrying no meaningful Fourth Amendment protection from a properly formatted administrative demand.

But the Founders put “papers” in the Fourth Amendment because financial records were then and are now the infrastructure of private life. The warrant requirement is still in the text, and Congress still has the authority to restore it.

Hundreds of Scottish fans and others were spotted downtown Tuesday at local restaurants and packed pubs.

The Republicans agreed with Dumocrats to remove very fair, and talented, William Pulte, from serving as Acting DNI in return for getting FISA approved by the Dumocrats. However, the Republicans moved so fast with the hearings of the Great Jay Clayton, current U.S. Attorney for the Southern District of New York, that Pulte would be gone before the Dumocrats would vote on FISA. Now, the Dumocrats are saying they will vote against FISA — So, the Republicans wound up having fulfilled their commitment, but Dumocrats broke the Deal. In addition, the newly nominated U.S. Attorney, Jamie McDonald, must be confirmed and blue slipped. Because of the ridiculous views of Republicans on blue slipping (Dumocrats are often willing to nix it), I may not be able to get the extraordinary Sullivan & Cromwell Partner, Jamie, approved, and I don’t want to take Jay Clayton away from the great job he is doing until Jamie is in place. Trump kills plan to quickly confirm new intelligence chief

The early morning announcement paves the way for Bill Pulte to become acting director of national intelligence Friday.

President Donald Trump upended plans to quickly confirm a new director of national intelligence, announcing in an early morning post Wednesday that he did not want a scheduled hearing for Jay Clayton later in the day to move forward.

The move paves the way for close political ally Bill Pulte to move into the acting DNI role Friday, something members of both parties had been hoping to forestall by quickly confirming Clayton this week. It also throws a revival of a key surveillance power known as Section 702 in further doubt.

In the Truth Social post published just before 4 a.m., Trump claimed “Republicans fell into a trap” by rushing to confirm Clayton, the top federal prosecutor in Manhattan, and block Pulte — allowing a renewal of the spy law to move forward.

In addition to reiterating a demand that Republicans attach a GOP elections overhaul, the SAVE America Act, to any Section 702 extension, he demanded the Senate confirm his pick to replace Clayton as U.S. attorney, James McDonald, before allowing the permanent DNI nomination to move forward.

“Regarding the approval of our Great Patriot, Jay Clayton, we are cancelling the Senate Hearing RE: DNI today, and will not be going forward until Jamie McDonald is approved to be U.S. Attorney,” Trump, who is currently in France attending the G7 meeting, added. “In the meantime, Bill Pulte will remain as the Acting Director of National Intelligence.”

Trump cannot unilaterally cancel a Senate hearing, and Senate Intelligence Committee Chair Tom Cotton (R-Ark.) announced Wednesday morning that there was no immediate change in plans.

“Jay Clayton is a pending nominee before the Intelligence Committee,” he wrote on X. “We will proceed with his hearing as scheduled unless the president directs him not to appear or withdraws his nomination.”

But two White House officials who spoke on the condition of anonymity said Trump’s morning post directed Clayton to not appear and that he is expected to comply with the president’s wishes. Trump sent the post from France, where he is attending the annual G7 summit of global leaders.

Whether or not the hearing proceeds, the announcement is yet another finger in the eye of Senate Majority Leader John Thune, who has struggled to reconcile Trump’s demands with the wishes of his thin majority.

Some Senate Republicans, according to two additional people granted anonymity to speak candidly, believe Trump is mad over the GOP pushback against Pulte, who runs the Federal Housing Finance Agency and has no national security experience. He’s also being encouraged to continue pushing for the elections bill by Senate conservatives who have publicly crusaded for its passage.

Thune has repeatedly warned that the elections bills does not have to votes to pass the Senate and attaching it to the surveillance law would kill any chance of passage.

Trump has paid no heed to those warnings, insisting Wednesday that the two measures be linked.
