Slotkin seeks assurance DOJ has ended probe into 'seditious' military video, after grand jury loss
Updated: February 13, 2026 5:29pm
Michigan Democratic Sen. Elissa Slotkin's attorney sent a letter Thursday to the Justice Department, asking if it had concluded its probe into a video in which she participated and posted last year that urged members of the military to ignore "illegal" orders.
The question comes after the DOJ suffered a setback this week by failing to secure a federal grand jury indictment against the video participants. The 90-second video featured six prominent Democratic lawmakers who were either veterans or past members of the Intelligence Community.
Slotkin's lawyer, Preet Bharara, maintained his client did not commit a crime by creating the video, despite claims that it was "seditious," and asked Attorney General Pam Bondi and D.C. U.S. Attorney Jeanine Pirro whether the probe was closed.
"The grand jury has spoken, loudly, clearly, and unanimously," Bharara wrote in the letter. "The grand jury’s refusal to indict Senator Elissa Slotkin cannot have been a surprise. Members of the military have a duty not to follow unlawful orders, and reminding them of that duty is no crime. The only responsible course is to respect the grand jury’s decision and immediately close the investigation of Senator Slotkin.”
Bharara warned the department not to seek an indictment through a second grand jury, claiming doing so would violate "ethical duties and Justice Department policy," and said Slotkin would pursue defenses of vindictive prosecution if it did.
The letter also comes after a federal judge Thursday blocked War Secretary Pete Hegseth from punishing Navy veteran and Arizona Democratic Sen. Mark Kelly for his appearance in the "seditious" video, which Hegseth has vowed to appeal.
The letter requests an update on the investigation and confirmation of its closure by the end of Friday.
