BOOM! Stephen Miller’s America First Legal Drops Bombshell Lawsuit Against Chief Justice John Roberts

Stephen Miller’s America First Legal (AFL) has filed a bombshell lawsuit against Chief Justice John G. Roberts, Jr., in his capacity as Presiding Officer of the Judicial Conference of the United States, and Robert J. Conrad, Director of the Administrative Office of the U.S. Courts.

The lawsuit accuses the powerful duo of running what AFL describes as an “unconstitutional shadow agency” and violating federal transparency laws.

The lawsuit, filed on April 22, slams the Judicial Conference of the United States and its administrative arm—both overseen by Chief Justice Roberts—as rogue “executive agencies” that have collaborated with far-left lawmakers to wage lawfare against conservative Supreme Court justices.

According to the lawsuit viewed by The Gateway Pundit:

“For several years, the media and enterprising lawmakers have launched an onslaught to destroy the impartiality and political neutrality of Article III courts and, particularly, the Supreme Court. Justices Thomas, Alito, and Kavanaugh have all faced political and physical threats because of the politicization and weaponization of the law.

This lawfare has been led by Senator Sheldon Whitehouse and Representative Hank Johnson, relying upon an ideologically favorable legacy media to falsely accuse Justices Thomas and Alito of ethical improprieties. Their aim was simple: to chill the judicial independence of these Supreme Court Justices.”

According to the explosive complaint, the Judicial Conference and the Administrative Office of the U.S. Courts — long presumed exempt from the Freedom of Information Act (FOIA) — have functioned more like executive agencies rather than neutral arms of the judiciary.

AFL argues that these entities must comply with FOIA because they exercise “executive powers,” including responding to congressional oversight and issuing binding regulations — all under the direction of Roberts himself.

AFL’s lawsuit stems from its FOIA requests for communications between these agencies and Whitehouse and Johnson, two of the most vocal Democrat crusaders against conservative justices.

After the agencies flatly denied the requests, claiming FOIA doesn’t apply to them, AFL took them to court.

“The Judicial Conference and the Administrative Office are central levers for Senator Whitehouse and Representative Johnson’s lawfare enterprise. The Conference and the Administrative Office have actively accommodated oversight requests from these congressmen concerning their allegations against Justices Thomas and Alito.

Under our constitutional tradition, accommodations with Congress are the province of the executive branch. The Judicial Conference and the Administrative Office are therefore executive agencies. Such agencies must be overseen by the President, not the courts. Judicial relief here not only preserves the separation of powers but also keeps the courts out of politics.

Courts definitively do not create agencies to exercise functions beyond resolving cases or controversies or administratively supporting those functions. But the Administrative Office of the U.S. Courts does exactly that.

[…]

The Judicial Conference’s duties are executive functions and must be supervised by executive officers who are appointed and accountable to other executive officers.

Thus, the Judicial Conference and Administrative Office exercise executive functions and are accordingly subject to FOIA. Accordingly, their refusal to comply with AFL’s FOIA request is unlawful.”

The lab cools atoms to almost absolute zero, or minus 459 degrees Fahrenheit (minus 273 degrees Celsius). At this temperature, some atoms can form a Bose-Einstein condensate, a state of matter in which all atoms essentially share the same quantum identity.

As a result, some of the atoms’ typically microscopic quantum properties become macroscopic, making them easier to study.

Quantum properties can sometimes cause atoms to act like solid objects and sometimes like waves.

Scientists don’t yet entirely understand how the building blocks of matter can transition between such different physical behaviors, but they’re using quantum technology like what’s available on the Cold Atom Lab to seek answers.

In microgravity, Bose-Einstein condensates can reach colder temperatures and can exist for longer, giving scientists more opportunities to study them.

The atom interferometer is among several tools in the CAL facility enabling precision measurements by harnessing the quantum nature of atoms.

Due to its wave-like behavior, a single atom can simultaneously travel two physically separate paths. If gravity or other forces are acting on those waves, scientists can measure that influence by observing how the waves recombine and interact.

“I expect that space-based atom interferometry will lead to exciting new discoveries, fantastic quantum technologies impacting everyday life, and will transport us into a quantum future,” said Nick Bigelow, a professor at University of Rochester in New York and Cold Atom Lab principal investigator for a consortium of U.S. and German scientists who co-authored the studies cited above.

Lightweight and compact, MOSPA can accommodate up to 56 nano or micro satellites and position them in low Earth orbit simultaneously or sequentially in shared transport missions aboard small launchers, such as the Miura 5, a rocket currently being developed by PLD.

Manuel Serrano emphasised that the company's values are ‘governed by the pursuit of excellence and reliability in its products, by guaranteeing delivery times and by the agility to react in a timely manner to the demands of its customers.’

In short, OCCAM is committed ‘to efficiency and technological simplicity, which is reflected in the company's name itself.

It includes the AMIGO family, compact actuators that are a real alternative to pyrotechnic separation systems.

Small, reusable, self-configurable and non-explosive, they are used, for example, for the deployment of solar panels, antennas and nanosatellites.

She said one of her priorities for the remainder of the legislative session is the passage of HB166, or the Freeing our Classrooms of Unnecessary Screens for Safety Act.

The FOCUS Act would ban public K-12 students from using cellphones during the school day, as well as requiring students to receive instruction prior to the eighth grade on the “risks and benefits” of social media and requiring local school boards to adopt an internet safety policy for district-owned devices.

“The FOCUS Act should be a widely, widely supported bipartisan measure,” Ivey said. “When your legislators return to Montgomery tomorrow, I’m hoping we can get a floor vote and get this bill to my desk so I can sign it into law.”

Ivey emphasized the importance of public safety related bills to her recent legislative priorities, pointing to SB116, a bill passed into law in March which bans Glock “switch” conversion devices that allow handguns to fire fully-automatically.

She also highlighted SB115, or the Officer Impersonation Act, which expands the definition of impersonating a law officer to include an individual accepting a job as an officer when ineligible because of state law or because of a revoked or suspended certification from the Alabama Peace Officer’s Standards and Training Commission.

Impersonating an officer is a Class C felony punishable by up to 10 years in prison.

“While we still have work ahead of us in these three remaining days, we can certainly be proud of what we’ve accomplished already this session,” Ivey said.

“We are protecting Alabama values, we’re supporting our veterans, we’re finally providing long overdue paid parental leave for our state workers and teachers.”

The governor reported that since she took office, Alabama has seen $55 billion in investments leading to the creation of roughly 93,000 jobs.

“Alabama is experiencing great momentum, from here in Huntsville all the way down to the Gulf of America, and all of you play a big part in our success,” Ivey said.

Ivey said the Alabama Department of Workforce is ensuring potential investors in the state have access to a strong workforce.

“The Department will plan and implement critical elements of Alabama’s workforce development efforts to answer the number one question for the future of Alabama’s economy,” Ivey said, “and that question is if I’m an investor looking to invest and grow my business in Alabama, how can I be guaranteed a ready and well-trained workforce for the next five, ten or even 25 years.”

She thanked Greg Reed, who has been the secretary of the newly established department since it replaced the Alabama Department of Labor earlier this year.

Federal judge orders results of NC Supreme Court race to be certified

RALEIGH, N.C. (WTVD) – Disputed ballots in the still unresolved 2024 race for a North Carolina Supreme Court seat must remain in the final count, a federal judge ruled late Monday, a decision that if upheld would result in an electoral victory for Democratic incumbent Allison Riggs.

U.S. District Judge Richard Myers agreed with Riggs and others who argued it would be a violation of the U.S. Constitution to carry out recent decisions by state appeals courts that directed the removal of potentially thousands of voter ballots deemed ineligible. Myers wrote that votes couldn't be removed six months after Election Day without damaging due process and equal protection rights of the affected residents.

Myers also ordered the State Board of Elections to certify results that, after two recounts, showed Riggs the winner - by just 734 votes - over Republican challenger Jefferson Griffin. But the judge delayed his decision for seven days in case Griffin wants to appeal the ruling to the 4th U.S. Circuit Court of Appeals.

The board "must not proceed with implementation of the North Carolina Court of Appeals and Supreme Court's orders, and instead must certify the results of the election for (the seat) based on the tally at the completion of the canvassing period," wrote Myers, who was nominated to the bench by President Donald Trump.

More than 5.5 million ballots were cast in what has been the nation's last undecided race from November's general election. Griffin filed formal protests after the election in hopes that removing ballots he said were unlawfully cast would flip the outcome to him.

Griffin's legal team was reviewing Myers' order Monday night and evaluating the next steps, Griffin campaign spokesperson Paul Shumaker wrote in an email.

Riggs was more assured in her statement: "Today, we won. I'm proud to continue upholding the Constitution and the rule of law as North Carolina's Supreme Court Justice."

Griffin wanted Myers to leave undisturbed the state courts' decisions, which also directed that most of the voters with otherwise ineligible ballots get 30 days to provide identifying information for their race choices to remain in the tally.

Riggs, the state Democratic Party, and some affected voters said Griffin was trying to change the 2024 election outcome after the fact by removing ballots cast by voters who complied with voting rules as they were written last fall.

Myers wrote that Griffin's formal protests after the election, which were rejected by the State Board of Elections, constituted efforts to make retroactive changes to the voting laws that would arbitrarily disenfranchise only the voters who were targeted by Griffin. Griffin's challenges over photo ID only covered at most six Democratic-leaning counties in the state.

"You establish the rules before the game. You don't change them after the game is done," Myers wrote in a 68-page order.

"Permitting parties to 'upend the set rules' of an election after the election has taken place can only produce 'confusion and turmoil'" that "'threatens to undermine public confidence in the federal courts, state agencies, and the elections themselves,'" he added while citing other cases.

Democrats and voting rights groups raised alarms about Griffin's efforts.They called it an attack on democracythat would serve as a road map for the GOP to reverse future election results in other states.

The state Republican Party said Griffin was seeking to ensure that only legal votes are counted.
