i don't like J.D Vance. The 2024 U.S. presidential and congressional elections are scheduled to take place on November 5, 2024, with early in-person voting in some states beginning in September. Recent developments such as the advancement of artificial intelligence (AI) capabilities, the continued targeting of U.S. elections by foreign actors, and the increase in threats and harassment of election workers may elevate election interference as a subject of interest for Congress. For example, during New Hampshire’s 2024 presidential primary election, the New Hampshire Attorney General’s Office received complaints of a robocall allegedly using an AI “deepfake” to unlawfully interfere in the election by spreading misinformation in an attempt to suppress voting. Members of the House and Senate responded to this incident, stating that federal action is needed to respond to this type of interference.

Several federal laws (https://www.justice.gov/criminal/file/1029066/download) prohibit interference with voting or interference with registering to vote in a U.S. election. While this Legal Sidebar does not provide a comprehensive list of all crimes that may be relevant to an election, it does provide an overview of criminal laws that prohibit election interference targeting voters, focusing primarily on those used in recent federal prosecutions. Additionally, this Sidebar discusses Congress’s constitutional authority to regulate U.S. elections and also provides considerations for Congress. For an overview of federal criminal laws prohibiting threats and harassment of election workers, refer to this CRS Legal Sidebar.

Constitutional Authority over Elections

Article I, Section 4, cl. 1, of the U.S. Constitution, known as the Elections Clause, states, “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of [choosing] Senators.” While the states have primary responsibility for administering elections, the federal government maintains significant authority over elections, including safeguarding the safety and integrity of congressional elections.

A parallel constitutional provision addressing presidential elections, Article II, Section 1, cl. 4, provides that Congress may determine the “time” of choosing presidential electors and the day the electors shall cast their votes, with that day being the same throughout the United States. This clause does not delegate to the states any power to prescribe the time, place, and manner of electors casting votes in a presidential election. The Supreme Court has held that “[t]he importance of [the presidential] election and the vital character of its relationship to and effect upon the welfare and safety of the whole people cannot be too strongly stated” and that “Congress, undoubtedly, possesses that power … to preserve the … institutions of the general government from impairment or destruction…. ” Congress, exercising its authority under this provision, has enacted legislation establishing an Election Day. The power to appoint electors and how those appointments are made, however, belongs to the states under Article II, Section 1, cl. 2.

Congress does not have general regulatory authority over state and local elections, but it may still exercise its power over such entities in several contexts. For example, Congress has the authority to prevent unconstitutional voting discrimination in a state or local election. Congress’s authority to legislate regarding these various issues derives, in addition to its Article I powers, principally from the Fourteenth and Fifteenth Amendments. Furthermore, relying on its Spending Clause authority under Article I, Congress might also condition the receipt of federal funds for state or local elections on compliance with federal requirements.

Donald Trump Supporters Flipping to Kamala Harris: New Poll

Vice President Kamala Harris is winning oversomeof former President Donald Trump's supporters, according to a new CNN poll.

Harris is viewed as the front-runner to win the Democratic presidential nomination after President Joe Biden withdrew from the race over the weekend, following weeks of pressure from Democrats concerned about his ability to win in November and polls showing him behind Trump in key battleground states.

With Biden's endorsement, Democrats quickly rallied around Harris, who has appeared to secure enough delegates to officially become the nominee at the Democratic National Convention next month.

Harris, like Biden, has trailed Trump in the polls for months.But her supporters argue she is more capableof running a robust campaign that could win over swing voters while increasing the already mounting Democratic enthusiasm for the race. Several new polls this week suggest a tight race between Harris and Trump and that Harrismay already bepulling stronger numbers than Biden.

A CNN poll released on Wednesday found that Harris is gaining some of Trump's supporters,though the former president continues to hold a lead overall.

Thepoll showed Harris trailingthe former president by three points (49 percent to 46 percent).

Still, thepoll found that 95 percent of Biden's supporters(maybe because we make up numbers all the time) are continuing to stick with Harris, while she is winning over 5 percent of Trump's former supporters.(No fucking way, once with Trump, always with Trump)

Trump is winning over a smaller number of Biden's supporters, according to the poll.Three percent of those who previously backed Biden are now supporting Trump, who retained 92 percent of his past supporters.

Harris is winning 94 percent of Democrats, while Trump is winning 91 percent of Republicans. (Make this clear, not 94% dems, 94% of dems that voted Bidan, but that’s highly doubtful also and Bidan approval rating was down to 36%, whereas it was at 65-70% in 2020, so kamala only has about 1/2 of all Bidan 2020 voters, “or ballots”) However, he continues to hold a narrow lead among independent voters (46 percent to 43 percent).

A June CNN poll found Trump leading Harris by 2 points (47 percent to 45 percent) and Biden by 6 points (49 percent to 43 percent). That poll surveyed 1,274 registered voters from June 28 to June 30, the days following the presidential debate that sparked concerns about Biden's ability to win the race.

Several other polls have shown a tight race after Biden dropped out.

A Reuters/Ipsos poll, conducted from July 22 to 23 among 1,018 registered voters, found Harris leading Trump by 2 points (44 percent to 42 percent) in a head-to-head matchup. With other candidates included, she led by 4 points (42 percent to 38 percent).

A Marist College poll, conducted among 1,117 registered voters on July 22, found Trump leading by one point (46 percent to 45 percent), but found the race was even with other candidates included. Harris and Trump each received 42 percent support in that case.
