Hotel quarantine inquiry seeks explanation from Brett Sutton after emails contradict his evidence on use of private security firms

Victoria's COVID-19 Hotel Quarantine Inquiry has asked Chief Health Officer Brett Sutton to provide another statement to the board after a series of emails contradicted his evidence.

In an extraordinary sitting this afternoon, counsel assisting Tony Neal QC told the chair of the probe that it had received a series of emails and was seeking more documents from the Department of Health and Human Services (DHHS) which better indicated when Professor Sutton knew of the decision to use private security at the hotels.

Professor Sutton claimed in evidence at the inquiry that he was not aware of private security's involvement in the program until he read it in "media reports" in May.

But in a chain of emails tendered to the inquiry today, senior public health bureaucrat Braeden Hogan told Professor Sutton of private security's use on March 27.

"Private security has been contracted to provide security at the hotels with escalation agreements to vic pol (Victoria Police) as needed, " he wrote to Professor Sutton and several other senior health and government officials.

Professor Sutton responded: "Thanks so much Braeden."

Mr Neal said the emails were relevant as they pointed "to the time at which Professor Sutton had knowledge of private security in the hotel program," but stated he was not implying that the inquiry had been misled.

"[There is] no basis for inferring or speculating that any view has been formed about the veracity or otherwise," he said.

DHHS told the inquiry it did not offer up the documents earlier because it did not consider them relevant and was working to a tight timeframe.

The chair of the board of inquiry, Jennifer Coate, said the revelations could mean the reporting date of November 6 would need to be pushed back.

"Most unfortunately these new developments may unsettle the due date of the report, but I am unable to be clear about that at this stage," she said.

"If the report date is affected and needs to be extended I will advise the Premier and seek any necessary extension."

Department of Premier and Cabinet also asked to provide more information

Mr Neal said as well as Professor Sutton, many other people had been asked to provide more documents and affidavits on "two discreet developments" that had arisen after the inquiry's hearings closed.

Mr Neal said despite evidence provided in the inquiry that indicated Graham Ashton had not spoken to Department of Premier and Cabinet secretary Chris Eccles, the two had in fact spoken at a key point in time.

"Mr Eccles's telephone records show, indeed, he telephoned Mr Ashton at 1:17pm on March 27 in a call that lasted 135 seconds," Mr Neal said.

"Having obtained this further information, the inquiry team requested certain parties to provide further answers on affidavit to questions directed to the issue of the decision to engage private security contractors in the hotel quarantine program and to provide further documents related to that issue."

Mr Eccles resigned after the inquiry sought his phone records last week.

A Jewish pediatrician who was convicted of possessing and distributing some 190,000 child pornography videos and images can serve as a medical supervisor at the Health Ministry’s student health services department, an Israeli court ruled last week:

"Avraham Barkai will be able to pay visits to schools but not treat children in his new position, which a panel of judges at the Nazareth Regional Labor Court determined that he should be allowed to fill, going against the recommendation of the Civil Service Commission.

Barkai was convicted in 2011 of being part of an international child pornography distribution ring and later sentenced to 18 months behind bars. However, the punishment was reduced on appeal to six months of community service, a nine-month suspended sentence and a NIS 20,000 ($5,690) fine.

For over a year up to his conviction, but after he had already been charged, Barkai continued to practice at a Haifa clinic of the Meuhedet HMO after a Health Ministry disciplinary committee ruled that he could continue to see children as long as a parent or nurse was in the room.

The disciplinary committee went on to rule that despite the charges, Barkai did not pose a danger to children as he had not been accused of physical acts against minors. As a result, it ruled that the pediatrician’s license should only be stripped for two years, and by July 2013 Barkai got his license back….

However, senior officials in the Health Ministry have come to Barkai’s defense. In 2014, the Health Ministry’s senior vice president of Administration and Human Resources, Dov Passat, submitted a letter to the disciplinary committee asserting that there should be nothing preventing Barkai from applying for tenders for positions as a pediatrician. The letter was submitted by Barkai as an official position of the Health Ministry to the Petah Tivka Magistrate’s Court, which ruled in 2018 that he be granted an exemption from the ban on employing convicted sex offenders as he does not pose a risk to the public, even if he works as a pediatrician.

In late 2018, a medical board voted unanimously to award Barkai a position as medical supervisor at the Health Ministry’s student health services department in the northern district. The Civil Service Commission subsequently interfered and blocked the appointment, stating in a 2019 hearing that “while the job at hand does not require clinical care for children, its core is oversight of student services and some of its assignments take place on school grounds and during the school day… Taking into account the nature of the offenses of which Dr. Barkai was convicted, [granting him this position] can greatly damage the image of the Civil Service Commission and the public’s confidence in its institutions.” "

I was at an embassy function recently and listened to speeches on what we must do with North Korea. There was talk of goodwill and engagement and warm, empty gestures. It upset me.

Canadians share a kind of naïvety about this world; we shrink from frank discussion of human rights for fear of hurting people’s feelings, and prefer sanitized talk about trade rather than prison camps.

For me, this is a bitter pill. I know how communists work. My family fled Vietnam in 1975 and has never returned.

We lived in Saigon; my father worked for the Ministry of Foreign Affairs. I followed in his footsteps and worked in the department. I was young then, fresh from school after graduating from the Sorbonne in Paris. My parents did not belong to any political party.

When my country fell in ‘75 I was working as a press attaché at the Vietnamese embassy in Bangkok. To return home would have brought instant arrest; communists hated diplomats second only to South Vietnamese army officers. I was stateless, but managed to find my way to Canada.

I knew friends and colleagues who could not escape. They were not tortured right away. First they were instructed to report to a certain office; then they were sent to “re-education” camps to “retool” their thinking; then they were imprisoned, in chains.

Some survived; a few escaped. One colleague was tortured so badly he can barely walk to this day. Others hid in the villages and tried to erase their past. I lost contact with many of my friends after 1975.

Vietnam, China, North Korea: all have labour camps. All abuse human rights and rule of law. Perhaps these realities are too raw for Canadians. Instead, we presume common interests and points of goodwill that do not really exist. These are not normal societies as you and I know them; normal gestures are pointless.

Governments promote trade with communist countries, but there is no evidence this diminishes the power of police states or has ever closed a single prison camp. They fill their pockets with dollars, and we fill our marketplace with goods made by cheap labour – 50¢ an hour compared to ten or twenty dollars in Canada.
