Chinese regulators summon Evergrande execs, warn on debt risks

China’s central bank said it summoned executives of the country’s most indebted property developer, China Evergrande Group, to talks on Thursday and issued a rare warning that the company needs to reduce its debt risks and prioritise stability.

The unusual summons comes amid fragile confidence in China’s credit markets and concern that any financial crisis at Evergrande could pose a systemic risk as the company struggles to find the cash it needs to pay its lenders. It also comes days after President Xi Jinping highlighted efforts to forestall major financial risks and as a flurry of regulatory crackdowns roil China’s equity markets. Evergrande had no immediate response, although it has been pursing asset sales, with Reuters reporting here on Thursday of efforts to offload part of its electric vehicle business. “The meeting shows Evergrande poses systemic risks. Its massive debt threatens financial stability,” said Rocky Fan, economist at Sealand Securities. “On the other hand, it shows Evergrande has the means to solve its problem, and regulators are pressing it to do more,” he added.

The move did not appear to flag a bailout of the kind announced hours earlier by another troubled borrower, China Huarong Asset Management Co Ltd. Evergrande must “actively diffuse debt risk and maintain real estate and financial markets stability,” said the People’s Bank of China and China’s banking regulator, the China Banking and Insurance Regulatory Commission, in a joint statement. “Evergrande, as a top real estate company, must earnestly implement strategic arrangements made by the central government to ensure the stable and healthy development of the real estate market, and strive to keep operations stable,” they said. Evergrande has more than 240 billion yuan ($37 billion) of bills and trade payables from contractors to settle over the next 12 months, according to ratings agency S&P Global.

Concern over the developer’s financial health intensified in June when it failed to pay some commercial paper on time.

Its bonds carry junk ratings from S&P, Moody’s and Fitch, all of whom recently issued downgrades, and its troubles have sent jitters through China’s entire junk-debt market at a time when corporate credit is rallying in the rest of the world.

The regulators’ statement said senior Evergrande executives were summoned for talks and urged the company to abide by disclosure rules and clarify market rumours promptly. Such summons’ are unusual, though were recently issued to Ant Financial both before and after its ultimately scuppered stock market listing in November. At least one bond investor said the move could mean Evergrande is on the verge of a default that would reverberate through the banking system. “This is what worries regulators the most,” said the fund manager, who declined to be named as he is not authorised to speak to the media.

The regulators’ statement was published after market hours. Evergrande stocks and bonds have been heavily sold for months amid fears it may not be able to meet repayments, with its share price hitting an almost five-year low in Hong Kong on Thursday.

BofA Italy Gets Record Patents as Lender Focuses on Machine Learning

Inventors at Bank of America Corp. kept originating ideas, leading to a record-setting first half of the year, even while continuing to work from home.

The U.S. Patent and Trademark Office granted the lender 227 patents in the first six months of 2021, up 23% from a year earlier, Bank of America said in a statement Thursday. The Charlotte, North Carolina-based company set its previous patent record in the first half of last year, when it was granted 184 amid the early days of the coronavirus pandemic.

“We’re in a period of unprecedented change, and as any great company knows, delivering for customers and clients requires a strong focus on innovation,” Cathy Bessant, the company’s chief operations and technology officer, said in the statement. “The culture we’ve created at Bank of America is immensely creative and forward-looking.” Bessant leads a technology team at Bank of America with a $14 billion budget. The company spends $10 billion of that on technology each year, $3 billion of which is set aside for new innovations, according to a spokesperson for the bank. For 2021, Chief Executive Officer Brian Moynihan increased the new-initiative budget to $3.4 billion.

About 40% the patents granted to Bank of America in the first half of the year relate to artificial intelligence or machine learning. The firm also pursued new technology related to blockchain, payment technology and data mining and analytics. The bank said it applied for a total of 722 patents last year, despite 85% of employees working from home during the pandemic, and was granted a record 444. One of Bank of America’s inventors, Manu Kurian, has filed more than 360 patents since 2014. A senior vice president in the firm’s global banking technology division, Kurian ranks among the top 300 patent holders in the world, with more than 220 granted to date. During the pandemic, “the team was able to grow the interaction with our clients to become more digital, while maintaining the high-touch experience,” Kurian said in an interview. He develops patents related to data and optimization, connecting clients across key segments of the bank. “We always had continuous improvement, but there has been more integration.”

The bank has received or applied for a total of 4,943 patents, stemming from the work of almost 6,000 inventors in 42 U.S. states and 13 countries. Its patents are often cited by other inventors, Bank of America said, with more than 2,800 patents and applications from a range of industries, including technology, citing the lender’s patents so far this year.

Democrats and Republicans are right to blame each other for the fall of Kabul. It’s a loss for America’s bipartisan foreign policy establishment as a whole. For nearly two decades Washington sent thousands of Americans to their deaths and spent trillions of taxpayer dollars to wage a strategically pointless war. And because both sides of the political divide should be held accountable, military as well as civilian officials, too, it is unlikely that anyone ever will be. Since everyone is to blame, holding anyone accountable implicates everyone.

The reality is that America lost its war in Afghanistan more than a decade ago, roughly around the time when CIA officers began bribing aging warlords with Viagra. The Americans knew all about the young boys the tribal leaders kept in their camps; because the sex drug helped Afghan elders rape more boys more often, they were beholden to America’s clandestine service. Losing Afghanistan then is the least of it. When you choose to adopt a foreign cohort’s cultural habits, customs for which the elders of your own tribe would ostracize and perhaps kill you, you have lost your civilization.

Yet military strategists, political pundits, foreign correspondents, and even historians will spend the next several decades wondering how a gang of rough Pashtun tribesmen galvanized by a fundamentalist version of Islam managed to defeat the most advanced military in the world. And that’s precisely the point: The problem with the American establishment is not simply that after 20 years in Afghanistan it did not understand the country or foresee what its opponents were likely to do after withdrawing forces. More importantly, our ruling class is so alienated from its own roots that it no longer understands the character of the country it purports to lead, and what makes it different, even exceptional. The evidence is that our elites sought to graft the effects of a civilization built by and for its own people—democracy, a military and police force, girls’ schools, etc.—onto a primitive society that had to be bribed to accept what we were offering.

There is no mystery about why the U.S. experience in Afghanistan ended in failure, embarrassment, and scandal. Nor is it a mystery why the Taliban took over Kabul so quickly. They were fighting for primacy. Their victory was foreordained.

The medieval Arab historian Ibn Khaldun explains the dynamic in his 14th-century masterwork, Al Muqaddima. History, he shows, is a repetition of the same pattern seen throughout the ages—a group of nomadic tribesmen overturn an existing sedentary culture, a civilization that has become weak and luxurious. What drives the success of the rising tribe is its group solidarity, or assabiya. Its awareness of itself as a coherent people with a drive for primacy is frequently augmented by religious ideology. The stronger the tribe’s assabiya, the stronger the group. Assimilating the conquered by imposing its will and worldview on them, the victor lays the foundations of a new civilization. But since, as Ibn Khaldun writes, “the goal of civilization is sedentary culture and luxury,” all groups carry the seeds of their own demise.

And so the struggle begins anew.

Maricopa County Responds To Attorney General’s Office – Requests “No Further Action” Be Taken

On August 6, Arizona Attorney General Mark Brnovich began an investigation into Maricopa County’s noncompliance with legislative subpoenas.

The Arizona Senate has subpoenaed the County multiple times with ongoing noncompliance. The materials requested are necessary to finish the full forensic audit of Maricopa County’s 2020 election.

Arizona State Senator Sonny Borrelli requested AG Brnovich to investigate the County’s noncompliance with the legal and enforceable subpoenas.

In a notice to Maricopa County, the Attorney General’s office requested a written response by Friday, August 20.

Maricopa County responded yesterday, claiming innocence and asking the Attorney General to take no further action.

On behalf of the Maricopa County Board of Supervisors (“MCBOS”), we respond to your letter dated August 6, 2021 regarding Senator Sonny Borrelli’s Request for Investigation (the “Request”) as to MCBOS’ alleged “failure to comply with valid and enforceable legislative subpoenas that originated from the AZ State Senate.” [Request, Exhibit A]. Specifically, Senator Borrelli claims that MCBOS is acting in conflict with A.R.S. §§ 41-1151, 1153-54 and 16-624 [see Ex. 1 at 1] by failing to produce certain documents and electronic materials requested in a legislative subpoena issued on July 26, 2021 (the “Subpoena”). [Ex. A at Attachment; see also Subpoena, Exhibit B].

The allegations in the Request are without merit. The Senate’s authority to enforce the Subpoena through its statutory contempt powers expired on June 30, 2021 with the adjournment of the legislative session. Accordingly, any action taken by MCBOS in relation to the Subpoena did not “violate[] state law or the Constitution of Arizona,” and we respectfully ask that your Office “take no further action” regarding the Request. A.R.S. § 41-194.01(A), (B)(3).1

On August 2, 2021, MCBOS provided written responses and objections to the Subpoena (the “Objection”). [Objection, Exhibit C].3 In pertinent part, the Objection advises that: (i) MCBOS “has already produced every responsive record in its custody and control” relating to Request No. 3, and it does not possess any passwords to access the ballot tabulation devices used in connection with the general election [see Ex. C at 2]; and (ii) in lieu of producing its routers (which would put sensitive, confidential data at risk, render law enforcement vulnerable to hackers, and disrupt operations costing millions of dollars), MCBOS has already provided numerous items in satisfaction of Request Nos. 5 and 6—i.e., windows event logs, precinct-based tabulator logs, central count tabulator logs, election management system workstations, sever logs, and all of the election tabulation equipment used in the general election—which sufficiently enable the Senates’ auditor to determine whether the tabulation equipment connected to the internet at any point during the election. [Id. at 3].
