Two Ex-Bank of America Traders Accused of Spoofing Found Guilty

Two former Bank of America Corp. traders were convicted Wednesday of rigging precious-metals prices by using an aggressive tactic known as spoofing, the latest win for prosecutors in a yearslong effort to crack down on the practice.

A federal jury found Edward Bases and John Pacilio guilty of wire fraud and conspiracy charges after a two-week criminal trial in Chicago. The proceeding was a test of prosecutors’ efforts to punish spoofing activity that predated a law defining the tactic and making it illegal. Prosecutors argued that trading by Messrs. Bases and Pacilio on futures exchanges operated by CME Group Inc. was deceptive, allowing the government to charge the conduct as fraud. Lawyers for the defendants argued that their style of trading was allowed before the 2010 Dodd-Frank financial overhaul law prohibited spoofing. Spoofing involves sending deceptive orders that can mislead traders into thinking supply and demand have changed, according to regulators and prosecutors. The mirage, which some traders and attorneys argue is lawful bluffing, can move prices in a direction desired by the spoofer, while causing their counterparties to lose money.

Prosecutors argued that Messrs. Bases and Pacilio used spoofing to gain an illicit advantage from 2008 to 2014. The law defining and making spoofing illegal took effect in 2011, after most of the alleged activity had occurred.

National Hurricane Center tracking three tropical waves

The tropical Atlantic is starting to become more active after a few weeks off.

The National Hurricane Center is tracking three tropical waves as of Wednesday morning, and two of them have the potential to develop into something more.

Newest to the board is a tropical wave in the central Atlantic located roughly halfway between the Lesser Antilles and the west coast of Africa.

It has generated a wide area of rain and storms but didn’t appear organized as of Wednesday morning, the hurricane center said.

There is a chance it could slowly develop late this weekend and into early next week when it tracks east of the Lesser Antilles.

It has a 20 percent chance of becoming a tropical depression in the next five days.

A second wave has a 30 percent chance of becoming a depression but is farther away. The hurricane center expects it to move off the west coast of Africa and into the eastern Atlantic late Thursday.

It will have more favorable conditions and could develop slowly as it heads westward about 15 mph, the hurricane center said.

A third tropical wave, located in the eastern Atlantic, has zero chance of development as of Wednesday but could bring heavy rain and gusty winds to parts of the Cabo Verde Islands today.

The tropical Atlantic has been quiet since the demise of Elsa on July 9. Elsa was briefly a hurricane and made landfall as a tropical storm in the Big Bend area of Florida on July 7.

There have been four other named storms so far.

NOAA plans to update its hurricane outlook for the Atlantic later today.

The first outlook, issued in late May, suggested there could be 13 to 20 named storms, six to 10 hurricanes and three to five major hurricanes.

An average season, according to NOAA, has 14 named storms, seven hurricanes and three major hurricanes.

The hurricane season comes to an official end on Nov. 30.

River Fire Erupts in Nevada and Placer Counties, Threatening Homes

A wildfire that broke out near the border between Nevada and Placer counties Wednesday afternoon quickly grew to 100 acres and was threatening houses, according to authorities. The fire — identified as the River Fire by Cal Fire — started just after 2 p.m. off Milk Ranch Road and Bear River Campground Road just north of Applegate. In the short time between when it was first reported by Cal Fire and the latest update, it’s size jumped from 45 acres to 100 acres. It is currently zero percent contained.

The Cal Fire Nevada Yuba Placer unit tweeted video and said the incident commander has requested support for structure defense due to the immediate threat to homes in the area.

The Modular Airborne Fire Fighting System, or MAFFS, Program provides emergency capability to supplement existing commercial tanker support on wildland fires. MAFFS aids the U.S. Department of Agriculture's Forest Service. When all other air tankers are activated but further assistance is needed, the Forest Service can request help from the Air Force's MAFFS units. MAFFS is a mission that highlights interagency cooperation. MAFFS units fit inside C-130 airplanes without requiring structural modification. This allows the units to be loaded on short notice. It takes about two hours to load a MAFFS unit onto the C-130. The C-130s drop retardant from an altitude of about 150 feet through a discharge tube located in place of the left rear paratroop door of the aircraft. A MAFFS unit can discharge its load 3,000 gallons weighing 28,000 pounds in less than five seconds. The retardant covers an area one-quarter of a mile long and 60 feet wide. After the plane discharges its load, and returns to an air tanker base, it can be refilled and airborne again in less than 20 minutes.

MAFFS units can drop either water or retardant called "slurry." Slurry is made of 80 to 85 percent water, 10 to 15 percent ammonium sulfate, a jelling agent and red coloring. The red in the retardant helps pilots see where they have dropped previous loads. Along with retarding the fire, the slurry acts as a fertilizer. Because the MAFFS discharges the agent in a mist, slurry does not cause damage to buildings.

Hidden on Page 508 of the Infrastructure Bill Is a Plan to Make It Too Expensive to Drive a Car

The cost of living is on the rise, calls for yet another wave of pandemic restrictions have begun and now, buried deep in the so-called bipartisan infrastructure bill, the left has laid out yet another idea to bring Americans to their knees.

Make no mistake: The suffering is intentional, goal-oriented and not bound to stop anytime soon.

Still, one proposal in the 2,702 page infrastructure bill seems especially cruel — cruel enough to make it too expensive for many Americans to even drive a car.

Nick Short of the Claremont Institute highlighted an item on Pages 508-519 of the bill that would introduce a national per-mile motor vehicle user fee on a trial basis.

“Buried on page 508 of the 2,702 page infrastructure bill is a pilot program for a national motor vehicle per-mile user fee (MBUF) which is basically a long-term plan to make it too expensive to drive a car,” Short said Tuesday on Twitter.

The pilot program is set up “to test the design, acceptance, implementation, and financial sustainability of a national motor vehicle per-mile user fee, to address the need for additional revenue for surface transportation infrastructure and a national motor vehicle per-mile user fee” and “to provide recommendations relating to the adoption and implementation of a national motor vehicle per-mile user fee,” the bill says.

An article from The Lid Blog attached to Short’s tweet detailed the proposal even further, breaking down each component, from the program’s objectives to its proposal that “volunteers” from each state should discover different ways to collect data on miles driven by “both commercial and private vehicle operators.”

On Page 513, the proposal says that the “Secretary of the Treasury shall establish, on an annual basis, per-mile user fees for passenger motor vehicles, light trucks, and medium- and heavy-duty trucks.”

In theory, these per-mile user fees would vary by vehicle contingent upon several factors, including — you guessed it — environmental impact.

To ease any apprehension about participating in the pilot program, the measure indicates that participants’ identities will be protected, perhaps, as The Lid said, to prevent ostracization “if this happens and achieves the desired result.”

The left can chalk up this test run of what eventually might turn into a full-blown measure to make owning a vehicle next-to-impossible as an effort to be “environmentally conscious,” but is it instead another way to cripple our existing ways of life?

We might dismiss it now, but imagine telling yourself five years ago that the government would order small business closures, codify when and how Americans could worship and adopt an increasingly draconian “do as I say, not as I do” policy to address a global pandemic.

Tesla Inc. Chairman Robyn Denholm sold 31,250 shares of the electric-vehicle maker for more than $22 million, according to a regulatory filing late Wednesday.

Denholm, who recently testified in a Delaware court as part of a shareholder lawsuit over Tesla’s controversial 2016 acquisition of SolarCity, has served on Tesla’s board since August 2014. She became chair in November 2018 after Chief Executive Officer Elon Musk was forced to relinquish the role as part of his settlement agreement with the U.S. Securities and Exchange Commission. The SEC agreement, announced in September of 2018, required Musk to step down from the role and be replaced by an independent chairman for three years.

Those three years are almost up, meaning that Musk could potentially resume the role. Tesla has yet to file its proxy for the 2021 shareholder meeting.

Denholm lives in Australia and was previously the chief financial officer at Australian telecoms company Telstra Corp. The filing Wednesday shows she exercised options to purchase the shares, paying the required strike prices, then subsequently sold the stock.
