Threading the Needle

Pilots flying in mountainous areas should receive training in mountain flying operations prior to attempting such flights.
The pilot of a Cessna 182J learned this lesson when attempting to land at a private airport outside of Gold Beach, Oregon on September 9, 2001.
The night prior to the accident,
the pilot and his pilot passenger reviewed a magazine article discussing the Half Moon Bar Lodge and the visual approach to its private airstrip.
According to accident report,
"The normal approach circles a 1,614-foot conical peak just south of the airstrip. The approach is started by flying through a 980 foot saddle northwest of the peak.
Once clear of the saddle, the turn is southbound to follow a canyon, descending to and following the Rogue River,
circling the conical peak counter-clockwise. The canyon narrows to about 250 feet wide at 100 feet AGL and narrows to 100 feet wide at river level.
The first sight of the threshold to the airstrip is about 1,500 feet away and clearly seen about 900 feet away."
During the right turn to the final approach the left wing was at the tree line, and the pilot felt that he was "really tight" as he descended.
As he descended below the tree line, on short final, the pilot over-banked to the right avoiding trees on the left.
This turn put the aircraft on a collision course with the trees on the right.
The pilot applied full power to attempt a climb, but the aircraft stalled and descended into the trees.
The pilot sustained minor injuries, however the passenger was ejected from the airplane and killed.
Rescuers noted that the passenger was not wearing his seat belt.
The magazine article clearly stated this was a difficult mountain approach and recommended that only experienced mountain pilots attempt it.
At the time of the accident, the private pilot had 327 total flight hours, with eight in the accident make and model.
He also had limited mountain flying experience.
According to the NTSB, the causes of this accident were the pilot's failure to attain the proper alignment while on final approach and maintain clearance from the trees.
A factor in the accident was the pilot's lack of flight experience in this type of mountain flying operation.

With crypto platforms going bankrupt and investors unable to withdraw funds from some crypto outfits, Senator Elizabeth Warren (D-MA) is calling on the Securities & Exchange Commission (SEC) to act. “Congress needs to act, but the SEC has a responsibility to use its authorities to put guardrails in place and crack down on crypto actors that break the rules,” Senator Warren told Yahoo Finance.

Under Gensler’s leadership, the SEC has been reluctant to propose rules to regulate crypto or apply existing securities laws. A lobbyist speaking on a condition of anonymity says it seem much of the agenda at the SEC is coming from the chair’s office while career folks at agency aren’t playing the role they have historically. More enforcement action is expected, according to one crypto industry lobbyist, who also says a significant amount of the crypto industry is afraid to proactively engage with the SEC over fears of enforcement actions.
When asked by Yahoo Finance in an interview on Thursday why the SEC hasn’t acted more aggressively to write rules to protect investors, Chair Gensler said he rejected the premise.
“We have rules in place for what it means to be an investment company, like a mutual fund, when you put your money in,” said Gensler.

Gensler also pointed to enforcement actions the Commission has taken against crypto firms that violated securities laws, specifically, crypto company BlockFi. Two bankruptcies in three weeks. Cryptocurrency investors are learning there’s no government safety net to protect them when funds disappear on a failed crypto platform. Customers of at least two crypto lenders — Celsius Network and Canada’s Voyager — have lost money and access to their accounts after both firms failed following the plunge in crypto markets. Voyager filed for bankruptcy earlier this month after crypto hedge fund Three Arrows Capital was unable to pay back a loan to the crypto lender. Late last week, Celsius filed for bankruptcy protection as well. Lawyers say the SEC is awaiting the outcome of a case from crypto firm Ripple — which the agency is hopeful it will win — to set precedent for crypto rule making while giving the agency more ammunition to regulate crypto tokens as securities. The SEC has charged Ripple for violating securities laws when it sold its token XRP without registering with the commission to finance its platform, thereby selling an illegal and unregistered security. Ripple has challenged the charges in an ongoing court case. (Ripple was also heavily used and seed money given by the Clinton Foundation a bird told me a few years ago.)
