TheFBI opened 1,200 probesrelated to politicians, journalists, religious leaders, academics and others tiedto “sensitive investigative matters,” using a special investigative tool that requires no factual predicate to launch, according to a Government Accountability Office report.

The GAO report, which was obtained by Just the News,was published last month but not made public, and it was titledFBI Investigative Activities: Oversight Efforts of Opening and Conducting Assessments Should be Strengthened.

The report, which assists in congressional oversight of the executive branch,provided details on the roughly 127,000 FBI "assessments" in all opened from 2018 to 2024, the vast majority of which were eventually closed without accusations of wrongdoing or criminal charges against those targets being scrutinized.

The 57-pagereport did not include any names of those targeted for assessment.

Among thetotal assessments, 1,200 were related to "sensitive investigative matters" that target public officials, news organizations, houses of worship or members of academia, which the bureau views as more sensitive in nature.

So-called "assessments" were established by Justice Department guidelines in 2008, providing the FBI with an investigative tool short of opening a full-fledged investigation requiring a factual predicate.

The probesare used by the bureau to "address a potential threat to national security or potential violation of federal criminal law," the congressional watchdog said. They allow FBI agents to open probes on authorized mattersbut without a factual basisand allow them to employ investigative such techniques as physical surveillance on subjects.

If sufficient basis is found,assessments can turn into preliminary investigations, full investigations or enterprise investigations. But most assessments are closed without meeting the standards for a full inquiry by the bureau, the GAO said.

The revelations were detailed in the GAO's January 2026 report,which was designated "For Official Use Only" because of the sensitive information it contains.GAO noted that the report should be "safeguarded when not being used and destroyed when no longer needed."

The categories include “domestic public officials or domestic political candidates(involving corruption or a threat to national security),religious or domestic political organizations or an individual prominentin such organizations, thenews media, an investigativematter with an academic nexus, or any other matter which, in the judgment of the official authorizing the assessment, should be brought to the attention of FBI headquarters and other DOJ officials.”

Assessments designated as a SIM have additional review and approval requirements before they can be opened or continued, the GAO said.

Over 500 SIM assessments in that roughly seven-year period were aimed at “public officials,” over150 targeted religious organizationsorprominent membersthereof,over 100 targeted political organizations or membersthereof, and over50 targeted news media organizations or journalists, the data compiled by the GAO shows.

Thewatchdog review focused on two maincategories ofFBI assessments, titled “Type I/II” assessments and “Type III” assessments. Type I/II assessments typically “seek information, proactively or in response to investigative leads, relating to activities – or the involvement or role of individuals, groups or organizations relating to those activities – constituting violations of federal criminal law or threats to the national security.”

The duration of those types of assessments is allegedly expected to be “relatively short.”

The specialType I/II probes targeting potentially politically and constitutionally sensitive targetswere also unique. The watchdog found that assessments targeting these categories of individuals or groups were converted into actual, predicated investigation at a higher rate than the average assessment.About half, 48%, were converted to an investigation.

The congressional watchdog said thatType III assessments generally “identify, obtain, and utilize information about actual or potential national security threats or federal criminal activities, or the vulnerability to such threats or activities.” This assessment type is allowed to last “as long as necessary to achieve its authorized purpose and clearly defined objective(s).”

Type III assessments were uniquein a different way. For these, theFBI only converted 4% of the roughly 100 Type III SIMassessments into full investigations.

Each type of probe couldlast on average 60 to 180 days, the files show.

Yet thevast majority of the roughly 127,000 assessments did not lead to a follow-on investigation by the bureau, the GAO said, noting that “of the approximate 124,000 Type I/II and 3,000 Type III assessments the FBI opened and subsequently closed, the agency closedroughly 86 percent of Type I/II and 94 percent of Type III assessmentswithout referring them for further investigations.”

FBI officials told the GAO that “many investigative leads that prompt assessments are determined to not be credible, resulting in staff often closing assessments without opening a subsequent investigation.”

GAO assessment triggered by bipartisan concern about FBI trampling on rights

In March 2022, then-Chairman of the House Oversight Committee Jamie Raskin, D-Md., along with Rep. Nancy Mace, R-S.C., requested GAO review the FBI’s “practice of surveilling subjects” through “assessments” – raising concerns such probes were not predicated on facts or evidence as in a traditional investigationand alleging the program resulted in improper monitoring of "protected First Amendment" activities.

“We are concerned thatFBI assessments operate as de facto investigations that can be launched without a factual predicate of criminal wrongdoing,” Raskin and Mace wrote in the letter, which triggered the review. “We ask that GAO examinewhether assessments result in the improper monitoring of protected First Amendment activity—including by political, racial, or religious organizations—and whether the FBI has sufficient controls in place to ensure that they do not run afoul of constitutional protections.”

They pointed specifically to the Guidelines for Domestic FBI Operations, which were revised by the Justice Department in 2008 to include the new category of assessments. According to those guidelines,such assessments “require an authorized purpose but not any particular factual predication.”

The guidelines provide that theFBI can employ “intrusive investigative techniques,” including the use of informants and physical surveillance ontargets not accused of criminal activity or who are not national security threats, the House members wrote. Between 2008 and 2011, theFBI had opened 82,235 with fewer than 4,000 yielding any information to form a basis to open an official investigation, Raskin and Mace wrote in the letter.

Those revised guidelines stem from the Justice Department’smotivation to “[prevent] crimes from occurring in the first place.” This is “preferable to allowing criminal plots and activities to come to fruition,” the guidelines read.

The guidelinesprovided expansive potential justifications for an assessment against an individual or group. They “may be undertaken proactively with such objectives as detecting criminal activities” or gathering information on “individuals, groups, or organizations of possible investigative interest either because they may be involved in criminal or national security-threatening activities or because they may be targeted for attack or victimization by such activities.”

Assessments could also be used to assess whether individuals would be valuable to the bureau as human sources, the guidelines show.

'Self-reporting' shortcomings and other compliance problems with FBI assessments

The GAO found that not only had the bureau opened a significant number of assessments on sensitive individuals such as journalists and elected officials that never became predicated investigation, but that there were issues with the FBI's compliance with the assessment policy's guidelines.

“The FBI relies on staff to self-report noncompliance with assessment policy requirements” and that “the FBI noted that self-reporting likely undercounts actual noncompliance, but has not assessed if other tools could identify it," the GAO reported to Congress.

The watchdog said that “each FBI field office receives a National Security Review” roughly every four years, during which the Justice Department audits “a sample of national security assessments and recommends corrective actions as necessary.”

GAO said there were reviews of 988 Type I/II assessments and “information only” incidents which found that approximately 5 percent of those “included instances of insufficient authorized purposes” while roughly 7% of them “included instances of unauthorized investigative methods.”

The watchdog said that “these types of findings occurred at multiple field offices.”

The GAO said that during a review period from 2021 to 2024, 24 of the 56 FBI field offices – or 43% — “had at least one instance of using unauthorized investigative methods for an information only incident.”

One review even identified the FBI opened two assessments that lacked an authorized purpose and, in both instances, conducted investigative activities based solely on the exercise of First Amendment-protected activities," seeming to confirm the fears of Congress that the assessment authority had been used to infringe on constitutionally protected rights.

The watchdog stressed that, despite unearthing wrongdoing, “the FBI does not summarize findings or recommendations from these reports or share such information with other field offices.”

In response to inquiries by the watchdog group, the FBI stated in March 2025 that “it planned to launch a new process to address recommendations from the National Security Reviews.”

The congressional watchdog confirmed that the FBI “began a new process to address recommendations from National Security Reviews” in June 2025 “but has not identified who permanently will be responsible for the process to ensure recommendations are addressed.”

The court case—in which Planned Parenthood has sued the state of Missouri over a trigger law banning abortion after the Dobbs decision—Planned Parenthood expert witness, maternal fetal medicine doctor Dr. Steven Ralston, claimed that a one-year-old is unlikely to feel pain, and said that they may not be "conscious beings."

Planned Parenthood sued after the voters in Missouri voted the “Reproductive Freedom Initiative” into the state constitution in 2024, which enshrines abortion as state law.

Ralston stated in court: “I don’t know that [a one-year-old experiences pain] because I don’t know that a one-year-old experiences consciousness.” Ralston also could not tell the court when consciousness begins, stating: “I think it’s different for different individuals," per Townhall.

The case has been taking place at a Jackson County, Missouri courthouse, where Planned Parenthood has sued in order to "restore abortion access in the state," according to a press release from Planned Parenthood concerning the lawsuit.

For years before he became director of the Food and Drug Administration's Center for Biologics Evaluation and Research, epidemiologist Vinay Prasad openly railed against what he perceived as the shoddy design of drug trials and the deference regulators gave them, sending biotech stocks tumbling when Commissioner Marty Makary appointed him.

A vaccine maker that hit the federal jackpot during COVID-19 acted caught off-guard when the former University of California San Francisco medical professor put his gripes into practice, halting its FDA application for a new mRNA flu vaccine based on what he considered weak trial design.

Moderna accused Prasad, who described his predecessor Peter Marks as a "bobblehead" for drug approval, of changing the rules in the middle of the game by refusing to review its biologics license application (BLA) without citing "specific safety or efficacy concerns."

Prasad's Feb. 3 "refusal to file" letter – which Moderna posted a week later on its COVID resources page for some reason – says the FDA warned the company before it even started the mRNA flu trial that the proposed design raised red flags.

"CBER does not consider the application to contain a trial 'adequate and well-controlled' and the application is therefore, on its’ [sic] face, inadequate for review," because the control arm "does not reflect the best-available standard of care in the United States at the time of the study," Prasad said, which was "consistent with FDA's advice" before the study.

This was just the agency's "preliminary review of the application and is not indicative of deficiencies that would be identified later," when the FDA conducts a "substantive review," Prasad emphasized, implying fresh hurdles for Moderna even if it runs a new trial.

Moderna CEO Stéphane Bancel responded with his own thinly veiled threat against Prasad, who had already left the administration once under assault from populist and corporate conservatives who blasted his avowed support for progressive policies and more regulation before Prasad joined the administration.

CBER's decision, which Bancel reiterated "did not identify any safety or efficacy concerns with our product, does not further our shared goal of enhancing America's leadership in developing innovative medicines," said the billionaire Frenchman, who came to Boston-based Moderna from French diagnostics company BioMerieux.

The company gave trial participants 65 and older "a substandard of care against the recommendation of FDA scientists" by using standard-dose vaccines, rather than "a subset of high dose flu shots," as the control in their trial, thus exposing them to an "increased risk of severe illness," Nixon wrote in an email. "In this case, the FDA reviewed and cleared the trial design as adequate before the study began 18 months ago. Then in August of 2025, upon success of the trial, the FDA indicated the use of comparator – which is worth noting is an FDA approved vaccine – would be a point of discussion during the review period," he said. "Now, however, they have refused to even have that discussion."

'A more potent control might have narrowed or erased the efficacy gap'

"Comparing a new vaccine only to a weaker, non-preferred option creates a biased yardstick," Institute for Pure and Applied Knowledge founder and CEO James Lyons-Weiler, a former University of Pittsburgh senior research scientist, wrote in an analysis of the dispute.

The study design "inflates the apparent relative benefit and fails to show whether the new product is truly an advance over the vaccines that seniors should be receiving today," he wrote. "A more potent control (like Fluzone High-Dose) might have narrowed or erased the efficacy gap that Moderna observed."

The publication of the RTF letter crashed a Moderna stock rally earlier in the day, Feb. 10, dropping its share price 10% in after-hours trading, according to Seeking Alpha stock analyst Stephen Ayers, who said it reiterates why he lists Moderna as "sell."

"While I believe the FDA is in 'the wrong' for issuing an RTF instead of just reviewing the data and asking for more, comparing a new-age mRNA vaccine to an older, weaker standard-dose vaccine for seniors – even if deemed acceptable – may have understandably come off as scientifically lax," Ayers wrote.

Drugmakers had a friendly relationship with Prasad's predecessor, Marks, who overruled FDA career scientists and advisers to first approve, then expand a pediatric gene therapy, whose distribution Prasad pressured its maker to halt in the wake of three deaths.

Days after Sarepta Therapeutics paused Elevidys last summer, President Trump whisperer Laura Loomer attacked Prasad as a "leftist saboteur," followed by The Wall Street Journal editorial board dubbing him a "Bernie Sanders Acolyte in MAHA Drag."

The FDA quickly lifted the hold, and the White House threw Prasad under the bus, prompting his resignation, but Makary coaxed Prasad back less than two weeks later. By Thanksgiving, Prasad was flexing again, imposing stricter guidelines for vaccine approvalsafter the agency confirmed 10 children died “after and because of” receiving a COVID vaccine.

Following Moderna's submission of the Phase 3 trial protocol in April 2024, CBER's "written guidance" said it would be "acceptable" for the company to "use a licensed standard dose influenza vaccine as the comparator,"but the agency "recommend[s]" using high-dose vaccines among participants 65 and up, according to Moderna.

The latter are "preferentially recommended for use in older adults," and the data on "comparative efficacy" of Moderna's new vaccine against these high-dose vaccines "may help inform" the Centers for Disease Control and Prevention's Advisory Committee on Immunization Practices' recommendation for the new vaccine in older people, the guidance said.

"If you proceed with using a standard dose influenza vaccine comparator in participants ≥65 years of age, we agree with your plan to include statements in the Informed Consent Form," CBER said, according to Moderna.

The company said it had a "pre-submission" meeting with CBER in August 2025 after the Phase 3 efficacy trial met "all agreed upon pre-specified primary endpoints."

The "written feedback" from CBER asked for "supportive analyses on the comparator" in Moderna's submission, indicating the data would be a "significant issue" for the BLA, and Moderna complied by providing data from a separate Phase 3 trial comparing the new vaccine against "a licensed high-dose influenza vaccine."

Prasad's RTF letter was the first time CBER frowned on the "adequacy" of the trial in nearly two years of back-and-forth, Moderna said.

"It should not be controversial" to use "an FDA-approved vaccine as a comparator," which CBER "agreed on" before the trial started, Bancel said.

Lyons-Weiler, the IPAK CEO, emphasized thatModerna had "ethical and practical considerations" in what to use as a comparator, given that high-dose vaccines weren't recommended for middle-age adultswhen it planned its studies, and that the FDA "initially acquiesced" to this "middle path."

The problem is its "headline claim" that the mRNA shot was 26.6% more effective than the standard jab – comparable to "what prior enhanced vaccines achieved over standard-dose products" – comes from a trial that "pooled adults 50 and over, using a suboptimal control for those over 65," undermining its "clinical significance," Lyons-Weiler wrote.

Seeking Alpha's Ayers said Moderna didn't seem to appreciate there's a new sheriff in town with higher standards and underestimated the "bumpiness" it would face.

By not comparing "a vaccine to the best version currently given to that specific group," Moderna is likely to miss "at least two influenza seasons" and lose ground against competitors, as it's forced to conduct an outcomes trial against the high-dose vaccine, Ayers said.

The phone call was intercepted by aforeign intelligence agency, who then relayed their interpretation of the discussion to the U.S. National Security Agency(NSA).

Senegalese police arrested 14 suspects in a criminal network allegedly run by a French citizen that sexually exploited children in the West African country.

The suspected ringleader and French national, Pierre Robert, was arrested in France last April, police said in a statement on Sunday. Police said the network had been operating since 2017.

The charges against the 14, all Senegalese nationals, include “child rape, pimping, acts against nature and the deliberate transmission of HIV,” the police said in a statement Sunday. The group allegedly forced boys to have unprotected sex, often with HIV positive men, and filmed them.

Four of the suspects are accused of acting as “sex trainers” and allegedly admitted carrying out the abuse in exchange for money transfers from Robert, according to the police.

It was not immediately clear how many children fell victim to the group.

The arrests, following a joint investigation involving Senegalese and French authorities, were carried out in coordinated raids at the suspects’ homes in Dakar and in Kaolack, about 200 kilometers (124 miles) southeast of the capital.

Senegal has strict laws against sexual abuse of children, with prison sentences raging from five to 10 years for offenses involving children under 16. But limited police resources, lack of staff and gaps in judicial follow-through have hampered enforcement of child protection laws, Human Rights Watch said in a 2018 report.

As Hakeem Jeffries sits in the minority of a GOP-controlled Washington,he is still haunted by a Republican gerrymandering gambit that he believes cost him the speaker’s gavel — and cost his party control of the House.

This time, he’s making sure Democrats fight back.

Jeffries is leading the Democratic party’s counterpunch to President Donald Trump’s aggressive mid-decade redistricting push.He’s going all in with money, legal firepower and his own political capital to make sure no seat is left on the tablefor Democrats —forcing the party to abandon the left’s longtime moral opposition to party-line map meddling.(KEK what a big lie)

“Republicans started this redistricting war, and Democrats have made clear, we’re going to finish it,”Jeffries said in an interview with CNN. “When they go low, we strike back.”

Top Democrats, including Jeffries, are buoyed by signs of surging anti-Trump sentiment across the country — with special election wins even in ruby red parts of Texas — and believe they will capture the House, and possibly the Senate, in November.But Jeffries believes he can’t afford to ignore the GOP’s gerrymandering, when just three seats in North Carolina in 2024 were enough to cost Democrats the majority.

After a huge win on redistricting in California, Jeffries is vowing to spend “tens of millions” of dollars to push through an April ballot initiative in Virginia to potentially give Democrats four more seats. And he is now turning his attention to Maryland, whereDemocrats’ big gerrymandering gamble is facing its most difficult test yet.Jeffries and other top Democrats are now intensifying pressure on a key party leader, the 42-year-old Baltimorean who runs the state Senate, who refuses to help draw his party another more favorable seat that would target the state’s lone GOP-held congressional district.

Jeffries issued a stark warning to that Democrat,state Senate President Bill Ferguson — suggesting the move could help Trump’s GOP win the midterms.

“One man shouldn’t stand in the way of the people of Maryland … being able to decide, ‘Should we go in this direction?Or should we not answer Donald Trump’s continued efforts to rig the midterm election?’” Jeffries said.

If Ferguson doesn’t back down, Jeffries vowed to personally apply the pressure: “At some point I’m going to have a conversation with him if he continues to stand in the way of an up-or-down vote.” CNN has reached out to Ferguson for comment.

The prevailing sentiment in the Maryland Senate Democratic Caucus, however, is one of skepticism. They insist a new map at this point would only backfire on Democrats.

Democrats say they were dragged into the redistricting fight by Trump and the GOP, who kicked off the redistricting arms race last year in Texas.Now, as many Democrats see it, it’s the new future of House campaigning.

Jeffries and his team are already looking ahead to states like Washington, Colorado and even Pennsylvania for the 2028 cycle, according to multiple people familiar with party strategy. In their minds, it’s not just the path to the House majority this year, it’s the way to hold onto it.

“(Trump) wanted to rig the midterm elections, and for whatever the reason, didn’t think that Democrats were going to forcefully respond. He got that wrong,” Jeffries said.

Just months after the GOP’s Texas effort, Democrats believe they are on track to gain as many as five seats in California, one in Utah and several in Virginia — moves that could nearly neutralize the GOP’s own gerrymandering push. Another seat could be coming in New York if a court challenge goes their way.

Republicans, meanwhile, have enacted new congressional maps in four states, targeting nine House seats held by Democrats. (One seat in Missouri, though, is still tied up in courts.) A big push in Florida is still to come.

Jeffries, though, believes it could end up as a wash.

“The best-case scenario for Republicans at this point is status quo, which is very different than what they were claiming when they were beating on their chest last year, saying they were going to gerrymander our opportunities out of existence,” Jeffries said.

Both parties are closely watching another big state fight: Virginia.

Newly elected Gov. Abigail Spanberger and state Democrats are pursuing a strategy so aggressive that it’s surprised even some Democrats in Washington.They are looking to eliminate as many as four GOP seats, transforming their House delegation — which has six Democrats and five Republicans — into one with 10 Democrats and just one Republican.

That’s all in a state where Kamala Harris won by about 6 points.

Jeffries told CNN he is willing to devote “tens of millions of dollars” to make sure Democrats are successful on the ballot in April. (House Majority Forward, a group linked to Jeffries, committed $5 million last week, and it is expected to spend more before April, the group told CNN.)

Democrats are much more anxious about neighboring Maryland, where Jeffries and others are ratcheting up pressure on the state Senate president to yield in time.

It may not be enough. Ferguson and others in the caucus are insisting there is no path forward, both publicly and privately, according to interviews with a half-dozen people closely tracking the state’s push.

“At the end of the day, if he won’t bring it to a vote, there’s not much you can do about that,” Rep. Glenn Ivey, a Maryland Democrat, told CNN.

Ivey said he personally wouldn’t have chosen this path if Trump hadn’t forced Democrats’ hand, adding: “It’s an awful game.”

But Ivey, like many others, is deeply anxious about what could happen if blue-leaning Marylandignores what GOP leaders in Texas, Florida, North Carolina and other states are doing.

“We better not lose the House by one seat,”Ivey said.

Ferguson and other skeptics believe a new Democratic map in Maryland would not survive the courts and could ultimately backfire. Andy Harris, the GOP lawmaker who stands to lose the seat if Democrats redraw the maps, predicted that Republicans could actually gain a seat if Democrats moved forward — with a court forcing them to redraw in favor of the GOP.

“We’ll get a second seat. That’s why the Senate president doesn’t want to do it,”Harris said in an interview with CNN.

But Jeffries was blunt when asked about a new map backfiring on Democrats: “That’s not going to happen.”

Top Democrats believe they can still win back the House even without that single additional seat in Maryland. But they don’t want to take the gamble.

Asked if Ferguson’s move could cost Democrats a possible majority, Jeffries said: “Well, he’d have to live with that.”

Alfredo Alejandro Aljorna was on shift in Minneapolis on a Wednesday evening last month, making deliveries as a DoorDash driver, whenhe realized he was being followed by ICE agents, his attorney said.

He drove home andwas tackled by an agentbut broke free and ran into the house where his cousin Julio Cesar Sosa-Celis was standing, the attorney said. As he shut the door and was trying to lock it,Sosa-Celis said he was shot in the leg by an Immigration and Customs Enforcement agent.

Coming just seven days after a federal agent fatally shot Renee Good, the incident spawned renewed protests and heated clashes with police.An account of the events from the Department of Homeland Securitysoon after the incidentconflicted with the narratives from the two menand their family members.

DHS claimed Sosa-Celis was driving the car and he,Aljorna and another man assaulted the agent before the agent fired his weapon.

The first inkling of the government questioning the DHS accountcame from the US Department of Justice.In a January 16 court filingsupporting criminal charges against the two men,the DOJ asserted Aljorna was the one driving the vehicle.

In a stunning reversal, the Justice Department on Thursdayfiled a motion seeking to drop criminal charges against the two Venezuelan men. In it, the DOJ saidfederal prosecutors provided incorrect information to the court, whileICEissued a statementadmitting its federal agents made “false statements” under oath.

The two federal agents involved have been placed on administrative leave while the Justice Departmentinvestigates their “untruthful statements,” which wererevealed by a review of video evidence, ICE Director Todd Lyons said in a statement.

The twoofficers may be firedand potentiallyface criminal prosecution, Lyons said.

DOJ’s motioncited “newly discovered evidence” contradicting statementsthe agency included asthe basis for filing criminal chargesagainst the men.

It’s not clear what video evidence was uncovered,describedin the motion as“materially inconsistent with the allegations” from federal prosecutorsin the charging document. CNN has reached out to DHS for further clarity on the evidence and whether it stands by the initial statement following the shooting but did not hear back. The DOJ declined to comment on the motion when contacted by CNN.

“This was an absolute unreasonable use of force, and the officer was fabricating claims against my client to justify that,” said Aljorna’s attorney, Frederick J. Goetz.

The dismissed case fits into a larger patternin which the federal government has been quick to release accounts after a shooting by its law enforcement agents, which were later proven to be false,misleading or incomplete, according to CNN senior legal analyst Elie Honig. *Examples include video evidence after federal agents fatally shot Good and Alex Pretti, which appeared to undermine elements of the government’s accounts of what happened. The shifting narrativesfrom the federal government in the case of Sosa-Celis and Aljornahave further chipped away at the Trump administration’s credibility, as themotion to dismiss the charges with prejudiceis amore dramatic admissionfromfederal prosecutorsbecause itindicates they put forth wrong information and means the case cannot be brought back, Honig said.

Lawyers for both Sosa-Celis and Aljorna commended the department’s motion, callingit “extraordinary” and “exceedingly rare” in statements to CNN.

Here’s whatwe know about the case and how it fell apart:

Federal agencies offered conflicting narratives

In a January 15 news release,DHS claimed federal agents were targeting Sosa-Celis in a traffic stop– not Aljorna – as part ofan immigration enforcement operationon January 14 when heattempted to evade arrest, crashed into a parked car and tried to flee on foot.

Sosa-Celisallegedly began to “resist and violently assault” one of the officersand the two were in a “struggle on the ground,”then “got loose and began striking the officer with a shovel or broom stick,” at which point theofficer fired a “defensive shot,” DHS said. Two other people came out of a nearby apartment and attacked the officer, the agency said.

DHS Secretary Kristi Noem described the men’s actions as “an attempted murder of federal law enforcement.” The agency stood by its initial statement a few days after the shooting when contacted by CNN.

On January 16,however, the Justice Department offered an account painting a different pictureof the events in a filing supporting criminal charges against Sosa-Celis and Aljorna. That document said thedriver of the car was Aljorna,who prosecutors saidwas zigzagging through traffic while agents pursued the vehicle.

Aljorna, the affidavit claimed, hit a light pole before fleeing from the car,with an ICE agent chasing him on foot toward the home.Both Sosa-Celis and Aljorna were accused of hitting one of the agentswith a shovel or broombefore the agent pointed his weapon at the two men, causing them to run toward the home, the affidavit said.

As Sosa-Celis and Aljorna ran inside, the agent fired one round from his pistol“towards the vicinity” of the two men but at the time,the officer was “uncertain if his shot struck any of them,” the DOJ’s affidavit said.

Videos, interviews with family discredit DHS account

Aljorna’s attorney told CNN the Trump administration’s claims his client andSosa-Celis attacked federal agents with a broomstick or shovel “never happened.”

Sosa-Celis, speaking from a hospital room on a livestream video on his Facebook account, described engaging in some sort ofstruggle with federal agents as he was helping his cousin escape arrestand get inside their shared home.

As Aljorna was being followed in his car, the fatal shooting of Good the week prior was fresh in his mind and he was fearful, according to Goetz, his attorney. Aljorna called his family members, who told him to get home.

Approaching his home,Aljorna lost control of the car due to ice on the roadwayand hit a snowbank, Goetz said.

Aljornawas then tackled by an ICE agent after running from the car, just 10 feet away from the door, where Sosa-Celis had walked out and called for him to get inside, the attorney said.

Aljorna was able to slip out of his jacket, freeing himself from the agent’s grasp, and ran to his cousin, Goetz said. They both got behind thedoor and closed it when a shot rang out, he added.

The accounts from the two men were reiterated by their family members in interviewsand livestream videos of their 911 calls, which differed from DHS’ statement.

One of them showed a video call made by Sosa-Celis’ partner and reviewed by CNN,frantically describing to family members what she says happened, according to Alicia Celis, Sosa-Celis’ mother, who spoke to CNN.

In onevideo call, Sosa-Celis’ partner said, “Julio arrived first. They were chasing Alfredo – he had to jump from his car.”

“He ran and they threw themselves on top of him. After, Julio threw open the door, and they shot,” she added.

A different video obtained by CNN showswhat was happening outside the homewhile the family waited inside,revealing agents approaching the home and setting off a flash-bang. Smoke can be seen, and ramming sounds are heard as someone says, “They’re in! There’s more than a dozen of them.”???

“He told me, ‘Mom, ICE was chasing me,” Aljorna’s mother Mabel Aljorna later said. “Once we were inside, they shot at Julio,’” she added.

In his livestream from the hospital, Sosa-Celis said, “The shot that was fired happened when my cousin managed to escape, and he entered inside. I closed the doorand as I was locking it, I heard the shot, and that’s when I realized I had been shot in the leg.”
