Justice Dept. Says Trump's Denial of Rape Accusation Was an Official Act

The Justice Department said Monday that President Donald Trump should not be sued personally for having denied a rape allegation because he made the statement while acting in his official capacity as president.

Lawyers for the government made the argument as they defended Attorney General William Barr’s decision to intervene in a defamation lawsuit filed in a New York court against Trump by E. Jean Carroll, a writer.

Carroll has said that Trump raped her in a department store two decades ago and then falsely denied the attack while in office, branding her a liar and harming her reputation.

But Justice Department lawyers say that even though the allegation concerns an incident that occurred decades before Trump became president, his denial was still an official act because he “addressed matters relating to his fitness for office as part of an official White House response to press inquiries.”

“Given the president’s position in our constitutional structure, his role in communicating with the public is especially significant,” the Justice Department wrote, adding, “The president’s statements fall within the scope of his employment for multiple reasons.”

On Sept. 8, the Justice Department took the highly unusual step of seeking to intervene on Trump’s behalf even though the lawsuit concerns a claim of defamation stemming from an event that allegedly occurred in the 1990s, long before Trump became president.

Using a law designed to protect federal employees from defamation suits when they perform their duties, Barr sought to transfer the lawsuit from state court to U.S. District Court in Manhattan and to substitute the federal government for Trump as the defendant.

That maneuver, if approved by a judge, would have the practical effect of dismissing Carroll’s lawsuit because government employees enjoy immunity from most defamation claims.

TAIPEI – Terry Gou, the founder of Apple supplier Foxconn, has disputed reports the Taiwanese manufacturer had scrapped plans to build a factory in the U.S. state of Wisconsin.

"Foxconn will remain committed to the completion and continued expansion of our project and investment in Wisconsin as long as policymakers at the federal, state, and local levels remain committed to Foxconn," Gou said Monday in a rare statement as a private individual.

The statement comes ahead of a U.S. presidential election that lets American voters pass judgment on the economic record of Donald Trump, who courted Gou's Foxconn as an investor in American manufacturing early on in his term. Wisconsin is a battleground state that Trump won in the 2016 election.

Then-Wisconsin Gov. Scott Walker, a Republican ally of Trump's who backed subsidies for the Foxconn project, went on to lose his gubernatorial re-election bid. His successor Tony Evers, a Democrat, later sought to revise those incentives.

Gou said in the statement that Foxconn has invested "approximately $750 million" in Wisconsin without receiving incentive payments from the state.

US marshal says they're 'getting closer' to Lester Eubanks, a killer on the run for decades

MANSFIELD, Ohio – U.S. marshals believe they are getting closer to locating convicted child killer Lester Eubanks, on the run for 47 years in the 1965 death of 14-year-old Mary Ellen Deener of Mansfield, Ohio.

Brian Fitzgibbon of the U.S. Marshal Service said Monday that Eubank's story is being featured in an episode of "Death Row Fugitives" on Netflix, beginning Oct. 20.

"He's alive," said Fitzgibbons. "I feel we're getting closer."

Mary Ellen went searching for change for the laundromat on Nov. 14, 1965.

It was the last time the 14-year-old was seen alive, according to archives of the Mansfield News Journal, part of the USA TODAY Network.

Eubanks raped the girl, beat her, and shot her twice, the News Journal earlier reported.

Eubanks was convicted in May 1966 and sentenced to death. In 1972, the Supreme Court declared the death penalty unconstitutional, and his sentence was commuted to life in prison.

Eubanks could have faded from public consciousness, but he was back in the news on Dec. 7, 1973, after escaping while Christmas shopping in Columbus on an honor assignment.

Eubanks, 76, has been on the run ever since. At the time of his disappearance, authorities described him as 5-foot-11 with black hair and brown eyes, weighing approximately 175 pounds.

Fitzgibbon said the marshal service is getting a lot of tips from people filling in the holes.

Fitzgibbon said usually the marshal service asks for help from the public on a person's whereabouts but he said no tip is too small.

"There's nothing putting him in a place (location)," Fitzgibbon said. "We're looking for any information to his life on the run or the history of his life on the run," he added.

Statement of the Attorney General on the Announcement Of Civil Antitrust Lawsuit Filed Against Google

Attorney General William P. Barr released the following statement:

“This morning the Department of Justice, along with eleven states, filed a civil lawsuit against Google for unlawfully maintaining a monopoly in general search services and search advertising in violation of the U.S. antitrust laws. This is a monumental case for the Department of Justice and, more importantly, for the American consumer.

Today, millions of Americans rely on the Internet and online platforms for their daily lives. For years, there have been broad, bipartisan concerns about business practices leading to massive concentrations of economic power in our digital economy. Hearing those concerns, I have made it a primary commitment of my tenure as Attorney General for the Department of Justice to examine whether technology markets have been deprived of free, fair, and open competition.

To that end, the Department of Justice formally opened a review of online market-leading platforms in July 2019. One part of this review is the Antitrust Division’s investigation of Google. Over the course of the last 16 months, the Antitrust Division collected convincing evidence that Google no longer competes only on the merits but instead uses its monopoly power – and billions in monopoly profits – to lock up key pathways to search on mobile phones, browsers, and next generation devices, depriving rivals of distribution and scale. The end result is that no one can feasibly challenge Google’s dominance in search and search advertising.

This lack of competition harms users, advertisers, and small businesses in the form of fewer choices, reduced quality (including on metrics like privacy), higher advertising prices, and less innovation.

The complaint filed today against Google is based on violations of the U.S. antitrust laws and is separate and distinct from concerns raised about content moderation and political censorship by online platforms. As part of the Department’s broader review of market-leading online platforms, we listened to myriad public concerns about how online platforms fail their users. While many of the concerns we heard were competition-related, others were not – like online child exploitation, public safety, and censorship. Outside the Antitrust Division, the Department has considered these issues separately, including by advocating for Section 230 legislative reforms. Our antitrust investigation of Google, by contrast, is based solely on traditional antitrust principles and is aimed at promoting consumer welfare through robust competition.

Twenty-five years ago, the Department of Justice sued Microsoft, paving the way for a new wave of innovative tech companies – including Google. The increased competition following the Microsoft case enabled Google to grow from a small start-up to an Internet behemoth. Unfortunately, once Google itself gained dominance, it resorted to the same anticompetitive playbook. If we let Google continue its anticompetitive ways, we will lose the next wave of innovators and Americans may never get to benefit from the “next Google.” The time has come to restore competition to this vital industry.

Today’s challenge against Google – the monopoly gatekeeper of the Internet – shows the tremendous efforts of the Department, in particular the hardworking men and women of the Antitrust Division, and our state partners to restore competition in markets beholden to an unlawful monopolist. This is an important milestone, but not the end of our review of market-leading online platforms. The Department will continue to vigorously investigate and enforce the antitrust laws where appropriate to protect and promote competition in the digital economy for the benefit of the American consumer.”

The political official of the Libyan National Struggle Front, Ahmed Gaddaf al-Dam, announced Monday he’s initiated first steps to sue former US presidential candidate and ex-Secretary of State Hillary Clinton on charges of spreading destruction and supporting terrorism in Libya.

The cousin of the late Libyan president, Colonel Muammar Gaddafi, said in an exclusive interview with Russia’s Sputnik that he had assigned his legal team to sue the former U.S. Secretary of State.

Gaddaf al-Dam added that he provided the legal team with other documents not released by the U.S. State Department to prosecute Hillary Clinton on charges of spreading destruction and supporting terrorism in Libya.

No further details were released and it is not clear where the lawsuit will be filed.

Mail that was stolen, including numerous ballots, were found discarded in multiple bags by roadsides and ditches in Seattle, officials said.

Brian Zinser, the postmaster of the Redmond Post Office, also said he warned the Sammamish Police Department that “unopened or incomplete ballots have been inappropriately placed in out-going mail bins,” according to a statement from the City of Sammamish.

The inappropriately placed mail included about 30 Sammamish ballots and six Issaquah ballots, according to the local outlet MyNorthWest. All of the ballots were unopened and the motive is currently unclear.

Officials on Friday sent out a warning to Sammamish residents, a city located just east of Seattle, about the mail theft, and are asking people to check and empty mailboxes often to avoid the theft, which is common going into the holiday season.

“Please check and empty your mailboxes often; and please keep them locked,” the statement reads. “If you do not have a lock on your mailbox, please consider getting one through the post office.”

United States Postal Service (USPS) officials, together with the police department, are currently working on returning the stolen mail and ballots to their rightful owners.

Sammamish Police Chief Dan Pingrey told MyNorthWest that mail theft is not uncommon in the area, but does not believe himself the crime was politically motivated.

Democrats have been promoting mail voting as a convenience and safety precaution, while Republicans have cautioned against it, raising concerns of fraud and mismanagement.

While Democrat and Republican groups both have filed lawsuits this year over vote-by-mail rules across the country, most of the more than 100 lawsuits are backed by Democrats.

The Departments of Justice and Homeland Security Publish Final Rule to Restrict Certain Criminal Aliens’ Eligibility for Asylum

New Mandatory Bars Prevent Convicted Felons, Drunk Drivers, Gang Members, and Other Criminal Aliens from Receiving Asylum

Today, the Department of Justice and the Department of Homeland Security announced the publication of a Final Rule amending their respective regulations to prevent certain categories of criminal aliens from obtaining asylum in the United States. The rule takes effect 30 days after publication of the Final Rule in the Federal Register, which is scheduled to occur on Wednesday, Oct. 21.

Asylum is a discretionary immigration benefit that generally can be sought by eligible aliens who are physically present or arriving in the United States, irrespective of their status, as provided in section 208 of the Immigration and Nationality Act (INA), 8 U.S.C. § 1158. However, in the INA, Congress barred certain categories of aliens from receiving asylum. In addition to the statutory bars, Congress delegated to the Attorney General and the Secretary of Homeland Security the authority to establish by regulation additional bars on asylum eligibility to the extent they are consistent with the asylum statute, as well as to establish “any other conditions or limitations on the consideration of an application for asylum” that are consistent with the INA.

To ensure that criminal aliens cannot obtain this discretionary benefit, the Attorney General and Secretary of Homeland Security have exercised their regulatory authority to limit eligibility for asylum for aliens who have engaged in specified categories of criminal behavior.

The new bars apply to aliens who are convicted of:

(1) A felony under federal or state law;

(2) An offense under 8 U.S.C. § 1324(a)(1)(A) or § 1324(a)(1)(2) (Alien Smuggling or Harboring);

(3) An offense under 8 U.S.C. § 1326 (Illegal Reentry);

(4) A federal, state, tribal, or local crime involving criminal street gang activity;

(5) Certain federal, state, tribal, or local offenses concerning the operation of a motor vehicle while under the influence of an intoxicant;

(6) A federal, state, tribal, or local domestic violence offense, or who are found by an adjudicator to have engaged in acts of battery or extreme cruelty in a domestic context, even if no conviction resulted; and

(7) Certain misdemeanors under federal or state law for offenses related to false identification; the unlawful receipt of public benefits from a federal, state, tribal, or local entity; or the possession or trafficking of a controlled substance or controlled-substance paraphernalia.

Aliens who have committed certain domestic violence offenses, even if not convicted, will also be barred from asylum.

There is no real possibility of delaying the election. That would require legislation—the House, the Senate, and the president agreeing quickly on new dates—which is politically unlikely, and would be legally awkward when voting has already started. Instead of postponing or redoing the election, the system relies instead on replacing candidates. The rules for doing so are clear, but what will happen under those rules is anything but.

Both parties provide in their rules for replacing a candidate. Even at this late date, if a candidate died or became so sick that withdrawing was necessary, party leaders would confer and select a replacement. The process by which they would do this is not set, and is entirely up to them. The leadership in this case are the 168 members of the Republican National Committee, and the 400-plus members of the Democratic National Committee. (The RNC allows for the possibility of reconvening its national convention, but doing so this late seems unlikely.

After the People Have Spoken

If a candidate dies between the popular vote and the meeting of the Electoral College the parties follow the same process to fill the vacancy on the ticket. If the candidate that dies is on the winning ticket, it's still the party's responsibility to provide a new candidate their electors could vote into office.

But here, the political implications are more serious because it takes some of the power away from the people; they don't get to vote again. The replacement candidate's name goes on the Electoral College ballot only, and their political party expects its electors to vote the replacement candidate into office.

There's no federal law saying the electors have to vote for the new candidate. Theoretically, if the candidate to whom they pledged their votes dies and their party doesn't name a preferred successor, electors could vote for the party's VP candidate, a third-party candidate or a leading contender within their own party. But state laws vary on the matter.
