"Court officials went to extreme measures to ensure it was as difficult as possible to figure out what Mueller's team was doing as the US Court of Appeals for the District of Columbia Circuit held a secret and mysterious argument about a grand jury subpoena challenge.
An entire floor of the courthouse was closed to the public and press for more than an hour. During that time, attorneys secretly entered the courthouse to argue before three federal appellate judges over a grand jury subpoena.
The mystery of the subpoena appeal appears to date back to early September, when CNN witnessed several lawyers from Mueller's office entering a courtroom to argue against an unknown defense team before a trial-level judge who oversees federal grand jury-related cases.
Clearly, a challenge related to Mueller's grand jury investigation was underway.
Shortly after, that judge, Chief Judge Beryl Howell of the DC District Court, ruled on a case related to a grand jury subpoena, and the losing party attempted to appeal the ruling. The appellate court batted the case back down to Howell, who held a second sealed hearing on October 5. Though CNN was locked out of the courtroom while the arguments took place, the hearing featured the same team from Mueller's office as before, which included top criminal law appellate lawyer Michael Dreeben.
Mueller's office declined to comment on the hearings.
That same day Mueller's team clashed in a sealed courtroom with an unknown opponent, Howell issued another ruling on the same grand jury subpoena challenge she had decided before, sending the losing party back to the appellate court to ask for reconsideration.
Politico a few days later overheard an attorney at the appellate court discussing sealed Mueller court filings – and the mysterious grand jury challenge got its argument date set before a three-judge panel at the DC Circuit Court of Appeals.
Argument day arrived Friday.
Typically, DC Circuit Court arguments run smoothly, one after another until three cases have been argued publicly, starting at 9:30 am in a large, portrait-lined courtroom on the Fifth Floor of the federal courthouse on Constitution Avenue. But after Circuit judges David Tatel, Thomas Griffith and Stephen William – who coincidentally has written two books on Russian history – heard an immigration-related case Friday morning, the courthouse security went into lockdown mode.
Tatel, Griffith and Williams took a brief recess, indicating they'd return to the courtroom shortly.
Then, security officers cleared the appeals courtroom, allowing only about a dozen law clerks working for federal judges to stay behind, including at least one who assists Howell with her cases.
Security guards also cleared the vestibule to the courtroom and checked the coat closet where attorneys coming to listen to arguments stash their belongings. They locked the door leading to the attorneys' lounge on that floor and shooed the more than 20 reporters prowling the hall away from the elevator bank and told them to vacate the nearby stairwells. On December 6, 2018 at 9:15 PM, a seven-year-old female juvenile Guatemalan was apprehended with her father for illegal entry with a group of 163 illegal aliens approximately a half mile west of the Antelope Wells Port of Entry at the Bounds Forward Operating Base (Bounds FOB). There were four Border Patrol Agents on scene at the time.
Upon apprehension, the Border Patrol Agent conducted an initial screening, which consists of an interview and observation of the detainee to identify any health or safety problems to ensure that they receive necessary medical care. The initial screening revealed no evidence of health issues. Additionally, the father claimed that the child was in good health as indicated on the Form I-779.
Due to the extreme remote nature of the location, while awaiting transport to the nearest Border Patrol station, the aliens were held inside the Sally Port of the Antelope Wells Port of Entry and had access to food, water and restrooms.
At 10:00 PM, an MCI Transport Bus left the Lordsburg Border Patrol Station route to the Bounds FOB. The Lordsburg Border Patrol Station is approximately 94 miles away from the FOB Bounds. Due to the remoteness of this area, vehicle transport between locations takes between two to three hours.
Around 12:20 am on December 7, the MCI Transport Bus transported the first group to the Lordsburg Border Patrol Station. Because Unaccompanied Alien Children are a priority, UACs were on the first transport to the Lordsburg Border Patrol Station.
The MCI Transport Bus returned at 4:00 AM to the Bounds FOB. At 4:30 AM, the second group of aliens including the child and her father was loaded onto the MCI Transport Bus. Just prior to departure, at 5:00 AM, the father first advised the agent that the child was sick and vomiting while on the bus.
At this time, the Agents notified the Lordsburg Border Patrol Station to prepare to receive the child and provide emergency medical care. Due to the remoteness of the area, meeting emergency medical personnel in Lordsburg was the best means to provide the child with emergency care.
Shortly before 6:30 AM, the bus arrived at the Sally Port of the Lordsburg Border Patrol Station and the father advised that the child was not breathing. A Border Patrol Emergency Medical Technician began to provide medical care and revived the child twice. It was determined at this time that she had a temperature of 105.7 degrees.
Hidalgo County EMS arrived and began providing care at 6:40 AM. A decision was made to transport to the nearest trauma center, Providence Children’s Hospital in El Paso, Texas.
Air Ambulance departed LOB with the child at 7:45 AM, she arrived at the Providence Children’s Hospital in El Paso at 8:50 AM and immediately received additional emergency medical care.
Her father was transported by USBP via a government vehicle to the hospital.
At 11:00 AM December 7, LOB was notified juvenile went into cardiac arrest again and was subsequently revived. LOB learned that the CT scan revealed brain swelling. She was breathing by machine and diagnosed with liver failure.
She died at 12:35 AM on December 8 with her father on scene. The Guatemalan government was notified immediately and is working with the El Paso Sector leadership.

Shocking new documents obtained by Gizmodo reveal that Reddit co-founder and famed digital activist Aaron Swartz was caught up in warrantless FBI email data collection which would later be used against him in an unrelated case.
Swartz is widely recognized as the face of everything wrong with the Computer Fraud and Abuse Act.
In 2013, Swartz killed himself after being aggressively prosecuted for downloading academic articles from a subscription-based research website JSTOR – at MIT, his university – with the intention of making them available to the public. He was facing 35 years in prison for his efforts to open access to scientific publications to wider audiences.
“Information is power. But like all power, there are those who want to keep it for themselves,” Swartz wrote in his Guerrilla Open Access Manifesto. “Forcing academics to pay money to read the work of their colleagues? Scanning entire libraries but only allowing the folks at Google to read them? Providing scientific articles to those at elite universities in the First World, but not to children in the Global South? It’s outrageous and unacceptable.”
The newly released documents reveal that in 2008, roughly five years prior to the case that would ultimately lead to him taking his own life, his emails were caught up in an investigation into al Qaeda.
Later that year, Swartz came under investigation by the FBI who were seeking to determine if he had violated any laws by downloading millions of court documents from PACER. The government ultimately did not press charges in that case because the documents were public.
However, according to the new report by Dell Cameron, while the FBI was trying to build a case against the popular activist, they “began quietly building a profile of the oft-described technology ‘wunderkind,’ noting, for example, his involvement in the creation of the formatting language Markdown and RSS 1.0, and jotting down the various code frameworks that Swartz had helped to create and organizations that he had helped to found. Eventually, with all open source avenues exhausted, an FBI employee sat down at a computer terminal that, to most people, would appear plucked straight from the 1980s. The employee ran a search using the bureau’s automated case support system, a portal to the motherlode of FBI investigative files.”
When the FBI employee searched Swartz’ website domain name, it got a hit, which revealed that his domain was involved in an international terrorism investigation — specifically into al Qaeda.
“That any information about Swartz was collected during an Al Qaeda investigation—only to be retrieved nearly two years later for totally unrelated purposes—adds a familiar and sympathetic face to a controversial procedure in intelligence gathering commonly referred to as a ‘backdoor search.’ That is, the FBI gathering information about Americans who are not accused of crimes, often without a warrant; storing that information in databases, sometimes for years; and later accessing it during the course of another investigation that ultimately has nothing to do with terrorism whatsoever. Maus first made her accusation Friday on Rede Globo (TV Globo), which reported spending three months investigating the story and conducting interviews with a dozen other alleged victims.
In his first public appearance since the accusations came to light, Faria told reporters and his followers Wednesday that he is not guilty and that he will "comply with Brazilian law."
"Brothers and my dear sisters, I thank God for being here," Faria said, Reuters reports. "I want to comply with Brazilian law. I am in the hands of the law. John of God is still alive."
As The New York Times underscores, Faria's "global fame exploded" largely as a result of Winfrey's repeated promotion of his psychic healing methods and his spiritual healing center, which is located in Abadiania, a small town in central Brazil. Faria's "miraculous" methods include performing surgery without anesthesia and channeling "spirits of the dead" to heal patients suffering serious conditions. After producing a profile on him in 2010, Winfrey visited his center in 2012.

In fact, a case with very far-reaching implications involving federal agencies cleared the high court just this week that could spell the end of the government’s vast regulatory powers.

The website noted that the Supreme Court granted writ of certiorari in a case, Kisor v. Wilkie, involving a challenge to a previous legal precedent established in Auer v. Robbinsand Bowles v. Seminole Rock & Sand Co., both of which “direct courts to defer to an agency’s reasonable interpretation of its own ambiguous rule,” the SCOTUS Blog noted.
Granting of a writ does not necessarily mean that the high court disagrees with a lower court’s decision. What it does mean is that at least four of the justices believe that the circumstances of a case are worth a review by the high court.

The US Court of Appeals for the DC Circuit heard Friday morning arguments involving a grand jury matter that is currently sealed - a typical practice while cases are pending. The publicly available information on the case offer little clues as to what's going on, as there are no description of the subject of the case, no information on the parties or their lawyers, and no public access to the documents.
The tight-lipped approach of Mueller and his team has led to rampant speculation and curiosity. Several hours later, a sealed response was filed in the grand jury case.
It was not confirmation that the sealed grand jury case was indeed related to Mueller's investigation, but it was enough to make Friday's arguments a must-attend event. -BuzzFeed
What makes this interesting is that the federal court in DC is where Mueller's team has brought most of their cases - as there have been two other grand jury matters we know about in front of said court; one relates to Paul Manafort and the other is still pending in the DC Circuit involving former Roger Stone associate Andrew Miller.
Reporters began to gather more than an hour before arguments were scheduled to begin at 9:30 a.m., however no members of Mueller's team, anyone connected to the Russia investigation, or anyone from the Trump administration were spotted. The first case was argued. Then the second. Still nothing. At the end of arguments in the second case, court employees instructed everyone in the courtroom to leave. Court staff and security officials then cleared the entire floor, an unusual occurrence in the courthouse. Reporters scattered, staking out other hallways, stairwells, and exits. At one point at least 20 journalists roamed the courthouse building and its grounds.
After roughly an hour and a half, reporters were allowed back onto the floor, although the courtroom was locked and it wasn't clear if arguments had ended. A little after noon, the courtroom deputy confirmed that the judges were, in fact, done hearing arguments for the day.
