His organization on Friday dropped its case against the other firm, Morrison & Foerster, after that firm similarly removed language specifying that its fellowship program is only open to Black, Hispanic, Native American or LGBTQ+ applicants.

Perkins Coie on Friday similarly expanded the applicant pool for its diversity fellowship program to all law students, not just members of "historically underrepresented" groups like people of color, LGBTQ+ community members and disabled students.

The firm's lawyers in a brief said that since the diversity fellowship program no longer has any race-based restrictions on who can apply, there is nothing left for U.S. District Judge Sam Lindsay to enjoin and the case is moot.
