Devin Nunes warns 'future of this country' hinges on Durham indictments

The "future of this country" depends on who is indicted next in special counsel John Durham's criminal inquiry into the Russia investigation, warned a top House Republican.

Rep. Devin Nunes, ranking member of the House Intelligence Committee, said Thursday that trust in the Justice Department and FBI among conservatives nationwide hangs in the balance.

"The Biden DOJ can let people off if they would like," the congressman from California said during a Fox News interview, referring to ex-FBI official Andrew McCabe winning back his full pension as part of a settlement with the Justice Department in a wrongful termination lawsuit.

"Durham is still out there," he said. "For the Department of Justice and the FBI to have any support amongst conservatives or half of this country, it’s going to really depend on who Durham indicts, and I think that is what a lot of us are waiting for."

During the Fox News interview, Nunes also scoffed at the news that Bill Clinton's former communications director, George Stephanopoulos, scored an interview with former MI6 agent Christopher Steele. Steele compiled the salacious and discredited anti-Trump "Steele dossier" after being hired by the opposition research firm Fusion GPS, which had been hired by the Clinton campaign.

The congressman said it is an "embarrassment" for Hulu, airing the interview onOct. 18,and Disney, which owns a majority stake in the streaming service. Nunes also noted the timing of the interview after stating Steele was uncooperative with the House Intelligence Committee's own Russia investigation.

"There is probably more to come. I'm sure it will be quite a comical and entertaining movie," he said.

Double Jeopardy Claim Leads To Indefinite Hold On Retrial In Michael Avenatti Case

SANTA ANA (CBSLA) — The retrial of Michael Avenatti, who is most known for representing adult film actress Stormy Daniels in lawsuits against former President Donald Trump, has been indefinitely put on hold based on an argument of double jeopardy.

Double jeopardy is a procedural defense that prevents someone from getting prosecuted twice for the same crime.

The decision was made on Friday by a federal judge in a Santa Ana court for the retrial that was initially set to be held on Nov. 2.

Currently, Avenatti is attempting to have his case thrown out.

Avenatti is charged with defrauding several clients of nearly $10 million in settlement funds.

A few months ago, he was also sentenced to 30 months in prison for trying to extort nearly $25 million from popular sports company Nike.

In California, Avenatti is facing a 36-count indictment, including charges of wire fraud and failing to file tax returns, eight counts of willful failure to collect and pay over-withheld taxes, two counts of bank fraud, three counts of a false declaration in bankruptcy, and one count each of aggravated identity theft and providing false testimony under oath in bankruptcy. The retrial would be only on the 10 counts of wire fraud, while the remainder of the case would be tried at a later date.

U.S. District Judge James V. Selna vacated the Nov. 2 trial date, saying the 9th U.S. Circuit Court of Appeals is responsible.

Selna then declared a mistrial on Aug. 24 after reporting a failure to turn over bookkeeping evidence, which he presented as n oversight rather than an act of misconduct.

Avenatti argued in his appeal that he requested to retrieve bookkeeping evidence to prove that he did not defraud his clients, and said his pleas were ignored.

Avenatti said a retrial would violate his rights against double

jeopardy and for due process.

In response to Avenatti’s argument that a retrial would violate double jeopardy, prosecutors said in court papers that Avenatti’s motion was a “frivolous double-jeopardy argument to delay a retrial that he asked for” and that the appellate justices, which Selna said is responsible for the case, has no jurisdiction over the double jeopardy claim.

It’s unclear if and when that retrial will be rescheduled.

How Funding by the Federal Government has Caused Corruption in Child Protective Services

Out of every 10 foster children taken, 1 will NEVER AGAIN have a home. Child Protective Services or CPS has become a very corrupt government agency. From time to time problems with CPS (such as Justina Pelletier) make the news. However, these are but symptoms of a very large disease. The deep down problems with CPS are not reported on a large scale, and therefore are not addressed. Scandals about the IRS and the VA have been in the news, but the corruption within CPS is far worse. The victims are the most innocent; our nation’s children.

In 1974 Congress passed CAPTA (the Child Abuse Prevention and Treatment Act). This began the feeding of federal funding to state’s child welfare agencies to place children in foster care. The number of children in foster care subsequently jumped to over 500,000 in only a few years. To address the free for all child snatching CAPTA had caused, in 1980 PL 96-272 was passed partly to add accountability to CPS. Each state is supposed to account annually in an AFCARS report each child in care, and establish citizen review panels for CPS accountability. Additionally, the federal government is supposed to perform compliance audits, or section 427 reviews. And if the state didn’t comply or satisfy the audit, they were to voluntarily reimburse the feds for all the goodies they had taken. Upon passage of this act children in foster care dropped dramatically to 300,000. But since there was no enforcement, within a few years, the number of children in foster care again doubled.

The citizen review panels are only in a few states, and the 427 audits are a mere rubber stamp. CPS is allowed to act totally out of compliance without any intervention. Hundreds of billions have been spent to destroy children and families. In 1988, George Miller, the author of PL 96-272 said “I think what has been demonstrated here is that you may have a system that, for lack of a better phrase, is simply in contempt. This system has been sued and sued and orders have been issued and people have just continued on their merry way. And HHS has just continued to look the other way. You have a system that is not only somewhat out of control; it is also illegal at this point.” Read more

Out of every 10 dollars spent for child welfare 9 REQUIRES foster care. CPS is now a 30 billion dollar a year business, with funding driven by the federal government. Ninety to ninety-five percent of federal money is paid to states when children are removed from their homes and sent to foster care and when children are adopted away from their homes. See Government Document that discusses Title IV-E spending. In the first paragraph it says that 12.3 BILLION is spent on foster care programs by the government. States have quotas for adoption, and bonuses are paid every time a child is adopted. There are no incentives or bonuses to keep a family together. These federal funds are paid through social security from Title IV-E, where in 2014 6.5 billion was paid directly to the states for foster care, adoption bonuses, and another 4 billion for administration. In 2014 592 million was paid to the states under Title IV-B, a more general category, part of which is for family services. (Click for more info)

With the glut of kids placed in foster care, there became a problem of kids left in care for years and never finding a home. After all, every child taken is money paid to the state… So in 1997 the feds had this brilliant idea: under the ‘adoption and safe families act’ states are paid a ‘bonus’ every time a child is placed for adoption. Even though the government says that ‘reasonable efforts’ should be made to reunite families, there are no bonuses or any incentives to keep the family intact. Children that are shipped into foster care often stay ‘within the system’ for years without a permanent home. Currently 1 out of ten children taken into foster care will NEVER AGAIN have a home. THE CORRUPT BUSINESS OF CHILD PROTECTIVE SERVICES

In this report, I am focusing on the Georgia Department of Family and Children Services (DFCS). However, I believe Child Protective Services nationwide has become corrupt and that the entire system is broken almost beyond repair. I am convinced parents and families should be warned of the dangers.

I had witnessed the “Gestapo” at work and I witnessed the deceitful conditions under which children were taken in the middle of the night, out of hospitals, off of school buses, and out of homes.

Parenting classes, anger management classes, counseling referrals, therapy classes and on and on are demanded of parents with no compassion by the system even while they are at work and while their children are separated from them. This can take months or even years and it emotionally devastates both children and parents. Parents are victimized by “the system” that makes a profit for holding children longer and “bonuses” for not returning children. Caseworkers and social workers are oftentimes guilty of fraud. They withhold evidence. They fabricate evidence and they seek to terminate parental rights. However, when charges are made against them, the charges are ignored.

The Adoption and Safe Families Act, set in motion by President Bill Clinton, offered cash “bonuses” to the states for every child they adopted out of foster care. In order to receive the “adoption incentive bonuses,” local child protective services need more children. They must have merchandise (children) that sells and you must have plenty of them so the buyer can choose. Some counties are known to give a $4,000.00 bonus for each child adopted and an additional $2,000.00 for a “special needs” child. Employees work to keep the federal dollars flowing.

The National Center on Child Abuse and Neglect in 1998, reported that six times as many children died in foster care than in the general publicand that once removed to official “safety,” these children are far more likely to suffer abuse, including sexual molestation than in the general population.

According to the California Little Hoover Commission Report in 2003, 30% to 70% of the children in California group homes do not belong there and should not have been removed from their homes.

The system cannot be trusted. It does not serve the people. It obliterates families and children simply because it has the power to do so.

There should be open records and “court watches”! Look who is being paid! There are state employees, lawyers, court investigators, guardian ad litems, court personnel, and judges. There are psychologists, and psychiatrists, counselors, caseworkers, therapists, foster parents, adoptive parents, and on and on. All are looking to the children in state custody to provide job security. Parents do not realize that the social workers are the glue that hold “the system” together that funds the court, funds the court appointed attorneys, and the multiple other jobs including the “system’s” psychiatrists, therapists, their own attorneys and others.

State Departments of Human Resources (DHR) and affiliates are given a baseline number of expected adoptions based on population. For every child DHR and CPS can get adopted, there is the bonus of $4,000 or maybe $6,000. But that is only the beginning figure in the formula in which each bonus is multiplied by the percentage that the State has managed to exceed its baseline adoption number. Therefore States and local communities work hard to reach their goals for increased numbers of adoptions for children in foster care.

When a child is placed in a mental health facility and is on 16 drugs per day, like two children of a constituent of mine, more funds are involved and so is Medicaid;

As you can see this program is ordered from the very top and run by Health and Human Resources. This is why victims of CPS get no help from their legislators. It explains why my bill, SB 415 suffered such defeat in the Judicial Committee, why I was cut off at every juncture. Legislators and Governors must remember who funds their paychecks.

State Department evacuation flights out of Afghanistan will resume by the end of the year, a senior State Department official told The Wall Street Journal.

U.S. citizens, U.S. legal permanent residents and immediate family members will receive priority treatment in securing seats on evacuation flights, the official said. The State Department is hoping to eventually have several aircraft leave the country each week.

Special Immigrant Visa (SIV) applicants will be eligible for American evacuation flights, but they will need to complete most of the SIV vetting process, according to the official. Other Afghans at risk, such as female judges or government workers, will not qualify under the department’s current plan.

A date to resume the evacuation has not yet been set by the State Department due to details not yet worked out with neighboring countries such as documentation for travelers. “As soon as we have the right combination of documentation and logistics, we will get going again,” the senior State Department official said.
