Michigan Governor May Have Covered Up Deaths in Nursing Homes Like Cuomo

Two public policy experts are suing Governor Gretchen Whitmer and the state of Michigan, asking a court to force them to release background data on the executive order that funneled nursing home residents hospitalized with COVID-19 back into nursing homes. This is the same policy followed by New York Governor Andrew Cuomo, who is now under criminal investigation for covering up the massive numbers of seniors who died as a result of the policy.

Steve Delie, the policy lead for open government and transparency at the Mackinac Center for Public Policy, and Charlie LeDuff, a Pulitzer-Prize winning journalist and a radio show host say that underlying data that Whitmer and the state are refusing to release could shed more light on the actual number of COVID deaths, as well as data relevant to Whitmer’s public health decisions that have remained secret.

Michigan is one of only two states where the governor is exempt from Freedom of Information laws, and the only state where that exemption is written into statute. Thanks to this exemption, the governor has no obligation to produce any records whatsoever, despite making decisions affecting the lives of every Michigander.

Gov. Whitmer has used this veil of secrecy to act with impunity. Her office has almost single-handedly dictated the state’s COVID-19 policies, without disclosing the data she has used to make her decisions. After the Michigan Supreme Court struck down the statute Gov. Whitmer relied on for her emergency authority, the Michigan Department of Health and Human Services became the vessel for COVID decision-making. Yet while that department is subject to FOIA, it has not been any more transparent. The state continues to release information about the number of cases and deaths but not the underlying records.

Whitmer ruled Michigan with an iron hand until the Supreme Court took her authority away. She unilaterally extended lockdowns with no reasonable explanation. She banned travel to residents’ vacation homes. Her confusing, sometimes contradictory lockdown orders were praised by the media from coast to coast.

Many of them are still in place.

That’s why we’re suing the Michigan Department of Health and Human Services. After the state began adding additional deaths to its daily tally, known as vital records deaths, one of us (Mr. LeDuff) requested the underlying data of these newly added deaths. This included the age of the deceased, date of death, when the death was added to the published data, and most importantly, which cases that led to death originated at a long-term care facility or nursing home.

While the department could have easily released this data, it claimed the details would reveal protected health information. Yet records with even more specific data — such as death certificates — are already available for public purchase, and the department has released some information drawn from these records already.

It makes one wonder what the state government might be hiding behind their legal firewall.

More than any other governor, Whitmer acted with impunity and little oversight during the pandemic. The underlying emergency has long since vanished. And yet, her imperious dictates continue to control the behavior of state residents.

Prying open the records should prove to be very revealing.

Riviera Maya Gang Members Sentenced in Romania

A Bucharest court sentenced on Friday six members of the so-called Riviera-Maya Gang to prison terms between three and 10 years for setting up a large-scale skimming operation in Mexico.

Led by Florian Tudor, aka The Shark, - who remains at large in Mexico - the gang compromised up to 100 ATM machines along Mexico's Riviera Maya, in Cancun, Sayulita, Puerto Vallarta and Tijuana to steal credit card details from tourists and withdraw money from their accounts.

The six were found guilty of atempted murder, extortion, setting up an organized crime group, illegal possession of a gun and driving without a licence.

Tudor was also indicted, but he remains in Mexico and prosecutors have to file a warrant in absentia, local media reported.

The gang members were put on trial in January last year with prosecutors claiming that Tudor’s criminal group may be nearly 1000 men strong.

Last year the OCCRP, Elemento Lab, Mexicanos Contra la Corrupción y la Impunidad (MCCI) and Rise Project published an investigation that revealed details of the prosecution’s accusations against Tudor and his group.

Meanwhile law enforcement investigators concluded that the gang was responsible for 12% of an illegal skimming market worth an estimated two billion dollars. Much of the stolen money the members allegedly funnelled into real estate in Mexico and Romania through companies they controlled.

Three of Tudor’s associates were on Friday found guilty of trying to kill Sorinel Marcu, who was once Tudor’s right hand. The ‘Shark’ and his muscle had a falling out over money and jealousy.

On April 2, 2018, Marcu was outside a DHL office in Cancún when the three convicts stabbed him multiple times. Marcu’s spleen was later removed at a Cancún hospital as a result of his injuries.

Tudor was indicted with attempted murder along with the three convicts. When contacted by OCCRP in 2020, he denied any of the allegations and claimed that he was a legitimate businessman.

“I am not a criminal and I never will be,” Tudor said in an email exchange with the OCCRP. “I have never killed anyone and I have never ordered anyone killed.”

In February of 2020 the U.S. Federal Bureau of Investigation (FBI) asked Mexican authorities to investigate Tudor’s organized crime network.

Mexico's Financial Intelligence Unit (UIF) launched a financial investigation, tracking the gang’s properties and transactions. The UIF, in collaboration with Mexico’s Attorney General’s office, discovered transactions between at least eight companies headquartered in Mexico and one in Romania.

In early February this year the UIF froze the accounts of 79 people and companies believed to be linked to the group. President Andrés Manuel López Obrador asked the head of the Financial Intelligence Unit (UIF) to present a full report on The Riviera Maya Gang, after the accounts were frozen.

Senior NATO Official Convicted of Spying for China

After being arrested in September, a senior official for the North Atlantic Treaty Organization (NATO) was convicted of spying for China last week.

The alleged Chinese spy who worked for NATO is Tarmo Kõuts, an Estonian military defense scientist. The scientist was sentenced last week to serve three years in prison after been arrested by the Internal Security Service in September.

According to the report, intelligence services for the Baltic countries allegedly have been warned of the growing Chinese threat for years, but Kõuts’ conviction would be the first of its kind. He was tried in the Tallinn-based Harju County Court.

A Baltic Offical allegedly told Business Insider:

Russian intelligence activity obviously takes the highest priority in our neighborhood but the amount of resources required to monitor China increases for us each year. Our natural experience is more with the Russians but we have been warning about China for well over a year.

The deputy director of Kaitsepolitsei (KAPO) and Tallinn’s top counterintelligence official, Aleksander Toots, spoke to the Beast about Kõuts:

Kõuts was recruited in 2018 by China’s Intelligence Bureau of the Joint Staff Department of the Central Military Commission—as Beijing’s military intelligence agency is known—along with an alleged accomplice who is yet to be tried in court. Both were arrested on September 9, 2020, with no publicity or discussion of the case in the Estonian media.

Kõuts was recruited on Chinese territory, said Toots, who spoke exclusively with The Daily Beast and Estonia’s Delfi newspaper: “He was motivated by traditional human weaknesses, such as money and need of recognition.”

Toots added that Kõuts received cash payments from his Chinese handlers as well as paid trips to various Asian countries, with luxury accommodations and dinners at Michelin star restaurants. The intelligence operatives handling him were operating under cover of a think tank. Inna Ombler, the prosecutor handling the case confirmed that Kõuts earned €17,000 — a little over $20,000 — for his espionage, which the Estonian government has since seized from him.

Toots also said the reason the Chinese went after Kõuts was due to the security clearances he held. This is why “we decided to put a stop to his collaboration [with the Chinese] so early,” Toots said.

The scientist pleaded guilty to “conducting intelligence activities against the Republic of Estonia on behalf of a foreign state,” said the report.
