Bill Cosby set to be released from prison after court vacates conviction

Disgraced comedian Bill Cosby will be released from prison after the Pennsylvania Supreme Court overturned his conviction for sexual assault.

The state Supreme Court looked at two parts of the case that Cosby's attorneys had challenged in an appeal last year: the judge's decision to allow all five accusers to be called by prosecutors and an agreement that Cosby had with a former prosecutor that he would never be charged.

The court said the previous prosecutor's decision not to charge Cosby led to his engagement in a civil lawsuit against him, giving testimony which was key in his later conviction. "The circumstances before us here are rare, if not entirely unique," the court wrote in its wrote in its opinion.

The justices concluded that Cosby had suffered "far greater" due to the testimonies given at his two trials and rebuffed a suggestion that a third criminal trial be conducted. Instead, they wrote that overturning his conviction would be the only action that would suffice. "A contrary result would be patently untenable. It would violate long-cherished principles of fundamental fairness. It would be antithetical to, and corrosive of, the integrity and functionality of the criminal justice system that we strive to maintain."

Trump Org And CFO Weisselberg Expected To Be Charged Thursday With Tax Crimes

The Trump Organization and its CFO, Allen Weisselberg, is expected to be charged on Thursday with tax-related crimes, according to the Wall Street Journal, citing people familiar with the matter. Trump himself is not expected to be charged, as we noted earlier this week.

The action by the Manhattan district attorney's office would mark the first criminal charges against the former US president's company since prosecutors began investigating three years ago. Weisselberg reportedly refused prosecutors' attempts to get him to cooperate against Trump, according to the report.

The defendants are expected to appear in court Thursday afternoon.

The Trump Organization and Mr. Weisselberg are expected to face charges related to allegedly evading taxes on fringe benefits, the people said. For months, the Manhattan district attorney’s office and New York state attorney general’s office have been investigating whether Mr. Weisselberg and other employees illegally avoided paying taxes on perks—such as cars, apartments and private-school tuition—that they received from the Trump Organization. -WSJ

According to the report, if prosecutors can show the Trump Organization and its executives systematically avoided paying taxes, more serious charges could follow.

ARIZONA: Senator Ugenti-Rita KILLS Election Integrity Bill, Votes With Dems Against Vital Legislation

Republican Arizona Senator Michelle Ugenti-Rita has killed an election integrity bill put forward by fellow State Senator Kelly Townsend, who plans to reconsider it.

SB1241, which was set for its third reading in the Senate on Tuesday, contained over 34 various election integrity measures, including: requiring paper ballot copies for every vote cast on a voting machine, securing those machines and hard drives outside of voting hours, sending ballots with mismatched signatures to the Attorney General for potential investigation, requiring ballot observers to be able to see the voting machines, increasing chain of custody requirements, and forcing anyone registering in Arizona who moved from another state to deregister from their previous state.

However, Republican Senator Michelle Ugenti-Rita, announced that she would join the Democrats in voting against the election integrity bill, which Townsend implied was revenge for her own vote against Ugenti-Rita’s SB1485. Although SB1485 included some election integrity measures, it would not have applied key revisions in time for the 2022 primaries, leaving them open to the same potential attacks that may have occurred in the 2020 election.

Much of the provisions included in the final version of SB1241 were tacked onto the bill when it went through the House, after Ugenti-Rita refused to allow Townsend to hear the issues in the Government Committee that she chaired. When it came to voting, Ugenti-Rita objected exactly because of the methodology Townsend used to get the issues into the bills, despite the fact it was her own tactics had seemingly forced her to do.

Speaking on the Arizona Senate floor, Townsend argued that the uncommon method of producing the final bill was “no reason to vote no on good election integrity language that is needed this year in order to be in effect in time for the primary election next year,” adding that she found it “reprehensible that pride, lack of reading the bills in the beginning, or any other reason, is actually going to kill good legislation that would restore confidence for every single person in this state in their election process so that they can cast a ballot in next year’s primary knowing that chain of custody is secure.”

Credit Suisse Major Shareholder Qatar Investment Authority Trims Stake

One of Credit Suisse Group AG’s biggest and longest-term shareholders, the Qatar Investment Authority, trimmed its stake in the bank, a blow to the beleaguered Swiss lender.

QIA, a sovereign-wealth fund of the gas-rich Gulf state, cut its stake to 4.8% from 5.2% on Wednesday, according to its filings with the Securities and Exchange Commission. Credit Suisse is under pressure to revamp following twin scandals from the failures of Archegos Capital Management and Greensill Capital.

QIA didn’t immediately respond to a request for comment. A Credit Suisse spokesman declined to comment.

The Qatar fund first took a large stake in Credit Suisse in 2008 and helped shore up its capital as the financial crisis hit. It reported a stake of just under 10% in Credit Suisse shares and derivatives that year and reduced the stake since then.

Credit Suisse lost around $5.5 billion this spring from exiting large, concentrated stock positions of Archegos Capital, a New York-based family office that came undone when some of the stocks fell and it couldn’t meet margin calls. Other banks including Morgan Stanley and UBS Group AG also lost money.

It's impossible to mention the border crisis without reminding everyone that the Mexican Navy seized 52,000 pounds of fentanyl off one ship in 2019.

The Mexican Navy intercepted the fentanyl shipment which originated from Shanghai, China and was bound for the Sinaloa Cartel home base of Culiacán, Sinaloa.

Undoubtedly, to be pressed into pills, snuck through the southern border, and to be distributed throughout cities in the United States.

This was enough fentanyl to kill 11.5 billion people or 1.5 times the world’s population.

Mexican Navy seizes 25 tons of fentanyl from China in single raid

Mexican government authorities reported a seizure of approximately 25.75 tons of powdered fentanyl in the port city of Lázaro Cárdenas, in the western Mexican state of Michoacán — and it came from China.

The Secretariat of the Navy of Mexico intercepted the fentanyl shipment which originated from Shanghai, China and was bound for the Sinaloa Cartel home base of Culiacán, Sinaloa, as reported by local media outlet Tobasco Hoy on Saturday.

Investigators discovered the fentanyl aboard a Danish vessel in a cargo container whose manifest indicated a shipment of calcium chloride.

When the Mexican Customs laboratory tested a sample of the contents, investigators found the powdered substance tested positive for fentanyl. The customs investigators went on to seize 931 sacks of the same substance, amounting to a weight of 23,368 kilograms (about 25.75 tons). Initial reports on the total weight of seizure are still only an estimate as authorities are still determining the total amount of captured fentanyl powder.

The seizure was the result of joint efforts by the Secretariat of the Navy of Mexico and customs enforcement members from Lázaro Cárdenas.

The most recent seizure comes just days after the U.S. Drug Enforcement Administration announced a cumulative seizure of over a million illicitly created fentanyl pills, by the DEA’s Phoenix Field Office and various Arizona law enforcement agencies over the course of the 2019 fiscal year. The 1,138,288 pills are nearly triple the 380,000 fentanyl pill seizures estimated in fiscal year 2018. The high yield of captured fentanyl is an even further increase over just 20,000 fentanyl pills seized within the state of Arizona in the 2016 fiscal year.

Breitbart News’ Texas news bureau reported the dismantling of a Sinoloa Cartel lab fentanyl pill lab in Northwest Culiacán, Sinaloa last week. Some 2,500 fentanyl pills were discovered at the lab and authorities seized a pill press used to make “M-30s” or “Mexican Oxy” derived from the powdered fentanyl.

Investigators also determined the lab to be a training site for other cartel drug manufacturers. Breitbart reports that fentanyl has become a favored drug of production, lucrative to the Sinoloa Cartel due to its easy production and accessible trafficking routes across the Mexican border into the U.S.

In April, Mexican media outlet Excelsior reported significant fentanyl seizures related to the Sinoloa Cartel and discovered an active Sinoloa Cartel fentanyl lab, seizing 33,000 pills and 25 pounds of powdered fentanyl in the process. Mexican government authorities at the time also found 13 pounds of heroin and chemical precursors at the cartel lab.

Fentanyl has been determined by the Center for Disease Control and Prevention to be between 50 and 100 times more potent than morphine and has been a major contributor to opioid deaths in the United States.

Do We Hear A Trillion: Fed's Reverse Repo Hits Record $992 Billion, Up $150 Billion In One Day

There's not much we can add here: after all we have beaten to death the topic of the Fed's soaring reverse repo facility (see "With Fed's Reverse Repo Hitting Half A Trillion, Wall Street Scrambles To Figure Out What Comes Next" and especially "Powell Just Launched $2 Trillion In "Heat-Seeking Missiles": Zoltan Explains How The Fed Started The Next Repo Crisis"), but while many were expecting fireworks for month and quarter end, nobody expected that a record 90 counterparties (up from 74 on Tuesday) would park an additional $150 billion in loose liquidity (for context, all of QE2 was $600 billion) at the Fed's reverse repo facility where it is now earning 0.05% compared to the 0.00% rate prior to the June FOMC, bringing the total reverse repo usage to a mindblowing $991.9 billion, after printing a record $841.2 billion on Tuesday (across 74 counterparties).

In an amusing twist, whereas once upon a time banks would flood into the Fed's repo facility at quarter end to window dress their balance sheet, now it is an all out scramble to just get rid of excess liquidity which the Fed continues to inject at a pace of $120 billion.

But while today's print is likely an outlier due to quarter end, we expect the new normal reverse repo usage to rise above $1 trillion shortly for the very reason Zoltan Pozsar explained last week: with the banks repurchasing well over $100 billion in stock, their CET1 balance sheet capacity is about to collapse by over $2 trillion due to the 20x leverage. As a reminder this is what we said:

... imagine what will happen to the RRP facility if banks indeed proceed to repurchase $142BN in stock; applying Pozsar's 20x leverage multiple, this means that bank balance sheets will shrink by just under $3 trillion, including trillions in reserves which will have to be parked at the Fed, which also means that in the coming weeks usage on the Fed's reserve facility is set to explode to unprecedented levels.

The Cable News Network (CNN) run by Jeff Zucker is celebrating the 100th anniversary of one of the most brutal and illegitimate regimes in human history – the Chinese Communist Party.

In CNN’s own words, “Xi [Jinping] will be the real star” of the celebrations.

In a new article, the network hypes the Chinese Communist Party (CCP) as “willing to adapt,” and “aware of the risks it faces, from a slowing economy, an aging population and a shrinking workforce, to an increasingly united West that is determined to counter its rise.”

Authored by China correspondent Ben Westcott, the piece goes on to state “the [Chinese Communist] party has much to celebrate” before finally, towards the end of the piece, mentioning “Tiananmen Square, the decade of mayhem under former Chairman Mao Zedong’s Cultural Revolution, and the millions who starved to death as a result of disastrous CCP economic policy decisions.”

CNN is one of the key Western sponsors behind a “Marxist Journalism School” based out of Xi Jinping’s alma mater at Tsinghua University.

The network or its anchors have:

Taken meetings with top CCP propagandists;

Attended major conference with Xi Jinping;

Sent staffers to work at CCP-owned news outlet CGTN;

Gloated about a CCP app defrauding a Trump rally;

When I was president, I delivered on my promise to build a border wall to protect our country. All Joe Biden had to do was paint it.

Instead, Biden has enacted the most radical open borders agenda imaginable. This is perhaps the first time in world history a nation has purposely and systematically dismantled its own defenses to invite millions of foreign migrants to enter its territory and break its laws.

No one knows who they are, presenting a dangerous threat to Americans. To say that Biden has provoked a national security disaster does not even begin to do justice to the calamity.

In May, illegal border crossings were nearly 700% higher than when I was president during the same period last year. For each of the last three months, more unaccompanied minors have arrived than in any prior month in recorded history. Seizures of ultra-lethal fentanyl are up 265% from last year — more of the drug has already been intercepted than in the entirety of 2020.

Joe Biden has restored catch-and-release, torn up our hard-earned asylum agreements with Mexico, Guatemala, Honduras, and El Salvador, and announced that anyone on the planet who lives in a crime-afflicted area now qualifies for asylum in the United States. Meanwhile, ICE is effectively shut down, senior border security officials have been fired, and criminals are being released in record numbers.

To top it all off, the Biden administration has announced a new program whereby the U.S. government will literally pay to fly illegal aliens’ relatives from other countries to join them in the United States.

These policies are utterly depraved — the actions of someone who by all indications wants to completely abolish America’s southern border.

Yet of all the vindictive, shocking, and self-defeating border security actions Joe Biden has taken, none surpasses his decision to stop the final completion of the wall.

Nearly 740 miles of border wall had been fully funded and more than 660 miles were already built or undergoing construction, Customs and Border Protection confirmed on Jan. 15, five days before I left office. After more than two years of litigation and Democrat obstruction, the wall was going up at an average rate of two miles per day. We had already more than doubled the length of the physical barrier protecting our southern border. We had also replaced much of the previously existing dilapidated fencing with new impenetrable metal beams, focusing on the highest traffic areas that border patrol agents themselves had identified.

The wall was planned, approved, paid for, and virtually done. Only a few key areas remained to be completed. All Joe Biden had to do was let the contractors finish their work. The border agents wanted it, and it would make the whole country safer.

Instead, Biden sabotaged the completion of the wall, ordered an immediate halt to construction on his first day in office, impounded the funds Congress had appropriated and took steps to terminate the National Emergency declaration that had facilitated it.

HFT Giant To Challenge Citadel's Dominance Of Retail Stock Trading

By now it's common knowledge that the golden goose that powers the tremendous revenue and cash flow juggernaut of HFT giant Citadel, which resulted in record EBITDA of $4 billion last year, more than doubling the prior year results..... not to mention the driving force behind Ken Griffen's mansion and artwork collection, is Citadel's near monopoly when it comes to controlling retail orderflow in the US: Citadel Securities estimates that it commands 27% of equity volume market share in the U.S., up from 21% in 2017 a recent loan private presentation revealed; the company is especially dominant in retail order flow, with 46% of the market.

There's more: according to Bloomberg, Citadel's EBITDA for Q4 was $1 billion and a whopping $4.1 billion for the year, also a record. It also means that Citadel has an EBITDA margin of more than 60%, an unprecedented number even for a high-margin brokerage.

So seeing how Citadel's near-monopoly of this particular corner of the market had led to such staggering monetary gains, we were always confused why there is so little competition in the retail orderflow business.

Well, that's finally changing.

According to WSJ, Hudson River Trading, one of the biggest high-frequency trading firms, is planning to enter the business of executing stock trades for retail investors. By doing so, the New York-based Hudson River sets its sights on two huge rivals: Citadel Securities and Virtu Financial, which combined handle more than 70% of individual investors' stock orders.

The firm - which handles 8% of daily U.S. stock-trading volume, or about a third of Citadel's market share - has been building out a so-called retail wholesaler business. It aims to launch later this year or in early 2022, an executive at the firm told The Wall Street Journal. Wholesalers - such as Citadel and Virtu - execute orders to buy and sell stocks submitted by people using online brokerages such as Robinhood Markets Inc. and TD Ameritrade. In fact, Citadel has long been the single biggest paying client to Robinhood...

... and what it gets in exchange for these orderflow payments, is a first look at what everyone in the retail space is buying and selling, both en masse and at the individual level. Which of course is known as frontrunning, but because "everyone does it", payment for orderflow is viewed as perfectly legal in the US.

Why? Because of the universal "get out of jail" card - namely that wholesalers "provide liquidity" which of course is bullshit - liquidity collapses once these wholesalers have no more retail trades to frontrun or when volatility surges, resulting in numerous flash crashes, as for bid/ask spreads, these shrink simply because the HFTs position themselves inbetween the natural buyers and sellers in hopes of getting the trade ahead of everyone else. "We have a lot of respect for Citadel Securities and Virtu and their ability to provide great execution for retail investors," Adam Nunes, Hudson River's head of business development, told the WSJ. "We do see demand from retail brokers for an additional wholesaler. We are confident that we can compete with Citadel Securities and Virtu in providing liquidity to retail investors, the same way we do on exchanges." This too, is a joke: as even the WSJ admits, "most retail traders would be unlikely to notice the effect of increased competition from Hudson River. Investors typically save a small amount of money, often just a fraction of a penny per share, by having their orders routed to wholesalers." However, it does mean that there will be one more shark swimming in the waters, hoping to frontrun their orders away. What Hudson River's involvement really means is that Citadel's market share of retail orderflow is about to drop as competition ramps up, while the money firms like Robinhood who sell retail traffic, will pocket from HFTs should rise as there is more competition for the same limited universe of orders.
