CFTC Orders Glencore to Pay $1.186 Billion for Manipulation and Corruption

The Commodity Futures Trading Commission today issued an order filing and settling charges against Glencore International A.G. of Switzerland, Glencore Ltd. of New York, and Chemoil Corporation of New York (collectively, Glencore), an energy and commodities trading firm, for manipulative and deceptive conduct. The conduct, which spanned from least 2007 to 2018, involved manipulation and foreign corruption in the U.S. and global oil markets, including manipulation or attempted manipulation of four U.S. based S&P Global Platts physical oil benchmarks and related futures and swaps. Glencore is required to pay a total of $1.186 billion, which consists of the highest civil monetary penalty ($865,630,784) and highest disgorgement amount ($320,715,066) in any CFTC case. The CFTC’s order finds that Glencore’s manipulative and fraudulent conduct—including conduct relating to foreign corruption—defrauded its counterparties, harmed other market participants, and undermined the integrity of the U.S. and global physical and derivatives oil markets. Platts physical oil benchmarks, including those that were the subject of Glencore’s manipulative conduct, serve as price benchmarks for end-users and market participants, and are incorporated as reference prices for the settlement of numerous derivatives. “When individuals and entities seek to disrupt the reliability of benchmarks, they interfere with the proper functioning of the markets that directly impact consumers,” said Chairman Rostin Behnam. “Without question, manipulating oil markets can drive up the cost Americans pay at the pump or to heat their homes. And today my message to the markets is clear: the CFTC will continue to pursue even the slightest hint of manipulative, corrupt, or fraudulent behavior.”

Acting Director of Enforcement Gretchen Lowe commented, “Today’s enforcement action demonstrates that the CFTC will work with its enforcement partners around the world to ensure that the U.S. markets operate free of manipulation and corruption, and the CFTC will impose substantial and robust sanctions against those market participants who engage in such conduct.” The order finds that from as early as 2007 (try since the 1970's biotch-like since the petro-dollar introduced-see moar below) through at least 2018, Glencore sought to increase profits from its physical and derivatives oil products trading by manipulating or attempting to manipulate U.S. price-assessment benchmarks relating to physical fuel oil products, and related futures and swaps, in order to benefit Glencore’s trading positions. https://www.cftc.gov/PressRoom/PressReleases/8534-22

There is not enough space to even scratch the surface here so here's what I know: Kissinger hired Rich (Marc Rich and Co. for the coming Petro-dollar (rig oil markets) because they knew they had to control the Gold and the Oil. The deal they made (backroom w/ the Saudis) was that Gold would drop when oil rose and vice-versa. James Comey and the Marc Rich Pardon

Bill Clinton formerly created the William J Clinton Foundation in 2001 at the end of his presidency. On January 20, 2001 – and just hours before formally leaving the presidential office for good – Bill Clinton pardoned Marc Rich, an international commodities trader. Rich had been indicted on charges of tax evasion and illegally trading oil with Iran. It was the biggest tax evasion case in U.S. history. He was indicted on 65 counts but fled to Switzerland. The man who brought the indictment against Rich was none other than Rudy Giuliani. Rich was pardoned after his ex-wife gave over $1 million to the Democratic Party – including $100,000 to the senate campaign of Bill’s wife, Hillary Clinton – and $450,000 to the Clinton Library. The pardon also happened after senior UBS executive, Pierre de Weck, sent a letter to Clinton requesting the pardon and offering a… you guessed it…paid speech. Note that UBS has factored significantly among the Clinton Foundation donors in more recent years per Wiki Leaks. There are other long-lingering ties stemming from Rich’s pardon. Large Clinton Foundation donors Nigerian businessman Gilbert Chagoury and Russian investor Sergei Kurzin (Uranium One deal), among others, both had close ties to Rich (Kurzin had worked for Rich). The pardon was extremely controversial with even president Jimmy Carter saying there was no doubt that “some of the factors in his pardon were attributable to the large gifts”. A NY Times editorial called it a “shocking abuse of power”. Rich’s attorney, Jack Quinn, had been Vice President Al Gore’s Chief of Staff and then became White House Counsel to President Bill Clinton. Quinn also had a close relationship with Deputy Attorney General (later Attorney General) Eric Holder. It was Holder who decided the pardon petition should bypass normal procedures and be submitted directly to the White House. A Federal Prosecutor, Mary Jo White (currently Chair of the Securities and Exchange Commission), was appointed to investigate President Clinton’s pardon of Rich. She ultimately stepped down from the investigation and was replaced with a man who had been a vocal critic of both Eric Holder’s pardon recommendation and the pardon itself. The man who replaced White was…Current FBI Director James Comey.

The Marc Rich pardon scandal is important on several fronts:

*It was in essence the formulation of the Clinton Foundation,it allowed the Clinton’s to recognize (and realize) their monetary power that stemmed from Bill’s presidency

*It brought many of the current players in the Clinton Foundation into the Clinton fold

The Clinton Foundation Investigation had been proceeding on a parallel track due to the exposure brought on by Peter Schweizer’s book “Clinton Cash”. Note that Comey specifically refused to comment on the Clinton Foundation when he testified before Congress. For those of you who thought the sudden release of Marc Rich’s pardon documents two days ago by the FBI was a bit strange, perhaps this all makes matters a bit more clear. The release of the Marc Rich documents was a message. The Clinton Foundation Investigation is not over.

How a Book Crushed the Virtu Financial IPO

It was going to be a stellar debut. The IPO roadshow was kicking off in just a few days. Goldman Sachs, Citigroup, Credit Suisse, and J.P. Morgan were lined up to take the company public in a matter of weeks. With plans to raise $250 million from investors, the IPO pegged the value of Virtu Financial at $3 billion. The little-known firm had carved out an extremely profitable niche in the financial sector. Its business is known simply as “high-frequency trading.” And it’s an incredibly profitable business. In fact, it’s so profitable that Virtu never loses money. According to the firm’s S-1 filing with the Securities and Exchange Commission, the firm is profitable 99.92% of the time.The SEC filing reports “As a result of our real-time risk management strategy and technology, we had only one losing trading day [out of] a total of 1,238 trading days.”Aside from a little hand-wringing, the high-frequency trading firms Michael Lewis accused of “rigging” the stock market in his groundbreaking new book, “Flash Boys: A Wall Street Revolt,” haven’t been tangibly impacted yet. Except one. Virtu Financial, a multinational electronic trading firm that claims to “lower costs for both retail and institutional investors,” was set to embark on its pre-IPO road show in early April. Yet immediately following the release of Flash Boys, Virtu indefinitely postponed its initial public offering. No official reason was given for the delay of the Virtu Financial IPO. But every analyst knows why: In the wake of Lewis’ book, this is not a good time for high-frequency trading (HFT) firms to be going public. The public backlash has been too great, with investors around the world expressing outrage over some of the claims made in Flash Boys. For those who aren’t familiar with the book, the premise is that high-frequency trading firms are robbing traders by using computers that are able to identify the way someone is about to trade. In doing so, they jack up the price by a penny or two before the investor is able to buy the stock. In essence, it allows traders who use sophisticated computer programs to skim profits away from traders employing simpler tools and techniques. A penny or two more doesn’t sound like much. But when it’s done millions of times per day … that adds up. “Legalized front-running” is what Lewis called this predatory trading activity in a recent “60 Minutes” feature (click here to watch the full interview). Virtu Financial is one of the firms Lewis accuses of doing this “legalized front-running.” He only mentions them by name in a footnote in the book. But that was enough to turn public sentiment against them. The Virtu Financial IPO has been indefinitely suspended out of fear that the bad publicity might result in a low valuation once the company goes public. Virtu was seeking to raise $250 million in its IPO, which would give the company a valuation of close to $3 billion. While Virtu may still go public at a later date, the company appears to be waiting for the smoke surrounding high-frequency trading to clear first. That hasn’t happened yet. KCG Holdings (NYSE: KCG), another high-frequency trading firm with shares on the New York Stock Exchange, has fallen 17% in the month since Flash Boys was released.

Cap #2 is an example of Goldman Sachs being observed hanging out some offers on both sides bid and ask of a small position hoping that it fools others (humans) into taking the bait so that it also triggers others to come and an play. These orders are quickly pulled because they don't want to fill them they just want to see what humans are up to and use that as a way to flush out what real orders may be waiting to be placed.

Dollar sinks to one-month low amid easing Fed rate hike bets

The U.S. dollar sank to a one-month low versus major peers on Friday as traders lowered Federal Reserve rate hike expectations amid signs the central bank might slow or even pause its tightening cycle in the second half of the year. The dollar index , which measures the greenback against a basket of six major peers, fell as low as 101.43 for the first time since April 25. A rally in Asian stocks also sapped demand for the greenback as a haven.

Against the euro , the U.S. currency also slipped to the weakest since April 25 at $1.0765, and dropped to the lowest against sterling since April 26 at $1.2607. The risk-sensitive Australian dollar rallied 0.51% to $0.7136, while the New Zealand dollar jumped 0.49% to $0.6510.

The dollar index is headed for a 1.5% drop this week, following last week's 1.37% slide. That would be the first two-week decline since the turn of the year. It reached a nearly two-decade peak above 105 mid-month, but retreated amid signs that Fed tightening may already be slowing economic growth. Treasury yields have also dropped from multi-year highs, further undermining the dollar. The dollar weakened 0.3% to 126.69 yen, sliding gradually over the past three weeks from a two-decade high of 131.35.
