U.S. SEC unveils rules to better oversee security-based swap execution

A U.S. markets regulator on Wednesday will propose new rules that would require platforms that execute trades of security-based swaps to register with the agency in a bid to increase the transparency of the over-the-counter derivatives market. The proposals from the U.S. Securities and Exchange Commission (SEC) would fulfil a mandate under the Dodd-Frank Financial Reform Law, passed in the aftermath of the 2007-09 global financial crisis, to bring clearer oversight to the opaque multitrillion-dollar derivatives market, the agency said. The measures, which are subject to public consultation, would require platforms known as swaps execution facilities (SEF) to register with the SEC and would see the agency more closely regulate platforms that trade security-based swaps.

Wednesday's package of proposals, known as Regulation Swaps Execution, would better harmonize the SEC's rules with a similar but more sweeping rule introduced by the Commodities Future Trading Commission (CFTC). While the CFTC oversees all financial contracts in which two counterparties agree to exchange or “swap” payments with each other as a result of changes in interest rates or commodity prices, the SEC's rules would focus on swaps based on a security or a credit default swap.

SEC Chair Gary Gensler said the rules would work to bring together buyers and sellers with transparent, pre-trade pricing, lowering risk in the marketplace, and would ultimately protect investors. The move aims to mitigate conflicts of interest at newly registered security-based SEFs, exchanges and clearing agencies and would promote competition and market integrity, the SEC said. The measures would not apply to platforms already registered with the SEC as a clearing agency and those whose operations are designed to further the accuracy of end-of-day valuations, it added.

Holdings of shorter-term Treasury bills would be targeted as they are “high valued as safe and liquid assets by the private sector.” Fed officials also sharply raised their inflation outlook and lowered their economic growth expectations-DERP!!!!!!!!!!!-bond market did that for you already but they are sticking with the mantra that "prime" is what sets rates.....hilarious.

Buffett’s Berkshire Hathaway Builds New $4.2 Billion HP Stake

Warren Buffett’s Berkshire Hathaway Inc. bought a stake in HP Inc. valued at more than $4.2 billion. Shares of the laptop maker surged as much as 10%. Berkshire bought some of the stock earlier this week in multiple transactions and now holds an investment of about 121 million shares in the computer company, according to a regulatory filing Wednesday.

Berkshire has increasingly been finding ways to put its money to work, helped in part by volatility that dragged the S&P 500 Index down nearly 6% so far this year. Buffett’s company spent some time in March buying up shares in Occidental Petroleum Corp., building a stake that now ranks among Berkshire’s top 10 common-stock bets.

HP stock rallied last year, gaining 53% in 2021, but had fallen 7.3% since the beginning of the year through Wednesday’s close. Berkshire, which had historically shied away from some technology investments, has leaned further into that sector in recent years and built up a stake in Apple Inc. that was valued at more than $161 billion at the end of 2021. HP, a maker of printers and computers, surged as high as $38.38 in extended New York trading after the filing. An HP spokesperson didn’t immediately respond to a request for comment.

IEA countries to tap 60m barrels of oil on top of 180m by U.S.'

International Energy Agency states agreed to tap 60 million barrels of oil from storage, the director of the group said on Wednesday, on top of a 180-million-barrel release announced by Washington last week aimed at cooling prices after Russia's invasion of Ukraine.

The move by the U.S.-allied IEA countries, which represent 31 mostly industrialized countries but not Russia, would be their second coordinated release in a month and would be the fifth in the agency's history to confront oil market outages.

"The @IEA is moving ahead with a collective oil stock release of 120 million barrels (including 60 million barrels contributed by the US as part of its overall draw from its Strategic Petroleum Reserve)," IEA Executive Director Fatih Birol tweeted.

It was the largest release from non-U.S. IEA countries on top of the largest draw from the United States. "This will supplement our 1 million barrels per day for six months and of course will serve as a bridge until the end of the year when domestic production ramps up," a U.S. official said on condition of anonymity.

Sanctions and buyer aversion have disrupted Russian oil supplies, pushing oil near $140 a barrel on March 7 despite the previous IEA release of 60 million barrels, with half of that coming from the United States, about a week earlier. Russia calls its actions in Ukraine a "special operation."

Markets appeared to be cheered by the latest IEA move, with Brent oil falling about 5% to about $101.50 a barrel on Wednesday.

The United States will match the 60-million-barrel draw tapped by the other IEA countries in its 180-million-barrel draw from the U.S. Strategic Petroleum Reserve announced in March.

The timing of when the additional 60 million barrels from non-U.S. IEA countries would come to market was not immediately clear. Birol said details on specific contributions would be made public soon.

In the last three releases coordinated by Washington and its IEA allies, the United States provided half or a little less than the total volume.

Analysts have said that the tapping of finite supply to plug reduced flows in the oil market may not succeed at bringing down prices in the long term.

Claudio Galimberti, senior vice president of analysis at consultancy Rystad Energy, said the U.S. SPR release of 1 million bpd would struggle to plug potential lost Russian output of over 2 million bpd.

"This historically large SPR release is the right decision in the current crisis and consumers should feel the benefit soon, but it only solves half the problem."

The move comes as the United States and allies struggle with multi-decade-high inflation and rising energy and gasoline prices. High fuel prices are a vulnerability for U.S. President Joe Biden's fellow Democrats ahead of Nov. 8 congressional elections.

China Allows Evergrande Creditors to Sue Locally to Recoup Debt

Several Chinese lenders have been told they can file legal cases against China Evergrande Group in local courts, in an apparent easing of a restriction that required all such lawsuits to be handled in a single court, according to people familiar with the matter.

The move may help onshore creditors gain control of assets ahead of a looming debt restructuring. At least three lenders in Zhejiang and Shandong province were told by courts last month that they can file the cases against the embattled developer in their own jurisdictions rather than to a court in Guangzhou, where Evergrande was based for decades, said the people, asking not to be identified discussing a private matter. Some cases have already been accepted, said the people. Creditors have filed hundreds of lawsuits to the Intermediate People’s Court of Guangzhou after China’s Supreme Court in early August ordered all cases against Evergrande and its affiliates to be processed there. The backlog and protracted process have led to slow progress for many banks, trusts and suppliers to seize assets and recover their losses.

Evergrande, started 28 years ago by billionaire Chairman Hui Ka Yan, officially became a defaulter in December and aims to provide creditors with a preliminary overhaul proposal by the end of July. Both onshore and offshore investors are closely watching the development of what could be one of the nation’s biggest restructurings, as they are prepared for a lengthy battle over who gets paid from what remains. Evergrande didn’t immediately respond to a request seeking comment. Calls to the Supreme Court and the Intermediate People’s Court of Guangzhou went unanswered. The August order to centralize cases had given Evergrande some breathing room as it helped hold off creditors’ attempts to freeze accounts while allowing the developer to complete more than one million unfinished homes. Smaller rival Kaisa Group Holdings Ltd. in November flagged it was also resorting to this approach to prevent assets being frozen by courts under numerous lawsuits. However, the Guangzhou court alone can’t deal with hundreds of filings from the country, the people said. As of Dec. 9, it has accepted 367 cases with claims totaling 84 billion yuan ($13 billion), the Financial Times reported in December citing official records. The latest change may allow creditors to gain faster control of Evergrande’s real estate projects, many of which were being pledged for borrowings, said the people. Signs have already emerged that Evergrande is speeding up on disposing of stakes in some property projects. At least three trust companies have bought stakes in at least seven projects from Evergrande this year.
