Brazil Election this week: Lula vs. Bolsonaro

-The race: Brazilians vote on Oct. 4 in the first round of a closely watched presidential election, with incumbent Luiz Inácio Lula da Silva and Sen. Flávio Bolsonaro dominating the polls.

-Why it matters globally: The result could influence Brazil’s relationships with the U.S. and China, including over trade and access to critical minerals, as Bolsonaro emphasizes alignment with Washington while Lula stresses Brazilian sovereignty.

-The economic stakes: Whoever wins will inherit pressure to address Brazil’s public finances, with high government debt, a large budget deficit and elevated borrowing costs putting fiscal policy at the center of investor attention.

Brazil will hold a knife-edge vote on Sunday as its presidential race kicks off — but the election’s outcome is likely to be felt far beyond the country’s borders.

Voters will head to the polls to decide whether incumbent Luiz Inácio Lula da Silva — known colloquially as Lula — should remain in office or be replaced by one of 12 alternative candidates.

If no ​candidate wins more than 50% of votes ​in Sunday’s first round, the two candidates with the most support ⁠will progress to a final runoff vote on Oct. 25.

Polls point to a tight race, with frontrunners Lula and Flávio Bolsonaro effectively tied for support among voters.

A win for left-leaning Lula would mark his fourth presidential term, while victory for Bolsonaro is expected to mark a shift back to his father’s right-wing movement.

Lula’s center-left Workers Party (PT) has been a pioneer of social programs aimed at lifting millions of people out of poverty — but it has been stained by corruption scandals. Lula himself spent 18 months in prison after receiving a coastal property from an engineering firm involved in the so-called Car Wash corruption investigation. Former president Dilma Rousseff, who succeeded Lula in 2010, was impeached in 2016, having been accused of budget manipulation.

Flávio Bolsonaro is a senator and son of former president Jair Bolsonaro, who is currently under house arrest. Jair Bolsonaro was sentenced to 27 years in prison for plotting a coup after losing the 2022 presidential election to Lula.

Bolsonaro is widely viewed as the political heir to his father, with his policy mix favoring privatization, spending cuts and close alignment with the U.S. — policies that have had recent successes across Latin America, with Bolivia, Chile, Colombia and Peru all inaugurating conservative leaders in the last 12 months.

Lula, meanwhile, has put Brazilian sovereignty at the center of his campaign. He has also pledged to reduce Brazil’s traditional six-day work week, cut income tax for low-earners and enact policing reforms.

The president has endured a rocky relationship with the Trump administration, which treated Jair Bolsonaro – dubbed colloquially the “Trump of the Tropics” – as a close ally. U.S. President Donald Trump announced 50% tariffs on Brazil in July 2025 in response to what he labeled a “witch-hunt” trial against Jair Bolsonaro.

Otaviano Canuto, a nonresident senior fellow at The Brookings Institution and a former executive director at the Board of the International Monetary Fund for Brazil, told CNBC that the upcoming vote was a “hinge election” for the broader region with respect to the U.S. and the so-called “Donroe Doctrine” that has seen the Trump administration take a greater interest in Latin America.

“Brazil is the largest economy in the region and if you take the region as a whole, 20 republics [in Latin America] are now are ruled by right-wing leaders,” he said. “And of course, if a victory by Flavio Bolsonaro happens, that would deepen the strategic alignment of the region with President Donald Trump’s plan for America. By contrast, if Lula obtains a fourth term, that will frustrate Washington’s bid to dominate the neighborhood, and squeeze out the Chinese influence.”

Paulo Nogueira Batista Jr., a Brazilian economist and former vice president of the BRICS New Development Bank, told CNBC that the outcome of the election will have “a substantial effect on all parts of Brazilian life” because the two leading candidates are “radically different.”

“Flavio Bolsonaro has declared to be closely aligned to Donald Trump, and this might affect Brazilian-Chinese relations — [and] China is our main trade partner,” he explained. “The geopolitical situation of Brazil that will change enormously if Bolsonaro wins, and will continue more or less like it has been in recent years if Lula wins his re-election bid.”

According to Canuto, part of Brazil’s appeal to the U.S. administration is the country’s abundance of critical minerals.

“Trump has been very proactive in trying to guarantee the access to critical minerals, and Brazil is the second source rare earth reserves on the planet, [behind] China,” he said.

“So, the U.S.-China rivalry spills over to access to critical minerals and rare earths, and as we all know, all signals coming from Washington point in the direction of demanding the countries in the region establish restrictions to the Chinese access and so on.”

-Section 351 of the tax code generally lets investors transfer property to a corporation in exchange for its stock without recognizing a capital gain, with limitations, and the transfer of a portfolio of securities to a newly formed ETF has become a clever way for gains to be avoided among the rich.

One of the selling points of ETFs is that they can be highly tax-efficient for managing capital gains and losses, but wealthy investors may have to rethink certain ETF tax-deferral strategies following recent communications from the Internal Revenue Service and U.S. Treasury.

At issue are certain use cases of Section 351 exchanges, in which wealthy individuals, through an intermediary, create new ETFs with a basket of highly appreciated stocks. The intent is to defer capital gains taxes — which remains a legitimate strategy, but with additional qualifications, according to new guidance from tax authorities.

Treasury Secretary Scott Bessent said in an X post earlier this week that the guidance, “makes clear Treasury is serious about cracking down on transactions designed to dodge taxes or exploit our federal tax code.”

He added of a companion IRS revenue ruling related to Section 351 ETF conversions designed to avoid tax, “Our message on these conversions is clear: they don’t work under existing law.”

The combined effort covers instances that tax authorities find troubling, including when an ETF is “merely a conduit” for transferring securities in an attempt to avoid taxes. A revenue ruling is an official interpretation of a specific set of facts by the IRS, in relation to the tax code and regulations, useful for anticipating tax treatment by the agency. A notice, meanwhile, sets out more general guidance for broader circumstances.

Section 351 of the tax code generally lets investors transfer property to a corporation in exchange for its stock without recognizing a capital gain, under certain conditions. For example, no one asset can exceed 25% of the portfolio’s value, and the top five holdings cannot exceed 50% of the overall value, according to Kitces.com. This is still generally accepted practice.

“The IRS and Treasury are focused on tax strategies that they consider abusive practices,” said Jeffrey Colon, professor of law at Fordham Law, who focuses on tax law and policy.

According to tax authorities, by inappropriately avoiding gains, investors are subverting the intention of the rules.

For wealthy investors, as well as their investment and tax advisors, who have turned to ETFs as a tax shield, the landscape is expected to change in the wake of the new guidance from tax authorities.

The IRS’s revenue ruling related to a transfer of a portfolio of securities to a newly formed ETF. As part of the planned transactions, the ETF distributed the contributed securities soon after, and the investor ended up with a “materially different” portfolio, without recognizing any built-in gains in the original securities.

“This is really about getting diversification without paying tax,” said Brian Gray, tax partner at Gursey Schneider.

Tax authorities said this is a problem, but the issue did not come out of nowhere.

A Bloomberg analysis from last July found that a total of $22 billion in ETFs had been created for this purpose, deferring as much as $6.5 billion in capital gains, with the activity accelerating significantly since 2024.

“Tax rules should reward investment, not abusive financial engineering,” Bessent had said in a July 22 post on X, adding that regulators “will not turn a blind eye to abusive Wall Street tax dodges or tolerate products designed to exploit our federal tax code. If a tax pitch sounds too good to be true, then it probably is and investors should think twice.”

He referenced that July warning in his post this week.

Officials from the IRS and Treasury had met in July with members of the Wall Street Tax Association to discuss the kinds of transactions the government has taken an interest in, including questionable Section 351 exchanges.

The notice addresses many of the strategies discussed.

Generally, only higher-income individuals are using Section 351 exchanges.

Fees are one reason. It can cost $200,000-$300,000 to create an ETF, said John Pantekidis, managing partner and general counsel at TwinFocus in Boston. Some firms suggest investors should have at least $25 million of appreciated stocks to include in the ETF for it to be a viable option, but Pantekidis sets the bar even higher, saying it doesn’t make sense for anyone with less than $100 million of stocks to include.

The notice does not imply all Section 351 transactions are suspect.

“This notice does not address, and expresses no view regarding, transactions in which a Section 351 transaction is used to seed a newly established ETF with assets that are consistent with the ETF’s investment thesis and that are intended and expected to be retained by the ETF absent a substantial change in circumstances,” the notice reads.

Indeed, there can be valid reasons for high-net-worth individuals and families to do a Section 351 exchange, said Joshua Norman, principal in the Bardstown, Kentucky, office of Cerity Partners. For example, a wealthy person might want to gift shares of an ETF to another individual who doesn’t want individual shares of stock. Also, converting separately managed accounts into ETFs can lessen the ongoing tax burden for wealthy individuals, enhancing after-tax returns.

Some ETF experts took the position that this language in the notice might lead to even more use of the strategy. “Non consensus view: Regulators opened the door this week for well designed 351s to hit the mainstream,” wrote Mel Faber, founder of ETF manager Cambria Funds, which has provided an overview of the strategy to investors.

Tax regulators are placing additional restrictions in order for the transfer to be considered tax-deferred.

“The timing behind it is also key,” Norman said.

The notice from tax regulators makes it clear that transactions that occur “shortly after” appreciated securities are contributed are suspect.

But the IRS did not elaborate on what this means, and that has left tax practitioners and legal professionals to expect further guidance.

How long “shortly thereafter” is will remain a gray area until tax regulators release additional guidance, Norman said.

Other tax experts agreed with this view.

“Regarding Treasury’s Rev. Rul. on §351 for seeding ETFs, I’m looking at 3 things as evidence of aggressive planning... 1) evidence of a plan 2) quick redemption following seed 3) a very different portfolio from the contribution. This leaves a lot of gray area and I think we’ll see many ‘facts and circumstances’ analyses in the coming months/years,” Brent Sullivan, a tax analyst who runs Tax Alpha Insider, a blog devoted to taxes and portfolio strategies, wrote on X.

The IRS and Treasury are requesting comments on the notice by October 28.

One thing regulators are not going to do is kill the idea of exchanging securities for shares, because all the big ETFs rely on redeeming and creating units that aren’t taxable as part of their daily operations. “It’s a multi-trillion-dollar industry,” Pantekidis said.

However, they will probably provide more guardrails for smaller ETFs that are creating units and immediately diversifying portfolios for tax advantages, he added.

Tax authorities are also looking more closely at additional strategies, according to the notice. These include transfers to partnerships in connection with Section 351 conversions and ETFs that use “box spread” strategies, which involve options and allow investors to defer capital gains.

“Tax practitioners must understand these highlighted strategies to advise clients on emerging audit exposures,” Ed Zollars, tax partner at accounting firm Thomas, Zollars & Lynch, wrote in a blog.

Congress could also decide to step in to make some changes to existing ETF regulations. For example, they could narrow how ETFs benefit by distributing appreciated securities, said Colon.

Gray suggests investors looking to manage capital gains taxes consider an exchange fund instead. It’s a private investment vehicle, typically structured as a limited partnership, that allows investors with concentrated, appreciated stock positions to pool their shares into a diversified portfolio, while deferring capital gains taxes. One disadvantage is the seven-year holding period for participants to redeem their units.

Investors can also use a charitable remainder trust to manage capital gains and losses, he said.

Nearly 200 People Under Observation After Irkutsk Lab Worker Dies From Plague

Health authorities in Siberia’s Irkutsk region have placed nearly 200 people under medical observation after a laboratory worker died from plague, according to media reports and a statement by a regional leader Friday.

Alexei Tsydenov, head of the neighboring republic of Buryatia, confirmed that the woman had died from an unspecified form of plague. Irkutsk officials had previously described the illness only as a “particularly dangerous infection.”

Citing information from Russia’s consumer safety watchdog Rospotrebnadzor and Buryatia’s government, Tsydenov said the woman had not visited his republic and that her infection was unrelated to the region.

“There are no plague outbreaks in the republic, including in areas bordering Mongolia,” he wrote on social media.

The woman was identified as Daria Sh., a 27- or 28-year-old employee of the Irkutsk anti-plague institute, by the exiled news outlet Lyudi Baikala (People of Baikal) and pro-Kremlin broadcaster REN TV.

She reportedly told medical staff that she had accidentally broken a test tube containing live bacteria while collecting samples for testing.

She was hospitalized Tuesday with symptoms of severe pneumonia in Shelekhov, a town near the regional capital of Irkutsk. She was placed on a ventilator and died Thursday, according to the reports.

The Shelekhov district hospital was placed under quarantine pending an assessment by a special commission.

At least 197 people who may have had contact with her were reportedly placed under medical isolation, including more than 100 in hospital wards.

Authorities canceled planned public events in Irkutsk, while law enforcement reportedly opened a criminal investigation into potential health safety violations resulting in death.

Irkutsk region Governor Igor Kobzev urged the public to remain calm after meeting with Rospotrebnadzor chief Anna Popova to coordinate emergency containment measures.

“All identified contact persons have been placed under medical observation. As of today, the contacts show no signs of illness, and their laboratory test results are negative,” Kobzev wrote on Telegram on Friday. He did not mention the reports of the laboratory worker’s death.

Media reports have described the suspected infection as pneumonic plague, which affects the lungs and can spread between humans through respiratory droplets. Tsydenov’s statement did not specify the form of plague.

FBI Made Over 8,900 Arrests, Located 1,410 Child Victims Under Operation Summer Heat 2.0

The Federal Bureau of Investigation has located 1,410 children and arrested 8,927 individuals in around three and a half months under Operation Summer Heat 2.0.

Compared to Operation Summer Heat 1.0, which concluded in 2025, arrests are up 3 percent and the number of children located is higher by 34 percent, according to a Sept. 30 post on X by FBI Director Kash Patel. A total of 5,013 weapons have been seized in the current operation, a 120 percent jump from last time.

Operation Summer Heat 2.0 - active between June 1 and Sept. 20 - included the seizure of more than 59,525 pounds of cocaine and more than 1,499 pounds of fentanyl. Six most-wanted fraudsters were caught during this period, while six alleged cybercriminals were extradited.

In an Aug. 29 post on Facebook, FBI Omaha said that under Operation Summer Heat 2.0, they worked with various state, local, tribal, and federal partners in Nebraska and Iowa, resulting in the arrest of around 95 individuals and the seizure of 119 weapons.

The FBI said in a Sept. 14 statement that the operation led to the arrests of 662 individuals across the state of Louisiana, with 315 firearms seized.

"Communities are safer because of our ongoing partnerships and initiatives like Operation Summer Heat 2.0," Special Agent in Charge Jonathan Tapp said in the statement. "Incarcerating a dangerous criminal for one night or even a few hours is 100 percent ineffective at maintaining public safety. However, putting them in prison for years, is a different story."

"This year, the FBI reported the largest year-to-year decrease in violent crime since we started collecting and reporting numbers in 1936," Tapp said.

Last year's Operation Summer Heat, which ran from June 24, 2025, to Sept. 20, 2025, had led to the arrests of 8,629 individuals, with 2,281 firearms being seized. In addition, 1,053 children were identified or located.

Poll: 6 In 10 Americans Oppose Democrats’ Plan To Pack The Supreme Court

Voters overwhelmingly want to keep the Supreme Court bench capped at nine justices, a new poll found, despite Democrats’ push to pack the court.

A new McLaughlin Associates poll found that voters overwhelmingly support keeping the Supreme Court at nine justices and back the “Keep Nine Amendment.”

The amendment sought to require that the Supreme Court be comprised of nine justices.Notably, nearly every single House Republican and one Democrat, Don Davis of North Carolina, supported the amendment during a Sept. 2 vote that came to 212-206. Fifteen members did not vote. The measure failed to get the two-thirds majority needed to pass it.

The new poll asked respondents: “Would you support or oppose an Amendment to the U.S. Constitution, Called ‘Keep Nine’ Which States: ‘The Supreme Court of the United States shall be composed of nine justices?'”

Amongst all respondents, nearly 64 percent supported the amendment while nearly 18 percent opposed it. When broken down among party lines, 46 percent of Democrats support the Keep Nine Amendment and 54 percent of independents support it.

Yet despite the public favoring keeping the court at nine justices by a more than 3-1 margin, Democrats are promising to expand the court should they take back power.

“Thirteen is a pretty good number,” Rep. James Clyburn, D-S.C., said on NBC’s Meet the Press in August. “A baker’s dozen would be a good number to have on the court.”

His calls for expanding the Supreme Court are among a cacophony of voices on the left who want to expand the bench should Democrats take back power.

Former Vice President Kamala Harris advocated for expanding the bench to 13 justices and has called for Supreme Court reform. Rep. Pramila Jayapal, D-Wash., said in June that Democrats are “absolutely” going to try and expand the court after the Supreme Court’s decision on Temporary Protected Status.

Rep. Chris Deluzio, D-Penn., said just last month that he would support “legislation that adds additional justices.”

Georgia State Election Board asks Justice Department to investigate voting machines

The Georgia State Election Board asked the Justice Department this week to investigate the state’s voting systems as voters and the state prepare for the midterm elections next month.

The election board's executive director, James Mills, penned the letter to Attorney General Todd Blanche and Assistant Attorney General for Civil Rights Harmeet Dhillon on Wednesday.

The leader asked the officials to require an update to the state’s voting machine software and prohibit the use of QR codes for ballot tabulation amid concerns about potential software vulnerabilities. State election officials have said updating the software cannot be completed before voting begins because it is a months-long process.

President Donald Trump is planning to visit at least 10 states during the final month before the midterm elections, embarking on an aggressive blitz as Republicans fight to maintain control of Congress.

Trump’s planned travel will take him to nearly every major battleground except for Maine, where Sen. Susan Collins (R-ME) is defending her seat against Democratic challenger Troy Jackson. Argentina is putting a price on citizenship as President Javier Milei searches for dollars to help the country meet its debts

BUENOS AIRES, Argentina - Argentina on Friday announced plans to offer citizenship to wealthy foreigners in exchange for cash contributions or investments in government bonds, as libertarian President Javier Milei seeks new sources of dollars for the debt-burdened nation.

Economy Minister Luis Caputo unveiled the so-called “golden passport” scheme at an investor event in Paris, saying applications are expected to open before the end of the year.

Applicants have two options: make a nonrefundable $350,000 contribution to the Argentine Treasury or invest $800,000 in a new government bond that must be held for seven years. Contributions would increase depending on family size, with a family of four expected to pay $500,000, officials said.

Securing dollars is critical for Milei as he prepares to seek reelection next year. Argentina’s Treasury faces nearly $25 billion in foreign-currency debt payments coming due in 2027. But having narrowed its financing options by holding off on a return to international bond markets, the government is searching for alternative sources of revenue.

A consortium of investment firms advising the government estimated that the paid-citizenship program could raise up to $2.5 billion for Argentina if it receives the expected number of applicants.

Citizenship with global reach

So-called “golden visa” programs have become increasingly common among cash-strapped countries battling to attract deep-pocketed foreigners, with about 60 nations offering residency privileges in exchange for one-off investments. U.S. President Donald Trump launched his own “gold card” program for the U.S. last year.

Citizenship-for-investment programs go further, offering more rights and a passport that opens doors abroad. Only about a dozen countries have active programs, including small Caribbean island states.

Argentina, a G-20 nation of 46 million people home to a vast Patagonian wilderness and culturally vibrant capital, is set to become the first South American country to join their ranks.

“The Argentine passport is highly valued, accepted in more than 140 countries,” Caputo said, referring to destinations Argentines can visit without obtaining a visa in advance — from China and Russia to Europe’s Schengen area and most of Latin America.

For wealthy people from countries that face visa restrictions, whether in Southeast Asia or the Arab world, Argentine citizenship could make it easier to travel and do business internationally, said Kristin Surak, a professor at the London School of Economics and author of “The Golden Passport: Global Mobility for Millionaires."

"It’s not only the benefits that you get within Argentina,” she said. “You also get benefits globally in terms of where you can go.”

A second passport as a Plan B

The clientele of such programs has shifted since the COVID-19 pandemic, industry experts say, with more Americans and Europeans — whose passports already offer extensive visa-free travel — seeking a foothold abroad as an escape hatch at a time of mounting geopolitical uncertainty.

“The Southern Cone of South America is the ultimate Plan B destination. It’s not on the way to anywhere strategically important. It’s a region that’s always staying out of global armed conflict,” said Christian Nesheim, editor of Investment Migration Insider, a trade journal. “It’s self-sufficient when it comes to food, to energy.”

Left wing author Malcolm Gladwell recently appeared on MSNOW’s ‘Morning Joe’ and suggested that the Second Amendment of the U.S. Constitution, which guarantees American citizens the right to bear arms,was really written about slave patrols.

He spends much of the segment complaining about the Supreme Court, which he says has been ‘a significant impediment’ in the left’s pursuit of gun control.

The most amazing thing is that what he is saying here is treated as completely normal by the hosts, who do not interrupt or correct him in any way.

MIKE BARNICLE, MS NOW CONTRIBUTOR: What do you say about a culture, American culture, that when a disease is identified and it’s threatening and it’s killing people, you can talk about from the inception of polio vaccines through AIDS, we — we react, we find — we find a cure almost immediately. People feel relieved. Guns have been killing Americans on the streets for decades — decades. And there’s nothing we can do.

GLADWELL: Yeah. I mean, here I have two chapters in the book on the Supreme Court. And the Supreme Court has been a significant impediment here. They have — the last two major gun rulings — in the Bruen case and the Heller case — are abominations. And I had — I actually have fun with them because in both of those cases, the court plays historian and plays linguist, because in the Heller case, of course, Scalia famously.

And the — and the fellow justices try to make sense of the grammatical convolution that is the Second Amendment, which, if you read, makes — no one would ever write that sentence today. It makes no sense whatsoever. It’s commas everywhere. There’s this weird initial what’s called an initial being clause. Does it modify the main clause? And all of these linguists lined up and told the court, “Okay, here’s how people in the 18th century used an initial being clause — here’s how James Madison used that clause. Here’s what James Madison meant.” What he meant was, we’re talking about militias here, and by militias he meant slave patrols, right? And the court had no interest.

It’s amazing that someone with these views is allowed go on cable news and spread this insanity with absolutely no push back.

It’s outrageous enough that Donald Trump’s Justice Department has targeted the prosecutors who investigated the scandal-plagued Republican president. Though it seems hard to believe, it adds insult to injury to learn that the hyperpoliticized DOJ is also taking a fresh look at the prosecutors who investigated a different scandal-plagued Republican president.

The Wall Street Journal reported:

The department is reviewing whether the special prosecutor’s office that investigated the famed Watergate break-in committed misconduct, according to people familiar with the matter, more than half a century after that scandal led to Nixon’s resignation.

Geoff Shepard, a former Nixon aide turned Watergate historian and revisionist,recently gave a two-hour presentation at Justice Department headquarters that laid out his theory that the deep state took Nixon down.

The title of his 78-page slide deck: “Watergate As Lawfare.”

According to the Journal’s article, it was just last month when a senior Justice Department official invited Shepard to come to Main Justice and make his case before the Office of Professional Responsibility. A Justice Department spokesperson confirmed on the record that this actually happened.

“The review is preliminary,” the Journal said, “and it isn’t clear whether it will lead to a full-fledged probe.”

If this sounds at all familiar,it’s because Team Trump has been focused on Nixon and Watergate quite a bit lately.

Just a few months ago, for example,Ed Martin, before he stepped down as the highly controversial U.S. pardon attorney,published a bizarre item to social media, arguing that the Watergate scandal was a “hoax” orchestrated in part by the CIA.

Martin added, “The only thing worse than the lying CIA is the two-faced liar John Dean [who served as Nixon’s White House counsel] and the fiction-writer [Bob] Woodward. May they suffer in eternity.”

The Republican activist’s claims were ridiculous, but hours later they were nevertheless endorsed by Monica Crowley, a former Fox News personality who currently serves as the Trump administration’s chief of protocol.

“President Nixon was the target of a Deep State hoax,” Crowley wrote online while referencing Martin’s tweet. “He will be vindicated.”

Days later, JD Vance appeared at the Richard Nixon Presidential Library and Museum in California, where the vice president kept the rhetorical campaign going.

After arguing that Nixon’s legacy is “enjoying a bit of a renaissance,” the Ohio Republican said, “As I joked … backstage, if Watergate happened tomorrow, it would be, like, a 12-hour news story. The idea that it would have taken down a presidency is crazy.”

As part of the same comments, Vance argued in apparent seriousness, “If you look at the story of how the deep state took down Richard Nixon, it’s not all that different from what the same groups of people, the same institutions, tried to do to Donald Trump in the first Trump administration.”

There were all kinds of problems with Vance’s pitch, including the simple fact that it’s bonkers to think Nixon was brought down by nefarious government insiders who plotted against him. We have, after all, heard the tapes. Nixon chose to engage in systemic abuses. His crimes were his own, not the fault of “the deep state,” whether Republicans choose to acknowledge reality or not.

Historian and journalist Garrett Graff, who wrote one of the defining books about Watergate, described Vance’s comments as “shockingly” ahistorical and an “immature understanding of what Watergate was and wasn’t.”

The Justice Department has asked state officials to provide voter names, dates of birth, residential addresses, driver’s licenses and Social Security data.

While many states have complied, the Justice Department has sued 30 states and Washington, D.C., for refusing.

The Justice Department is seeking voter registration list data from all 50 states and the District of Columbia as part of what they consider to be their responsibility to “ensure that states have proper and effective voter registration and voter list maintenance programs.”

While many states have complied with the requests, the department has filed lawsuits against 30 states and Washington, D.C., for refusing.

The Justice Department has said it must comply with the president’s March 2025 executive order, which requires the attorney general to “ensure compliance” with voter registration laws, and to “take appropriate action with respect to states that fail to comply” with voter laws.

The requests were unusual. The Justice Department has asked for information from states on elections before, but not voter registration databases from so many states.

States run their own elections and maintain their own voter data. There is no national database of voters, and the federal government does not oversee U.S. elections.

But President Donald Trump, who still falsely maintains the 2020 election was stolen and that there is widespread voter fraud though members of his own administration have said there was no evidence to back up those claims, has suggested that Republicans should nationalize elections. That move would violate the U.S. Constitution.

The Justice Department is asking states to agree to what they call a “confidential memorandum of understanding,” which would require states to include voter names, dates of birth, residential addresses, state driver’s licenses and the last four digits of their Social Security numbers.

The DOJ says that after the states hand over the data, they’ll alert the officials to any “voter list maintenance issues, insufficiencies, inadequacies, deficiencies, anomalies, or concerns, the Justice Department found when testing, assessing and analyzing” the state’s voter registration lists.

Notably, six Republican-leaning states have refused to turn over their data: Idaho, Utah, West Virginia, Kentucky and Georgia. And not every state that has handed over their data has agreed to sign the agreements; Iowa, Mississippi, South Dakota and Tennessee did not.

They’ve sued secretaries of state, elections commissions and boards of elections around the country in their efforts to get this information that they say will be used to look into any potential “voter list maintenance issues, insufficiencies, inadequacies, deficiencies, anomalies or concerns.”

Dismissal appealed:

Arizona, California, Colorado, Connecticut, Illinois, Kentucky, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Hampshire, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Virginia, West Virginia and Wisconsin.

Dismissal affirmed by appeals court:

Michigan.

Litigation dismissed:

Georgia, Vermont and Washington.

Outliers:

The Justice Department reached a settlement with Oklahoma, with the state agreeing to provide voter data in exchange for the DOJ dismissing the lawsuit. The Justice Department and the North Carolina State Board of Elections reached a legal settlement on the issue. North Dakota has been discussing a potential information-sharing agreement with the DOJ, and no lawsuit has been filed.

In Alabama, a request for data was made but state officials didn’t respond to questions about where that request stands. In North Dakota, the Justice Department was in discussions with the state over supplying the data as of last summer, according to the Brennan Center for Justice, which tracks the cases.

States that willingly provided voter data:

Iowa, Wyoming, South Dakota, Nebraska, Ohio, Indiana, Texas, Alaska, Louisiana, Mississippi, Arkansas, Tennessee, South Carolina, Florida, Missouri, Kansas and Montana.

New York City plans to give up to $100,000 in taxpayer dollars for their first home. It won’t ask if you are here illegally. And the city made sure to let illegal immigrants know this. They don’t need a Social Security number, can bypass traditional credit checks, and can use municipal credit checks, at least initially.

The City’s HomeFirst program gives $100,000 for a down payment or closing costs.

The City’s website says, “You will not be asked about your immigration status when you apply.”

Just imagine the fraud.

It’s paid for with city and federal tax dollars, and the loan is forgiven if they stay in the home long enough. Young Americans who were born here can’t afford a starter home, and Democrats are using their tax money to help people who may not even be here legally buy one.

Noncitizens don’t need a Social Security number or taxpayer identification number. It’s by lottery. If selected, the noncitizen can bypass traditional credit checks. They can also use alternative forms of identification, like municipal IDs, initially.

This is not generosity or compassion. It’s theft and Marxist redistribution. It’s communism.

I don’t understand how they are allowed to use federal tax dollars. It sounds illegal.

Judging by what this article actually SAYS, it's NOT the administration that's the problem, it's Congress:

The appearance of debate inside the administration suggests the possibility of a growing crackdown, but real action to sharply limit H-1B visas would require congressional action. Many bills on that topic are parked in committee, right now, and here’s one example as a closing thought: The “High-skilled Immigration Reform for Employment Act,” H.R.6305, was introduced in November by Rep. Raja Krishnamoorthi, an Illinois Democrat. It would sharply increase the annual cap on new H-1B visas, from 65,000 a year to 130,000.

As Krishnamoorthi notes in his press release on the bill, “The legislation is supported by ITServe Alliance, the nation’s largest association of IT services organizations.”

Elections matter.
