Jeff Sessions testifies for defense in hip-hop star Pras Michel’s illegal lobbying trial

Published: Apr. 18, 2023, 6:07 p.m.

Former U.S. Attorney General Jeff Sessions on Tuesday took the stand as a defense witness in the illegal lobbying trial of hip-hop star Pras Michel, testifying that he could not recall meeting Michel and that the Fugees rapper’s request for a meeting did not appear improper.

Michel was charged in 2021 by federal prosecutors in Washington with participating in an illegal lobbying campaign to have a dissident Chinese businessman deported and for DOJ officials to drop an embezzlement investigation involving a Malaysian sovereign wealth fund.

On Tuesday, Sessions recalled two meetings where DOJ officials discussed deporting the dissident, Guo Wengui, including one requested by a Chinese vice minister for public security, Politico reported.

But Sessions said Guo wasn’t deported when he was attorney general and he never took the meeting requested by the Chinese official.

Sessions, the longtime former U.S. Senator from Alabama, also testified that he was unaware of ever meeting Michel.

“I don’t recall ever having met him,” Sessions said, according to Politico.

Still, said Sessions, Michel’s request for a meeting did not have an air of impropriety on its face.

“I think that’s an appropriate action, although the State Department would have an important role to play in that and others, perhaps Homeland Security, since this figure was important to China,” he said.

While federal prosecutors allege Michel acted as an unregistered agent on behalf of China and a Malaysian national, the Fugees rapper claimed he was acting in a humanitarian capacity.

Rare solar eclipse to cross remote Australia, Indonesia

A rare solar eclipse will cross over remote parts of Australia, Indonesia and East Timor on Thursday.

The lucky few in the path of the hybrid solar eclipse will either get plunged into the darkness of a total eclipse or they’ll see a “ring of fire” as the sun peeks out from behind the moon.

The eclipse path will swoop from the Indian Ocean to the Pacific Ocean, mostly over water. For those viewing the total eclipse, it will last a little over a minute.

Such celestial events happen about once every decade: The last one was in 2013 and the next one isn’t until 2031. They occur when Earth is in the “sweet spot” so the moon and the sun are almost the exact same size in the sky, said NASA solar expert Michael Kirk.

At some points, the moon is a little closer and blocks out the sun in a total eclipse. But when the moon is a little farther away, it lets some of the sun’s light peek out in an annular eclipse. …

Who is Harlan Crow?

https://en.wikipedia.org/wiki/Harlan_Crow 1949 (age 73–74) Dallas, Texas, U.S. Education	Emory University University of Texas, Austin (BA) Occupation	Real estate developer Political party	Republican

Harlan Rogers Crow (born 1949) is an American real estate developer. Born in Dallas, Texas, he is the chairman (and former CEO) of Crow Holdings, which was founded by his father, Trammell Crow. He is a leading donor to Republican and conservative causes.Crow became the subject of controversy in 2023 relating to his gifts to Supreme Court Justice Clarence Thomas.

Career He worked as a leasing agent for Trammell Crow Houston Industrial from 1974 to 1978 and managed the Dallas Office Building development operations of Trammell Crow Company from 1978 to 1986. He then served as President of the Wyndham Hotel Company from 1986 to 1988. He assumed responsibility for Crow Holdings in 1988,[2] doing so during a downturn in the company's finances. Crow diversified the company and took on more property management business, revitalizing the company.[3] He currently serves as chairman[2] and was formerly its chief executive officer.[4]

Political activities He is a member of the founding committee of the 501(c)4 organization Club for Growth, and has served on the board of the American Enterprise Institute since 1996.[5][6][7] He has donated almost $5 million to Republican campaigns and conservative groups. Crow is a member of the all-maleBohemian Club, and as early as 1997 he had hosted Supreme Court Justice Clarence Thomas as a guest at the group's annualBohemian Grovesummer gathering,[8][9] having met Thomas in the mid-1990s.[3] He is also a friend and former business partner of the publisher Wick Allison.[10]

Crow donated $500,000 toward publicity campaigns forPresident George W. Bush's nominees for the Supreme Court.[3] According to Politico, that same year, he provided $500,000 to Liberty Central, which was established by Virginia Thomas, the wife of Justice Thomas.[12] Crow declined to comment on whether he was the anonymous donor in question, telling The New York Times, "I don't disclose what I'm not required to disclose."[13]

Undisclosed gifts allegations In 2023, ProPublica reported that Crow has given several gifts to Associate Supreme Court Justice Clarence Thomas, including a $19,000 Bible that belonged to Frederick Douglass. Crow gave Thomas a portrait of the justice and his wife, according to the painter, Sharif Tarabay. Tax filings show that Crow's foundation also gave $105,000 to the Yale Law School, Thomas's alma mater, for the "Justice Thomas Portrait Fund". Justice Thomas has accepted numerous week-long luxury trips, including island-hopping on Crow's superyacht, international and domestic private jet travel, and private resort stays.[14] Under rules that went into effect on March 14, 2023, justices must disclose many forms of gifts they receive; but exceptions exist if a gift of food, lodging, or entertainment is deemed "personal in nature" and the hospitality has been directly offered by an individual who has a personal relationship to the government official in question.[15] The new rules do however require disclosure of stays at commercial properties as well as private jet travel.[16]

Legal experts cited by ProPublica say that Thomas did not disclose the gifts, violating a financial disclosure law and ethical norms for judges.[14][17] According to Crow, he has "never sought to influence Justice Thomas on any legal or political issue".[3] Democratic lawmakers reacted to the revelations by demanding Thomas' resignation and calling for an investigation.[16]On April 13, 2023, ProPublica reported that Crow had quietly paid Thomas for property occupied by Thomas's mother's home, despite law requiring disclosure of property sales by public officials.[18]Crow said he bought the property with the intent of later turning the home into a public museum dedicated to Thomas. Allegations have risen that Crow has been "subsidizing the lifestyle of Thomas and his wife" as Thomas continued to support conservative causes on the Supreme Court.[19]

Art and memorabilia collections'Crow's Dallas residence is home to an extensive collection of Nazi memorabilia, including two paintings by Adolf Hitler and a signed copy of Mein Kampf.[20][21][22]

Crow's backyard garden is home to at least 20 statues of authoritarian leaders and Communist icons, including Vladimir Lenin, Joseph Stalin, Fidel Castro, Mao Zedong, Karl Marx, Hosni Mubarak, Josip Broz Tito, Nicolae Ceausescu, Walter Ulbricht, Gavrilo Princip, Bela Kun, and Che Guevara.[23][24][25] Crow acquired these former public monuments after the collapse of the Soviet Union and the Eastern Bloc.[26] According to Crow, he collects such memorabilia because he "hates communism and fascism".

The Family "Business"…

Trammell Crow Company

Main article: Trammell Crow Company

By 1970, Crow had developed the Trammell Crow Company into a nationwide organization, another innovation in a field that was, at the time, dominated strictly by local builders.

Forbes in 1971 and The Wall Street Journal in 1986 called Crow the largest landlord in the US. The Journal said the company he founded was then the largest developer in the nation.

Crow once had interests in nearly 300,000,000 square feet (28,000,000 m2) of developed real estate, comprising eight thousand properties in more than one hundred cities. Crow's holdings were said to be much larger than those of the better-known William Zeckendorf and Donald Trump and include hotels, hospitals, residential developments, and – just as in the early days of the company – warehouses.[citation needed] The Austin Business Journal said in its profile of TCC, "When compared to Trammell Crow, other real estate companies are for the birds."[5]

Yahoo! Finance, also making a joke about the Crow name, said in its company profile: "It takes a tough bird to succeed in the real estate business, and Trammell Crow Company is one of the cocks of the walk." Calling the organization "one of the top diversified real estate management companies in the US," the profile estimates that the company manages nearly 550,000,000 square feet (51,000,000 m2) of warehouse, service center, and retail space in the United States and Canada.[6]

As of June 2007, the company was set to grow even further with the scheduled $60 million purchase of the HealthSouth headquarters building in Birmingham, Alabama.[7]

The Trammell Crow Company was privately held until 1997 when it went public on the New York Stock Exchange (NYSE) under the symbol TCC. In 2006, the firm was sold to CB Richard Ellis group (NYSE:CBRE) for approximately $2.2 billion.

Billionaire linked to Sarah Ferguson accused of financing sex trafficking ring

Trammell Crow Jr, who reportedly met with the Duchess on his Texas ranch this year, faces a lawsuit from two women

By Rozina Sabur, Washington Editor 20 March 2023 • 8:53pm

A billionaire Texan property tycoon linked to the Duchess of York has been accused of financing a sex-trafficking ring in the US.

Trammell Crow Jr, who Sarah Ferguson has reportedly struck up a friendship with, has been named in a lawsuit by two women who claim he financed a sex and labour trafficking venture.

Mr Crow, 72, a property magnate and environmental philanthropist, met with the Duchess on his ranch near Austin, Texas earlier this year according to The Sun.

Mr Crow inherited his large fortune from his father Fred Trammell Crow, once known as America’s biggest landlord and a major Republican donor.

He reportedly struck up an unlikely friendship with the Duchess over their “shared interest in environmental issues".

It has since emerged that Mr Crow is facing a lawsuit from two women who claim they were sexually abused in a trafficking venture for which he provided the “essential financial assistance”.

Mr Crow's lawyer, Ken C Stone, said the accusations were “absurd and blatantly false”.

It is another embarrassing episode for the Duke and Duchess of York, following Prince Andrew’s settlement over sex abuse claims last year.

The lawsuit, filed in California last November, names Mr Crow “and at least eight other prominent Texas businessmen” in the venture.

The filing claims the trafficking venture made one of the women became "a virtual long-term sex slave" and claims another of the women was also beaten and raped.

The trafficking ring utilised doctors, a police officer and others to keep the women drugged and become “an illegal racketeering enterprise”, the lawsuit claims.

It claims Mr Crow was involved at the very start of the trafficking ring in 2010, and knew “all the details of the force, fraud, threat, and coercion… and without him the venture never could have succeeded”.

It further claims the Texan billionaire maintained what he called "lingerie rooms" in his properties, "in which he kept a variety of lingerie for female guests to wear, as well as what he called ‘stripper shoes’.”

Some of the defendants in the lawsuit have filed a motion to dismiss the case. Mr Crow is expected to ask for the case to be dismissed at a hearing soon.

It comes as the Duchess and her ex-husband Prince Andrew fear losing their £30m Royal Lodge home in Windsor.

Prince Andrew stepped back from Royal duties after he reached an out-of-court financial settlement with his accuser Virginia Roberts Giuffre, who claimed he sexually abused her when she was 17.

The Duchess, 63, was reported to have flown to meet with Mr Crow earlier this month. A source told The Sun: “Officially they’ve bonded over a shared interest in environmental issues, but it feels like a lot of discussions and a lot of air travel to solely discuss green matters.”

A spokesman for the Duchess told the newspaper: “The Duchess has only met Mr Crow once with others to discuss environmental issues.”

The Duchess was reportedly unaware of the allegations against the businessman and has no plans to work with or meet him again.

Mr Crow's lawyer, Mr Stone, told The Sun the story shared in the lawsuit was “upsetting and paints a picture of numerous troubled and broken domestic relationships.

The Washington state legislature has officially passed the ban an semi-automatic firearms, which they are calling “assault weapons.”

@GovInslee is expected to sign the legislation tomorrow.

My MK Ultra mind control owner since I was 13, US Sen Byrd, had an office in the FBI building to set up National Center for Missing & Exploited Children as a catch net operation for any child who escaped human trafficking ops since mid '80's.

Its time NCMEC and FBI were defunded

Every year, the National Center for Missing & Exploited Children® (NCMEC) honors people who go above and beyond to help protect our nation's most valuable resource - our children, but this year they decided to honor a guy who is accused of Child Trafficking and should be locked up! He is a criminal and would be a danger to ALL children! You can’t make this 💩 up 🤡 🤬

==The Year of Section 702 Reform=

Closing the Gaps and Completing the Modernization of FISA

In a previous post, I described the political landscape for this year’s Section 702 reauthorization debate and noted the view of most observers that Section 702 is unlikely to be reauthorized this year without significant reforms. I outlined four key areas of reform and discussed the first of these: closing the backdoor search loophole. In today’s post, I discuss the second area of needed reform: closing gaps in the law that permit the collection and use of Americans’ communications and other Fourth Amendment-protected information without statutory authorization or judicial oversight.

There are two primary gaps that Congress must address. First, changes in communications technology since FISA’s 1978 enactment have dramatically altered the reach of the law. In 2008, Congress addressed one of the unintended outcomes of these changes: The government was required to obtain FISA Court orders to collect purely foreign communications, simply because they were routed through or stored in the United States. However, Congress failed to fully address the flip side of the issue: massive amounts of Americans’ communications and other sensitive information are routed and stored overseas, rendering them vulnerable to collection outside any statutory framework. To complete the modernization of FISA that began with Section 702, Congress must close this critical gap in coverage.

Second, after 9/11, the government sought to evade FISA’s substantive and procedural constraints by relying on claims of inherent executive authority. Congress responded by reaffirming that FISA was the exclusive means by which the government could conduct “electronic surveillance.” Because of the highly technical definition of that term, however, the exclusivity provision fails to reach many types of collection covered by FISA. There is ample reason for concern that the government is exploiting these gaps to collect some of the most sensitive data Americans generate without adhering to FISA’s requirements — including by purchasing it from data brokers. Congress should fill the holes in FISA’s exclusivity provision and bar the government from buying its way around FISA and other legal restrictions on governmental access to Americans’ data. …

New York Judge Tells Manhattan DA Alvin Bragg His Office Must Testify to Congress

theconservativetreehouse.com/blog/2023/04/20/new-york-judge-tells-manhattan-da-alvin-bragg-his-office-must-testify-to-congress

April 20, 2023

Political DA Alvin Bragg was smacked down pretty hard by a New York judge Wednesday, telling his office there is no legal mechanism to avoid accountability and testimony before Congress.

The DA office took federal funds to prosecute Donald Trump, the DA office is interfering in a federal election, the DA office has openly stated their intentions are politically motivated, and therefore the DA office has no standing to try and avoid federal legislative scrutiny.

As Judge Mary Kay Vyskocil clarified to Bragg’s team, she has no standing to block a legislatively authorized congressional subpoena.

New York – […] “The sole question before the Court at this time is whether Bragg has a legal basis to quash a congressional subpoena that was issued with a valid legislative purpose. He does not,” Vyskocil wrote in her decision Wednesday.

Bragg, a Democrat, has accused Jordan of pursuing the subpoena to score political points while supporting Trump, a Republican. Vyskocil said the dispute appeared political, but said that did not impact her decision.

“In our federalist system, elected state and federal actors sometimes engage in political dogfights,” Vyskocil wrote in her order, noting that Bragg is an elected official. “Bragg complains of political interference in the local DANY case, but Bragg does not operate outside of the political arena.”

“Jordan, in turn, has initiated a political response to what he and some of his constituents view as a manifest abuse of power and nakedly political prosecution, funded (in part) with federal money, that has the potential to interfere with the exercise of presidential duties and with an upcoming federal election,” Vyskocil wrote. “The Court does not endorse either side’s agenda.”

The subpoena to Pomerantz demands his appearance before the Judiciary Committee on Thursday. It is unclear if he will appear. A spokesperson for Bragg said Wednesday, “We respectfully disagree with the District Court’s decision and are seeking a stay pending appeal.”

Vyskocil denied Bragg’s request for a stay Wednesday night. (read more) https://www.cbsnews.com/news/judge-rules-against-manhattan-da-alvin-bragg-mark-pomerantz-house-judiciary-committee/

Video shows human smuggler attempt to run over Texas state trooper

Troopers continue to engage in dangerous, high-speed pursuits of human and drug smugglers, some with open arrest warrants.

warrants, and apprehend mostly single, military-age men who’ve illegally entered the U.S.

In one instance, human smugglers during a high-speed chase attempted to run over a Texas State Trooper. The incident was caught on body camera footage.

The drivers who have open warrants are the most dangerous, law enforcement officials have explained to The Center Square, because they have the most to lose if they get caught. They are often illegally carrying firearms and in one recent incident, one tried to run over a state trooper, authorities said.

Most smugglers are responding to ads on social media to smuggle people from the border to larger cities in Texas, according to DPS. Prices for smuggling vary depending on the location, distance to travel, and number of people in the car, but if caught, result in multiple felony counts.

In Kinney County, on April 13, a DPS OLS trooper stopped the driver of a black Volkswagen Passat for a traffic violation on Highway 277, which runs parallel to the Rio Grande River. Upon inspection, he learned the driver had picked up four Mexican nationals, including one minor, who’d entered the country illegally, DPS spokesperson Lt. Chris Olivarez said.

The driver, from Houston, responded to a Craigslist ad to smuggle people from the border.

“Criminal smuggling organizations continue to recruit drivers through social media and advertisements. The driver was recruited through Craigslist,” Olivarez tweeted with accompanying photos.

The Craigslist ad, listed under “Houston, labor gigs,” states, “Transportation Gig Available! All you need is a Vehicle… ALL Vehicle Types Wanted. Payout Same Day and CASH ON DELIVERY!!”

Earlier this month, DPS troopers engaged in a high-speed pursuit on Highway 90 in Kinney County after the driver of a vehicle failed to pull over for a traffic violation. DPS troopers pursued him from behind and drove in front to prevent him from getting away. The driver veered off and on the highway and into the lane on the opposite side of the highway. He eventually lost control of his vehicle and crashed into a fence.

IRS whistleblower alleges cover-up of Hunter Biden tax evasion in bombshell letter to Congress

https://nypost.com/2023/04/19/irs-whistleblower-alleges-cover-up-of-hunter-biden-tax-evasion/

WASHINGTON — An IRS whistleblower has informed Congress that he wants to come forward to reveal a coverup in the tax evasion investigation focused on first son Hunter Biden, according to a letter obtained by The Post. A lawyer for the official told a group of congressional committee leaders Wednesday that he wants to expose “preferential treatment” and false testimony to Congress by a “senior political appointee.” The unnamed whistleblower is “a career IRS Criminal Supervisory Special Agent who has been overseeing the ongoing and sensitive investigation of a high-profile, controversial subject since early 2020,” attorney Mark Lytle wrote to nine members of Congress. Although Hunter, 53, isn’t named in the letter, a congressional source confirmed the complaint pertains to the first son, who reportedly borrowed about $2 million last year to pay off a tax bill assessed on income earned overseas. Lytle did not immediately respond to The Post’s request for comment, but in an interview with “CBS Evening News” said that his client has worked at the IRS for more than a decade and has extensive documentation. “It really doesn’t come down to his credibility, whether you believe him or not,” Lytle said. “Because the things he’s been through are very well documented in emails, and other communications with the Department of Justice.” The White House referred The Post’s request for comment to the IRS and the Justice Department, which did not immediately respond. Representatives of Hunter Biden also did not respond. Lytle addressed his Wednesday letter to the top Republican and Democratic members on the Senate Finance and Judiciary Committees and on the House Judiciary and Ways and Means Committees, in addition to whistleblower caucus co-chair Sen. Chuck Grassley (R-Iowa).

“Despite serious risks of retaliation, my client is offering to provide you with information necessary to exercise your constitutional oversight function and wishes to make the disclosures in a non-partisan manner to the leadership of the relevant committees on both sides of the political aisle,” Lytle wrote.

“My client has already made legally protected disclosures internally at the IRS, through counsel to the US Treasury Inspector General for Tax Administration, and to the Department of Justice, Office of Inspector General. The protected disclosures: (1) contradict sworn testimony to Congress by a senior political appointee, (2) involve failure to mitigate clear conflicts of interest in the ultimate disposition of the case, and (3) detail examples of preferential treatment and politics improperly infecting decisions and protocols that would normally be followed by career law enforcement professionals in similar circumstances if the subject were not politically connected.” The bombshell allegations have yet to be fleshed out by congressional investigators, but come as Republicans probe President Biden’s role in Hunter and first brother James Biden’s foreign business dealings dating to their powerful relative’s vice presidency. Lytle, who previously represented ex-Twitter employee Yoel Roth during the House Oversight Committee’s probe of government pressure on social media companies to censor content, wrote that tax-record privacy laws add a layer of complexity that will require guidance from Congress. “Some of the protected disclosures contain information that is restricted by statute from unauthorized disclosure to protect taxpayer and tax return information,” Lytle wrote. “My client would like to share the same legally protected disclosures with Congress pursuant to 26 U.S.C. § 6103(f)(5) and the protections afforded by 5 U.S.C. 2302(b)(8)(C)—that he has already shared with other oversight authorities. Out of an abundance of caution regarding taxpayer privacy laws, my client has refrained from sharing certain information even with me in the course of seeking legal advice. Thus, it is challenging for me to make fully informed judgments about how best to proceed.”

Robert F. Kennedy Jr. Kicks Off Democratic Presidential Candidacy Campaign

2:06:01

"I've come here today to announce my candidacy for the Democratic nomination for the President of the United States. My mission over the next 18 months of this campaign and throughout my presidency will be to end the corrupt merger of state and corporate power that is threatening now to impose a new kind of corporate feudalism on our country. They commoditize our children, our purple mountains majesty, to poison our children and our people with chemicals and pharmaceutical drugs, to strip-mine our assets, to hollow out the middle class, and keep us in a constant state of war."

“This is what happens when you censor someone for 18 years. I got a lot to talk about. They shouldn’t have shut me up for that long. Now I’m going to really let loose on them. For the next 18 months, they are going to hear a lot from me.”

6-year-old girl, parents shot after basketball rolls into man’s North Carolina yard

A North Carolina 6-year-old and her parents were shot Tuesday night by an angry neighbor who fired at them after a basketball rolled into his yard, a report.

Kinsley White was wounded along with her mother Ashley Hilderbrand and father William White when a gunman opened fire at around 8 p.m. in Gaston County after he became enraged about the bouncing ball,

White was critically injured attempting to protect his daughter.

Neighbors told the station a group of kids was playing basketball when the ball bounced into the alleged gunman’s yard.

Suspected shooter Robert Louis Singletary grew angry and ran down the street as he fired at a neighbor, they reportedly said.

Then he came back and began shooting at the family, including the young daughter who needed stitches on her face from bullet fragments, WSOC-TV reported.

Her father was also hit, and is still in the hospital Wednesday, police said.

He reportedly tried to draw gunfire toward him to keep his kids safe before he was struck in the back.

“We don’t even know the man,” Kinsley told the station, adding. “Why did you shoot my daddy and me? Why did you shoot a kid’s dad?”

Hilderbrand was grazed by a bullet and is recovering at home with her daughter, WSOC-TV reported. Neighbors told the station Singletary allegedly kept shooting until he was out of bullets.

“He looked at my husband and my daughter and told them, ‘I’m going to kill you,’” Hilderbrand told the station.

Authorities said Singletary, 24, is still on the lam.

The department is seeking the public’s help in locating and arresting the fugitive, offering a $1,000 reward.

“I want to say to the people of Gaston County – this sort of violence will not stand,” Police Chief Stephen Zill said in a statement, noting the US Marshals are not involved in the search for Singletary.

Bombshell filing: 9/11 hijackers were CIA recruits

thegrayzone.com/2023/04/18/9-11-hijackers-cia-recruits

Kit KlarenbergApril 19, 2023

At least two 9/11 hijackers had been recruited into a joint CIA-Saudi intelligence operation that was covered up at the highest level, according to an explosive new court filing.

A newly-released court filing raises grave questions about the relationship between Alec Station, a CIA unit set up to track Al Qaeda chief Osama bin Laden and his associates, and two 9/11 hijackers leading up to the attacks, which was subject to a coverup at the highest levels of the FBI.

Obtained by SpyTalk, the filing is a 21-page declaration by Don Canestraro, a lead investigator for the Office of Military Commissions, the legal body overseeing the cases of 9/11 defendants. It summarizes classified government discovery disclosures, and private interviews he conducted with anonymous high-ranking CIA and FBI officials. Many agents who spoke to Canestraro headed up Operation Encore, the Bureau’s aborted, long-running probe into Saudi government connections to the 9/11 attack.

Despite conducting multiple lengthy interviews with a range of witnesses, producing hundreds of pages of evidence, formally investigating several Saudi officials, and launching a grand jury to probe a Riyadh-run US-based support network for the hijackers, Encore was abruptly terminated in 2016. This was purportedly due to a byzantine intra-FBI bust-up over investigative methods.

When originally released in 2021 on the Office’s public court docket, every part of the document was redacted except an “unclassified” marking. Given its explosive contents, it is not difficult to see why: as Canestraro’s investigation concluded, at least two 9/11 hijackers had been recruited either knowingly or unknowingly into a joint CIA-Saudi intelligence operation which may have gone awry.

‘A 50/50 chance’ of Saudi involvement

‘A 50/50 chance’ of Saudi involvement

In 1996, Alec Station was created under the watch of the CIA. The initiative was supposed to comprise a joint investigative effort with the FBI. However, FBI operatives assigned to the unit soon found they were prohibited from passing any information to the Bureau’s head office without the CIA’s authorization, and faced harsh penalties for doing so. Efforts to share information with the FBI’s equivalent unit – the I-49 squad based in New York – were repeatedly blocked.

In late 1999, with “the system blinking red” about an imminent large-scale Al Qaeda terror attack inside the US, the CIA and NSA were closely monitoring an “operational cadre” within an Al Qaeda cell that included the Saudi nationals Nawaf al-Hazmi and Khalid al-Mihdhar. The pair would purportedly go on to hijack American Airlines Flight 77, which crashed into the Pentagon on 9/11.

Al-Hazmi and al-Midhar had attended an Al Qaeda summit that took place between January 5th and 8th 2000, in Kuala Lumpur, Malaysia. The meeting was secretly photographed and videotaped by local authorities at Alec Station’s request although, apparently, no audio was captured. En route, Mihdhar transited through Dubai, where CIA operatives broke into his hotel room and photocopied his passport. It showed that he possessed a multi-entry visa to the US.

A contemporaneous internal CIA cable stated this information was immediately passed to the FBI “for further investigation.” In reality, Alec Station not only failed to inform the Bureau of Mihdhar’s US visa, but also expressly forbade two FBI agents assigned to the unit from doing so.

“[I said] ‘we’ve got to tell the Bureau about this. These guys clearly are bad…we’ve got to tell the FBI.’ And then [the CIA] said to me, ‘no, it’s not the FBI’s case, not the FBI’s jurisdiction’,” Mark Rossini, one of the FBI agents in question, has alleged. “If we had picked up the phone and called the Bureau, I would’ve been violating the law. I…would’ve been removed from the building that day. I would’ve had my clearances suspended, and I would be gone.”

On January 15th, Hazmi and Mihdhar entered the US through Los Angeles International Airport, just weeks after the foiled Millennium plot. Omar al-Bayoumi, a Saudi government “ghost employee” immediately met them at an airport restaurant. After a brief conversation, Bayoumi helped them find an apartment near his own in San Diego, co-signed their lease, set them up bank accounts, and gifted $1,500 towards their rent. The three would have multiple contacts moving forward.

In interviews with Operation Encore investigators years later, Bayoumi alleged his run-in with the two would-be hijackers was mere happenstance. His extraordinary practical and financial support was, he claimed, simply charitable, motivated by sympathy for the pair, who could barely speak English and were unfamiliar with Western culture.

The Bureau disagreed, concluding Bayoumi was a Saudi spy, who handled a number of Al Qaeda operatives in the US. They also considered there to be a “50/50 chance” he – and by extension Riyadh – had detailed advance knowledge of the 9/11 attacks.

That remarkable finding wasn’t known publicly until two decades later, when a tranche of Operation Encore documents were declassified upon the Biden administration’s orders, and it was completely ignored by the mainstream media. Don Canestraro’s declaration now reveals FBI investigators went even further in their assessments.

A Bureau special agent, dubbed “CS-3” in the document, stated Bayoumi’s contact with the hijackers and support thereafter “was done at the behest of the CIA through the Saudi intelligence service.” Alec Station’s explicit purpose was to “recruit Al-Hazmi and Al-Mihdhar via a liaison relationship”, with the assistance of Riyadh’s General Intelligence Directorate.

A most ‘unusual’ CIA unit

A most ‘unusual’ CIA unit

Alec Station’s formal remit was to track bin Laden, “collect intelligence on him, run operations against him, disrupt his finances, and warn policymakers about his activities and intentions.” These activities would naturally entail enlisting informants within Al Qaeda.

Nonetheless, as several high level sources told Canestraro, it was extremely “unusual” for such an entity to be involved in gathering intelligence and recruiting assets. The US-based unit was run by CIA analysts, who do not typically manage human assets. Legally, that work is the exclusive preserve of case officers “trained in covert operations” and based overseas.

“CS-10”, a CIA case officer within Alec Station, concurred with the proposition that Hazmi and Mihdhar enjoyed a relationship with the CIA through Bayoumi, and was baffled that the unit was tasked with attempting to penetrate Al Qaeda in the first place. They felt it “would be nearly impossible…to develop informants inside” the group, given the “virtual” station was based in a Langley basement, “several thousand miles from the countries where Al Qaeda was suspected of operating.”

“CS-10” further testified that they “observed other unusual activities” at Alec Station. Analysts within the unit “would direct operations to case officers in the field by sending the officers cables instructing them to do a specific tasking,” which was “a violation of CIA procedures.” Analysts “normally lacked the authority to direct a case officer to do anything.”

“CS-11”, a CIA operations specialist posted to Alec Station “sometime prior to the 9/11 attacks” said they likewise “observed activity that appeared to be outside normal CIA procedures.” Analysts within the unit “mostly stuck to themselves and did not interact frequently” with others. When communicating with one another through internal cables, they also used operational pseudonyms, which “CS-11” described as peculiar, as they were not working undercover, “and their employment with the CIA was not classified information.”

The unit’s unusual operational culture may explain some of the stranger decisions made during this period vis a vis Al Qaeda informants. In early 1998, while on a CIA mission to penetrate London’s Islamist scene, a joint FBI-CIA informant named Aukai Collins received a stunning offer: bin Laden himself wanted him to go to Afghanistan so they could meet.

Collins relayed the request to his superiors. While the FBI was in favor of infiltrating Al Qaeda’s base, his CIA handler nixed the idea, saying, “there was no way the US would approve an American operative going undercover into Bin Laden’s camps.”

Similarly, in June 2001, CIA and FBI analysts from Alec Station met with senior Bureau officials, including representatives of its own Al Qaeda unit. The CIA shared three photos of individuals who attended the Kuala Lumpur meeting 18 months earlier, including Hazmi and Mihdhar. However, as an FBI counter-terror officer codenamed “CS-15” recalled, the dates of the photos and key details about the figures they depicted were not revealed. Instead, the analysts simply asked if the FBI “knew the identities of the individuals in the photos.”

Another FBI official present, “CS-12”, offers an even more damning account. The Alec Station analysts not only failed to offer biographical information, but falsely implied one of the individuals might be Fahd Al-Quso, a suspect in the bombing of the USS Cole. What’s more, they outright refused to answer any questions related to the photographs. Nonetheless, it was confirmed that no system was in place to alert the FBI if any of the three entered the US – a “standard investigative technique” for terror suspects.

Given Hazmi and Mihdhar appeared to be simultaneously working for Alec Station in some capacity, the June 2001 meeting may well have been a dangle. No intelligence value could be extracted from inquiring whether the Bureau knew who their assets were, apart from ascertaining if the FBI’s counter-terror team was aware of their identities, physical appearances, and presence in the US.

Quite some coverup

Another of Canestraro’s sources, a former FBI agent who went by “CS-23,” testified that after 9/11, FBI headquarters and its San Diego field office quickly learned of “Bayoumi’s affiliation with Saudi intelligence and subsequently the existence of the CIA’s operation to recruit” Hazmi and Mihdhar.

However, “senior FBI officials suppressed investigations” into these matters. “CS-23” alleged, furthermore, that Bureau agents testifying before the Joint Inquiry into 9/11 “were instructed not to reveal the full extent of Saudi involvement with Al-Qaeda.”

The US intelligence community would have had every reason to shield Riyadh from scrutiny and consequences for its role in the 9/11 attacks, as it was then one of its closest allies. But the FBI’s eager complicity in Alec Station’s coverup may have been motivated by self-interest, as one of its own was intimately involved in the unit’s effort to recruit Hazmi and Mihdhar, and conceal their presence in the US from relevant authorities.

“CS-12”, who attended the June 2001 meeting with Alec Station, told Canestraro that they “continued to press FBI Headquarters for further information regarding the subjects in the photographs” over that summer. On August 23rd, they stumbled upon an “electronic communication” from FBI headquarters, which identified Hazmi and Mihdhar, and noted they were in the US.

“CS-12” then contacted the FBI analyst within Alec Station who authored the communication. The conversation quickly became “heated”, with the analyst ordering them to delete the memo “immediately” as they were not authorized to view it. While unnamed in the declaration, the FBI analyst in question was Dina Corsi.

The next day, on a conference call between “CS-12”, Corsi, and the FBI’s bin Laden unit chief, “officials at FBI headquarters” explicitly told “CS-12” to “stand down” and “cease looking” for Mihdhar, as the Bureau intended to open an “intelligence gathering investigation” on him. The next day, “CS-12” emailed Corsi, stating bluntly “someone is going to die” unless Mihdhar was pursued criminally.

It was surely no coincidence that two days later, on August 26th, Alec Station finally informed the FBI that Hazmi and Mihdhar were in the US. By then, the pair had entered the final phase of preparations for the impending attacks. If a criminal probe had been opened, they could have been stopped in their tracks. Instead, as foreshadowed by the officials in contact with “CS-12,” an intelligence investigation was launched which hindered any search efforts.

In the days immediately after the 9/11 attacks, “CS-12” and other New York-based FBI agents participated in another conference call with Bureau headquarters. During the conversation, they learned Hazmi and Mihdhar were named on Flight 77’s manifest. One analyst on the line ran the pair’s names through “commercial databases,” quickly finding them and their home address listed in San Diego’s local phone directory. It turned out they had been living with an FBI informant.

“CS-12” soon contacted Corsi “regarding information on the hijackers.” She responded by providing a photograph from the same surveillance operation that produced the three pictures presented at the June 2001 meeting between Alec Station and FBI agents; they depicted Walid bin Attash, a lead suspect in Al Qaeda’s 1998 East Africa US Embassy bombings and its attack on the USS Cole.

Corsi was unable to explain why the photo was not shown to FBI agents earlier. If it had been, “CS-12” claims they would have “immediately linked” Hazmi and Mihdhar to bin Attash, which “would have shifted from an intelligence based investigation into a criminal investigation.” The FBI’s New York field office could have then devoted its “full resources” to finding the hijackers before the fateful day of September 11, 2001.

Alec Station operatives fail upwards

Alec Station’s tireless efforts to protect its Al Qaeda assets raises the obvious question of whether Hazmi and Mihdhar, and possibly other hijackers, were in effect working for the CIA on the day of 9/11.

The real motives behind the CIA’s stonewalling may never be known. But it appears abundantly clear that Alec Station did not want the FBI to know about or interfere in its secret intelligence operation. If the unit’s recruitment of Hazmi and Mihdhar was purely dedicated to information gathering, rather than operational direction, it is incomprehensible that the FBI had not been apprised of it, and was instead actively misdirected.

Several FBI sources consulted by Canestraro speculated that the CIA’s desperation to penetrate Al Qaeda prompted it to grant Alec Station the power to recruit assets, and pressured it to do so. But if this were truly the case, then why did Langley refuse the opportunity to send Aukai Collins – a proven deep cover asset who had infiltrated several Islamist gangs – to penetrate bin Laden’s network in Afghanistan?

One alternative explanation is that Alec Station, a powerful rogue CIA team answerable and accountable to no one, sought to infiltrate the terror group for its own sinister purposes, without the authorization and oversight usually required by Langley in such circumstances. Given that Collins was a joint asset shared with the FBI, he could not be trusted to participate in such a sensitive black operation.

No member of Alec Station has been punished in any way for the supposed “intelligence failures” that allowed 9/11 to go ahead. In fact, they have been rewarded. Richard Blee, the unit’s chief at the time of the attacks, and his successor Alfreda Frances Bikowsky, both joined the CIA’s operations division, and became highly influential figures in the so-called war on terror. Corsi, for her part, was promoted at the FBI, eventually rising to the rank of Deputy Assistant Director for Intelligence.

In a perverse twist, the Senate Intelligence Committee’s report on the CIA’s torture program found that Bikowsky had been a key player in the agency’s black site machinations, and one of their chief public apologists. It is increasingly clear that the program was specifically concerned with eliciting false testimony from suspects in order to justify and expand the US war on terror.

The public’s understanding of the 9/11 attacks is heavily informed by testimonies delivered by CIA torture victims under the most extreme duress imaginable. And Bikowsky, a veteran of the Alec Station that ran cover for at least two would-be 9/11 hijackers, had been in charge of interrogating the alleged perpetrators of the attacks.

The veteran FBI deep cover agent Aukai Collins concluded his memoir with a chilling reflection which was only reinforced by Don Canestraro’s bombshell declaration:

“I was very mistrustful about the fact that bin Laden’s name was mentioned literally hours after the attack… I became very skeptical about anything anybody said about what happened, or who did it. I thought back to when I was still working for them and we had the opportunity to enter Bin Laden’s camp. Something just hadn’t smelled right…To this day I’m unsure who was behind September 11, nor can I even guess… Someday the truth will reveal itself, and I have a feeling that people won’t like what they hear.”

Previously unreported interviews filed in court claim CIA is hiding information relating to a failed 'recruitment' effort

UPDATED

LIKE MANY GREAT SPY STORIES, this one begins with a brief, mundane scene whose significance only becomes apparent later on. Around lunchtime on February 1, 2000, a man dropped a piece of paper near a table in a Middle Eastern restaurant outside Los Angeles and paused long enough to strike up a conversation with two Arabic-speaking men dining nearby. It would take FBI agents nearly 20 years to understand the full meaning of that small event.

The man who dropped the piece of paper was Omar al-Bayoumi, a Saudi intelligence asset, recently declassified FBI documents show. And the two Arabic-speaking men with whom he struck up a conversation with were Nawaf al-Hazmi and Khalid al-Mihdhar, the first two future 9/11 hijackers to arrive in the United States. Was this meeting, as the alleged agent later claimed to investigators, mere happenstance?

Or was it an intelligence operation being conducted on U.S. soil? It was an intelligence operation, according to a previously-unreported court filing SpyTalk has obtained that corroborates and expands our understanding of this extraordinary meeting, which took place just as the 9/11 plot was taking shape.

The court filing details a five-year inquiry by an investigator for the Guantanamo Military Commission into whether the meeting at the Mediterranean Gourmet restaurant was an operation that involved not only Saudi agents but CIA officers as well.

The theory that the CIA had launched a failed effort to recruit the hijackers through the Saudis has been around for years and was always circumstantial at best, but the document obtained by SpyTalk reveals there is more evidence to support it. One former FBI agent claimed to the investigator that the CIA possesses top secret “operational” files and a “paper trail” about the Saudi spy who met the hijackers that are still being suppressed.

A CIA spokesperson denied that the agency was hiding information. The FBI declined to comment.

The revelations were found in a 21-page court document filed in 2021 at the Guantanamo Bay naval base in Cuba where the cases of the 9/11 defendants are being heard. The document was on the public docket but went unreported because it was completely redacted except for an unclassified marking. Spytalk obtained an unredacted copy.

The legal filing consists of summaries of interviews with anonymous FBI agents, 9/11 Commission staff, and others who investigated the attacks on New York and Washington. It was compiled by Don Canestraro, an investigator for the Office of Military Commissions, as the court hearing the cases of the 9/11 defendants is formally known. Canestraro previously served for more than two decades as an agent with the Drug Enforcement Administration.

Canestraro’s filing is chock-full of new details about the multiple investigations into 9/11. And it follows the release last year of declassified FBI documents that offered an unprecedented portrait of Saudi intelligence operations inside America. Read together, this new information raises issues that go to the heart of America’s fraught relationship with the oil-rich Kingdom—and the 9/11 attacks.

Four unnamed former FBI agents involved in the 9/11 investigation told Canestraro they believed the CIA was covering up an operation on U.S. soil to penetrate Al Qaeda. The most explosive allegations come from a former FBI agent who spoke to Canestraro in June 2021. The former agent, identified only as CS-23, was described as having “extensive knowledge of counterterrorism and counterintelligence matters.”

CS-23 pointedly described the meeting between the Saudi agent and the hijackers at the Middle Eastern Gourmet restaurant as part of “an operation directed by the Central Intelligence Agency,” and indicated that the CIA has “operational” files on Bayoumi that predated 9/11.

Before 9/11, according to CS-23, the CIA was determined to get a human source inside Osama bin Laden’s terror network, and the arrival of two members of Al Qaeda in Southern California in January 2000 offered an unprecedented opportunity. The CIA is legally barred from collecting information on U.S. citizens “but its foreign intelligence collection mission can be conducted anywhere," according to the agency website.

Collaborators

After 9/11, CS-23 told Canestraro, “FBI officials in San Diego and at FBI headquarters became aware of both Bayoumi’s affiliation with Saudi intelligence and subsequently the existence of the CIA’s operation to recruit Hazmi and Mihdhar through Bayoumi.” Senior FBI officials “suppressed investigations” into the matter, C-23 said.

CS-23’s account could not be independently verified. Canestraro said all the formerCIA officersand FBI agents he spoke with were granted anonymity and Canestraro said he could not put SpyTalk in touch with CS-23 without violating attorney-client privilege.

Canestraro said his investigation would not have been possible without initial assurances of confidentiality. The FBI has tried to silence at least one former agent who spoke publicly about Saudi Arabia and the 9/11 investigation. In a 2019letter, a copy of which was obtained by SpyTalk, the bureau reminded the agent of the duty of confidentiality that he agreed to when he joined the bureau and instructed him to clear all future disclosures with headquarters.

The starting point for this investigation, Canestraro wrote, was Omar al-Bayoumi, the Saudi man who met the two hijackers in the Middle Eastern Gourmet restaurant on Venice Boulevard in Culver City. Bayoumi played a critical role in helping the two newly-arrived hijackers settle in the United States. He encouraged the two men to come to San Diego and once there, he helped them open bank accounts, found them an apartment, paid their security deposit, co-signed their lease, and threw a welcoming party for them. He also introduced the hijackers to Anwar al-Aulaqi, then an imam at a mosque in San Diego, California who “reportedly served as their spiritual advisor during their time in San Diego,” according to the joint congressional committee’s report on 9/11. Aulaqi was killed in a drone strike in Yemen in 2011.

Lawyers for the 9/11 defendants in Guantanamo have asked a judge to order the CIA, the FBI, Congress, and the 9/11 Commission to turn over all documents relating to Bayoumi. “People in a position to know have suggested that the CIA concealed information about Hazmi and Mihdhar’s travel because the CIA wanted to recruit them through Saudi intelligence, which would go a long way to support the defense theory that the United States and Al Qaeda are not at war,” defense lawyers wrote in a motion to compel discovery. Canestraro’s affidavit was attached to the motion. A judge in the slow-moving military commissions has still not yet ruled on the motion.

Bayoumi was a subject of FBI investigations that stretched over more than 20 years, and he was long suspected to have been a Saudi intelligence agent. But he was certainly no James Bond. He was frequently spotted videotaping events at the local mosque. Even one of the hijackers thought Bayoumi was a spy, according to the 9/11 Commission. He lived with his family in San Diego on a student visa, despite not attending classes, and he received a salary from the Kingdom of Saudi Arabia for a job he never performed. But Bayoumi told FBI agents in Riyadh in 2003 that the claim that he was a spy was “absolutely not true.” Bayoumi told the 9/11 Commission that Hazmi’s description of him as a spy “hurt him very much.”

Robert McFadden, a former senior counterterrorism agent with the Naval Criminal Investigative Service, tells SpyTalk he understood Bayoumi’s complaint. Bayoumi “was likely a useful, marginally employed, Saudi government fixer and facilitator for Riyadh, who 'took care' of idiot expats like the Hazmi brothers and Khalid al-Mihdhar, who had never traveled to the U.S. before or had much English,” McFadden said. “Most importantly, a Bayoumi would keep an eye on any known or suspected Saudi opposition activity.”

Bayoumi appeared on the FBI’s radar before 9/11, when he attracted suspicion from his San Diego apartment manager. According to CS-23, FBI special agents in San Diego queried the CIA as part of that inquiry. The agency reported that it had no information on Bayoumi. That was a “falsehood,” C-23 told Canestraro in June 2001.

“C-23 stated the CIA maintained ‘operational’ files on Omar al-Bayoumi,” Canestraro wrote. “CS-23 explained to me that ‘operational’ files are those files related to an intelligence operation conducted by a given agency. CS-23 further explained that he/she was aware of a ‘paper trail’ concerning al-Bayoumi.”

Canestraro says CS-23’s account suggests the CIA hid critical evidence from the FBI about an agent of Saudi intelligence. “The CIA did not share all it knew about Bayoumi with the FBI both prior to and after the 9/11 attacks,” he told SpyTalk. “Certainly, this impacted the FBI's investigations into Bayoumi.”

A CIA spokesperson strongly disputed that claim, but stopped short of claiming that such files do not exist.

“The allegation that CIA is ‘hiding’ information related to the attacks of September11th, 2001, is false,” the CIA spokesperson tells SpyTalk. “CIA has fully complied with Executive Order 14040 of September 2021, which mandated the review and, wherever possible, public release of government information ‘collected and generated in the United States Government’s investigation’ of the attacks. In keeping with the executive order, CIA declassified the maximum amount of information possible in hundreds of documents, which are now publicly available online.”

A veteran CIA case officer involved in the 9/11 investigation tells SpyTalk that there may very well be some information on Bayoumi in a file somewhere in the agency. The CIA has contacts with many people, all over the world, and case officers are required to document them, this person said. But the possibility that a CIA officer met Bayoumi once years ago doesn’t mean anything on its own, he said, and FBI agents making a big deal out of that are just trying to shift blame away from the bureau’s failure to heed the pre-9/11 warnings of its own agents. An FBI agent in Phoenix, for example, requested an investigation of terrorists training at U.S. flight schools. Another agent in Minnesota wrote a memo theorizing that Zacarias Moussaoui, now serving life in prison for his role in the attacks, seemed like a terrorist planning to “fly a plane into the World Trade Center.” Both were ignored.

“For them to say we’re holding out on them now—fuck you,” the CIA veteran says. “That’s what I want to say to all of you: Fuck you, assholes. Three thousand people dead and 22 years later, and you’re still trying to wash the stain off the FBI.”

Another CIA veteran told SpyTalk he found the recruiting theory laughable: The Saudis would never allow the CIA to recruit one of their own citizens. But he said he wouldn’t put anything past the personnel in Alec Station, as the CIA’s bin Laden station was known— including going out of channels to try to recruit Hazmi and Mihdhar.

Rogue Operators

(It wouldn’t be the first or last time: Years after former FBI special agent and private investigator Robert Levinson went missing in Kish Island, Iran, in 2007 for example, his family learned that he had gone “at the direction of certain CIA analysts who had no authority to run operations overseas,” according to a Washington Post investigation. The CIA had told the Senate Intelligence Committee and FBI that the spy agency “had nothing to do with him going to Iran.”

Two former CIA case officers who spoke to Canestraro saw Alec Station as a place where the normal rules didn’t apply. Located in a northern Virginia office outside CIA headquarters, Alec Station was stuffed with analysts who saw themselves as operatives. Even though they were not undercover, the analysts would refer to each other by their code names around the office. Despite their limited operational training, the analysts at Alec Station would also direct operations in the field and even went so far as to block one operation targeting Al Qaeda, according to Canestraro’s interviews.

“CS-10,” a 25-year CIA veteran, “told me that the analysts at UBL station felt that they could undertake operations as easily as the case officers even though they had not been trained in covert intelligence-gathering techniques,” Canestraro wrote.

The other former CIA case officer, CS-11, told Canestraro that “it would have been difficult” for any of the analysts “to run an operation out of UBL Station without approval from other CIA officers.”

The theory about a failed CIA recruitment effort surfaced in Lawrence Wright’s Pulitzer Prize-winning 2007 book, The Looming Tower: Al Qaeda and the Road to 9/11. Mark Rossini, a former FBI agent detailed to the CIA, was the first former insider to go public with his belief that the spy agency sought to use Bayoumi to recruit the hijackers. Richard Clarke, the National Security Council counterterrorism coordinator in the Clinton and Bush White Houses, followed with a 2016 article claiming that a major element of the 9/11 tragedy remained unrevealed. Clarke wrote that he too believed that the CIA had used Bayoumi to approach the hijackers in what he called a “false flag” operation.

Clarke tells SpyTalkthat he began to suspect something was amiss when CIA Director George Tenet paid a personal visit to his office in the White House after 9/11. The CIA’s inspector general was examining whether the agency had done enough to stop the attacks. Tenet, accompanied by two of his lieutenants, Cofer Black and Richard Blee, asked Clarke to write a letter to the inspector general, John Helgerson, praising the agency’s performance. Clarke was a little hesitant to write a letter on Tenet’s behalf but he eventually did say something along the lines of what they asked, he told SpyTalk.

What struck Clarke as odd was how nervous the CIA director seemed. “What was shocking to me was here’s the CIA director really worried about a CIA inspector general investigation into him and his relationship to 9/11,” Clarke says. “That’s one of the reasons I’ve often thought that my recruitment theory was probably right.”

Philip Zelikow, former executive director of the 9/11 Commission, has said there was no evidence to support such a theory. “If the ‘recruitment theory’ posited by Clarke and Rossini were true, there would be evidence of a recruitment effort—some CIA attempt to locate and contact al-Mihdhar and al-Hazmi. There is no such evidence. Nor was there any evidence of a recruitment plan or even the consideration of one,” Zelikow wrote in a 2017 article. (Zelikow did not return emails from SpyTalk.)

Several former FBI agents told Canestraro that the alleged recruitment effort explained one of the most glaring intelligence-sharing failures in the runup to 9/11: The CIA’s failure to notify the FBI upon learning that the hijackers were headed to the United States. Not only did the CIA fail to take the simple step of putting the hijackers’ names on a watchlist, it also blocked FBI agents detailed to the CIA from sending a memo informing FBI headquarters. Nineteen months later Mihdhar and Hazmi were part of a team that hijacked American Airlines Flight 77 and crashed it into the Pentagon.

End Run

Rossini was an eyewitness to the CIA’s efforts to prevent his headquarters from learning that Mihdhar had a multiple-entry U.S. visa. (Rossini declined to comment for the record for this story.)But in interviews in 2015 and a brief memoir that was published online, Rossini revealed that a CIA officer in the agency’s bin Laden station ordered him in early 2000 to keep silent. It was “not a matter for the FBI,” Rossini says he was told. “The next Al Qaeda attack is going to be in Southeast Asia, and if and when we want to let the FBI know we will and you are not to say anything.” Rossini did not name the CIA officer, but she has previously been identifiedas Michael Anne Casey.

The CIA’s Inspector General concluded that the agency’s failure to pass the information on Hazmi and Midhar’s arrival to the FBI until August 2001 was not a mistake borne out of a reluctance to share it but rather one of poor implementation, guidance, and oversight of processes designed to foster exchanges. An anonymous CIA officer—subsequently identified as Tom Wilshire, a former deputy chief of the bin Laden station—told the joint congressional committee investigating 9/11, “Something apparently was dropped somewhere and we don't know where that was.”

SpyTalk was able to identify some of Canestraro’s sources. Rossini’s previous statements fit those of the former FBI agent identified in Canestraro’s filing as “CS-3.” The statement of “CS-4” matches the account in Newsweek of James Bernazzani, who oversaw the FBI contingent in the CIA’s Counterterrorist Center and described how he rushed word on Hazmi and Midhar down to headquarters as soon as he learned of it. (Bernazzani did not return messages left seeking comment.)

Rossini’s statement to Canestraro adds a new wrinkle to his version of events. A few years after 9/11, Rossini says he was at CIA headquarters, when he heard James Pavitt, the CIA deputy director for operations, and Director George Tenet discuss the 9/11 Commission’s request to speak with Michael Anne Casey, the CIA officer who instructed him that Mihdhar’s visa was “not a matter for the FBI.” Pavitt told Tenet that he was “glad” the CIA had kept Casey away from the 9/11 Commission, Rossini said, and Tenet agreed that it was a good idea. “CS-3 stated that the conversation indicated two CIA officials had conspired to obstruct the 9/11 Commission,” Canestraro wrote. (The CIA did not respond to questions about the purported conversation. Tenet did not return a message left seeking comment. Pavitt died last December.)

Rossini left the FBI 2008 after pleading guilty to criminally accessing an FBI database for information that was later used by Hollywood private eye Anthony Pellicano. He pleaded not guilty last year in a federal corruption case involving a former governor of Puerto Rico.

Canestraro’s court filing in Guantanamo also raises long-simmering questions about the Saudi government and 9/11. Fifteen of the 19 hijackers were from Saudi Arabia. Was the Saudi government connected in any way to the terrorist plot? Did any Saudi government officials have prior knowledge of the plan to attack New York and Washington?

The U.S. intelligence community has been grappling with those questions for years. The CIA Inspector General’s 9/11 Review Team reported in 2005 that it found no evidence that the Saudi government knowingly and willingly supported Al Qaeda. But newly declassified documents reveal that, at a minimum, the Saudi government knew far more about Hazmi and Mihdhar’s arrival in America than it was letting on to the FBI.

Another one of Canestraro’s interviewees, identified as CS-8, told him that "diplomatic pressure" was exerted on the FBI not to investigate the Saudi government’s connections to the 9/11 attacks. The person did not elaborate.

A recently declassified FBI memo from 2017 revealed the bureau’s belated discovery that Bayoumi was paid a monthly stipend as a “cooptee” of the Saudi General Intelligence Presidency. (A cooptee is a citizen of a country, but not an officer or employee of that country’s intelligence service, who assists that service on a temporary or opportunity basis.) The memo notes that the allegations of Bayoumi’s involvement with Saudi intelligence were not confirmed at the time of the 9/11 Commission’s report, which had concluded that Bayoumi was “an unlikely candidate for clandestine involvement with Islamic extremists.
