Durham probe costs nearly five times less than Mueller probe, data shows

Mueller's inquiry cost a total of $32 million while Durham's has cost at least $6.5 million so far.

Special counsel John Durham's probe into the FBI's investigation into ties between the 2016 Trump campaign and Russia has cost the Justice Department less than $10,000 a day on average, nearly five times less than the daily cost of special counsel Robert Mueller's probe into the discredited Trump-Russia collusion allegations.

Durham's ongoing probe has cost at least $6.5 million from Oct. 19, 2020, until Sept. 30, 2022, according to Justice Department data released Friday.

This means Durham spends an average of over $9,100 a day on his probe.

From May 17, 2017 through May 29, 2019, Mueller's inquiry cost $32 million, multiple outlets reported. Mueller's investigation cost an average of more than $43,000 a day.

Comparing the prices of the two investigations, Mueller's probe costs about 4.7 times more than Durham's on average.

Durham's inquiry secured the guilty plea of former FBI attorney Kevin Clinesmith for altering a document about the government's surveillance of a former Trump campaign adviser.

However, his inquiry suffered several setbacks this year when Clinton campaign attorney Michael Sussman and key Steele dossier source Igor Danchenko were acquitted. Durham is expected to produce a final report on his findings.

NY Congressman-Elect George Santos Admits To Being Total Liar

After a week of total silence, New York Representative-elect George Santos admitted to a laundry list of lies, ranging from his education, professional background, property ownership, and religion.

And he's still going to take the oath of office on Jan. 3, joining the House majority.

Santos, who was elected in November to represent residents from north Long Island and northeast Queens, was confronted by the New York Times with several falsehoods.

"My sins here are embellishing my résumé," he told the NY Post in a Monday interview.

The lies include;

Graduating from college

Claiming he worked for Citigroup or Goldman Sachs

That his family owns a real estate portfolio of 13 properties (he admitted Monday he's not a landlord)

That he's Jewish

"I never claimed to be Jewish," he told the Post, adding "I am Catholic. Because I learned my maternal family had a Jewish background I said I was ‘Jew-ish.’"

Santos also acknowledged owing thousands in unpaid rent and, despite being openly gay, a yearslong marriage he never revealed.

"I dated women in the past. I married a woman. It’s personal stuff," he told the Post, adding that he is "OK with my sexuality. People change."

Mr. Santos acknowledged that a string of financial difficulties had left him owing thousands to landlords and creditors. But he failed to fully explain in the interviews how his fortunes reversed so significantly that, by 2022, he was able to lend $700,000 to his congressional campaign.

Mr. Santos also firmly denied committing a crime anywhere in the world, even though The Times had uncovered Brazilian court records showing that Mr. Santos had been charged with fraud as a young man after he was caught writing checks with a stolen checkbook. -NY Times

"I am not a criminal here — not here or in Brazil or any jurisdiction in the world," he told the Post. "Absolutely not. That didn’t happen."

Except, court records show that he confessed to the crime and was charged, but the case was unable to move forward because authorities were unable to locate him.

Santos also said he graduated from Baruch College in 2010 before working for Citigroup, and then went on to Goldman Sachs - which made its way to a biography on the National Republican Congressional Committee website (which also included a degree from NY University).

The colleges and companies told the Times they have no record of Santos.

"I didn’t graduate from any institution of higher learning. I’m embarrassed and sorry for having embellished my résumé," later said, adding "We do stupid things in life."

He also admitted that he never worked directly for Goldman Sachs or Citigroup, blaming a “poor choice of words” for creating the impression that he had.

Past statements of Mr. Santos are relatively clear however: An archived version of Mr. Santos’s former campaign website preserved by the Internet Archive’s Wayback Machine says he “began working at Citigroup as an associate and quickly advanced to become an associate asset manager in the real asset division of the firm.”

Instead, he told The Post on Monday, he dealt with both firms through his work at another company, LinkBridge Investors, which connects investors with potential clients. LinkBridge, he said, had “limited partnerships” with the two Wall Street firms. -NY Times

The Times was unable to confirm his employment with LinkBridge. 

What he did confirm was that he worked at a call center in Queens in late 2011 and early 2012.

And while Santos could face ethics investigations once seated, legal experts say the House can only prevent candidates from office of they violate the Constitution's age, citizenship or state residency requirements.

Questions do remain, however - such as how he was able to reportedly earn millions of dollars from his company, the Devolder Organization.

"I had the relationships and I started making a lot of money. And I fundamentally started building wealth, and I decided I’d invest in my race for Congress," said Santos, adding "There’s nothing wrong with that — no criminal conduct. No anything of the sort," he told City & State.

In short, he's perfect for Congress.

Special counsel John Durham’s investigation proved to be a rather embarrassing failure. As The Washington Post reported, it also proved to be quite expensive.

In other words, the $6.5 million figure — in taxpayer money — is where things stand now. It’s difficult to say with confidence how much higher the final price tag will eventually end up.

For those who might benefit from a refresher — you’d be forgiven for thinking, “John Durham’s name sounds familiar, but I can’t remember why I’m supposed to care about him” — let’s revisit our earlier coverage and explain how we arrived at this point.

The original investigation into Donald Trump’s Russia scandal, led by then-Special Counsel Robert Mueller, led to a series of striking findings: The former president’s political operation in 2016 sought, embraced, capitalized on, and lied about Russian assistance — and then took steps to obstruct the investigation into the foreign interference.

The Trump White House wasn’t pleased with the conclusions, but the Justice Department’s inspector general conducted a lengthy probe of the Mueller investigation, and not surprisingly, the IG’s office found nothing improper.

This, of course, only outraged Trump further, so then-Attorney General Bill Barr tapped a federal prosecutor — U.S. Attorney John Durham — to conduct his own investigation into the investigation. That was more than three years ago.

At this point, Durham’s investigation into the Russia scandal investigation has lasted longer than Mueller’s original probe of the Russia scandal.

After an extended period of apparent inactivity, the prosecutor last year indicted cybersecurity attorney Michael Sussmann for allegedly having lied to the FBI. The case proved to be baseless; Sussmann was acquitted; and one of the jurors publicly mocked Durham’s team for having taken the case to trial.

Five months later, Durham and his team also tried to prosecute Russian analyst Igor Danchenko. That failed too, bringing the probe to an apparent, ignominious end.

The tale of the tape is brutal:

Two trials

Zero convictions

One provocative resignation

A largely meaningless guilty plea from an obscure figure

A –''

By any fair measure, this is the most misguided and inconsequential special counsel investigation in the modern history of American law enforcement.

But the humiliation is not limited to the prosecutor. Every once in a while, Trump still blurts out Durham’s name, hoping the prosecutor might yet bolster some of the former president’s conspiracy theories. As regular readers may recall, the Republican — who predicted that Durham would uncover “the crime of the century” — has even suggested at times that Durham’s probe could serve as a possible vehicle for retaliating against his perceived enemies.

So much for that idea.

Over the summer, The New York Times’ Charlie Savage wrote a report questioning why the Durham investigation existed. He added, “Mr. Barr’s mandate to Mr. Durham appears to have been to investigate a series of conspiracy theories.”

Those theories, however, lacked merit, which is why the Durham probe is ending with an expensive whimper.

There is a degree of irony to the circumstances: For years, Team Trump insisted that the Russia scandal was pointless but the Durham investigation was real. It now appears these Republicans had it exactly backward: The Russia scandal was real, and the Durham investigation was pointless.

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. Policy.It is the policy of my Administration to coordinate a whole-of-government approach to advance biotechnology and biomanufacturing towards innovative solutions in health, climate change, energy, food security, agriculture, supply chain resilience, and national and economic security.Central to this policy and its outcomes are principles of equity, ethics, safety, and security that enable access to technologies, processes, and products in a manner that benefits all Americans and the global community and that maintains United States technological leadership and economic competitiveness.

Biotechnology harnesses the power of biology to create new services and products, which provide opportunities to grow the United States economy and workforce and improve the quality of our lives and the environment. The economic activity derived from biotechnology and biomanufacturing is referred to as “the bioeconomy.” The COVID-19 pandemic has demonstrated the vital role of biotechnology and biomanufacturing in developing and producing life-saving diagnostics, therapeutics, and vaccines that protect Americans and the world. Although the power of these technologies is most vivid at the moment in the context of human health, biotechnology and biomanufacturing can also be used to achieve our climate and energy goals, improve food security and sustainability, secure our supply chains, and grow the economy across all of America.

For biotechnology and biomanufacturing to help us achieve our societal goals, the United States needs to invest in foundational scientific capabilities.We need to develop genetic engineering technologies and techniques to be able to write circuitry for cells and predictably program biology in the same way in which we write software and program computers; unlock the power of biological data, including through computing tools and artificial intelligence; and advance the science of scale-up production while reducing the obstacles for commercialization so that innovative technologies and products can reach markets faster.

Simultaneously, we must take concrete steps to reduce biological risks associated with advances in biotechnology. We need to invest in and promote biosafety and biosecurity to ensure that biotechnology is developed and deployed in ways that align with United States principles and values and international best practices, and not in ways that lead to accidental or deliberate harm to people, animals, or the environment. In addition, we must safeguard the United States bioeconomy, as foreign adversaries and strategic competitors alike use legal and illegal means to acquire United States technologies and data, including biological data, and proprietary or precompetitive information, which threatens United States economic competitiveness and national security.

We also must ensure that uses of biotechnology and biomanufacturing are ethical and responsible; are centered on a foundation of equity and public good, consistent with Executive Order 13985 of January 20, 2021 (Advancing Racial Equity and Support for Underserved Communities Through the Federal Government); and are consistent with respect for human rights. Resources should be invested justly and equitably so that biotechnology and biomanufacturing technologies benefit all Americans, especially those in underserved communities, as well as the broader global community.

To achieve these objectives, it is the policy of my Administration to:

(a)bolster and coordinate Federal investment in key research and development (R&D) areas of biotechnology and biomanufacturing in order to further societal goals;

(b) foster a biological data ecosystem that advances biotechnology and biomanufacturing innovation, while adhering to principles of security, privacy, and responsible conduct of research;

(c) improve and expand domestic biomanufacturing production capacity and processes, while also increasing piloting and prototyping efforts in biotechnology and biomanufacturing to accelerate the translation of basic research results into practice;

(d) boost sustainable biomass production and create climate-smart incentives for American agricultural producers and forest landowners;

(e) expand market opportunities for bioenergy and biobased products and services;

(f) train and support a diverse, skilled workforce and a next generation of leaders from diverse groups to advance biotechnology and biomanufacturing;

(g) clarify and streamline regulations in service of a science- and risk-based, predictable, efficient, and transparent system to support the safe use of products of biotechnology;

(h) elevate biological risk management as a cornerstone of the life cycle of biotechnology and biomanufacturing R&D, including by providing for research and investment in applied biosafety and biosecurity innovation;

(i) promote standards, establish metrics, and develop systems to grow and assess the state of the bioeconomy; to better inform policy, decision-making, and investments in the bioeconomy; and to ensure equitable and ethical development of the bioeconomy;

(j) secure and protect the United States bioeconomy by adopting a forward-looking, proactive approach to assessing and anticipating threats, risks, and potential vulnerabilities (including digital intrusion, manipulation, and exfiltration efforts by foreign adversaries), and by partnering with the private sector and other relevant stakeholders to jointly mitigate risks to protect technology leadership and economic competitiveness; and

(k) engage the international community to enhance biotechnology R&D cooperation in a way that is consistent with United States principles and values and that promotes best practices for safe and secure biotechnology and biomanufacturing research, innovation, and product development and use.

The efforts undertaken pursuant to this order to further these policies shall be referred to collectively asNational Biotechnology and Biomanufacturing Initiative.

Sec. 2. Coordination. The Assistant to the President for National Security Affairs (APNSA), in consultation with the Assistant to the President for Economic Policy (APEP) and the Director of the Office of Science and Technology Policy (OSTP), shall coordinate the executive branch actions necessary to implement this order through the interagency process described in National Security Memorandum 2 of February 4, 2021 (Renewing the National Security Council System) (NSM-2 process). In implementing this order, heads of agencies (as defined in section 13 of this order) shall, as appropriate and consistent with applicable law, consult outside stakeholders, such as those in industry; academia; nongovernmental organizations; communities; labor unions; and State, local, Tribal, and territorial governments to advance the policies described in section 1 of this order.

Sec. 3.Harnessing Biotechnology and Biomanufacturing R&D to Further Societal Goals. (a) Within 180 days of the date of this order, the heads of agencies specified in subsections (a)(i)-(v) of this section shall submit the following reports on biotechnology and biomanufacturing to further societal goals related to health, climate change and energy, food and agricultural innovation, resilient supply chains, and cross-cutting scientific advances.The reports shall be submitted to the President through the APNSA, in coordination with the Director of the Office of Management and Budget (OMB), the APEP, the Assistant to the President for Domestic Policy (APDP), and the Director of OSTP.

(i) The Secretary of Health and Human Services (HHS), in consultation with the heads of appropriate agencies as determined by the Secretary, shall submit a report assessing how to use biotechnology and biomanufacturing to achieve medical breakthroughs, reduce the overall burden of disease, and improve health outcomes.

(ii) The Secretary of Energy, in consultation with the heads of appropriate agencies as determined by the Secretary, shall submit a report assessing how to use biotechnology, biomanufacturing, bioenergy, and biobased products to address the causes and adapt to and mitigate the impacts of climate change, including by sequestering carbon and reducing greenhouse gas emissions.

(iii) The Secretary of Agriculture, in consultation with the heads of appropriate agencies as determined by the Secretary, shall submit a report assessing how to use biotechnology and biomanufacturing for food and agriculture innovation, including by improving sustainability and land conservation; increasing food quality and nutrition; increasing and protecting agricultural yields; protecting against plant and animal pests and diseases; and cultivating alternative food sources.

(v)The Director of the National Science Foundation (NSF), in consultation with the heads of appropriate agencies as determined by the Director, shall submit a report identifying high-priority fundamental and use-inspired basic research goals to advance biotechnology and biomanufacturing and to address the societal goals identified in this section.

(b) Each report specified in subsection (a) of this section shall identify high-priority basic research and technology development needs to achieve the overall objectives described in subsection (a) of this section, as well as opportunities for public-private collaboration. Each of these reports shall also include recommendations for actions to enhance biosafety and biosecurity to reduce risk throughout the biotechnology R&D and biomanufacturing lifecycles.

(c) Within 100 days of receiving the reports required under subsection (a) of this section, the Director of OSTP, in coordination with the Director of OMB, the APNSA, the APEP, the APDP, and the heads of appropriate agencies as determined through the NSM-2 process, shall develop a plan (implementation plan) to implement the recommendations in the reports. The development of this implementation plan shall also include the solicitation of input from external experts regarding potential ethical implications or other societal impacts, including environmental sustainability and environmental justice, of the recommendations contained in the reports required under subsection (a) of this section. The implementation plan shall include assessments and make recommendations regarding any such implications or impacts.

(d) Within 90 days of the date of this order, the Director of OMB, in consultation with the heads of appropriate agencies as determined through the NSM-2 process, shall perform a budget crosscut to identify existing levels of agency spending on biotechnology- and biomanufacturing-related activities to inform the development of the implementation plan described in subsection (c) of this section.

(e) The APNSA, in coordination with the Director of OMB, the APEP, the APDP, and the Director of OSTP, shall review the reports required under subsection (a) of this section and shall submit the reports to the President in an unclassified form, but may include a classified annex.

(f) The APNSA, in coordination with the Director of OMB, the APEP, the APDP, and the Director of OSTP, shall include a cover memorandum for the reports submitted pursuant to subsection (a) of this section, along with the implementation plan required under subsection (c) of this section, in which they make any additional overall recommendations for advancing biotechnology and biomanufacturing.

(g) Within 2 years of the date of this order, agencies at which recommendations are directed in the implementation plan required under subsection (c) of this section shall report to the Director of OMB, the APNSA, the APEP, the APDP, and the Director of OSTP on measures taken and resources allocated to enhance biotechnology and biomanufacturing, consistent with the implementation plan described in subsection (c) of this section.

(h) Within 180 days of the date of this order, the President’s Council of Advisors on Science and Technology shall submit to the President and make publicly available a report on the bioeconomy that provides recommendations on how to maintain United States competitiveness in the global bioeconomy.

Sec. 4. Data for the Bioeconomy. (a) In order to facilitate development of the United States bioeconomy, my Administration shall establish a Data for the Bioeconomy Initiative (Data Initiative) that will ensure that high-quality, wide-ranging, easily accessible, and secure biological data sets can drive breakthroughs for the United States bioeconomy. To assist in the development of the Data Initiative, the Director of OSTP, in coordination with the Director of OMB and the heads of appropriate agencies as determined by the Director of OSTP, and in consultation with external stakeholders, shall issue a report within 240 days of the date of this order that:

(i) identifies the data types and sources, to include genomic and multiomic information, that are most critical to drive advances in health, climate, energy, food, agriculture, and biomanufacturing, as well as other bioeconomy-related R&D, along with any data gaps;

(ii) sets forth a plan to fill any data gaps and make new and existing public data findable, accessible, interoperable, and reusable in ways that are equitable, standardized, secure, and transparent, and that are integrated with platforms that enable the use of advanced computing tools;

(iii) identifies — based on the data types and sources described in subsection (a)(i) of this section — security, privacy, and other risks (such as malicious misuses, manipulation, exfiltration, and deletion), and provides a data-protection plan to mitigate these risks; and

(iv) outlines the Federal resources, legal authorities, and actions needed to support the Data Initiative and achieve the goals outlined in this subsection, with a timeline for action.

(b) The Secretary of Homeland Security, in coordination with the Secretary of Defense, the Secretary of Agriculture, the Secretary of Commerce (acting through the Director of the National Institute of Standards and Technology (NIST)), the Secretary of HHS, the Secretary of Energy, and the Director of OMB, shall identify and recommend relevant cybersecurity best practices for biological data stored on Federal Government information systems, consistent with applicable law and Executive Order 14028 of May 12, 2021 (Improving the Nation’s Cybersecurity).

(c) The Secretary of Commerce, acting through the Director of NIST and in coordination with the Secretary of HHS, shall consider bio-related software, including software for laboratory equipment, instrumentation, and data management, in establishing baseline security standards for the development of software sold to the United States Government, consistent with section 4 of Executive Order 14028.

Sec. 5.Building a Vibrant Domestic Biomanufacturing Ecosystem.(a) (issued 9/13/22, start date approximately 3/12/23) Within 180 days of the date of this order, the APNSA and the APEP, in coordination with the Secretary of Defense, the Secretary of Agriculture, the Secretary of Commerce, the Secretary of HHS, the Secretary of Energy, the Director of NSF, and the Administrator of the National Aeronautics and Space Administration (NASA), shall develop a strategy that identifies policy recommendations to expand domestic biomanufacturing capacity for products spanning the health, energy, agriculture, and industrial sectors, with a focus on advancing equity, improving biomanufacturing processes, and connecting relevant infrastructure. Additionally, this strategy shall identify actions to mitigate risks posed by foreign adversary involvement in the biomanufacturing supply chain and to enhance biosafety, biosecurity, and cybersecurity in new and existing infrastructure.

(b) Agencies identified in subsections (b)(i)-(iv) of this section shall direct resources, as appropriate and consistent with applicable law, towards the creation or expansion of programs that support a vibrant domestic biomanufacturing ecosystem, as informed by the strategy developed pursuant to subsection (a) of this section:

(i) the NSF shall expand its existing Regional Innovation Engine program to advance emerging technologies, including biotechnology;

(ii) the Department of Commerce shall address challenges in biomanufacturing supply chains and related biotechnology development infrastructure;

(iii) the Department of Defense shall incentivize the expansion of domestic, flexible industrial biomanufacturing capacity for a wide range of materials that can be used to make a diversity of products for the defense supply chain; and

(iv) the Department of Energy shall support research to accelerate bioenergy and bioproduct science advances, to accelerate biotechnology and bioinformatics tool development, and to reduce the hurdles to commercialization, including through incentivizing the engineering scale-up of promising biotechnologies and the expansion of biomanufacturing capacity.

(c) Within 1 year of the date of this order, the Secretary of Agriculture, in consultation with the heads of appropriate agencies as determined by the Secretary, shall submit a plan to the President, through the APNSA and the APEP, to support the resilience of the United States biomass supply chain for domestic biomanufacturing and biobased product manufacturing, while also advancing food security, environmental sustainability, and the needs of underserved communities. This plan shall include programs to encourage climate-smart production and use of domestic biomass, along with budget estimates, including accounting for funds appropriated for Fiscal Year (FY) 2022 and proposed in the President’s FY 2023 Budget.

(d) Within 180 days of the date of this order, the Secretary of Homeland Security, in coordination with the heads of appropriate agencies as determined by the Secretary, shall:

(i) provide the APNSA with vulnerability assessments of the critical infrastructure and national critical functions associated with the bioeconomy, including cyber, physical, and systemic risks, and recommendations to secure and make resilient these components of our infrastructure and economy; and

Iran’s state broadcaster IRIB TV2 aired a video describing what it claims would be the response to an Israeli strike on Iran’s nuclear sites, warning that Israeli targets would be destroyed within minutes and that a follow-up wave of rocket attacks would “raze Tel Aviv.” The video aired on December 17, and was reported upon by the Washington-based Middle East Media Research Institute monitor group on Monday.

Younes Shadlou, an official from the state broadcasting agency (IRIB), said that if Israeli jets strike Iran, the base from which they took off would likely be destroyed before they make it back to Israel. He said that in the first phase of Iran's response, the IRGC Aerospace Force's tactical missiles Dezful and Khaybar Crusher missiles would target Israel's "nuclear warhead production site" in Dimona, and that in the second phase, Iran's Sejjil missiles would raze Tel Aviv to the ground. He also said that these plans are a response to a joint US-Israel exercise simulating an attack on Iran's nuclear facilities.

"A few days ago, the Zionist regime conducted another joint exercise with the U.S. to simulate an attack on Iran's nuclear facilities, like the Natanz uranium enrichment site. Let's assume that Israeli jets manage to reach the Natanz nuclear site in one piece, and let's assume that they manage to bomb this site and damage it,” Shadlou said.

"Even if they manage to leave Iran's sky safely, it will take them at least an hour to return to their main base in the occupied lands. The question is whether there would be any base left for them to land at. This is what the first few minutes of an Iranian response will look like. In less than seven minutes, the tactical missiles of the IRGC's Aerospace Force – like the solid-fueled Dezful and the newest Khaybar Crusher missiles – will destroy their targets with great accuracy, if they are launched from a place like Natanz where One of their designated targets is located: Israel's nuclear warhead production site in Dimona. Obviously, this is a simulation of the attack. When the first wave of the attack reaches its target, the IRGC strategic missiles will be fueled in underground silos, and the missile bases will be ready for the second wave of the attack. These missiles, like the Sejjil, strike their targets at velocities greater than ten times the speed of sound, and they carry a one-ton payload," he added.

The speaker of the channel asked Shadlou if the “Zionist regime is not big enough to be considered among the enemies of the Iranian people”. To which Shadlou said that it was the reason that Iran’s supreme leader Ali Khamenei had warned Israel eleven years ago, saying, "If they make even the slightest mistake, the Islamic Republic will raze Tel Aviv and Haifa to the ground.” The remarks were followed by footage showing multiple launches of surface-to-surface missiles and impacts on the ground as Shadlou predicted the Islamic Revolutionary Guard Corps would launch barrages of solid-fuel missiles that “in less than seven minutes will destroy their targets with great accuracy.”

Can Iran make a nuclear bomb?

Iran’s state media announced last month that it had begun producing enriched uranium at 60% purity at the country’s underground Fordo nuclear plant, in addition to enrichment to the same level at a plant in Natanz that it said had begun in 2019. Enrichment to 60% purity is a short, technical step away from weapons-grade levels of 90%. Nonproliferation experts have warned in recent months that Iran now has enough 60%-enriched uranium to reprocess into fuel for at least one nuclear bomb, reported Israeli media.

A day before the fateful Jan. 6 riot rocked the U.S. Capitol, security officials in the House and Senate received a warning of a possible aviation terror threat to the seat of Congress but shrugged off the concerns until congressional leadership found out from news media and began pressing for answers.

"Are you making any notification regarding the intel that I'm told is going public?" then-House Sergeant at Arms Paul Irving texted Michael Stenger, his counterpart in the Senate, about the aviation security threat early on the evening of Jan. 5, 2021, according to text messages reviewed by Just the News.

"I am under the impression that it has been deemed aspirational," Stenger responded. "Agree, all good," said Irving.

The two didn't text again for six days, according to information put out by congressional investigators. But a short while after the exchange, CBS News would report that U.S. intelligence had made the warning to the Capitol, alerting congressional leaders who then peppered the Capitol security apparatus about why they had been kept in the dark and what was being done to address the threat, the messages show.

The powerful anecdote was contained in text messages released as part of a House GOP report on Capitol security last week, adding further evidence of a laissez-faire security apparatus inside Congress that would fail spectacularly on Jan. 6 when a rowdy, pro-Trump mob, some of whom used violence to overrun police lines, invaded the building.

Multiple investigations have determined that Capitol Police and congressional security officials had received extensive intelligence warning of violence on Jan. 6 and failed to create an adequate security plan, allowing worries from above about "optics" to take precedence over deploying National Guard ahead of the riot or better fortifying the building.

The House and Senate sergeants at arms and police chief all resigned in the aftermath of those failures, but there are concerns not enough reforms have been made to avert future security calamities inside the Capitol.

The newest report by GOP Reps. Rodney Davis, Jim Banks, Jim Jordan, Troy Nehls and Kelly Armstrong said the uninspired reaction to the aviation threat on Jan. 5 and the pre-Jan. 6 intelligence warnings exposed not only a reactive security mindset but also bureaucratic gridlock that spread security decision-making across the House and Senate sergeants at arms, the Capitol Police chief, the Capitol Architect and a supervisory Capitol Police Board.

Those layers of bureaucracy remain today, posing continued inefficiencies that threaten future security planning and responses, the lawmakers warned, noting that the board has "resisted calls for reform" on multiple occasions dating to 2001.

"The communications related to the aviation threat against the Capitol on January 5, 2021, show the ad hoc nature of the Board's response to security events," the lawmakers wrote in a report obtained by Just the News. "Even if the various stakeholders had attempted to proceed more deliberately, they

would have been stymied by a confusing web of authorities."

The Government Accountability Office, the independent investigative arm of Congress, warned in its February 2022 review of the Jan. 6 incident thatthe Capitol Police Board and police department lack "comprehensive, documented process to assess and mitigate risks," leaving them susceptible to "overlooking potential security risks."

Nehls (R-Texas) told Just the News that the Capitol is not as secure as it could be in part because the intelligence and security failures have not been fully aired or rectified, leaving the 1,800-plus Capitol Police officers on the job still vulnerable.

The political and security leaders in the Capitol "failed the American people, and they failed the 1,840 personnel of the Capitol Police because they had all the intelligence" warning of the Jan. 6 threat, Nehls said.

The five GOP lawmakers have proposed a significant restructuring and reform of the Capitol Police Board when Republicans take control of the House next month to improve its transparency and to make its security decision-making more crisp. Those proposed reforms include:

•	compelling the Board to send meeting minutes to the relevant oversight committees;

•	requiring the Board to regularly appear before the relevant oversight committees;

•	providing additional resources for the Capitol Police Board to professionalize its support staff;

•	clearly defining and limiting the Board's authority over real-time decisions that police needed to make;

•	making the Inspector General independent from the Board;

•	changing the structure of the Capitol Police Board to add two new members to the Capitol Police Board and to replace the Chief of Police with a Commissioner.

Meanwhile, the text messages show how unnerved some members of congressional leadership were when the aviation threat became public in the news media the evening of Jan. 5, 2021 and they hadn't been alerted to the intelligence.

About a half hour after Irving and Stenger texted at 6:20 p.m. on Jan. 5 and decided not to alert congressional leadership, CBS reported on Twitter that the FBI and FAA were investigating a security breach into air traffic control frequencies and had received a threat about flying an airplane into the Capitol on Jan. 6.

The two sergeants at arms then forwarded the CBS News tweet to others in the Capitol, according to the House GOP report.

Within minutes, a staffer for then-Senate Minority Leader Chuck Schumer's office emailed then-Police Chief Steve Sund and the sergeants at arms, requesting guidance on how to advise Senate Leadership.

Sund responded quickly, saying that his department was investigating, along with federal partners, and they "have no information deeming this as credible."

Shortly before 8 p.m. that day, Wyndee Parker, House Speaker Nancy Pelosi's chief national security adviser, reached out to Irving, requesting more information on the aviation threat. Irving promised to call her back, the email and text messages show.

At 8:31p.m., a staffer in Senate Majority

Leader Mitch McConnell's office weighed in.

"I must observe there is collective concern from the Congressional leadership about learning about this threat reporting from the media rather than from USCP or SAA," the staffer wrote. "We are also concerned that timely notification may not have been made to USCP and SAA and are making inquiries with respective federal agencies.

"Even if it is not a credible threat, we want to ensure the systems we have in place are appropriate," the staffer added.

While the aviation terror threat never materialized, congressional leaders would get a horrifying look at just how ill-prepared the $600-million-a-year Capitol Police were when the Capitol Building was easily overrun by rowdy protesters.

As Just the News reported last week, two staffers in Pelosi's office met and regularly corresponded with security officials crafting the Jan. 6 safety plan, at one point even helping to edit documents, while Republicans were not invited to key planning meetings.

Text and email messages from the night before the riot show thatnot only were National Guard troops requested by the police to reinforce security turned down, there was even concern about the optics of National Guardsmen directing traffic in the city outside the building.

For instance, a Democrat staffer from the House Appropriations Committee sent a message on Jan. 5, 2021 questioning how close National Guard troops deployed for traffic control purposes will be in relation to the Capitol complex.

"I only ask to be ahead of any members who might question a photo or live tv shot that shows National Guard with the Capitol dome in the backdrop," the staffer wrote in one message released in the House GOP report.

Jordan (R-Ohio) told Just the News last week the involvement of Pelosi's staff in security planning and the prioritization of optics over safety had a profound effect on the security failures that occurred on Jan. 6.

"There's this pattern that develops where the sergeant of arms is meeting with Pelosi staff," said Jordan, incoming chairman of the House Judiciary Committee. "Many of those meetings, Republican staff wasn't allowed to be there. But they had this pattern where everything had to be run through her office, her staff before the sergeant of arms can make a decision.

"That's I think the pattern that emerges, the reason there wasn't a proper security presence on that day. It goes right to the Speaker's staff and the Speaker's office."
