Trump Scores Two Huge Victories In Fight For Special Master

The Biden administration cannot use the documents the FBI seized from Donald Trump’s Mar-a-Lago home for criminal investigative purposes until a special master completes an independent review of the material, a federal judge held on Thursday.

That decision and the court’s selection of Trump’s preferred special master candidate, coupled with the fulsome review process adopted yesterday by presiding Judge Aileen Cannon, represent a huge victory for the former president. But Trump’s win shouldn’t be a loss for the Department of Justice—unless the Biden administration played fast and loose with the facts and seeks to hide the truth from the country to launch an October surprise.

During the August 8, 2022, Mar-a-Lago raid, the FBI seized more than 11,000 documents, as well as clothing and other items from the Trumps’ home. On September 5, 2022, Judge Cannon, a Trump appointee, granted the former president’s request for the appointment of a special master to review the seized property. That order left open several issues, however, including the identity of the special master and the process and timing for the review.

Pending the special master’s review of the seized material, Judge Cannon also entered an injunction prohibiting the government from using the documents “for criminal investigative purposes. Three days later, the DOJ filed a notice of appeal, announcing its intent to ask the Eleventh Circuit Court of Appeals to overturn Cannon’s injunction.

The DOJ simultaneously filed a partial motion to stay with the trial court, asking Cannon to put on hold her ruling as to the documents marked classified. Specifically, the DOJ asked the court to hold that while its appeal proceeds, it need not provide documents marked as classified to the special master for review. The DOJ also asked the court to allow it to use the documents marked classified as part of its criminal investigation during the pendency of the appeal.

Judge Cannon denied the government’s request for a stay late Thursday. In a ten-page order, she explained her reasoning, noting first that in seeking a stay related to the documents marked classified,the DOJ effectively asks the court to accept at face value the government’s representationsthat “all of the approximately 100 documents isolated by the Government (and ‘papers physically attached to them’) are classified government records.” The court was unwilling to accept the government’s representation “without further review by a neutral third party in an expedited and orderly fashion.”

In rejecting the DOJ’s motion, Cannon further noted she was “not persuaded that the Government will suffer an irreparable injury without the requested stay.” Here, the court noted that while the DOJ framed its request as necessitated by urgent national security needs, the government has not identified any “emergency” or any likely “imminent disclosure of classified information arising from Plaintiff’s allegedly unlawful retention of the seized property.” On the contrary, the only disclosures seen to date, Cannon stressed, were the “unfortunate” “leaks to the media after the underlying seizure.”

The court further found a stay unnecessary because the special master will be directed to prioritize the review of the approximately 100 documents marked as classified, which Judge Cannon did in a second order entered yesterday.

Cannon’s second order appointed Judge Raymond J. Dearie to serve as special master and established his responsibilities and other logistical duties. Trump proffered Dearie, a semi-retired senior judge for the Eastern District of New York, as one of two recommended candidates. Dearie’s recommendation raised some eyebrows given that Dearie, who had served for seven years on the Foreign Intelligence Surveillance Act or “FISA” court, had signed the fourth faulty Carter Page surveillance order that allowed federal intelligence agencies to spy on Trump’s administration and campaign.

While the DOJ objected to the other candidate proposed by Trump, the government agreed that Dearie would be acceptable. In accepting the special master assignment, Dearie, a Reagan appointee, signed a declaration attesting that he had no known conflicts of interest.

Wait, There’s More

The court’s selection of one of Trump’s preferred candidates to serve as special master represents but a sliver of Judge Cannon’s Thursday order, with the remainder of the detailed order providing several additional positives for Trump.

First, Cannon directed Dearie to “review all of the materials” seized during the Mar-a-Lago raid, something the DOJ desperately wanted to avoid, especially for the documents it segregated as marked classified.

Second, Dearie must verify that the property listed in the “Detailed Property Inventory” “represents the full and accurate extent of the property seized.” Here Cannon suggests that Dearie may consider obtaining sworn affidavits from individuals involved in the raid. While not a failsafe, the sworn affidavits will lessen the chance that agents omitted (or added) items from the property inventory list.

Judge Cannon also directed the special master to review the documents for privilege, including for formal assertions of “executive privilege.” This represents another victory for Trump because the DOJ has been adamant that Trump has no right to assert “executive privilege.” But without knowing what documents the DOJ has, Trump lacks the ability to develop an argument that he retains some vestiges of executive privilege.

Knowing what documents the DOJ has, in fact, proves the biggest victory for Trump from yesterday’s order. Cannon ensured that Trump’s legal team can learn the specifics of what was seized, with, most significantly, the court ordering the DOJ to make any documents with classification markings to be made available “for inspection by Plaintiff’s counsel, with controlled access conditions (including necessary clearance requirements) and under the supervision of the Special Master.” The government must also provide copies of all other documents to Trump’s lawyers and for nondocumentary items, the DOJ must make them available to Trump’s attorneys for inspection.

Not only will Trump’s attorneys be entitled to review the totality of the material, then, but Judge Cannon’s order also directs the lawyers to provide their position on which of four categories each item seized falls into: 1) personal items and documents not claimed to be privileged; 2) personal documents claimed to be privileged; 3) presidential records claimed to be privileged; and 4) presidential records not claimed to be privileged. Then the special master will make recommendations on areas of disagreement for Judge Cannon to decide.

The court also directed the special master and the parties to prioritize the documents marked classified—the point Judge Cannon noted further justified her denial of the DOJ’s motion to stay. The entirety of the review must be completed by November 30, 2022, according to Judge Cannon’s order.

While Dearie could complete his review before November 30, 2022, that hard deadline suggests the court is cognizant of the possibility the DOJ intendsto use the raid of Trump’s home and future developments in their criminal investigation as an October surprise. Putting the deadline for the special master’s review of the documents after the midterm elections lessens the chance that the Biden administration can use its investigation of Trump to interfere in the elections.

Letting Trump Know What They Took

Allowing Trump’s attorneys to review the materials seized also serves as a check on the politicization seen by the leaks. Now, if leakers wrongly spin the material seized as heavily classified documents related to nuclear secrets, Trump’s legal team will have the knowledge necessary to push back against the narrative. That alone is well worth the cost of admission, as Trump must fund the entirety of the special master work, per yesterday’s court order.

TheBiden administration does not want Trump to know what the FBI seized, especially if what his lawyers discover is that all the documents marked classified were previously declassified, just as Trump has maintained. And the government has already promised to seek a stay from the Eleventh Circuit Court of Appeals to halt the special master’s review of the documents marked classified.

But given the speed with which the process can progress now, the DOJ’s effort to obtain a stay based on a supposed national security emergency proves unpersuasive. How the Eleventh Circuit will rule on both the motion to stay and the underlying appeal remains to be seen, but what is obvious to anyone looking is that the Biden administration does not want anyone to know what is in the documents. And that suggests a further setup for Trump.

In a tweet on Thursday, German left-wing politician and chairman of the Bundestag committee on energy, Klaus Ernst, referenced statements by Chancellor Olaf Scholz that the sanctions should not hit Europe harder than Russia itself: “We have now imposed seven packages of sanctions and Gazprom is making record profits. At the same time, we are threatened with a wave of bankruptcies. Therefore: negotiate with Russia with an open mind".

The largest EU economy is anticipated to contract in 2023, as gas and electricity prices continue to skyrocket. According to the Ifo Institute for Economic Research, the Munich-based think tank, the ongoing energy crisis as a result of the war in Ukraine is “wreaking havoc” on the German economy and they project it could lead to a 0.3% drop in GDP next year.

The CEO of Deutsche Bank, Christian Sewing, previously stated that “as a result, we will no longer be able to avert a recession in Germany. Yet we believe that our economy is resilient enough to cope well with this recession — provided the central banks act quickly and decisively now,” noting that for now, many in Germany still have pandemic savings to fall back on in order to meet skyrocketing energy costs, while most companies remain "sufficiently financed".

However, Sewing warned that “the longer inflation remains high, the greater the strain and the higher the potential for social conflict.”

The German government approved August 4 a €65 billion relief package, which includes continued cheaper public transport and tax breaks for energy-reliant companies, as they have been affected the most by the biggest surge in prices.

According to the Federal Statistical Office, Germany's inflation rose to almost 8% in August after declining slightly in the months of June and July.

German politician and fellow left-wing, Sahra Wagenknecht, condemned the government for dragging the country into a full-blown “economic war” with Russia who happened to be its top energy supplier, while she referred to the Bundestag concerning the fatal impacts that the Russian sanctions have on Germany.

The Bundestag warned that Germany's economic health is at stake considering the spiraling of energy prices out of control, which will serve as “a reminder of the good old days,” followed by Wagenknecht urging for the cancellation of restrictions and engaging in talks with Moscow.

The German government announced on Friday that it was taking control of the German operations of Russian energy firm Rosneft in a bid to secure energy supplies affected by the European sanctions on Russia in the wake of the Ukraine war.

Germany placed the German subsidiaries of Rosneft under the trusteeship of the Federal Network Agency, the economy ministry said in a statement.

"The trust management will counter the threat to the security of energy supply," it said, as Rosneft's subsidiaries make up around 12% of the country's oil refining capacity.

The companies affected by the decision are Rosneft Deutschland GmbH (RDG) and RN Refining & Marketing GmbH (RNRM), in addition to PCK Schwedt, MiRo, and Bayernoil, all of which are refineries.

PCK Schwedt, in particular, is highly vital for Germany, as it supplies around 90% of the oil consumed in Berlin and its vicinity, including the Berlin-Brandenburg international airport.

By circumventing their own sanctions aimed at punishing Russia for the Ukraine war, Berlin taking control of the sites allows it to continue operating the refineries using crude from countries other than Russia.

Germany, like the rest of Europe, has been struggling in light of the meager amount of Russian energy making it to the continent due to the sanctions, prompting various measures from local governments and the European Commission to try and tackle the spiraling energy crisis.

The European Commission had prepared suggestions on measures aimed at tackling soaring energy prices to be discussed by the energy ministers of the bloc’s member states. The suggestions include the proposal to introduce a price cap on Russian natural gas.

However, the bloc failed to agree on the cap, Hungarian Minister of Foreign Affairs Peter Szijjarto revealed Friday.

EU chief Ursula von der Leyen proposed that the bloc's 27 nations agree on placing a price cap on Russian gas imports.

Von der Leyen's decision comes as a means of imposing further sanctions on Russia as the West looks for more means of punishing the country over the war in Ukraine.

13 EU nations have either ceased getting Russian gas entirely or are only receiving a portion of it due to the temporary blockage of the Nord Stream 1 pipeline, the Russian TASS news agency reported last week.

Surging costs of power linked to gas prices have already stunted the production of various industries, such as fertilizers and aluminum manufacturers, and prompted EU governments to increase their spending by billions in order to help their citizens.

Italy and Germany are now the two largest European countries most exposed to a gas supply shock due to their extensive use of natural gas and significant reliance on Russia, according to S&P Global Ratings.

About 60% of Germany's natural gas supply was piped in from Russia in 2020, primarily under long-term contracts.

Following White House secretary Karine Jean-Pierre's statement that sending migrants to Martha's Vineyard and Washington, D.C. by GOP governors is a maneuver of an "illegal stunt", Texas governor Greg Abbott responded by calling out the Biden administration for failing to acknowledge the dire situation of the US southern border - but the GOP politicians have been exploiting the migrants who they keep deliberately "shoving" left and right across the country, using them as a pressure card for the Democratic party and the White House.

Even after Jean-Pierre assured that the migrants voluntarily signed a waiver that was already available in multiple languages before getting into the busses, Abbott's office echoed its claims that both President Joe Biden and who Abbott called "Border Czar" Vice President Kamala Harris were failing to resolve the migrant conflict at the border, where Texas is the first stop.

Abbott's press secretary, Renae Eze, stated: "Instead of their hypocritical complaints about Texas providing much-needed relief to our overrun and overwhelmed border communities, President Biden and Border Czar Harris need to step up and do their jobs to secure the border—something they continue failing to do".

Migrants as 'political pawns'

Martha's Vineyard, an island belonging to the state of Massachusetts, received planes with mainly Venezuelan migrants on Wednesday, a move credited to Florida Gov. Ron DeSantis. According to Taryn Fenske, DeSantis' communications director, the Florida legislature ratified $12 million for the transportation of undocumented migrants from the state consistent with federal law.

Thursday morning witnessed two buses of migrants from the US-Mexico border were sent by Abbott to a location near Vice President Kamala Harris’ home at the Naval Observatory in Washington, D.C., followed by a tweet that he dropped off the migrants in her “backyard” and called on the Biden administration to “do its job & secure the border.” Just a week earlier, Abbott sent approximately 75 migrants to Chicago.

Arizona governor Doug Ducey followed suit with this approach, sending busses of immigrants to Washington D.C., disclosing in a news release that the voluntary bus trips are considered necessary as a result of “little action or assistance from the federal government.”

During a press conference on Thursday, Jean-Pierre said the series of putting the migrants on busses "is just cruel, and it's not about the process. Actually, It's about a political tool or political stunt that they're moving forward with," as she further accused the Republican governors of exploiting migrants as "political pawns."

Notorious border patrol agents

The fiscal year 2022 already recorded 1.8 million arrests of migrants by US border agents. Since the start of Joe Biden's term in office, more than one million migrants have entered the US, per figures cited by Customs and Border Protection (CBP).

The process goes as follows: after migrants cross the US-Mexico border, a CBP facility hosts them before being released by border officials and are served documents to appear in court, after which they are no longer in federal custody and are free to travel across the country, but many remain in waiting months for case hearings due to legal and procedural backlogs.

John Durham’s team has known of these discrepancies for years but has failed to hold responsible those who used the CIA to target a political opponent with false smears.

A whitepaper obtained first by The Federalist suggests Special Counsel John Durham botched the investigation of a second Russia collusion hoax, the one concerning Yota cellphones.

In a scandal linked to the Spygate operation, Hillary Clinton cronies peddled to the CIA fake evidence they claimed established Donald Trump and his associates were using the Russian-made Yota cellphones in the vicinity of the White House and other key locations. The news of this operation broke during the special counsel’s prosecution of former Clinton campaign attorney Michael Sussmann. However, the just-obtained Yota whitepaper that was supposed to undergird Sussmann’s claims differs substantially from the memoranda documenting what Sussmann supposedly said to the CIA.

Durham’s team has known of these discrepancies for years but has failed to hold responsible those who used the CIA to target a political opponent and the then-president of the United States with false smears of corruption with a foreign power. Now with the news that thespecial counsel’s office has let the grand jury expire, suggesting a winding down of the investigation, Durham’s failure to seek charges related to the Yota phone hoax is appalling. Durham offered the only apparent opportunity for justice in this entire collection of major scandals.

Sussmann Trial Unveiled Another Collusion Hoax

One year ago, almost to the day, Durham charged Sussmann with one count of lying to the then-FBI general counsel James Baker. According to the indictment, during a September 19, 2016, meeting with Baker, Sussmann provided the FBI’s general counsel information that purported to show the existence of a secret communication channel between the Trump organization and the Russian Alfa Bank.

“The indictment charged that Sussmann told Baker during that meeting that he was not working on behalf of any client, when, according to the indictment, Sussmann was actually acting on behalf of ‘a U.S. technology industry executive at a U.S. Internet company’—later identified as Rodney Joffe—and ‘the Hillary Clinton Presidential Campaign.’”

While a jury acquitted Sussmann of the charged offense, the prosecution of the former Clinton campaign lawyer revealed several previously unknown details related to the Russia collusion hoax, including Sussmann’s peddling of a second Trump-Russia connection to the CIA.

According to court filings, beginning in December of 2016, Sussmann sought to score a meeting with the CIA. Then on January 31, 2017, Sussmann previewed the information he hoped to hand off to the agency, telling a former CIA employee that he represented a client who had discussed “some interesting information about the presence and activity of a unique Russian made phone around President Trump.”

During his January 2017 conversation, according to a memorandum summarizing the exchange, Sussmann said the activity began in April 2016 when then President-elect Trump was working out of the Trump Tower on its Wi-Fi network. After his move to the White House, Sussmann stressed, the same phone surfaced on the Executive Office Building network.

The Narrative Web Sussmann Wove

Sussmann also relayed that his client, later identified as Rodney Joffe, claimed the phone at issue was the extremely rare Russian “Yota phone,” of which only about a dozen or so are used in the United States. Joffe also claimed Russian government officials often received Yota phones as a gift.

The memorandum then summarized the many specifics Sussmann relayed about the supposed connection between Trump and the Yota phone. After the cellphone that first surfaced in April 2016 on Trump Tower’s network, according to Sussmann’s briefing, it was also used on the Wi-Fi at Trump’s Grand Central Park West apartment.

Also, “when Trump traveled to Michigan to interview a cabinet secretary the phone appeared with Trump in Michigan,” the memorandum reported. Then, according to the memorandum, Sussmann claimed that “in December 2016 the phone disappeared from Trump Tower Wi-Fi network and surfaced on EOB network.” Sussmann added that “the phone was never noticed in two places at once, only around the President’s movements.”

Sussmann reportedly also told his contact that from April 2016 forward, the Yota phone was used to make several calls to Moscow and St. Petersburg, Russia, and obtained systems upgrades.

Sussmann Pitches the CIA Some Documents

After highlighting these details for his contact, the memorandum notes that Sussmann indicated Joffe would most likely only provide his data to senior CIA officers, and if the agency was not interested he would most likely provide the information to The New York Times. Sussmann’s sales pitch worked, with the former CIA employee passing the information on to the agency the same day. The CIA later agreed to meet with Sussmann.

Then, during a February 9, 2017, meeting, according to a memorandum prepared by the CIA, Sussmann provided the agents “both written documents and thumb drives which he claimed contained data related to potential Russian activities connected to then Presidential candidate/elect Trump.” The memorandum also noted, inconsistently with the January 2017 memo, that Sussmann said he was not representing a specific client.

According to the memo, Sussmann then described generally the data he was providing on the thumb drive, noting it related to “domain name systems.” Sussmann further explained that his “contacts had gathered information indicating that a Russian-made Yota-phone had been seen by them connecting to WiFi from the Trump Tower in New York, as well as from a location in Michigan, at the same time that then-candidate Trump was believed to be at these locations.” Sussman also told the agents that in December 2016 his associates saw the Yota phone connecting to Wi-Fi from the Executive Office of the President.

Durham: Sussmann Misled the CIA

In a pre-trial motion filed in Sussmann’s criminal case, Special Counsel Durham first revealed Sussmann’s efforts to peddle the Yota phone theory to the CIA on behalf of Joffe. The special counsel further explained that the Yota phone internet data Sussmann provided the CIA came from Joffe and his associates’ exploitation of domain name system (DNS) Internet traffic, including at the Executive Office of the President.

According to Durham’s team, Joffe’s employer “had come to access and maintain dedicated servers for the EOP as part of a sensitive arrangement whereby it provided DNS resolution services to the EOP.”

In Sussmann’s case, the special counsel also stressed that it had found no support for Sussmann’s claim to the CIA that the DNS data showed Trump or his associates were using the Yota phones. On the contrary, Durham’s team explained that the more complete DNS data obtained by Joffe and his associates “reflects that such DNS lookups were far from rare in the United States.”

For example, data gathered by Joffe’s team, but not provided to the CIA, “reflected that between approximately 2014 and 2017, there were a total of more than 3 million lookups” of Yota phone provider’s IP addresses by U.S. users, and of those fewer than 1,000 originated at Trump Tower. Additionally, the more complete data assembled by Joffe and his associates “reflected that DNS lookups involving the EOP and Russian Phone Provider-1 began at least as early 2014,” meaning the connections came during the Obama administration. The data Sussmann provided the CIA on behalf of Joffe omitted these facts.

As I wrote at the time of the special counsel’s filing: “This revelation is huge. It means Joffe had data that disproved the very theory Sussman peddled to the CIA about Trump or his associates using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations. Further, the CIA received only the misleading data and not the full analysis Joffe had commissioned.”

Failing to Pursue This Is Inexplicable

Yet Durham did not charge Sussmann related to the Yota-phone hoax and to date Joffe has also avoided an indictment. At the time, those tracking developments in the special counsel’s probe wondered why charges were not pursued. But now, having obtained a copy of a whitepaper supposedly backing up the Yota phone theory, the special counsel’s complete inaction over this hoax proves inexplicable.

In response to an open-records request submitted to Georgia Tech seeking a copy of a whitepaper analyzing Yota-related data, The Federalist on Monday obtained a document entitled “Network Analysis of Yota-Related Resolution Events.” Georgia Tech researcher David Dagon, one of Joffe’s associates involved in mining the DNS data, had identified the document as one responsive to a special counsel subpoena. The metadata of the file shows a creation date of February 8, 2017—just one day before Sussmann provided the CIA data supposedly supporting the Yota phone theory.

Together these facts strongly suggest this document provided the basis for Joffe’s claims—relayed by Sussmann to the CIA—about the Yota phones. But the whitepaper’s claims pale in comparison to the story Sussmann told the CIA, as memorialized in the two memoranda and highlighted above.

Whitepaper Doesn’t Support Sussmann’s Claims

“Network traffic analysis strongly suggests communications between Russian networks and Trump Tower, associated Trump properties, with artifacts also present at EOP,” the paper opens. The whitepaper makes no further mention of the EOP.

The whitepaper is similarly circumspect about the Yota phones moving in tandem with Trump, stating merely: “It is possible that one or more devices is at times traveling between locations as there are sometimes gaps possibly correlated to newsworthy events such as New York, NY to Grand Rapids, MI, lifting of some sanctions on Russia, and the disappearance of the queries from New York in mid-December and from Grand Rapids, MI in mid-January 2017.”

The unidentified authors then note that the “document summarizes factual observations, so that others may infer activities associated with these Russian phones on Trump’s networks.”

What Sussmann told the CIA, however, included many more extensive details than the whitepaper, raising the question of where the inferences peddled to the CIA originated. Who concocted the theory that the Yota phone traveled with Trump to Michigan or to the EOP? On what basis? Who provided the data supposedly showing the same Yota phone calling Moscow and St. Petersburg? Who culled that data?

Whitepaper Creators Omitted Key Facts

The text of the whitepaper also makes more concrete—and more appalling—Durham’s revelation that Joffe and his associates omitted key details about the number of Yota phone lookups. While Joffe and his associates knew there were more than 3 million lookups of the Yota-phone provider from U.S.-based IP addresses from 2014 to 2017, the whitepaper included an entire section entitled, “Rarity of Yota in US,” that concluded YotaPhones are “rarely seen on US networks.”

While the special counsel’s office highlighted this omission in the Sussmann case, nothing of consequence seems to have come from that discovery. Further, given the gulf that separates what Sussmann told the CIA and the much more milquetoast assertions in the whitepaper, one must wonder what Durham’s team has done to unravel this aspect of the Russia-collusion hoax.

Finally, the evidence is now clear that Joffe shared the EOP data with someone at Georgia Tech, since the whitepaper referencing that data proved responsive to a right-to-know request served on the university. But Joffe’s right to the EOP data was limited.

So the key question becomes: Why has Durham’s team not pursued charges against anyone related to the Yota phone hoax?

We were by no means wealthy, but you just gave. My mom always taught us that. My brother does the same thing. My brother owns a sober house. He bought it and he runs it. And he employs most of the people in the sober house in his company. But I really think it’s Christ-centered.”

Her volunteer work with young people through church is another important part of Belcastro’s life. “My passion is with young people. My dream is to have a Christian school free here on the Island,” she told me. “No cost for parents. That’s my dream. After COVID we’ll start focusing on that dream. But yeah, the kids are my passion. That’s where my heart is, youth groups.”

“There aren’t words to describe the joy from working with the kids,” Belcastro says. She described how some of the kids in the two youth groups she works with come from solid homes, single-parent homes, or some are in foster care. The youth groups are not affiliated with any one church, she explained, and are open to everyone.

“The youth groups aren’t with one church,” she said. “We have kids from several churches and kids who don’t go at all. The kids just want to be heard, and they like asking questions and having an adult listen to them, to help them problem solve situations. It’s so important. It sounds hokey but it really is an honor and a privilege. When you give of yourself you want to give more; it’s rewarding just to be around them.”

I asked her what the winter shelter is in need of and she said the greatest need is a permanent shelter.

“People can definitely make a donation. Our greatest need is a permanent structure, or time and services when we do get one. We need a permanent structure. Housing is the number one problem. With Harbor Homes, this shelter is only one of our options. We have the Tashmoo house, which is more permanent with six rooms, but you have to be clean and sober to get in there. There is a waitlist for those who are medically fragile or mentally fragile, and we have grants for hotel rooms for those who couldn’t come and stay here. This is a wet shelter. You can be clean and sober or you can be tipsy and still come in the door; we don’t turn people away.”

Texas declines to pardon late George Floyd

State clemency board formally rejected a petition asking governor to erase a drug conviction against police brutality victim

A Texas clemency panel has formally rejected a petition for a posthumous pardon of George Floyd, whose death sparked massive protests against police brutality after he was killed by a Minnesota police officer in 2020. The panel had initially recommended clearing his slate, but reversed the decision late last year.

The Texas Board of Pardons and Paroles voted unanimously against calling on Governor Greg Abbott to grant a rare revision of a person’s criminal record after their death, the Texas Tribune reported on Thursday.

The letter sent to Floyd’s attorney Allison Mathis, to notify her about the decision was first published by a reporter for the Marshall Project, a non-profit outlet covering criminal justice news. It did not explain the board’s reasoning for rejecting the petition.

Mathis, a Houston public defender, petitioned the board to pardon Floyd over a 2004 drug conviction in April 2021. That came after a police officer whose testimony helped build the case against Floyd, was accused of using false evidence in multiple cases.

The officer, Gerald Goines, is now also facing murder charges after a botched drugs raid in 2019. During the investigation, he was accused of inventing confidential informants and otherwise lying to smear defendants.

The board had recommended pardoning Floyd in October last year, but rescinded the decision two months later. The governor’s office said at the time that the clemency body would review the case to “resolve procedural errors and issues”. Abbott could not consider the pardon without a proper recommendation, his press secretary explained.

Mathis, Floyd’s attorney, told the Tribune that Texas had missed a chance “to do a small, good thing: to take an apolitical stance that no matter who a person is, their rights need to be respected and an accurate record of their life is important.”

Floyd was killed in May 2020 during a police arrest, which was filmed by witnesses and quickly went viral on social media. The footage sparked nationwide protests against racism and police brutality.

Derek Chauvin, the white officer who held his knee on Floyd’s neck for eight minutes as he was restraining the black man, was convicted in April 2021 of unintentional second-degree murder, third-degree murder, and second-degree manslaughter.

Putin warns of more serious response in Ukraine

Russia has shown a reserved reaction to Kiev’s actions and “terror attacks,” but that may change, the president has signaled

Russian President Vladimir Putin has commented on Ukraine’s ongoing counteroffensive and warned of consequences for Kiev over its attempts to stage what he described as “terror attacks.”

So far, Moscow has shown “restraint” in its reaction, Putin insisted, but he warned thatthis may change. The president was speaking at a press conference in Samarkand, Uzbekistan, on the sidelines of the Shanghai Cooperation Organization summit.

“The special military operation is not a warning of some sort, but a special military operation. We’re witnessing attempts to stage terror attacks, attempts to damage our civilian infrastructure. We respond to this with restraint, but only for the time being,” Putin stated.

Quite recently, the Russian armed forces delivered a couple of sensitive strikes, let’s say they were a warning. If the situation continues to develop in such fashion, the response will be more serious.

While the president did not specify which specific incidents he was referring to, over the past week the Russian military has targeted several key infrastuctural sites across Ukraine.

The president also touched on the ongoing counteroffensive launched by the Ukrainian military, which is already celebrated as a great success by Kiev and its Western backers.Before drawing any conclusions, one should wait and see “how it ends,” Putin suggested.

According to DOJ whistleblowers, Facebook has been spying on Americans' private messages and reporting them to the FBI if they express 'anti-government or anti-authority' statements - including questioning the legitimacy of the 2020 US election.

As the New York Post's Miranda Devine writes, "Under the FBI collaboration operation, somebody at Facebook red-flagged these supposedly subversive private messages over the past 19 months and transmitted them in redacted form to the domestic terrorism operational unit at FBI headquarters in Washington, DC, without a subpoena."

"It was done outside the legal process and without probable cause," said one of the whistleblowers, who spoke on condition of anonymity. "Facebook provides the FBI with private conversations which are protected by the First Amendment without any subpoena."

According to one Post source, "They [Facebook and the FBI] were looking for conservative right-wing individuals. None were Antifa types."

The Facebook users whose private communications Facebook had red-flagged as domestic terrorism for the FBI were all “conservative right-wing individuals.”

“They were gun-toting, red-blooded Americans [who were] angry after the election and shooting off their mouths and talking about staging protests. There was nothing criminal, nothing about violence or massacring or assassinating anyone.

Once flagged, the private messages were farmed out as "leads" to FBI field offices around the country, which would then reach out to that area's US Attorney's Office to legally obtain the private conversations they had already been shown.

Germany Seizes Control Of Russian-Owned Oil Refineries

German officials said Friday that Berlin has taken control of three Russian-owned refineries located in Germany in a scramble to shore up energy security before the planned embargo on oil imports from Russia kicks in and further squeezes energy supplies.

Germany’s Economy Ministry said in a statement on Sept. 16 that Rosneft Deutschland GmbH and RN Refining & Marketing GmbH will be put under the administration of Germany’s Federal Network Agency.

With the move, German authorities will also assume control of Rosneft’s shares in three refineries—PCK Schwedt, MiRo (Karlsruhe), and Bayernoil (Vohburg), the ministry said.

Rosneft Deutschland is one of the biggest oil-processing companies in Germany, holding a total of around 12 percent of German oil refining capacity.

The takeover “counters the impending risk to the security of the energy supply, and lays a key foundation stone for the maintenance and future of the Schwedt operation,” the ministry said. Schwedt supplies some 90 percent of Berlin’s fuel.

European Scramble to Bolster Energy Security

The decision to seize control of Rosneft Deutschland is Germany’s latest attempt to stabilize the energy market, which has been rocked by disruptions stemming from Western sanctions on Russian energy and Moscow’s retaliation by curbing flows.

Russian energy firm Gazprom’s move to suspend gas supplies through the Nord Stream 1 pipeline at the end of August highlighted the prospect of gas shortages to generate electricity and heat households as winter approaches.

The German government said this week it would boost lending to companies at risk of being impacted by soaring gas prices.

‘In It for the Long Haul’

Governments across Europe have been racing to secure fuel deliveries and bolster their power providers and as they intensify sanctions on the continent’s major energy supplier, Russia, over its invasion of Ukraine.

The European Union has declared it would ban Russian oil imports by the end of 2022, even without an alternative source of cheap energy.

“We are in it for the long haul,” said European Commission President Ursula von der Leyen on Sept. 14.

Former Nevada deputy attorney general charged with 1972 fatal stabbing of teen girl

On Wednesday, a former Nevada deputy attorney general was arrested and charged in the 1972 cold-case murder of a teenage girl.

Fifty years ago, 19-year-old Nancy Anderson had recently graduated from high school and moved to Hawaii, the New York Post reported.

On January 7, 1972, police discovered Anderson dead inside her apartment. The young woman had been gruesomely attacked and suffered more than 60 stab wounds.

Police questioned knife salesmen who had been to Anderson’s apartment hours before her death. The men provided their fingerprints to detectives and agreed to polygraph tests. The police also questioned Anderson’s former boyfriends and the apartment’s property manager.

The cold case was reopened multiple times over the decades. Many suspects were investigated, but despite law enforcement’s best efforts to close the case, they could not identify the murderer.

It was not until December 2021 that authorities received a new tip recommending an investigation into Tudor Chirila Jr., a former Nevada deputy attorney general.

Chirila’s background

Chirila was a successful attorney in Reno, Carson City, and the Lake Tahoe area. He became Nevada’s deputy attorney in the late 1970s.

In 1998, Chirila was indicted for his role in defrauding the government in bankruptcy proceedings involving the Mustang Ranch, a brothel in Nevada.

Joe Conforte, the boss of the brothel, had his business seized by the IRS. Conforte was accused of attempting to defraud the government and regain ownership of the business by purchasing it back under the hidden ownership of another company.

Chirila acted as the president of the company A.G.E. Corp., and Conforte was allegedly the hidden owner of the company. In 1990, Chirila and the company illegally bought the brothel from the IRS. In court, the attorney testified that he knew Conforte owned A.G.E. Corp.

Chirila’s suspected involvement in Anderson’s murder

Following the tip to investigate Tudor Chirila Jr. for the 1972 murder, police collected a DNA sample from his son, John Chirila, in March 2022. Authorities confirmed that John’s DNA matched that of the biological child of the person whose DNA was found in Anderson’s apartment.

With that new evidence, authorities secured a search warrant and collected a DNA sample from Tudor Chirila Jr. on September 6.

The now 77-year-old man attempted suicide two days after police collected the sample. On Wednesday, he was arrested in Reno and charged with second-degree murder for the fatal stabbing of Nancy Anderson.

NBC News Asks Twitter, TikTok to Censor Videos of John Fetterman Speaking

NBC News falsely claimed that footage of John Fetterman struggling to speak during a recent rally was “doctored” and urged social media companies to censor. Fetterman, who suffered a stroke earlier this year, has struggled with public speaking while recovering, something the senate hopeful has himself admitted to. The outlet flagged videos of Fetterman speaking to Twitter and TikTok, baselessly claiming that they were in violation of their political misinformation policies. TikTok complied and removed the videos.

NBC News took issue with highlight reels of a recent Montgomery County rally in which Fetterman struggled through parts of his speech. The outlet accused one prominent conservative social media account of deceptively editing video of speeches to “create the perception that what he was saying was nonsensical.”

The report accused social media platforms of ignoring their own policies “against political misinformation” in allowing the videos to stay up.

NBC News Deputy Editor of technology Benjamin Goggin wrote, “Deceptively edited videos that have been viewed hundreds of thousands of times on Twitter and TikTok exaggerate the speech issues that have plagued John Fetterman, the Democratic nominee for Pennsylvania’s open U.S. Senate seat, after he had a stroke in May.”

Explaining the alleged edits, Goggin claimed they consisted of “cutting out the sound of the audience to make it appear as if he had abruptly stopped speaking (some of the stops occurred when he was pausing during moments of applause and crowd reaction, according to unedited videos seen by NBC News).”

The NBC News reporter singled out popular digital strategist Greg Price, whose supercut of Fetterman’s speech had been 600,000 times when the report was published.

Goggin claimed that the videos violate Twitter and TikTok’s policies “against political misinformation,” and the outlet flagged these videos for the platforms itself. TikTok ultimately removed the videos from its platform.

“So NBC News decided to accuse me of doctoring videos of John Fetterman that I posted. (I didn’t doctor anything),” Price wrote in a tweet. “They also reached out to Twitter to try and get them censored.”

“Twitter did not immediately respond to requests for comment. TikTok removed the videos that NBC News flagged to it, citing its ‘integrity and authenticity’ policy, which includes rules about misinformation,” Goggin reported.

Fetterman himself has admitted that he sometimes struggles with speaking while recovering from his stroke. “As I recover from this stroke and improve my auditory processing and speech, I look forward to continuing to meet with the people of Pennsylvania,” Fetterman said when he declined a debate with Dr. Mehmet Oz last month.

Fetterman’s team dodged debate challenges from the Oz campaign for weeks, though Fetterman has finally agreed to a debate in late October, deep into Pennsylvania’s early voting period.

The EU is Speeding Towards Digital ID, Currency, and Biometric Systems for Tracking Citizens.

A consortium of six European nations is pushing for a new, digital, cross-border payment system which ultimately aims to combine the EU Digital Identification program with a digital euro.

The NOBID (Nordic-Baltic eID) project – which is comprised of the governments of Denmark, Germany, Iceland, Latvia and Norway – is being supported by multinational banks, large technology firms, and other government agencies from across Europe.

NOBID’s website describes the project – which sounds eerily similar the kinds of social credit system used by countries like Communist China – as the brainchild of the unelected European Commission.

“The payment use case is recognized as a key use case based on several rationales, one being the potential extension to the Digital Euro,” they claim. In its current stage, the project will likely link national bank accounts to the centralized application, and will act as intermediary between banks and merchants.

Since the Digital Euro has not yet been deployed and is slowly looking to enable its application in a peer-to-peer framework, and such projects can drastically help to advance final implementation. A prototype phase for the ECB issued Digital Euro currency might be utilized by the end of 2023.

Tor Alvik, project manager of the consortium said, “We are hugely excited to turn the EU vision into a reality and make smoother, more readily available ID services possible for all,” effectively confirming the link between both the EU DigitalID System and the Digital Euro.

The European Digital Identity, in development since the beginning of the COVID-19 pandemic, integrates various aspects of personal identifiers including birth certificates, medical documents, bank accounts, tax returns, education status, and prescriptions. As The National Pulse has previously reported, the goal for the EUiD is to act as the central authority for identification for both physical and digital world.

Various consortiums and companies across Europe are already developing numerous projects as a second layer to the EU Digital ID system and expanding its capabilities. One company for example, iProov, is focused on biometric authentication systems which patented important biometric ID tools used by various governments and corporates. The company specializes in deepfake threat detection, passwordless authentication, facial recognition, vaccine status verification, and more. iProov is also part of the NOBID consortium.

With more services integrated on top of the EUiD, concerns are growing about threats to privacy and individual liberty. Given the developments that took place during COVID, people across Europe have experienced major violations of their personal freedoms – which were dictated by technocratic leadership on both national and supranational levels.

The letter, which has 67 signatures on it, calls for both Superintendent of Schools Toni Jones and Deputy Superintendent Ann Carabillo to immediately be put on leave until the independent investigation by the town is complete.

The letter signed by Greenwich Republicans calls for the ongoing school district’s investigation to be suspended because of potential conflicts of interest with future lawsuits and for the Board of Education to “instruct school administrators to remove from the classroom any curriculum and instructional materials that have not been reviewed and approved by a majority vote of the BOE.”

The letter also calls for the Board of Education to “review its policies relating to preventing political and religious bias in hiring and instruction, including curriculum materials, lesson plans and teaching practices and take strong steps to enforce such policies.”

Twitter could face billions in fines over not protecting minors from porn: ex-FTC officials

Twitter has reportedly failed to adequately police underage pornography across its social network — a mess posing the risk of a federal investigation that could cost the company billions of dollars in fines, The Post has learned.

The embattled social media site — which is in the middle of a court battle with Elon Musk to enforce an agreement to sell him the company for $44 billion — may have broken a so-called consent decree with the Federal Trade Commission when the company reportedly found in an internal study this year that it doesn’t adequately stop underage users from viewing and uploading porn, two former FTC officials told The Post.

Specifically, Twitter executives reportedly found in an internal study the company lacked adequate controls to prevent underage users from both accessing and uploading pornography, according to an Aug. 30 story in the Verge, which cited an internal Twitter team’s findings. Unlike other major social media companies, Twitter allows porn on its site.

The internal researchers reportedly said the site also is unable to consistently detect banned content such as child porn, revenge porn and non-consensual “upskirt” photos once it’s uploaded to the site.

“Twitter cannot accurately detect child sexual exploitation and non-consensual nudity at scale,” the researchers wrote in April, according to the Verge.

While regulators haven’t publicly reacted to the report thus far, Twitter’s failures could run afoul of its commitments under a consent decree signed in 2011, which requires that Twitter “shall not misrepresent” the extent to which it protects the security and privacy of users, former FTC officials said. The alleged problems with porn moderation could qualify as undisclosed user privacy and security problems, according to the officials.

Spokespeople for Twitter and Musk declined to comment. The FTC did not respond to a request for comment.

In response to the Verge story, Twitter said that it has “zero tolerance for child sexual exploitation.”

“We aggressively fight online child sexual abuse and have invested significantly in technology and tools to enforce our policy” the company added. “Our dedicated teams work to stay ahead of bad-faith actors and to help ensure we’re protecting minors from harm — both on and offline.”

‘No hesitation’

In an exclusive interview with The Post, former FTC Chairman William Kovacic called for the FTC, which he noted has a mission to protect consumers, to immediately investigate the allegations. He said Twitter could be hit with a fine in the range of $5 billion if it is found to have violated the consent decree by failing to protect underage users.

“There should be no hesitation,” Kovacic said of a potential FTC investigation.

Kovacic was one of five FTC commissioners who inked the 2011 consent decree — which followed a pair of major hacks that the FTC blamed on “serious lapses in the company’s data security” — requiring Twitter to not mislead consumers about safety and privacy. It remains in effect until 2031.

Another former FTC official, who asked not to be named, also told The Post that Twitter’s alleged underage porn problem should immediately be probed by the agency, which is currently led by anti-Big Tech hardliner Lina Khan.

Underage users’ access to porn had been a priority for the FTC when it drafted the 2011 consent decree, but it appears the company hasn’t done enough to live up to its commitments, the ex-FTC official said.

If Twitter can’t “control” which users view or upload porn, the ex-FTC official added, “then it’s reasonable to conclude that they would be in violation of the 2011 prohibition not to misrepresent security and privacy of users.”

Kovacic said the FTC fines a company based partly on how long it hasn’t complied with a consent decree. If the agency determines that Twitter has been out of compliance for more than 10 years, he said the fine could be in the $5 billion range — roughly equal to Twitter’s entire 2021 revenue.
