Russia ditches key demands in Ukraine peace talks – FT
Moscow has apparently dropped several key demands in the painstaking Ukraine peace talks, the Financial Times reported on Monday, citing “four people briefed on the discussions.”
The newspaper didn't clarify whether its alleged sources are from the Russian or Ukrainian side, or neither.
According to the report, Moscow is now prepared to let Ukraine “join the European Union if it remains militarily non-aligned as part of ongoing ceasefire negotiations” and drops its NATO aspirations.
“The draft ceasefire document does not contain any discussion of three of Russia’s initial core demands – ‘denazification’, ‘demilitarization’, and legal protection for the Russian language in Ukraine,” the newspaper asserted, adding thatits sources spoke “under the condition of anonymitybecause the matter is not yet finalized.”
The reported shift in Moscow’s position comes ahead of a new round of Russia-Ukraine talks scheduled to take place in Turkey on Tuesday. Moscow and Kiev have held three rounds of in-person talks and further contacts via video link, but the exchanges have failed to yield any tangible result apart from the two sides finding some common ground on humanitarian corridors and evacuation of civilians from combat zones.
In mid-March, the Financial Times reported an imminent breakthrough in the talks, claiming that the two sides had drafted a 15-point peace plan. The report, however, was refuted by both Moscow and Kiev, while no actual breakthrough occurred. The new claims by the newspaper have not prompted any official reaction so far.
The latest prediction appeared to directly contradict fresh statements by Russian Foreign Minister Sergey Lavrov, who told Serbian media that both “denazification” and “demilitarization” remain among the main goals of Moscow.
“It’s in our interest that these negotiations yield a result. A result that will meet our principal goals,” the top diplomat stated, adding that recent events in Ukraine have clearly shown that hard-line nationalist fighters “are exploring Nazi warfare style in practice.”
“If you have seen how the Nazi Ukrainians from the Azov or Aidar battalions treat Russian prisoners of war now, I think everything becomes clear to you,” Lavrov said, referring to gruesome footage, purporting to show the torture and execution of Russian POWs by the Ukrainians that emerged over the weekend.

MACOMB, Okla. – Newly unsealed court documents allege a social studies teacher, charged with distributing child pornography, shared thousands of files in a private messaging group that appear to show school-aged children engaged in sex acts.
Lucas William Cane,30, a Macomb Public Schools teacher, was arrested by U.S. Marshals on August 28 and made an initial appearance in Oklahoma federal court on distribution and conspiracy to distribute child pornography.
Cane, and Daniel A. Nickelson of Arizona,were charged in Washington, D.C. district court on August 24 in connection to an FBI child exploitation task force dating back to July.
Cane, who is married and has children, taught junior high and high school social studies and was set to start coaching the junior high boys basketball team this year, according to district officials. But, just weeks into the school year, Cane was arrested and charged with distribution and conspiracy to distribute child pornography.
“When the arrest occurred and we visited with law enforcement when they came to notify us, the question was asked, ‘Does this pertain to Macomb?’ And we were told that we were not part of the investigation,” said Macomb Public Schools Superintendent Matt Riggs. “What was disclosed to us was that he was arrested, they did disclose the nature of the charge.”
For two weeks, the charges and criminal complaint were under wraps, until a federal judge in Washington unsealed the documents last Friday.
According to the 21-page criminal complaint, an undercover Metropolitan Police Department detective assigned to the FBI Washington Field Office’s Child Exploitation Task Force was invited in early July to a messaging group called “PEDOS ONLY” on the free messaging app Kik.
That chatroom, according to court documents, led to another chatroom where Cane – posting under the Kik user “Summersweet87” – was asked by another user, later identified as Nickelson, to “post an image or video the group may like.”
According to the complaint,Cane posted 23 cloud storage links containing more than 6,500 pictures and videos“depicting children who appeared to be of elementary, middle, and high school ages engaged in sexual acts or posing sexually.” Some children appearing alone, with adults or with other children engaged in various sex acts.
Investigators subpoenaed Kik, AT&T and Apple for user data, tracking the person behind the post to Cane’s devices and his registered LLC in Ada.
Cane is currently suspended and awaiting transfer from Oklahoma to Washington on the charges.

Macomb Teacher Faces Federal Charges After Child Porn Arrest
An Oklahoma teacher was arrested on federal charges Tuesday, the Department of Justice reported Wednesday.
Lucas Cane, 30, of Ada, is accused of distribution of child pornography and conspiracy to distribute child pornography.
Cane was a teacher with Macomb Public Schools. The school district first confirmed arrest of the teacher and said the crime occurred off-campus. Cane has since been suspended.
Parents stress that while this is shocking, the school is still a safe place for students.
“There are a lot of parents concerned that maybe the school knew something. They did not know anything about this,” said Chelsea Johnston, a former student who now has two children enrolled in Macomb Schools. “I think this is one negative thing that will impact us for a long time, and I don't think that's fair. I don't think our school should be judged on that.”
The district said no students were harmed or at risk. The district said they cannot make further comment during the ongoing investigation.
Cane appeared in the U.S. District Court for the Western District of Oklahoma and is being held pending further court proceedings in the U.S. District Court for the District of Columbia.
In a release, the district said, "We will work closely with law enforcement to address the situation accordingly as we receive more specific information about it."

Defendant Independent School District No. 117 of Pottawatomie County, Oklahoma ("Defendant District") brings before the Court a Motion to Dismiss [Doc. No. 3], pursuant to Fed. R. Civ. P. 12(b)(6). Plaintiffs have filed a Response in Opposition [Doc. No. 5], to which Defendant has replied [Doc. No. 6]. These matters are now fully briefed and at issue.
BACKGROUND
Plaintiffs are the parents of minor children A.P.H. and A.N.H.(the "Minor Children"). The Minor Children have attended Macomb Public Schools ("MPS") since 2015. At the time of the alleged incidents, A.P.H. was six years old and in the first grade, and A.N.H. was five years old and in pre-kindergarten. Defendant Lucas Cane was employed by MPS as a middle school teacher.On June 4, 2018, during MPS summer school, Cane would visit A.N.H. in the cafeteria and classroom and ask A.N.H. for hugs. Cane would tell A.N.H. that he "really, really, really liked" A.N.H. He also told her that he did not like her name and would repeatedly call her "Sally" in the presence of her classmates. On June 21, 2018, A.P.H. attended an MPS field trip. Cane was present.Cane asked A.P.H. for hugs, demanded that A.P.H. lay on his lap, and said he "really liked" A.P.H.A.P.H. laid on Cane's lap, and Cane put his hand on her back.
Following the first trip, A.N.H. complained to her parents about Cane. Plaintiffs attempted to contact the MPS principal that day. They were told a new principal was now in place, though the replacement was never identified. On July 26, 2018, the Pottawatomie County Sheriff's Department ("PCSD") contacted Plaintiffs and stated that an agent of MPS had contacted PCSD. The Minor Children participated in a forensic interview with PCSD, and MPS took no action against Cane. Because of Cane's inappropriate behavior, on August 2, 2018, Plaintiffs filed for an emergency transfer order from MPS to remove the Minor Children from the school where Cane taught. The transfer was denied.
Cane was arrested on August 28, 2018, pursuant to federal charges. He plead guilty to, inter alia, charges of distribution of child pornography.Plaintiffs have since made diligent attempts to have the Minor Children transferred to another school. They bring charges here of (1) invasion of privacy; (2) violations of the Oklahoma Governmental Tort Claims Act; (3) negligence per se; (4) violations of Article II §§ 2 and 7 of the Oklahoma Constitution; (5) violations of 42 U.S.C. § 1983; and, (6) violations of Title IX of the Education Amendments of 1972, 20 U.S.C. § 1681(a) ("Title IX").

STANDARD OF DECISION
To survive a motion to dismiss under Rule 12(b)(6), a complaint must contain enough facts that, when accepted as true, “state a claim to relief that is plausible on its face.” Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009); see Robbins v. Oklahoma, 519 F.3d 1242, 1247 (10th Cir. 2008). A claim has facial plausibility when the court can draw “the reasonable inference that the defendant is liable for the misconduct alleged.” Iqbal, 556 U.S. at 678. In § 1983 cases, it is particularly important “that the complaint make clear exactly who is alleged to have done what to whom, to provide each individual with fair notice as to the basis of the claims against him or her.” See Robbins, 519 F.3d at 1249-50 (emphasis in original); see also Smith v. United States, 561 F.3d 1090, 1104 (10th Cir. 2009).
DISCUSSION
Defendant District moves to dismiss on several state law grounds and the following grounds addressing federal claims: (1) Plaintiffs' allegations do not sufficiently rise to the level of danger-creating or conscience-shocking; (2) Plaintiffs' allegations fail to show a causal link between Defendant District's policies and any deprivation of due process or equal protection; (3) Plaintiffs' allegations fail to show a history of custom and usage; and, (4) Defendant District did not have actual knowledge of Cane's alleged inappropriate comments, and such alleged comments were insufficient to alert Defendant District to any type of sexual misconduct by Defendant Cane under Title IX. The Court will address each argument in turn.
I. Plaintiffs fail to state a claim for substantive due process and equal protection violations.
Count Five of Plaintiffs' Complaint alleges violations of their due process and equal protection rights under the federal constitution, actionable pursuant to 42 U.S.C. § 1983.
A. Plaintiffs fail to allege conduct that shocks the judicial conscience.
Plaintiffs first assert a 42 U.S.C. § 1983 supervisory liability claim against Defendant District based on alleged due process violations.
A § 1983 claim seeking to impose supervisory liability based on due process violations can be brought on “a danger creation theory.” Currier v. Doran, 242 F.3d 905, 919 (10th Cir. 2001). “‘The Due Process Clause is not a guarantee against incorrect or ill-advised [government] decisions.'” Uhlrig v. Harder, 64 F.3d 567, 573 (10th Cir. 1995) (quoting Collins v. City of Harker Heights, 503 U.S. 115, 129 (1992)). “The danger creation theory . . . focuses on the affirmative actions of the state in placing . . . [an individual] in harm's way.” Doran, 242 F.3d at 919; accord Briggs v. Okla. ex rel. Okla. Dep't of Hum. Servs., 472 F.Supp.2d 1304, 1314 (W.D. Okla. 2007), aff'd sub nom. Briggs v. Johnson, 274 Fed.Appx. 730 (10th Cir. 2008).
The Tenth Circuit has devised a six-part test governing danger creation claims. As applied to this case, Plaintiffs must demonstrate that: (1) Defendant District either created the danger or increased the Minor Children's vulnerability to the danger in some way; (2) the Minor Children were members of a limited and specifically definable group; (3) Defendant District's conduct put the Minor Children at substantial risk of serious, immediate, and proximate harm; (4) the risk was obvious or known; (5) Defendant District acted recklessly in conscious disregard of that risk; and, (6) such conduct, when viewed in total, is conscience shocking. Gonzales v. City of Castle Rock, 307 F.3d 1258, 1263 (10th Cir. 2002), rev'd on other grounds, Town of Castle Rock v. Gonzales, 545 U.S. 748, 125 (2005)).
Although Plaintiffs state the sixth element of the six-part test is a question of fact for the jury, it is the judicial conscience that must be shocked by the conduct alleged. Uhlrig, 64 F.3d at 573. As such the Court addresses this factor as a matter of law.
“The shocks the conscience requirement for a danger-creation claim is grounded in three principles: (1) restraint in defining the scope of substantive due process claims; (2) the concern that § 1983 not replace state tort law; and, (3) the need for deference to local bodies in making decisions impacting public safety.” See

Melnyk, always outspoken about Russia’s invasion into Ukraine and annexation of Crimea, is livid at the hypocrisy of FIFA — soccer’s governing body — for allowing the country to stage the tournament while Russian president Vladimir Putin is waging war.
“(Putin) has no right to have that,” Melnyk, chairman of the Advisory Committee for United with Ukraine, said in a telephone interview Wednesday.
Melnyk suggests Putin is trampling on the tournament ideals of global unity and peace.
“It goes against every possible theme of soccer and the World Cup and what it’s supposed to stand for,” he said.
By targeting chief sponsors, United with Ukraine is hoping that the lost profits and sense of global awareness will eventually result in FIFA moving the tournament. A statement released by the organization Wednesday said it is “asking FIFA’s partners to take a firm and principled stand and demand FIFA immediately re-assign the 2018 World Cup to a more deserving nation.”
The organization already does have some international support. In March, United States senators Mark Kirk (Illinois) and Dan Coats (Indiana) called for FIFA to move the World Cup away from Russia in 2018, as well as to remove Russia from the upcoming World Cup. The 2014 tournament will be played in Brazil from June 12 to July 13.
A pair of Russian parliamentarians immediately responded by suggesting the United States should be banned from the 2014 World Cup, citing American military actions and human rights violations.
But Melnyk is dedicated to the cause.
“It’s gaining traction as we speak,” said Melnyk. “I think it will be impactful. This will be relentless. It will go on for as long as it takes. It’s well funded and very well organized and then you mix in the passion of the people involved.”
Melnyk’s parents escaped Ukraine and met in Toronto in the early 1950’s and he grew up hearing countless stories about the Soviet invasion of their homeland. His paternal grandmother was thrown out of her home by Soviet officials. Melnyk has supported a variety of causes and charities in Ukraine. He distrusts Putin and worries about the country’s future.
On Wednesday, he repeated a statement he said months ago that Putin appears to be following Adolph Hitler’s plan for advancing through Europe.
Ukraine elected Petro Poroshenko as its new president last week, giving hope that tensions could calm down, but Melnyk isn’t convinced.
“I really believe that this is a lull in the action,” he said. “This is the way the playbook ran with Hitler. There’s no doubt in my mind.”
He praises Canada’s political leaders, including Minister of Foreign Affairs John Baird, for being outspoken about what’s happening in Ukraine and says his boycott stance is the best way he can make a difference.
“To me, it’s very personal in many ways. The fact is, I can help. I can’t stand in the centre of Kiev and march, but if I can assist, I will.”
The Senators owner says the rest of the world has to wake up to what’s happening.
“We need everybody,” he said. “We need the U.S. We need the (European community). Unless (Putin) is stopped now, he’s going to pick up half of Ukraine, then roll into the other half, and then into Moldova, Romania, Bulgaria, Poland.”

Frydenberg hides $30 a week tax increase for most Australians
Despite the federal budget’s focus on cost of living measures, the typical working Australian will still be $50 a week worse off. This is before a hidden tax increase that will leave low and middle-income earners, who are facing a tidal wave of extra costs, $30 worse off in the next financial year. Callum Foote reports.
Treasurer Frydenberg announced a number of cost of living measures in his budget speech.
These include a one-off $250 cost of living tax offset for more than 10 million low and middle-income earners, a boost to people receiving the low and middle-income tax offset by $420 for the 2021-22 financial year as well as halving the fuel excise for six months.
Hidden tax increase
What the Treasurer didn’t say is that the additional $420 tax offset for low and middle-income earners he mentioned will stop entirely at the end of this financial year, on June 30.
The extra cash bumps the tax offset up to $1500 per year.
This means that despite the extra cash given to them this year, those on this tax offset will be $1500, or almost $30 per week, worse off.
Additional costs Australians are set to face
The cut to the fuel excise will be 22 cents per litre, a welcome but temporary reprieve, though industry bodies have calculated that the average cost per litre has risen 38 cents since the Ukrainian invasion.
On top of the cost of fuel and vanishing tax offsets, Australians are looking down the barrel of a superannuation contribution increase which is likely to come out of their take-home pay and mortgage interest rates which are likely to be raised and will increase the cost of living for the majority of Australians.
Adding up all these costs, the typical full time working Australian, on $85k per year, will be an estimated $50 a week worse off after-tax with this budget only relieving this burden by $20.8 per week.
Combined with the very low levels of wage growth workers have experienced in recent years, with the December quarter seeing just a 0.7% increase according to the Australian Bureau of Statistics, this budget fails to keep Australians afloat.

The West will not agree to Moscow’s request to pay its gas bills in rubles, French President Emmanuel Macron said during a phone call with Russian President Vladimir Putin, Reuters reported.
Macron told Putin it was impossible for Western clients to pay for gas in Russian currency, the news agency reported on Tuesday, citing an Elysee official.
“France is against paying in rubles,” the official said, as quoted by the media.
In its own readout of the call between the two leaders, the Kremlin confirmed that Moscow’s proposal on ruble payments had been discussed, but it did not provide details on the positions of both sides.
Putin had previously ordered Russia’s central bank and Gazprom energy giant to ready proposals to have gas payments from “unfriendly” countries made in rubles.
That plan was rejected by the EU and the G7 earlier on Tuesday. Meanwhile, Kremlin spokesman Dmitry Peskov said on Tuesday that Russia would not supply natural gas to the European market for free, as euros and dollars would not be accepted from March 31.
The Russian list of “unfriendly states,” which initially included just two countries – the US and the Czech Republic – was significantly expanded in March in the wake of the unprecedented economic sanctions imposed on Moscow by the West. Now it includes all the EU members, Ukraine, the UK, Canada, Japan, and others – the nations which condemned Russia’s offensive on Ukraine.
All of those countries are now subject to various retaliation measures, restrictions, and specific requirements from Russia, with switching gas payments to rubles being one measure. Another retaliatory initiative saw the Finance Ministry requesting that Russian companies wishing to work with firms from countries on the list to receive government permission first.
On Monday, Russian Foreign Minister Sergey Lavrov announced that the citizens of “unfriendly states” would soon be hit by visa sanctions restricting entry to the country.

The government’s own database of Vaccine Adverse Events Reporting System (VAERS) through March 18, 2022 shows that there are unprecedented increases in recorded deaths and injuries following COVID-19 vaccines for the past 15 months since they were issued emergency use authorizations (EUAs), as compared to recorded deaths and injuries reported following all FDA-approved vaccines for the previous 30 years.
These government statistics show there is no greater danger to the lives of Americans today than our own government which is sitting on data that show the following increases of reports in VAERS following COVID-19 vaccines:
68,000% increase in strokes
44,000% increase in heart disease
6,800% increase in deaths
5,700% increase in permanent disabilities
5,000% increase in life threatening injuries
4,400% increase in hospitalizations
This is mass murder and genocide.
If the corporate media switched from covering the war in Ukraine and published this data directly from the government’s own database, there would be riots all across the U.S. right now, if not a Civil War.
But the largely brain-dead American consumer is content to watch their corporate news and blame all the world’s problems on Russia right now instead, as we face huge labor shortages and supply chain bottlenecks due to all these deaths and injuries from the COVID-19 vaccines that will now be blamed on Russia.

How far down does the slippery slope go?
A newly proposed bill in the California State Legislature could expand the ghastly practice of abortion to include infanticide – the killing of a newborn child – for several weeks, months, or even years after a child is born.
According to the pro-life group ‘Right to Life League,’ CA Assembly Bill 2223 “literally decriminalizes infanticide” by eliminating civil and criminal penalties for abortion up to, and past, the point of birth. The bill specifically includes the term “perinatal death” under the definition of abortion, which would allow for fully-developed, already-born babies to be snuffed out at the will of their mothers for a still-undefined amount of time.
We all know how extreme the liberal bastion of California is already; however, AB 2223 takes things to a whole new level. This is pure evil.
From the text of AB 2223:
“[A] person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights, based on their actions or omissions with respect to their pregnancy or actual, potential, or alleged pregnancy outcome, including miscarriage, stillbirth, or abortion, or perinatal death.”
Last month, radical California lawmakers introduced a bevy of extreme pro-abortion proposals, including AB 2223, in an effort to uphold Governor Gavin Newsom’s promise to make California a “sanctuary” state for killing unborn children.
AB 2223 includes the most radical language of all the proposals, and clearly exposes the true colors of the radical pro-abortion lobby, according to Thomas More Society Special Counsel Charles LiMandri.
The proposed bill explicitly allows for the “brutal murder” of newborn babies for weeks, months, or potentially years, LiMandri said, pointing out that the Federal Government defines ‘perinatal’ as “up to 24 months” following birth.

Anheuser-Busch beer heiress Trudy Busch Valentine on Tuesday announced her Democratic primary campaign for U.S. Senate in Missouri.
Former state Sen. Scott Sifton endorsed Busch Valentine and dropped out of the previously low-profile Democratic primary after her announcement.
Sifton portrayed the race as Democrats versus former Gov. Eric Greitens, the frontrunner of the Republican Senate primary in Missouri who is facing accusations of abuse from his ex-wife.
"Excited to help make [Busch Valentine] Missouri’s next Senator. I know she has what it takes to beat Eric Greitens," Sifton tweeted Monday.
Greitens has denied the claims of his ex-wive Sheena Greitens. Court documents uncovered by Just the News on Tuesday show that she had lost two court cases involving the Senate candidate before filing an affidavit claiming he abused her and their children when they were still married.
He has faced calls from Republicans to step out of the race. Sen. Josh Hawley, R-Mo., tweeted last week, "If you hit a woman or a child, you belong in handcuffs, not the United States Senate. It’s time for Eric Greitens to leave this race."
Elections this fall will replace retiring Republican Missouri Sen. Roy Blunt.
Busch Valentine's campaign advertisement released Tuesday targeted an audience in a red state.
"We're going to reinvest in America, in our towns and cities, and the things that make them tick: our workers, teachers, nurses, farmers, firefighters, police, our Missouri communities big and small," she said.
Busch Valentine concluded her campaign video: "I'll put politics aside and put you and your family first. We'll show them we can work together."
A registered nurse, Busch Valentine's family owned a majority stake in Anheuser-Busch until it was sold in 2008 for $52 billion. The family's net wealth stands at $17.6 billion, making them America's 16th richest family as of 2020, according to Forbes.
