All of the quarantine and mask 'orders' and 'mandates' by governors are in violation of the United States Constitution and therefore are invalid under Deprivation of Rights Under Color of Law Title 18, U.S.C., Section 242:
'Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.
For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim . . .'

Michael Avenatti Tossed Out by Court of Appeals — Avenatti’s Tin Cup Now Out

Today the Ninth Circuit Court of Appeals issued an opinion reversing a jury verdict and ordering dismissal of a case that was the biggest of Michael Avenatti career in his prior profession as an attorney in Southern California.
The case was a class-action lawsuit brought by Avenatti on behalf of Plaintiff Bahamas Surgery Center, and against defendant multinational health care company Kimberly-Clark Corp. (KCC).
The allegations of the case were that KCC had sold hundreds of millions of dollars worth of surgical gowns through co-defendant distributor Halyard Co, which were labeled as being compliant with a certain industry-recognized standard for being a liquid bio-hazard barrier, when those gowns did not, in fact, meet the industry-standard as represented.
As described in reporting at the time, the Los Angeles federal court jury that heard the case — only six jurors in a federal civil case — was largely younger adults in their 20s, and Avenatti tailored his presentation, including his manner of speaking, to the audience.
In the end he was richly rewarded for his efforts, as the jury returned a verdict of general and punitive damages in the amount of $454 million for the members of the class that Avenatti was representing — all buyers of such mislabeled surgical gowns during the time period specified in the complaint.
One problem which Avenatti ran into in the aftermath of the jury’s verdict was with the federal District Court Judge. He tossed out the substantial punitive damages award, and reduced the verdict to only $25 million.
Today the Ninth Circuit applied the coup de grace. They tossed out the verdict altogether AND remanded the matter with instructions that the case be dismissed.
What had Avenatti done wrong??? In a STUNNING BIT OF POTENTIAL MALPRACTICE, Avenatti had taken a class-action case to trial with a Class Representative Plaintiff who had not been damaged — Bahamas Surgical Center had never purchased any the KCC manufactured gowns at issue.
Bahamas has no claim against Halyard [distributor of KCC gowns] because it purchased no gowns from it, and any injuries it has are not traceable to Halyard’s conduct. Without a claim of its own, Bahamas cannot “‘seek relief on behalf of [itself] or any other member of the class.’”
In a class-action case, the Class Plaintiff “stands in” for all other persons similarly situated and with substantially similar claims against the same defendant. To do that it is necessary that the Class Representative be — you know — representative of the class. One way that is established is by the fact that the Class Representative has a substantially identical claim against the defendant as all other members of the Class being represented.
This must have come up at some point in the discovery process. The Ninth Circuit puts fault on the District Court for certifying the class when Bahamas was not a representative plaintiff.
But there was no reason for Avenatti to not have moved to amend the complaint to add new Class Representatives when this issue came up.
The claims against KCC may have been sound and based in substantial facts. But this procedural error by Avenatti has all the class members now in a position of having to start over again.
Once the crowning glory of Avenatti’s Los Angeles legal career, this case is now worth zip, zero, nada.

Outdoor worship service in Redding defies California mask order, alarming health officials
Hundreds of worshipers, led by an organizer affiliated with a megachurch whose members believe they can heal the sick and raise the dead, gathered Wednesday at the Sundial Bridge in Redding, flouting mask-wearing orders and bans on large crowds.
Videos of the “Let us Worship” gathering show several hundred people singing in tightly packed groups below the bridge, one of Shasta County’s most popular tourist attractions. Few people were wearing masks.
The gathering wasn’t formally affiliated with Redding’s Bethel Church, whose members believe in faith healing. A church spokesman said the event was organized by Sean Feucht, a Christian musician and recent congressional candidate. Feucht produces music under Bethel Church’s record label.
“Sean and his family attend Bethel Church and he is a volunteer worship leader on one of our many church worship teams,” Bethel spokesman Aaron Tesauro said in an email.
Shasta County health officials condemned the event. In a news release, officials said that when they approached organizers, they were told attendees would adhere to social distancing rules, and the event would only involve a “small battery powered amplification for acoustic guitar and mic” instead of a concert. Organizers never sought a permit.
Officials noted local residents intermingled without wearing masks with people from out of town, putting the community at risk. Shasta County, population 180,000, until this point has largely avoided a major outbreak. It’s had 268 confirmed cases and 7 deaths from COVID-19.
“We truly empathize with all who have had to change the way they worship in the past few months,” county officials said in the news release. “Very sadly, some of our local cases of COVID-19, including hospitalizations, have resulted from faith gatherings, and it’s critical that our faith community leaders continue to offer safe services that follow the state guidelines.”
Feucht didn’t immediately respond to an email or a message sent through his website.
Feucht’s Twitter feed said similar protests are planned in the coming days in Pasadena, Bakersfield, Fresno and San Diego. He tweeted that those who’d planned to attend Wednesday’s gathering should wear masks, and said there would be some available.
“Spread out. Let’s worship Jesus and love on our city!” he Tweeted Wednesday.

Israel and the United States have long accused Mahan Air of ferrying weapons for Iranian-linked guerrillas in Syria and elsewhere.
Two American fighter jets came close to an Iranian passenger plane over Syrian airspace causing the pilot to change altitude quickly to avoid collision, which injured several passengers, the official IRIB news agency reported on Thursday.
The agency initially reported a single Israeli jet had come near the plane but later quoted the pilot as saying there were two jets which identified themselves as American.
The pilot of the passenger plane contacted the jet pilots to warn them about keeping a safe distance and the jet pilots identified themselves as American, IRIB reported.
Video posted by the agency showed a single jet from the window of the plane and comments from a passenger who had blood on his face.

The Iranian plane, belonging to Mahan Air, was heading from Tehran to Beirut and landed safely in Beirut, an airport source told Reuters.
An Israeli military spokesman had no immediate comment and there was no immediate comment from the U.S. military.
Israel and the United States have long accused Mahan Air of ferrying weapons for Iranian-linked guerrillas in Syria and elsewhere.
One passenger in the IRIB report described how his head had hit the roof of the plane during the change in altitude and video also showed an elderly passenger sprawled on the floor.
All of the passengers came off the plane and only some had minor injuries, the head of the Beirut airport told Reuters.

US Air Force, not Israeli, fighter jets were responsible for unsafely intercepting the Mahan Air plane over Syria, which resulted in injuries to several passengers traveling to Beirut, Iranian media reported.
Mahan Air Flight 1152 was en route from Tehran to Lebanon when it was intercepted by two F-15 fighters near the Syria-Jordan border. The approaching jets forced it to rapidly change course and altitude, resulting in several injuries among the passengers, the company said.
Initial reports from eyewitnesses on board spoke of Israeli planes, and were repeated by international media outlets. The captain of Flight 1152 later told the Iranian news agency Fars that the pilots had identified themselves as US Air Force during the radio contact.
Iran's Ambassador to the UN Majid Takht-Ravanchi had informed Secretary-General Antonio Guterres of the incident, and warned that “the Islamic Republic of Iran will take the United States responsible” if any harm befalls the plane on the way back to Tehran, according to the Iranian Foreign Ministry spokesman Seyed Abbas Mousavi.

By Thursday evening the plane had returned to Tehran safely, but at least three passengers on board were injured in the incident.
The intercept took place in Syrian airspace over the At-Tanf border crossing with Iraq, according to Syria’s SANA news agency. The US has established a military base in the area, which the government in Damascus considers a violation of Syrian sovereignty.
Mahan Air is a privately owned Iranian civilian carrier. It was placed on the US sanctions list against “proliferators of weapons of mass destruction and their supporters” in December 2019, when Washington accused it of transporting troops and equipment for the Islamic Revolutionary Guards Corps (IRGC).

‘I don’t believe it’: Huntington Beach a symbol of mask resistance as doubters abound
As Brad Colburn whisked his metal detector over the tan sands of Huntington Beach, a rejection of Orange County’s spiking coronavirus infection rates surfaced.
“I don’t believe it. I don’t believe the rates are rising,” Colburn said. “They’re inflated. It’s another way of shutting everything down … of the Democrats trying to get what they want.”
The 58-year-old Huntington Beach resident said he has yet to wear a mask outside of shopping. Standing by a beach path as cyclists and in-line skaters zoomed by, he offered his own alternative policy to restrictive coronavirus health orders.
“If you don’t want to go outside, don’t go outside,” Colburn said.
More than any other place in California, Huntington Beach has come to symbolize resistance to many of the coronavirus safety rules government officials have imposed in recent months. It’s not as though no one in the city is wearing masks and social distancing.
But many who oppose mandatory mask rules and other measures like closing beaches have been outspoken here, and used the tourist mecca as a platform for their views. In May, angry demonstrators converged a block away at the now mostly quiet Huntington Beach Pier to protest the state-ordered shutdown of local businesses.
Since then, many roaming through the city’s downtown area are proudly not wearing masks. And the stance has even inspired a parody video that went viral on social media in recent weeks.
Fred Smoller, a professor of political science at nearby Chapman University, described Huntington Beach as a conservative stronghold and said that the attitudes about the coronavirus there reflect larger political divides.
“Their ideology is a lens through which they are viewing the coronavirus,” Smoller said. “I would imagine many people there see it as a hoax, which the president has encouraged them to do in order to up his chance of reelection. I’m sure there’s quite a bit of animus toward the governor.… They’re viewing [state restrictions] as further evidence of the deep state and of an intrusive government.”
Huntington Beach Mayor Lyn Semeta said the city would continue its educational efforts to keep residents safe. Masks, she said in an email statement to The Times, are “critical in keeping people healthy and helping our businesses operate safely in the limited capacity they are able to.”
When asked about opposition to COVID-19 restrictions in Huntington Beach, Semeta said she was aware people around the state are “uncomfortable with the use of face coverings.”
“I can certainly understand that sentiment. However, while there is still much we are learning about this virus, health experts have come out strongly recommending face coverings as an effective measure that helps stop the spread of COVID-19,” Semeta said, urging residents to wear them.
The number of Orange County coronavirus cases has surged in recent weeks, with more than 31,000 confirmed cases and more than 500 deaths. The number of hospitalizations has tripled in the last two months and overall infections have grown so dramatically that the county is now second in the state to Los Angeles County.
There is widespread acceptance that masks play a key role in slowing the spread of the coronavirus, and their widespread use in other countries is credited with slowing infections dramatically.
But skepticism abounds over the seriousness of the outbreak.

When Supreme Court Justice Neil Gorsuch redefined “sex” in federal law, twisting federal bans on sex discrimination to include discrimination on the basis of sexual orientation and transgender identity, his colleague Samuel Alito rightly warned that the decision would wreak havoc on the health care industry. Almost exactly one month later, the ACLU filed a lawsuit to force a Roman Catholic hospital to perform transgender surgery in violation of the Hippocratic Oath, citing none other than Gorsuch’s opinion.
In Hammons v. University of Maryland Medical System (UMMS), a biological female who identifies as a transgender man, Jesse Hammons, claims St. Joseph Medical Center, a hospital operated by UMMS, unlawfully discriminated against her by refusing to perform a hysterectomy to remove a healthy uterus. The lawsuit would force Catholic hospitals to violate the Hippocratic Oath by removing a fully-functional organ and permanently sterilizing patients.
Under the Ethical and Religious Directives for Catholic Health Care Services established by the U.S. Conference of Catholic Bishops, Catholic hospitals may not perform procedures that induce sterility unless “their direct effect is the cure or alleviation of a present and serious pathology and a simpler treatment is not available.”
St. Joseph hospital does perform hysterectomies in order to treat serious medical conditions that require such a drastic surgery, such as “uterine fibroids, endometriosis, pelvic support problems, abnormal uterine bleeding, chronic pelvic pain, and gynecological cancer.”
According to Hammons and the ACLU, Hammons’ gender dysphoria (identifying with the gender opposite one’s birth sex) is a serious condition requiring hysterectomy. The lawsuit refers to the hysterectomy as a “medically necessary treatment relating to his [sic] diagnosis of gender dysphoria.” The hospital had scheduled the surgery for the plaintiff on January 6, 2020, but canceled the surgery because it would violate the Hippocratic Oath.
The lawsuit claims that canceling the surgery involved discrimination on the basis of sex in violation of the Fourteenth Amendment’s Equal Protection Clause and the Affordable Care Act (a.k.a. Obamacare). Since UMMS operates St. Joseph as a Catholic hospital, the lawsuit also claims that the alleged discrimination violated the Establishment Clause of the First Amendment.
The key point at issue revolves around whether or not transgender surgery — in this case, hysterectomy — is “medically necessary” or actively harmful. While many medical establishments have rushed to embrace the transgender bandwagon, many formerly transgender people have rejected their transgender identities and lamented the horrific results of “gender affirmation” surgery. One 19-year-old man who temporarily identified as a woman and had surgery to remove his male genitals and replace them with a simulated female version, described the result as a “Frankenstein hack job.”

Chicago Mayor Lori Lightfoot has accepted President Donald Trump’s offer of federal law enforcement officials to help fight crime in Chicago — but says they must not patrol protests, as federal officials are doing in Portland, Oregon.
President Trump and Mayor Lightfoot spoke Wednesday evening, after the administration announced that it would surge federal law enforcement agents to Chicago and other cities suffering from a wave of violent crime in the wake of Black Lives Matter protests. The protests have prompted police to scale back patrols — in some cases at the behest of politicians.
Lightfoot claimed that Trump “realized that what he did in Portland was a grave abuse of his presidential power,” though it was not clear that the president had made any such admission. The Department of Homeland Security has sent agents to protect the federal courthouse in downtown Portland, which has been vandalized and firebombed by black-clad rioters associated with Black Lives Matter protests. Some 200 federal officials are expected to be deployed to Chicago.
Earlier this week, Lightfoot compared federal law enforcement officials to terrorists and urged citizens to call 911 if they saw federal officials doing anything that seemed untoward. She seems to have softened her tone — but only somewhat.
White House Press Secretary Kayleigh McEnany told Fox News on Thursday morning that Lightfoot should “admit” that she needs the help. Violent crime in Chicago’s African American community has been a problem for years — one that local residents begged President Barack Obama to do something about, but which he neglected during his two terms.
Lightfoot, according to Newsmax, “has accepted additional FBI, DEA, and ATF agents to come to her city to augment and assist local police efforts to control the violence, but the ‘critical difference’ is that the agents will be managed by ‘the U.S. Attorney here in Chicago who I know and trust.'” Lightfoot is herself a former federal prosecutor.

'Joe, you got to hurry up and announce your Black woman VP so I can be enthused about voting for her,' the radio host said
"The Breakfast Club" radio host Charlamagne Tha God blasted former Vice President Joe Biden for calling President Trump the "first" racist president to be elected.
On Wednesday, Biden took aim at the president's alleged racism, suggesting it's historic compared to his predecessors.
“No sitting president has ever done this... No Republican president has done this. No Democratic president. We’ve had racists and they’ve existed and they’ve tried to get elected president. He’s the first one that has,” Biden said.
However, Charlamagne declared the presumptive Democratic candidate Thursday's "Donkey of the Day" for his comments.
"I really wish Joe Biden would shut the eff up forever and continue to act like he's starring in the movie 'A Quiet Place' because as soon as he opens his mouth and makes noise, he gets us all killed, OK?" the radio host said. "There's already so many people who are reluctantly only voting for Joe Biden because he's the only option and because Donald J. Trump is that trash."
Charlamagne then cited polling that showed a wide enthusiasm gap between Biden and Trump, noting that it's "not good" for the Democrat to be lacking excitement among his voters, and suggested Biden's latest remarks will further contribute to the "lack of enthusiasm."
"Old white male leadership has failed America and there is nothing worse than an old white male [who] can't recognize the faults and flaws of other old white males," Charlamagne told listeners. "Racism is the American way. Donald Trump is not the first. And sadly, he won't be the last, right? He's just more overt with his racism than most presidents in recent times."
The "Breakfast Club" co-host accused Biden of "revisionist history," calling his claim about Trump "a lie" that "relinquishes America of all responsibility of its bigotry."
"How are we ever going to atone for America's original sins if we don't acknowledge them?" Charlemagne asked in reaction to Biden's remarks. "How the hell can Donald Trump be the first racist president in a country where 12 presidents before him owned slaves?"
He later offered a message directly to Biden.
"Joe, you got to hurry up and announce your Black woman VP [vice president] so I can be enthused about voting for her because I will never be enthused about voting for you, and you know America is a terrible place when Kanye West seems like a viable option," Charlagmne added.
Charlamagne tha God created headlines during his interview with Biden in May after the former VP suggested that "you ain't Black" if Black voters were considering voting for Trump. Biden later walked back those remarks.

Report: Portland Rioters Barricaded Federal Agents in Courthouse, Tried to Burn it Down
Portland rioters barricaded federal law enforcement agents inside a federal courthouse as they tried to set the building ablaze amid ongoing violent protests in the Democrat-controlled city, according to a report.
The Washington Examiner reports:
The attack on the Hatfield Federal Courthouse began after 10 p.m. local time after more than 1,000 people gathered downtown. Some became violent. The attackers blocked the entrances to the courthouse, preventing the special DHS forces inside from easily getting out. Some federal officers escaped and tried to repel those vandalizing the outside of the courthouse but were beamed in the eye by lasers, which can cause temporary and long-term blindness.
Other rioters then installed wooden boards on the outside of the courthouse entrance to prevent the rest of the DHS officials from leaving, while others tried to break down the doors.
A federal official wrote in an email obtained by Examiner reporter Anna Giaritelli:
Around midnight rioters attempted to set the courthouse on fire, as they have done numerous times before. They also threw smoke bombs into the flames causing the interior of the courthouse to fill with smoke. In response, a team of federal officers was forced to leave the building, taking one individual into custody. When they did, a rioter threw a bag filled with hard objects at officers.
On Wednesday evening, Portland Mayor Ted Wheeler (D) joined demonstrators in the protest area, where he was jeered and hit with tear gas by federal agents. Wheeler, flanked by the police commissioner, said he would attend the protest in solidarity against federal law enforcement. “The reason I am here tonight is to stand with you,” the mayor said, as quoted by The Oregonian. “If they’re launching the tear gas against you, they’re launching the tear gas against me.” While addressing protesters, Wheeler decried President Trump’s crackdown on rioters an “egregious overreaction” and accused him of engaging in “urban warfare.”
This week, Wheeler joined the mayors of Atlanta, Chicago, D.C., Seattle, and Kansas City in calling for the Trump administration to remove federal agents directed to combat ongoing crime. The Portland mayor accused the president of “attacking progressive cities with a classic ‘divide and conquer’ tactics.”
On Wednesday, President Trump announced that he would expand the Justice Department program known as Operation Legend to Chicago as the Democrat-controlled city suffers from a crime wave.
Wednesday’s announcement comes after more than a dozen people were injured in a shooting at a funeral in Chicago on Tuesday night.
Trump on Wednesday said he had “no choice but to get involved” by sending federal officers to the cities.
“This bloodshed must end,” he said. “This bloodshed will end.”
On Tuesday, Chicago Mayor Lori Lightfoot tweeted that she would push back against efforts to send federal officers to the city.
