That's a complicated issue with jurisdiction. I would assume international copyright law applies for the sake of making things easy, but I really don't know. Oh, obligatory disclaimer - The following is my own opinion; I am not giving legal advice and so I am not liable if anyone takes what I say and uses it.
Well, the British law on Copyrights is set in the Copyright, Designs and Patents Act 1988 and it basically says what you said earlier - original authors are automatically the legal owners of their work, unless it was in the course of employment in which case the employer is the legal owner, unless there was a prior agreement stating otherwise. I think most jurisdictions would have something similar in their laws, but I can't say for certain.
As for the matter of employment, I think it would have been easy for Hotwheels to argue that he hired Josh under an oral agreement, but the lack of a written contract makes this entire case a shouting match between him and Josh. I'll just say this in general and I hope Hotwheels is reading this:
1. Never admit liability. The statement Hotwheels put in this message >>61367 defeats any arguments he could raise for ownership over Infinity Next, even if he could successfully persuade the court that Josh was working for him as an employee.
2. It should be plainly obvious that a written contract must be used in a matter as serious as this, especially since $12,000 was involved. He could have used that contract to secure ownership over Infinity Next as well.
Well, let's hope Hotwheels manages to pull through and find a solution which works.
