NSA starts spying on US PRIOR to 9/11 officially.
Defendant ATT's Construction of a Call Monitoring Center
for the Exclusive Use of the NSA.
81. Within eleven (11) days of the onset of the Bush administration, and at least seven (7) months prior to the attacks of September 11, 2001, defendant ATT began development of a center for monitoring long distance calls and internet transmissions and other digital information for the exclusive use of the NSA.
82. The center was put into development by ATT following a proposal by the NSA for the construction and development of a network operations center identical to ATT's own network operations center located in Bedminster, New Jersey for the exclusive use of the NSA.
83. The NSA proposal was accepted by the ATT sales division and referred to ATT Solutions, an ATT project development division situated in Florham Park, New Jersey.
84. The NSA proposal sought construction of a duplicate ATT Network Operations Center for the exclusive use of the NSA with the capacity to monitor all calls and internet traffic placed on the ATT long distance network, as well as ATT's wide area, fiber optic, T-1, T-3, T-5 and high speed data networks.
85. Such a data center would also enable the NSA to tap into any call placed on the ATT network and to monitor the contents of all digital information transmitted over the ATT network.

The project was described in the ATT sales division documents as calling for the construction of a facility to store and retain data gathered by the NSA from its domestic and foreign intelligence operations but was to be in actuality a duplicate ATT Network Operations Center for the use and possession of the NSA that would give the NSA direct, unlimited, unrestricted and unfettered access to all call information and internet and digital traffic on ATT's long distance networks.
87. Said data center would enable the NSA to tap into any phone line and to monitor any digital transfer of information on ATT's networks including voice telephone calls, facsimile transmission and all internet traffic.
88. Such project was in development not later than February 1, 2001, within eleven (11) days of the onset of the Bush Administration.
89. The NSA program was initially conceived at least one year prior to 2001 but had been called off; it was reinstated within 11 days of the entry into office of defendant George W. Bush.
90. The NSA program was code-named Pioneer-Groundbreaker and was also known at ATT Solutions division as GEMS (Groundbreaker Enterprise System).
91. International Business Machines Corporation (IBM) was one of the parties working with ATT and the NSA to develop the monitoring center and IBM personnel participated in meetings with ATT and NSA officials in the development of the monitoring center.
92. Among the purposes of the Pioneer-Groundbreaker project was the storing and monitoring of all phone call information coming across ATT's networks; by means of this program NSA sought to duplicate all of the phone call information that came across ATT's networks for real time, contemporaneous analysis or, alternately, for downloading and later use by the NSA.
93. The proposed project was to be a storage entity modeled on ATT's network operations center in Bedminster, New Jersey, and would have the capability to monitor all data and traffic that came across ATT lines, including ATT traffic and traffic originating from other carriers that used ATT lines or that sent calls to ATT customers.
94. The NSA was seeking to duplicate the ATT network operations center and sought by means of the Pioneer-Groundbreaker program the ability to monitor all traffic coming across ATT's network.
95. The contact list for the Pioneer-Groundbreaker project consisted of a minimum of 35 ATT employees dedicated in whole or in part to the Pioneer-Groundbreaker program.
96. An ATT Solutions logbook reviewed by counsel confirms the Pioneer-Groundbreaker project start date of February 1, 2001.
97. The ATT Solutions logbook confirms the dates and transmissions of copies of ATT, IBM and NSA e-mails setting forth the existence of the Pioneer-Groundbreaker program; said e-mails remain in the custody, possession and control of ATT, IBM and NSA.
98. Said logbook was maintained pursuant to ATT Solutions policy in the regular course of business by telecom engineers at ATT Solutions.
99. Counsel have been informed of the foregoing information by several informants who had direct knowledge or who have received direct admissions by ATT personnel as to the foregoing facts.
100. ATT has not denied any of the allegations in the media disclosures of May 11, 2006.
101. Accordingly, defendant carrier ATT was engaged in active and knowing participation and conspiracy to violate 18 U.S.C. 2702, et seq., in concert with the United States not later than February 1, 2001.

In the aftermath of 9/11 everyone, from elected officials and national security experts to ordinary citizens had one question: how could this happen to a nation with such an enormous and expensive military and intelligence architecture? The question was so ubiquitous that (in spite of some foot dragging by the Bush Administration) it eventually led to the creation of a high-level commission charged with seeking answers. Two and a half years after the attacks, in the summer of 2004, the Commission finished its work and released its report. The overriding conclusion was that the government’s principal failure in 9/11 was a failure to “connect the dots.” [1] What that meant was that pieces of the puzzle were to be found in many corners of the U.S. government but that no one connected the dots well enough or in a timely enough manner to predict with sufficient accuracy the attack that came.

The report listed in depth the many failures that prevented the government from seeing what was coming. They cut a swath across the vast United States government. The State Department was in charge of visas but failed to catch the fact that several of the visas and passports of the hi-jackers were manipulated in a fraudulent manner. The FBI had the responsibility of keeping track of bad guys inside the United States while the CIA had the responsibility of keeping track of bad guys outside the United States. So two of the terrorists were tracked as they moved internationally (Nawaf al-Hazmi and Khalid al-Mihdhar) but tracking responsibility was not handed over to the FBI once they landed in the United States. Even when they were tracked and arrested, as when Zacarias Moussaoui was, he was charged with immigration violations. However, what brought him to the attention of the FBI—taking flight lessons for the purpose of using an airplane for an attack (he had no interest in learning to land the plane)—was not passed up the chain of command and not linked to the possibility of a broader plot. The Navy had its own intelligence system. And information that linked the attacks on the Navy ship the Cole to one of the 9/11 hi-jackers and to Al-Queda was missed. The FAA was in charge of airline security as well as security at airports. And yet no-fly lists were not updated with the names of terrorists, passengers identified by the airlines’ own system were not checked and aircraft cockpit doors were not hardened.

Meeting the Threat of Terrorism after September 11

In the lead up to 9/11, the government was collecting vast amounts of data but failing to make sense out of it. Every day the U.S. government was collecting vast amounts of information via its satellites. And yet there were years of conversations waiting to be translated and years of photographs waiting to be looked at. Eight years after 9/11 the problem persisted—including huge backlogs and a shortage of translators.
There were other failures as well. The entire intelligence community was built to follow the Soviet monolith and it was moving at a glacial speed to try and adapt to the new threats posed by asymmetric warfare. For instance, it was laden with Russian speakers and disastrously short of Arabic speakers. According to one former intelligence community officer, speaking a few years after the attack, “…to a certain extent, the Soviet Union is still alive and well in the cultures and in the bureaucratic authorities of the IC.”
Finally, the 9/11 attacks signaled a change in the very nature of terrorism. Instead of being linked to concrete political goals, the new Islamic version welcomed mass casualties and did not shy away from killing non-combatants. Gina Bennett, a young state department analyst was one of the first American intelligence professionals to describe Osama bin Laden and his world view and she admitted that what she was describing “… wasn’t considered ‘normal’ in the world of counterterrorism.”[2]

In November 2001, Congress created the Transportation Security Agency which federalized airport security which had been largely in the hands of private contractors to the airlines. In late 2002, Congress passed the Homeland Security Act which combined 22 organizations into the first new Cabinet Department since 1989. A combination of factors—the failure to find weapons of mass destruction in Iraq, criticisms raised during the 2004 presidential campaign and intense pro-reform lobbying by the families of victims of 9/11—resulted in passage of the Intelligence and Reform and Terrorism Prevention Act of 2004. The legislation created a new office, the Office of the Director of National Intelligence (ODNI) which was to “coordinate” the FBI, the CIA and the 14 other agencies that made up the U.S. intelligence community. And it established the National Counterterrorism Center to analyze and integrate all intelligence and threats to Americans at home and abroad. The law was an attempt to make the boundaries between domestic and international intelligence that had contributed to the nation’s inability to disrupt the 9/11 attacks more porous. But it also raised concerns about privacy and civil liberties. Thus, the law also created the Privacy and Civil Liberties Oversight Board.
The early organizational changes struck many as orthogonal to the real problems—like moving the deck chairs on the Titanic. The Department of Homeland Security (DHS) in particular, had severe growing pains—becoming at times a dumping ground for political appointees. But the organizational changes suffused the government with the ethos of sharing information that could lead to attacks. National Defense became a truly national function, shared by the cop on the beat as well as by the spy in the souk. DHS and the FBI created information sharing organizations in cities and states.
For much of this time and until his death in 2011, bin Laden dreamed of repeating his 9/11 attacks with another mass casualty attack on the West—as recounted by Peter Bergen in his new book, The Rise and Fall of Osama bin Laden. Attacks were foiled and home-grown terrorists caught and jailed. Even though the ODNI and DHS and the proliferation of counter terrorism centers sounded like a lot of bureaucratic mumbo-jumbo—the front lines of American security were transformed. More intelligence was shared and training was altered. The border patrol agent, the state department visa specialist, the flight attendant, and the general public (“See something, Say something”) were all on the lookout for trouble.
Intelligence failures still happen, despite protestations to the contrary. It looks like the failure to predict the rapid fall of Kabul, Afghanistan is just the latest. But the U.S. homeland is no longer dependent on one intelligence body. The multi-layered system of government has served us well over the past twenty years, let’s hope it continues.

Bush Secretly Lifted Some Limits on Spying in U.S. After 9/11, Officials Say

WASHINGTON, Dec. 15 - Months after the Sept. 11 attacks, President Bush secretly authorized the National Security Agency to eavesdrop on Americans and others inside the United States to search for evidence of terrorist activity without the court-approved warrants ordinarily required for domestic spying, according to government officials.
Under a presidential order signed in 2002, the intelligence agency has monitored the international telephone calls and international e-mail messages of hundreds, perhaps thousands, of people inside the United States without warrants over the past three years in an effort to track possible "dirty numbers" linked to Al Qaeda, the officials said. The agency, they said, still seeks warrants to monitor entirely domestic communications.
The previously undisclosed decision to permit some eavesdropping inside the country without court approval represents a major shift in American intelligence-gathering practices, particularly for the National Security Agency, whose mission is to spy on communications abroad. As a result, some officials familiar with the continuing operation have questioned whether the surveillance has stretched, if not crossed, constitutional limits on legal searches.
"This is really a sea change," said a former senior official who specializes in national security law. "It's almost a mainstay of this country that the N.S.A. only does foreign searches."
Nearly a dozen current and former officials, who were granted anonymity because of the classified nature of the program, discussed it with reporters for The New York Times because of their concerns about the operation's legality and oversight.
According to those officials and others, reservations about aspects of the program have also been expressed by Senator John D. Rockefeller IV, the West Virginia Democrat who is the vice chairman of the Senate Intelligence Committee, and a judge presiding over a secret court that oversees intelligence matters. Some of the questions about the agency's new powers led the administration to temporarily suspend the operation last year and impose more restrictions, the officials said.
The Bush administration views the operation as necessary so that the agency can move quickly to monitor communications that may disclose threats to this country, the officials said. Defenders of the program say it has been a critical tool in helping disrupt terrorist plots and prevent attacks inside the United States.
Administration officials are confident that existing safeguards are sufficient to protect the privacy and civil liberties of Americans, the officials say. In some cases, they said, the Justice Department eventually seeks warrants if it wants to expand the eavesdropping to include communications confined within the United States. The officials said the administration had briefed Congressional leaders about the program and notified the judge in charge of the Foreign Intelligence Surveillance Court, the secret Washington court that deals with national security issues.
The White House asked The New York Times not to publish this article, arguing that it could jeopardize continuing investigations and alert would-be terrorists that they might be under scrutiny. After meeting with senior administration officials to hear their concerns, the newspaper delayed publication for a year to conduct additional reporting. Some information that administration officials argued could be useful to terrorists has been omitted.
While many details about the program remain secret, officials familiar with it said the N.S.A. eavesdropped without warrants on up to 500 people in the United States at any given time. The list changes as some names are added and others dropped, so the number monitored in this country may have reached into the thousands over the past three years, several officials said. Overseas, about 5,000 to 7,000 people suspected of terrorist ties are monitored at one time, according to those officials.
Several officials said the eavesdropping program had helped uncover a plot by Iyman Faris, an Ohio trucker and naturalized citizen who pleaded guilty in 2003 to supporting Al Qaeda by planning to bring down the Brooklyn Bridge with blowtorches. What appeared to be another Qaeda plot, involving fertilizer bomb attacks on British pubs and train stations, was exposed last year in part through the program, the officials said. But they said most people targeted for N.S.A. monitoring have never been charged with a crime, including an Iranian-American doctor in the South who came under suspicion because of what one official described as dubious ties to Osama bin Laden.
Dealing With a New Threat
The eavesdropping program grew out of concerns after the Sept. 11 attacks that the nation's intelligence agencies were not poised to deal effectively with the new threat of Al Qaeda and that they were handcuffed by legal and bureaucratic restrictions better suited to peacetime than war, according to officials. In response, President Bush significantly eased limits on American intelligence and law enforcement agencies and the military.
But some of the administration's antiterrorism initiatives have provoked an outcry from members of Congress, watchdog groups, immigrants and others who argue that the measures erode protections for civil liberties and intrude on Americans' privacy. Opponents have challenged provisions of the USA Patriot Act, the focus of contentious debate on Capitol Hill this week, that expand domestic surveillance by giving the Federal Bureau of Investigation more power to collect information like library lending lists or Internet use. Military and F.B.I. officials have drawn criticism for monitoring what were largely peaceful antiwar protests. The Pentagon and the Department of Homeland Security were forced to retreat on plans to use public and private databases to hunt for possible terrorists. And last year, the Supreme Court rejected the administration's claim that those labeled "enemy combatants" were not entitled to judicial review of their open-ended detention.
Mr. Bush's executive order allowing some warrantless eavesdropping on those inside the United States including American citizens, permanent legal residents, tourists and other foreigners is based on classified legal opinions that assert that the president has broad powers to order such searches, derived in part from the September 2001 Congressional resolution authorizing him to wage war on Al Qaeda and other terrorist groups, according to the officials familiar with the N.S.A. operation.
The National Security Agency, which is based at Fort Meade, Md., is the nation's largest and most secretive intelligence agency, so intent on remaining out of public view that it has long been nicknamed "No Such Agency.'' It breaks codes and maintains listening posts around the world to eavesdrop on foreign governments, diplomats and trade negotiators as well as drug lords and terrorists. But the agency ordinarily operates under tight restrictions on any spying on Americans, even if they are overseas, or disseminating information about them.
What the agency calls a "special collection program" began soon after the Sept. 11 attacks, as it looked for new tools to attack terrorism. The program accelerated in early 2002 after the Central Intelligence Agency started capturing top Qaeda operatives overseas, including Abu Zubaydah, who was arrested in Pakistan in March 2002. The C.I.A. seized the terrorists' computers, cellphones and personal phone directories, said the officials familiar with the program. The N.S.A. surveillance was intended to exploit those numbers and addresses as quickly as possible, the officials said.
In addition to eavesdropping on those numbers and reading e-mail messages to and from the Qaeda figures, the N.S.A. began monitoring others linked to them, creating an expanding chain. While most of the numbers and addresses were overseas, hundreds were in the United States, the officials said.
Under the agency's longstanding rules, the N.S.A. can target for interception phone calls or e-mail messages on foreign soil, even if the recipients of those communications are in the United States. Usually, though, the government can only target phones and e-mail messages in this country by first obtaining a court order from the Foreign Intelligence Surveillance Court, which holds its closed sessions at the Justice Department.
Traditionally, the F.B.I., not the N.S.A., seeks such warrants and conducts most domestic eavesdropping. Until the new program began, the N.S.A. typically limited its domestic surveillance to foreign embassies and missions in Washington, New York and other cities, and obtained court orders to do so.
Since 2002, the agency has been conducting some warrantless eavesdropping on people in the United States who are linked, even if indirectly, to suspected terrorists through the chain of phone numbers and e-mail addresses, according to several officials who know of the operation. Under the special program, the agency monitors their international communications, the officials said. The agency, for example, can target phone calls from someone in New York to someone in Afghanistan.
Warrants are still required for eavesdropping on entirely domestic-to-domestic communications, those officials say, meaning that calls from that New Yorker to someone in California could not be monitored without first going to the Federal Intelligence Surveillance Court.
A White House Briefing
After the special program started, Congressional leaders from both political parties were brought to Vice President Dick Cheney's office in the White House. The leaders, who included the chairmen and ranking members of the Senate and House intelligence committees, learned of the N.S.A. operation from Mr. Cheney, Gen. Michael V. Hayden of the Air Force, who was then the agency's director and is now the principal deputy director of national intelligence, and George J. Tenet, then the director of the C.I.A., officials said.
It is not clear how much the members of Congress were told about the presidential order and the eavesdropping program. Some of them declined to comment about the matter, while others did not return phone calls.
Later briefings were held for members of Congress as they assumed leadership roles on the intelligence committees, officials familiar with the program said. After a 2003 briefing, Senator Rockefeller, the West Virginia Democrat who became vice chairman of the Senate Intelligence Committee that year, wrote a letter to Mr. Cheney expressing concerns about the program, officials knowledgeable about the letter said. It could not be determined if he received a reply. Mr. Rockefeller declined to comment. Aside from the Congressional leaders, only a small group of people, including several cabinet members and officials at the N.S.A., the C.I.A. and the Justice Department, know of the program.
Some officials familiar with it say they consider warrantless eavesdropping inside the United States to be unlawful and possibly unconstitutional, amounting to an improper search. One government official involved in the operation said he privately complained to a Congressional official about his doubts about the legality of the program. But nothing came of his inquiry. "People just looked the other way because they didn't want to know what was going on," he said.
A senior government official recalled that he was taken aback when he first learned of the operation. "My first reaction was, ‘We're doing what?' " he said. While he said he eventually felt that adequate safeguards were put in place, he added that questions about the program's legitimacy were understandable.
Some of those who object to the operation argue that is unnecessary. By getting warrants through the foreign intelligence court, the N.S.A. and F.B.I. could eavesdrop on people inside the United States who might be tied to terrorist groups without skirting longstanding rules, they say.
The standard of proof required to obtain a warrant from the Foreign Intelligence Surveillance Court is generally considered lower than that required for a criminal warrant intelligence officials only have to show probable cause that someone may be "an agent of a foreign power," which includes international terrorist groups and the secret court has turned down only a small number of requests over the years. In 2004, according to the Justice Department, 1,754 warrants were approved. And the Foreign Intelligence Surveillance Court can grant emergency approval for wiretaps within hours, officials say.
Administration officials counter that they sometimes need to move more urgently, the officials said. Those involved in the program also said that the N.S.A.'s eavesdroppers might need to start monitoring large batches of numbers all at once, and that it would be impractical to seek permission from the Foreign Intelligence Surveillance Court first, according to the officials.
Culture of Caution and Rules
The N.S.A. domestic spying operation has stirred such controversy among some national security officials in part because of the agency's cautious culture and longstanding rules.
Widespread abuses including eavesdropping on Vietnam War protesters and civil rights activists by American intelligence agencies became public in the 1970's and led to passage of the Foreign Intelligence Surveillance Act, which imposed strict limits on intelligence gathering on American soil. Among other things, the law required search warrants, approved by the secret F.I.S.A. court, for wiretaps in national security cases. The agency, deeply scarred by the scandals, adopted additional rules that all but ended domestic spying on its part.
After the Sept. 11 attacks, though, the United States intelligence community was criticized for being too risk-averse. The National Security Agency was even cited by the independent 9/11 Commission for adhering to self-imposed rules that were stricter than those set by federal law.
Several senior government officials say that when the special operation first began, there were few controls on it and little formal oversight outside the N.S.A. The agency can choose its eavesdropping targets and does not have to seek approval from Justice Department or other Bush administration officials. Some agency officials wanted nothing to do with the program, apparently fearful of participating in an illegal operation, a former senior Bush administration official said. Before the 2004 election, the official said, some N.S.A. personnel worried that the program might come under scrutiny by Congressional or criminal investigators if Senator John Kerry, the Democratic nominee, was elected president.
In mid-2004, concerns about the program expressed by national security officials, government lawyers and a judge prompted the Bush administration to suspend elements of the program and revamp it.
For the first time, the Justice Department audited the N.S.A. program, several officials said. And to provide more guidance, the Justice Department and the agency expanded and refined a checklist to follow in deciding whether probable cause existed to start monitoring someone's communications, several officials said.
A complaint from Judge Colleen Kollar-Kotelly, the federal judge who oversees the Federal Intelligence Surveillance Court, helped spur the suspension, officials said. The judge questioned whether information obtained under the N.S.A. program was being improperly used as the basis for F.I.S.A. wiretap warrant requests from the Justice Department, according to senior government officials. While not knowing all the details of the exchange, several government lawyers said there appeared to be concerns that the Justice Department, by trying to shield the existence of the N.S.A. program, was in danger of misleading the court about the origins of the information cited to justify the warrants.
One official familiar with the episode said the judge insisted to Justice Department lawyers at one point that any material gathered under the special N.S.A. program not be used in seeking wiretap warrants from her court. Judge Kollar-Kotelly did not return calls for comment.
A related issue arose in a case in which the F.B.I. was monitoring the communications of a terrorist suspect under a F.I.S.A.-approved warrant, even though the National Security Agency was already conducting warrantless eavesdropping. According to officials, F.B.I. surveillance of Mr. Faris, the Brooklyn Bridge plotter, was dropped for a short time because of technical problems. At the time, senior Justice Department officials worried what would happen if the N.S.A. picked up information that needed to be presented in court. The government would then either have to disclose the N.S.A. program or mislead a criminal court about how it had gotten the information.
The Civil Liberties Question
Several national security officials say the powers granted the N.S.A. by President Bush go far beyond the expanded counterterrorism powers granted by Congress under the USA Patriot Act, which is up for renewal. The House on Wednesday approved a plan to reauthorize crucial parts of the law. But final passage has been delayed under the threat of a Senate filibuster because of concerns from both parties over possible intrusions on Americans' civil liberties and privacy.
Under the act, law enforcement and intelligence officials are still required to seek a F.I.S.A. warrant every time they want to eavesdrop within the United States. A recent agreement reached by Republican leaders and the Bush administration would modify the standard for F.B.I. wiretap warrants, requiring, for instance, a description of a specific target. Critics say the bar would remain too low to prevent abuses.
Bush administration officials argue that the civil liberties concerns are unfounded, and they say pointedly that the Patriot Act has not freed the N.S.A. to target Americans. "Nothing could be further from the truth," wrote John Yoo, a former official in the Justice Department's Office of Legal Counsel, and his co-author in a Wall Street Journal opinion article in December 2003. Mr. Yoo worked on a classified legal opinion on the N.S.A.'s domestic eavesdropping program.
At an April hearing on the Patriot Act renewal, Senator Barbara A. Mikulski, Democrat of Maryland, asked Attorney General Alberto R. Gonzales and Robert S. Mueller III, the director of the F.B.I., "Can the National Security Agency, the great electronic snooper, spy on the American people?"
"Generally," Mr. Mueller said, "I would say generally, they are not allowed to spy or to gather information on American citizens." President Bush did not ask Congress to include provisions for the N.S.A. domestic surveillance program as part of the Patriot Act and has not sought any other laws to authorize the operation. Bush administration lawyers argued that such new laws were unnecessary, because they believed that the Congressional resolution on the campaign against terrorism provided ample authorization, officials said.
Seeking Congressional approval was also viewed as politically risky because the proposal would be certain to face intense opposition on civil liberties grounds. The administration also feared that by publicly disclosing the existence of the operation, its usefulness in tracking terrorists would end, officials said.
The legal opinions that support the N.S.A. operation remain classified, but they appear to have followed private discussions among senior administration lawyers and other officials about the need to pursue aggressive strategies that once may have been seen as crossing a legal line, according to senior officials who participated in the discussions.
For example, just days after the Sept. 11, 2001, attacks on New York and the Pentagon, Mr. Yoo, the Justice Department lawyer, wrote an internal memorandum that argued that the government might use "electronic surveillance techniques and equipment that are more powerful and sophisticated than those available to law enforcement agencies in order to intercept telephonic communications and observe the movement of persons but without obtaining warrants for such uses."
Mr. Yoo noted that while such actions could raise constitutional issues, in the face of devastating terrorist attacks "the government may be justified in taking measures which in less troubled conditions could be seen as infringements of individual liberties."
The next year, Justice Department lawyers disclosed their thinking on the issue of warrantless wiretaps in national security cases in a little-noticed brief in an unrelated court case. In that 2002 brief, the government said that "the Constitution vests in the President inherent authority to conduct warrantless intelligence surveillance (electronic or otherwise) of foreign powers or their agents, and Congress cannot by statute extinguish that constitutional authority." Administration officials were also encouraged by a November 2002 appeals court decision in an unrelated matter. The decision by the Foreign Intelligence Surveillance Court of Review, which sided with the administration in dismantling a bureaucratic "wall" limiting cooperation between prosecutors and intelligence officers, noted "the president's inherent constitutional authority to conduct warrantless foreign intelligence surveillance."
But the same court suggested that national security interests should not be grounds "to jettison the Fourth Amendment requirements" protecting the rights of Americans against undue searches. The dividing line, the court acknowledged, "is a very difficult one to administer."

America has entered its third great era: the post-constitutional one. In the first, in the colonial years, a unitary executive, the King of England, ruled without checks and balances, allowing no freedom of speech, due process, or privacy when it came to protecting his power.
In the second, the principles of the Enlightenment and an armed rebellion were used to push back the king’s abuses. The result was a new country and a new constitution with a Bill of Rights expressly meant to check the government's power. Now, we are wading into the shallow waters of a third era, a time when that government is abandoning the basic ideas that saw our nation through centuries of challenges far more daunting than terrorism. Those ideas enshrined in the Bill of Rights are disarmingly concise. Think of them as the haiku of a genuine people's government.
Deeper, darker waters lie ahead and we seem drawn down into them. For here there be monsters.
The Powers of a Police State Denied
America in its pre-constitutional days may seem eerily familiar even to casual readers of current events. We lived then under the control of a king. (Think now: the imperial presidency.) That king was a powerful, unitary executive who ruled at a distance. His goal was simple: to use his power over “his” American colonies to draw the maximum financial gain while suppressing any dissent that might endanger his control.
In those years, protest was dangerous. Speech could indeed make you the enemy of the government. Journalism could be a crime if you didn’t write in support of those in power. A citizen needed to watch what he said, for there were spies everywhere, including fellow colonists hoping for a few crumbs from the king's table. Laws could be brutal and punishments swift as well as extra-judicial. In extreme cases, troops shot down those simply assembling to speak out.
Among the many offenses against liberty in pre-constitutional America, one pivotal event, the Stamp Act of 1765, stands out. To enforce the taxes imposed by the Act, the king's men used "writs of assistance" that allowed them to burst into any home or business, with or without suspicion of wrongdoing. American privacy was violated and property ransacked, often simply as a warning of the king’s power. Some colonist was then undoubtedly the first American to mutter, “But if I have nothing to hide, why should I be afraid?” He soon learned that when a population is categorically treated as a potential enemy, everyone has something to hide if the government claims they do.
The Stamp Act and the flood of kingly offenses that followed created in those who founded the United States a profound suspicion of what an unchecked government could do, and a sense that power and freedom are not likely to coexist comfortably in a democracy. A balancing mechanism was required. In addition to the body of the Constitution outlining what the new nation's government could do, needed was an accounting of what it could not do. The answer was the Bill of Rights.
The Bill's preamble explained the matter this way: “…in order to prevent misconstruction or abuse of [the government's] powers, that further declaratory and restrictive clauses should be added.” Thomas Jeffersoncommented separately, "[A] bill of rights is what the people are entitled to against every government on earth."
In other words, the Bill of Rights was written to make sure that the new government would not replicate the abuses of power of the old one. Each amendment spoke directly to a specific offense committed by the king. Their purpose collectively was to lay out what the government could never take away. Knowing first-hand the dangers of a police state and unchecked power, those who wrote the Constitution wanted to be clear: never again.
It needs to be said that those imperfect men were very much of their era. They were right about much, but desperately wrong about other things. They addressed “humanity,” but ignored the rights of women and Native Americans. Above all, they did not abolish the institution of slavery, our nation’s Original Sin. It would take many years, and much blood, to begin to rectify those mistakes.
Still, for more than two centuries, the meaning of the Bill of Rights was generally expanded, though especially in wartime it sometimes temporarily contracted. Yet the basic principles that guided America were sustained despite civil war, world wars, depressions, and endless challenges. Then, one September morning, our Post-Constitutional era began amid falling towers and empty skies. What have we lost since? More than we imagine. A look at the Bill of Rights, amendment by amendment, tells the tale.
The First Amendment
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
The First Amendment was meant to make one thing indisputably clear: free speech was the basis for a government of the people. Without a free press, as well as the ability to openly gather, debate, protest, and criticize, how would the people be able to judge their government's adherence to the other rights? How could people vote knowledgeably if they didn’t know what was being done in their name by their government? An informed citizenry, Thomas Jefferson stated, was "a vital requisite for our survival as a free people."
That was how it was seen long ago. In Post-Constitutional America, however, the government strives to "control the message," to actively thwart efforts to maintain a citizenry informed about what’s done in its name, a concept that these days seems as quaint as Jefferson's powdered wig. There are far too many examples of the post-9/11 erosion of the First Amendment to list here. Let's just look at a few important ones that tell the tale of what we have lost since 9/11.
(Lack of) Freedom of Information
In 1966, an idea for keeping Americans better informed on the workings of their government was hatched: the Freedom of Information Act (FOIA). Strengthened in 1974, it began with the premise that, except for some obviouscategories (like serious national security matters and personal information), the position of the government should be: everything it does is available to the public. Like the Bill of Rights, which made specific the limits of government, FOIA began with a presumption that it was the government’s duty to make information available and quickly to the people, unless a convincing case could be made otherwise. The default position of the FOIA switch was set to ON.
Three decades later, the FOIA system works far differently. Agencies are generally loath to release documents of any sort and instead put their efforts into creating roadblocks to legitimate requests. Some still require signatures on paper. (The State Department notes, “Requests for personal information cannot be submitted electronically and should be submitted by mail.”) Others demand hyper-detailed information like the precise dates and titles of documents whose dates and titles may be classified and unavailable. The NSA simply denies almost all FOIA requests out of hand, absent a court order.
Most federal agencies now regard the deadlinemandated for a response as the time period to send out a “request received” note. They tend to assign only a few staff members to processing requests, leading to near-endless delays. At the State Department, most FOIA work is done on a part-time basis by retirees. The CIA won’t directly release electronic versions of documents. Even when a request is fulfilled, “free” copying is often denied and reproduction costs exaggerated.
In some cases, the requested records have a way of disappearing or are simply removed. The ACLU’s experience when it filed an FOIA-style request with the Sarasota police department on its use of the cell phone surveillance tool Stingray could be considered typical. The morning the ACLU was to review the files, Federal Marshals arrived and physically took possession of them, claiming they had deputized the local cops and made the files federal property. An ACLU spokesperson noted that, in other cases, federal authorities have invoked the Homeland Security Act to prevent the release of records.
John Young, who runs the web site Cryptome and is a steadfast FOIA requester, stated, “Stonewalling, delay, brush-off, lying are normal. It is a delusion for ordinary requesters and a bitch of a challenge for professionals. Churning has become a way of life for FOIA, costly as hell for little results.”
Sealed Lips and the Whistleblower
All government agencies have regulations requiring employees to obtain permission before speaking to the representatives of the people – that is, journalists. The U.S. Intelligence Community has among the most restrictiveof these policies, banning employees and contractors completely from talking with the media without prior authorization. Even speaking about unclassified information is a no-no that may cost you your job. A government ever more in lockdown mode has created what one journalist calls a “culture where censorship is the norm.”
So who does speak to Americans about their government? Growing hordes of spokespeople, communications staff, trained PR crews, and those anonymous “senior officials” who pop up so regularly in news articles in major papers.
With the government obsessively seeking to hide or spin what it does, in-the-sunlight contact barred, and those inside locked behind an iron curtain of secrecy, the whistleblower has become the paradigmatic figure of the era. Not surprisingly, anyone who blows a whistle has, in these years, come under fierce attack.
Pick a case: Tom Drake exposing early NSA efforts to turn its spy tools on Americans, Edward Snowden proving that the government has us under constant surveillance, Chelsea Manning documenting war crimes in Iraq and sleazy diplomacy everywhere, John Kiriakou acknowledging torture by his former employer the CIA, or Robert MacLean revealing Transportation Safety Administration malfeasance. In each instance, the threat of jail was quick to surface. The nuclear option against such truthtellers is the Espionage Act, a law that offended the Constitution when implemented in the midst of World War I. It has been resurrected by the Obama administration as a blunt “wartime” tool for silencing and punishing whistleblowers.
The Obama administration has already charged six people under that act for allegedly mishandling classified information. Even Richard Nixon only invoked it once, in a failed prosecution against Pentagon Papers whistleblower Daniel Ellsberg.
Indeed, the very word “espionage” couldn’t be stranger in the context of these cases. None of those charged spied. None sought to aid an enemy or make money selling secrets. No matter. In Post-Constitutional America, the powers-that-be stand ready to twist language in whatever Orwellian direction is necessary to bridge the gap between reality and the king's needs. In the Espionage Act case of State Department contractor Stephen Kim, a judgedeparted from previous precedent, ruling that the prosecution need not even show that the information leaked to a Fox news reporter from a CIA report on North Korea could damage U.S. national security or benefit a foreign power. It could still be a part of an “espionage” charge.
A final question might be: How could a law designed almost 100 years ago to stop German spies in wartime have become a tool to silence the few Americans willing to risk everything to exercise their First Amendment rights? When did free speech become a crime?
Self-Censorship and the Press
Each person charged under the Espionage Act in these years was primarily a source for a journalist. The writers of the Bill of Rights chose to include the term “press” in the First Amendment, specifically carving out a special place for journalists in our democracy. The press was necessary to question government officials directly, comment on their actions, and inform the citizenry about what its government was doing. Sadly, as the Obama administration is moving ever more fiercely against those who might reveal its acts or documents, the bulk of the media have acquiesced. Glenn Greenwald said it plainly: too many journalists have gone into a self-censoring mode, practicing "obsequious journalism."
For example, a survey of reporters showed “the percentage of U.S. journalists endorsing the occasional use of ‘confidential business or government documents without authorization,’ dropped significantly from 81.8% in 1992 to 57.7% in 2013.” About 40% of American journalists would not have published documents like those Edward Snowden revealed.
And the same has been true of the management of newspapers. In mid-2004, James Risen and Eric Lichtblau uncovered George W. Bush's illegal warrantless eavesdropping program, but the New York Times held the story for 15 months, until after Bush's reelection. Executives at the Times were told by administration officials that if they ran the story, they'd be helping terrorists. They accepted that. In 2006, the Los Angeles Times similarly gave in to the NSA and suppressed a story on government wiretaps of Americans.
Government Efforts to Stop Journalists
Reporters need sources. Increasingly, the government is classifying just about any document it produces – 92 million documents in 2011 alone. Its intelligence agencies have even classified reports about the over-classification of documents. As a result, journalistic sources are often pressed into discussing, at great personal risk, classified information. Forcing a reporter to reveal such sources discourages future whistleblowing.
In one of the first of a series of attempts to make journalists reveal their sources, former Fox News reporter Mike Levine stated that the Justice Department persuaded a federal grand jury to subpoena him in January 2011. The demand was that he reveal his sources for a 2009 story about Somali-Americans who were secretly indicted in Minneapolis for joining an al-Qaeda-linked group in Somalia. Levine fought the order and the Department of Justice finally dropped it without comment in April 2012. Call it a failed test case.
According to Washington lawyer Abbe Lowell, who defended Stephen Kim, significant amounts of time have been spent by the Department of Justice in the search for a legal rationale for indicting journalists for their participation in exposing classified documents. A crucial test case is James Risen's 2006 book, State of War, which had an anonymously sourced chapter on a failed CIA operation to disrupt Iran’s nuclear program. When Risen, citing the First Amendment, refused to identify his source or testify in the trial of the former CIA officer accused of being that source, the government sought to imprison him. He responded that the “Obama administration… wants to use this case and others like it to intimidate reporters and whistleblowers. But I am appealing to the Supreme Court because it is too dangerous to allow the government to conduct national security policy completely in the dark.”
In June 2014, the Supreme Court refused to take Risen's case on appeal, essentially ratifying a U.S. Court of Appeals decision that the First Amendment didn’t protect a reporter from being forced to testify about “criminal conduct that the reporter personally witnessed or participated in.” That decision makes clear that a reporter receiving classified information from a source is part of the crime of “leaking.”
Risen has said he will go to prison rather than testify. It is possible that, having secured the precedent-setting right to send Risen to jail, the government will bring the suspected leaker to trial without calling on him. Attorney General Eric Holder recently hinted that his Justice Department might take that path – a break for Risen himself, but not for reporters more generally who now know that they can be jailed for refusing to divulge a source without hope of recourse to the Supreme Court.
The Descent Into Post-Constitutionalism
As with the King of England once upon a time, many of the things the government now does have been approved in secret, sometimes in secret courts according to a secret body of law. Sometimes, they were even approved openly by Congress. In constitutional America, the actions of the executive and the laws passed by Congress were only legal when they did not conflict with the underlying constitutional principles of our democracy. Not any more. “Law” made in secret, including pretzeled legal interpretations by the Justice Department for the White House, opened the way, for instance, to the use of torture on prisoners and in the Obama years to the drone assassination of Americans. Because such “legalities” remain officially classified, they are, of course, doubly difficult to challenge.
But can’t we count on the usual pendulum swings in American life to change this? There were indeed notable moments in American history when parts of the Constitution were put aside, but none are truly comparable to our current situation. The Civil War lasted five years, with Lincoln's suspension of habeas corpus limited in geography and robustly contested. The World War II Japanese internment camps closed after three years and the persecuted were a sub-set of Japanese-Americans from the West Coast. Senator McCarthy’s notorious career as a communist-hunter lasted four years and ended in shame.
Almost 13 years after the 9/11 attacks, it remains “wartime.” For the war on terror, the driver, excuse, and raison d'être for the tattering of the Bill of Rights, there is no end in sight. Recently retired NSA head Keith Alexander is typical of key figures in the national security state when he claims that despite, well, everything, the country is at greater risk today than ever before. These days, wartime is forever, which means that a government working ever more in secret has ever more latitude to decide which rights in which form applied in what manner are still inalienable.
The usual critical history of our descent into a post-constitutional state goes something like this: in the panic after the 9/11 attacks, under the leadership of Vice President Dick Cheney with the support of President George W. Bush, a cabal of top government officials pushed through legal-lite measures to (as they liked to say) “take the gloves off” and allow kidnapping, torture, illegal surveillance, and offshore imprisonment along with indefinite detentionwithout charges or trial.
Barack Obama, elected on a series of (false) promises to roll back the worst of the Bush-era crimes, while rejecting torture and closing America’s overseas “black sites,” still pushed the process forward in his own way. He expanded executive power, emphasized drone assassinations (including against American citizens), gave amnesty to torturers, increased government secrecy, targeted whistleblowers, and heightened surveillance. In other words, two successive administrations lied, performed legal acrobatics, and bullied their way toward a kind of absolute power that hasn’t been seen since the days of King George. That's the common narrative and, while not wrong, it is incomplete.
Missing Are the People
One key factor remains missing in such a version of post-9/11 events in America: the people. Even today, 45% of Americans, when polled on the subject, agree that torture is “sometimes necessary and acceptable to gain information that may protect the public.” Americans as a group seem unsure about whether the NSA's global and domestic surveillance is justified, and many remain convinced that Edward Snowden and the journalists who published his material are criminals. The most common meme related to whistleblowers is still “patriot or traitor?” and toward the war on terror, “security or freedom?”
It’s not that Americans are incorrect to be fearful and feel in need of protection. The main thing we need to protect ourselves against, however, is not the modest domestic threat from terrorists, but a new king, a unitary executive that has taken the law for its own, aided and abetted by the courts, supported by a powerful national security state, and unopposed by a riven and weakened Congress. Without a strong Bill of Rights to protect us indeed, secure us from the dangers of our own government, we will have gone full-circle to a Post-Constitutional America that shares much in common with the pre-constitutional British colonies.
Yet there is no widespread, mainstream movement of opposition to what the government has been doing. It seems, in fact, that many Americans are willing to accept, perhaps even welcome out of fear, the death of the Bill of Rights, one amendment at a time.
We are the first to see, in however shadowy form, the outlines of what a Post-Constitutional America might look like. We could be the last who might be able to stop it.

Disclosure’s Effects: WikiLeaks and Transparency

ABSTRACT: Constitutional, criminal, and administrative laws regulating government transparency, and the theories that support them, rest on the assumption that the disclosure of information has transformative effects: disclosure can inform, enlighten, and energize the public, or it can create great harm and stymie government operations. To resolve disputes over difficult cases, transparency laws and theories typically balance disclosure’s beneficial effects against its harmful ones—what I have described as transparency’s balance. WikiLeaks and its vigilante approach to massive document leaks challenge the underlying assumption about disclosure’s effects in two ways. First, WikiLeaks’ ability to receive and distribute leaked information cheaply, quickly, and seemingly unstoppably enables it to bypass the legal framework that would otherwise allow courts and officials to consider and balance disclosure’s effects. For this reason, WikiLeaks threatens to make transparency’s balance irrelevant. Second, its recent massive disclosures of U.S. military and diplomatic documents allow us to reconsider and test the assumption that disclosure produces certain effects that can serve as the basis for judicial and administrative prediction, calculation, and balancing. For this reason, WikiLeaks threatens transparency’s balance by disproving its assumption that disclosure necessarily has predictable, identifiable consequences that can be estimated ex ante or even ex post.
This Article studies WikiLeaks in order to test prevailing laws and theories of transparency that build on the assumption that disclosure’s effects are predictable, calculable, and capable of serving as the basis for adjudicating difficult cases. Tracing WikiLeaks’ development, operations, theories, and effects, it demonstrates the incoherence and conceptual poverty of an effects model for evaluating and understanding transparency.

The purpose of the visit was for you to take a polygraph examination in order to support the fact that you were a member of a group assembled as part of the C Battery, 2/81st Field Artillery US Army stationed on Strassburg Kaserine, Idar Oberstein, West Germany for the purpose of developing defensive strategies against attacks by hijacked aircraft. The discussions covered the possibility of aircraft being taken over by dissidents and used to attack important buildings in the United States of America.
You signed an agreement to undergo the polygraph examination. A copy of the agreement is attached.
After discussion it was agreed that the following were to be relevant questions.
1. Regarding the study that took place when you were a member of C Battery 2/81st FA in Idar Oberstein, West Germany in the 1970's. Do you intend to answer truthfully each question?
A. Yes
2. Did that study take place?

3. Did you discuss aircraft hijacking?
A. Yes.
4. Did you discuss the possibility of hijacked aircraft destroying buildings?

Your physiological responses recorded on the charts to Questions 1, 2, 3 and 4 were those expected from someone who was not attempting to deceive the examiner. I believe you were being truthful when you answered the questions as shown.

Information Poygraph Exam Based On
Briefly 25 years ago I was stationed on Strassberg Keserne in Idar Oberstein, Rhienland Pfatz, W. Germany assigned to C Battery, 2/81st FA, US Army. Here I took part in a Military Group for the purpose of "defending against" a developed attack scenario of hijacking airliners and crashing them into buildings to get around our air defence system.
For this letter I have selected facts from the records for the purpose of confirming that the records exist, they are in no sequence or order but they will suffice for the purpose of identifing the existence of these 25 year old records. These facts are from group conversations following the creation of the concept of hijacking airliners.
When asked the question, what kind of plane would be best to hijack? My choice was Boeing because it had the one lock/one key fleet; information I acquired from living in Everett, WA and having brothers who worked there. Lt. Teague on another day asked what could be done about it (?) I suggested asking Boeing to change their lock system.
When asked what kind of weapons could be used (?) I said a plastic handled box knife to get it through a metal detector; then Sgt Middleton said that you could get weapons on a plane through the luggage area (he knew someone who worked on a ground crew at an airport) he was then questioned separate like others whose ideas the groups leaders wanted more information on.
When asked what type of political climate the country would be in when the attack happens(?) we came up with hamstringing ; that is when one political party sets up the incoming administration with a disaster to happen.
When asked who might do this (?) another member said a name which I made an agreement to allow him to say in public first; but I can say that it was not George Bush neither President Bush who was President on Nov. 9, 1989 or George Bush who is President now.
4. One of the people from the group had done calculations and had came up with a time frame for a 100 story building to collapse after being hit by an airliner, it was between 1 and 2 hours the exact minutes I can't remember. Later when he was questioned by Military higher ups about a building's engineers disputing his calculations; he said, that unlike him they had to say that to keep their job.
5. The Military's calculations were what the warnings to NYC were based on.
One person from the group said that the US Government should contact NYC and have it tell the firefighters and police officers to not try and go up 80 floors in a building to try and put out the fire because the building would collapse before they could get there.
The records also include a person from the group who considered himself a religious person being a Priest in his Religion; made an International plea begging the US Government to tell New York City to not send those people to their unnecessary death.
When asked what an International plea of begging was (?) he explained that religious people can not twist anyone's arm to do anything, all they can do is beg a government to intercede and prevent a calamity.

Personal Account and Invitation
Since September 2001 I have been trying to get the information on this 25+ year old US Military Study Group into the public's knowledge but have only met with censorship from the US media.
The security lapses that were used on 9/11 reads like a checklist from this Military Study: the Democratic and Republican Political Parties could have began implementing the security upgrades that were recogmended by their own Congressional Commissioned Study in response to the hijacking and bombings following the 1974 [1973] Eygptian Israeli War, 25 [nearly 30] years ago.
Mr. Weller is a US Army-trained and -certified Military Polygraph Examiner and the exam I was given is the same one used by the US Government.
And the one American who has the backbone to accept my 1 year challenge to set up a polygraph with the examiner of their choice is Mr. Ted Nugent. I am going to his Tacoma,WA concert Aug. 29th and confront him with this information and the challenge to set up for me to take in New York City another polygraph exam with representatives of the NYC Fire Department, Police Department and surviving family members of those who died on 9/11 so that they will know beyond a shadow of a doubt that this US Congressional Commissioned Military Study Group took place and that the security upgrades that the Democratic and Republican Political Parties say they developed after 9/11 were actually developed 25 years ago.

Oct. 13, 2004 | Speculation continues to run wild about President Bush's mystery bulge. Since Friday, when Salon first raised questions about the rectangular bulge that was visible under Bush's suit coat during the presidential debates, many observers in the press and on the Internet have wondered aloud whether the verbally and factually challenged pre sident might be receiving coaching via a hidden electronic device.
Now a technical expert who designs and makes such devices for the U.S. military and private industry tells Salon that he believes the bulge is indeed a transceiver designed to receive electronic signals and transmit them to a hidden earpiece lodged in Bush's ear canal.
"There's no question about it. It's a pretty obvious one – larger than most because it probably has descrambling capability," said Alex Darbut, technical and business development vice president for Resistance Technology in Arden Hills, Minn. Darbut examined photographs of the president's back taken from the Fox News video feed at the first presidential debate in Coral Gables, Fla., as well as 2002 photos of the president driving and working in a T-shirt on his Crawford ranch, which were posted on the White House Web site.
Darbut speculates that the device the president wears is provided by the Secret Service, noting, "They're not going to have him driving around the countryside on his ranch without being in instant contact with him."
No one in the White House or Bush campaign, however, has offered such an explanation. In fact, the Bush camp has shed little light on the mysterious protuberance, turning aside questions with dismissive humor or rising tones of exasperation. The president is "a regular guy," White House chief of staff Andy Card told Salon before the second debate last week. "Maybe his suit had a little lump in it or something." Campaign spokeswoman Nicolle Devenish took the same line with the New York Times on Saturday: "It was most likely a rumpling of that portion of his suit jacket, or a wrinkle in the fabric." But Devenish, the Times dryly noted, "could not say why the 'rumpling' was rectangular." Campaign spokesman Scott Stanzel brushed aside a questioner in a Washington Post chat session by saying, "I think you've been spending a little too much time on conspiracy Web sites."
On Tuesday, in response to repeated questions from Salon, the Bush camp finally issued a flat denial. Campaign spokesman Reed Dickens denied that Bush has ever used an electronic device to aid his public speaking, insisting the president was wearing "nothing during the debates." When asked about the pictures taken at the Bush ranch, Dickens said the president has never used any devices except for cutting tools and earplugs to protect his ears from the high-decibel chainsaw. Nor has the Secret Service outfitted Bush with a hidden communications device, according to Dickens: "He doesn't need something like that because the Secret Service is always with him. They ride in the truck in the back. Wherever he goes, they're with him."
13 October 2004. Bear in mind that Bush may wear a communication device for personal protection, and if so, the Secret Service will not allow its revelation. Such devices are worn by security personnel, including the Secret Service, and it would not be unusual for the President's security staff to be in direct 24x7 communication with him in particular during public appearances, and most so when he cannot be surrounded by agents to alert him to danger and to give direction on what to do should a threat loom.
Other heads of state and VIPs are known to wear these devices, kept secret for security reasons. Signals are most often encrypted or otherwised protected from interception and interruption. However because encryption requires more time to process and transmit than unencrypted signal, there may be plain signals sent during an emergency, perhaps no more than a warning tone for an incoming urgent message.
How long these devices have been in use for presidential protection is not known, but they are well-established in the security field. It is possible that Bush was alerted to the 9/11 attacks by this technology while reading to school children, and that could account for his stare into space while listening; he might also have been directed to remain in place until security arrangements could be made for his escape to a secure location.
While it is not likely the use of such devices for presidential personal protection will be admitted publicly, there could be leaks from those who supply and service them, by ex-employees or others. The Secret Service Technical Security Division would probably be the contracting party for purchase and maintenance, and DoD's White House Communications Agency (WHCA), a unit of the Defense Information Systems Agency (DISA), could be involved as well.
The Techncial Security Division might well make the presidential devices, in cooperation with government and industry communication experts, to maximize protection against disclosure of their existence and capabilities.
The US government publication, Commerce Business Daily, lists unclassified solicitations and purchases; search on "usss" or "secret service" or "whca." Classified purchases would take place by non-public procedures.

After examining numerous frames of video footage [C-SPAN 30 Sept 04] I have come to the professional opinion that either George Bush was wearing a wireless prompter/queuing system on the night of the debates, or our president is growing some kind of mutant dorsal fin. By very carefully examining the movement of his body and how it interacts with his suit jacket it is easy to rule out the possibility "the bulge" is simply a wrinkle in his clothing or a problem with bad lighting.
As he moves his arms the jacket slides over the bulge, but the bulge does not move relative to his upper torso. The same is true when he swivels his hips where the jacket moves, and slides over the bulge between his shoulder blade, but the bulge itself does not move relative to his torso. When he moves in and out of the light, the shadows can be seem to move across the surface of his clothing and the shadows of the bulge sift accordingly, but the bulge remains at the exact same location between his shoulder blade. When he leans forward on the podium the bulge becomes more well defined as a something concealed under the suit coat, whereas a flaw in his garments would be pulled taut in such cases. This item appears to be the yoke assembly of the neck loop or wiring of a wireless prompter systems commonly used by public speakers. This behavior tends to indicate that the bulge is not attached to, or part of his suit jacket but is instead attached to an undershirt or oxford dress shirt.
The same situation is observed regarding the ridge that runs from bulge across this right shoulder blade and over his collar bone. Despite his movements the ridge does not move relative to his body, but the suit coat moves relative to it. This element behaves almost identically to the bulge between his shoulder blades and it also appears to be something close fitting and likely secured to his oxford shirt or undershirt.
Additionally, his shoulder blades, collar bone, and spine are not printing properly through his clothing and his clothing is not hanging properly on his frame. This appears to be caused by several milli-meters of stiff ballistic fabric being worn close to his body in the form of soft body armor.

Both federal and D.C. law expressly prohibited any employer with more than 50 employees from participating D.C.'s SHOP Exchange.
Newly unearthed documents suggest these officials knew they were violating the law.
The Heritage Foundation's John Malcolm and I have a new oped where we draw from newly uncovered to documents to show that the officials who bestowed upon Congress its own special exemption from ObamaCare likely violated numerous federal laws. Malcolm is a former assistant U.S. attorney, a former deputy assistant attorney general in the Department of Justice’s Criminal Division, and the current chairman of the Criminal Law Practice Group of the Federalist Society.
First, a little background. The Affordable Care Act threw members and staff out of the Federal Employees Health Benefits Program, and basically says they can only get health benefits through one of the law's new Exchanges. Under pressure from Congress and the president himself, the federal Office of Personnel Management (which administers benefits for federal workers, including Congress) decided the House and Senate would participate in the District of Columbia's "Small Business Health Options Program," or "SHOP" Exchange, rather than the Exchanges that exist for individuals. The reason is that federal law would not allow members and staff to keep receiving a taxpayer contribution of up to $12,000 toward their premiums if they enrolled in individual-market Exchanges. Yet putting Congress in a small-business Exchange isn't exactly legal, either. Both federal and D.C. law expressly prohibited any employer with more than 50 employees from participating D.C.'s SHOP Exchange. The House and Senate each employ thousands upon thousands of people.
Okay, now here's an excerpt from our new oped:
Documents obtained under the Freedom of Information Act show that unnamed officials who administer benefits for Congress made clearly false statements when they originally applied to have the House and Senate participate in D.C.’s “SHOP” Exchange for 2014. Notably, they claimed the 435-member House had only 45 members and 45 staffers, while the 100-member Senate had only 45 employees total…
Making a materially false or fraudulent statement as part of a claim against the U.S. Treasury is a separate federal crime, as is wire fraud. Ordinary citizens who violate these laws face fines of up to three times the amount drawn from the Treasury and/or up to 20 years in prison. They might also face prosecution for health care fraud (10 years), violating the Sarbanes-Oxley ban on falsifying documents (20 years), conspiracy to commit such offenses (5 years), and other crimes under federal and D.C. law.

Newly unearthed documents suggest these officials knew they were violating the law.
Those new documents include admissions by officials in Congress and D.C.'s small-business Exchange that the House and Senate are in fact not small businesses. Read the whole thing.
Just as I am once again highlighting how the Obama administration is trying to save this ill-conceived and unworkable law by spending money it has no authority to spend, University of Michigan law professor Nicholas Bagley is once again defending the administration. Bagley agrees with a large part of my account when he writes:
The exchange website in Washington, DC includes a field for the number of employees. If you enter a figure above 50, the website won’t accept the application. That’s because large employers are ineligible to use the SHOP exchange.
Actually, the web site doesn't include that field any more, which is part of why Bagley is wrong. But I'll save that for another day.
Bagley's argument is that since OPM determined Congress may participate in D.C.'s SHOP Exchange, those false statements were not "material to the approval of their applications," and therefore do not satisfy the elements of one of the federal crimes we mentioned.
If OPM's interpretation of the statute is lawful, Bagley may be right. But if OPM's decision is not lawful, then these false statements are what Malcolm and I allege: a material part of a fraudulent scheme "to facilitate illegal, taxpayer-funded gifts to members of Congress." So a lot is riding on whether OPM's determination is lawful.
Bagley claims OPM's determination is lawful because the ACA exempts Congress from the rules requiring SHOP Exchanges to reject employers with more than 50 employees. If he has evidence that such an exemption exists, he should cite it. He doesn't cite it, however, because it doesn't exist. If it did, OPM no doubt would have cited it when the agency announced this curious decision in the first place. Instead, the agency just pretended that such an exemption existed, and pretended the statutory requirement it was vitiating, and D.C.'s corresponding statutory requirement, do not. All Bagley offers in support of this claim is a link to a three-year-old post of his that addresses a different issue (about which Bagley is also wrong; but again, we'll save that another day). Curiouser and curiouser.
In sum, if Bagley can substantiate his claim that "the ACA singles out [Congress] as a special case" where the rules requiring SHOP Exchanges to reject large employers do not apply, he should do so. If not, what does that tell us?
(Two addenda. First, I have twice asked Bagley via email whether, regardless of whether he thinks it would be a good idea, 18 U.S.C. 1001 is broad enough to allow a federal prosecutor to bring charges given this fact pattern. No answer yet. Second, Bagley calls our oped "irresponsible" and counsels us to "try and keep some kind of perspective, for Pete’s sake." Good idea. Here's another. Let's stick to arguing the facts.)
