The 9th Circuit Court of Appeals has issued a ruling stating Americans do not have an inherent right to carry firearms, whether it be concealed or open carry.

“The US Court of Appeals for the 9th Circuit just ruled that THERE IS NO RIGHT TO CARRY – either openly or concealed in public. This ruling impacts RTC laws in AK, HI, CA, AZ, OR, WA, & MT. This was not an NRA case but we are exploring all options to rectify this,” the tweet noted.

The court ruling, handed down on Wednesday, could have wide ramifications for lawful gun owners around the country.

“After careful review of the history of early English and American regulation of carrying arms openly in the public square, the en banc court concluded that Hawai‘i’s restrictions on the open carrying of firearms reflect longstanding prohibitions, and therefore, the conduct they regulate is outside the historical scope of the Second Amendment,” the court decided. “The en banc court held that the Second Amendment does not guarantee an unfettered, general right to openly carry arms in public for individual self-defense.”

“Accordingly, Hawai‘i’s firearms-carry scheme is lawful,” the court continued. “The en banc court rejected Young’s argument that [the state law] is invalid as a prior restraint because it vests chiefs of police with unbridled discretion to determine whether a permit is issued. Joining its sister circuits, the en banc court held that the prior restraint doctrine does not apply to Second Amendment challenges to firearm-licensing laws.”

Four judges dissented from the court’s majority ruling, however.

“Dissenting, Judge O’Scannlain, joined by Judges Callahan, Ikuta, and R. Nelson, would hold that both [the state law] and the 1997 County regulation destroy the core right to carry a gun for self-defense outside the home and are unconstitutional under any level of scrutiny,” the ruling continued. “Judge O’Scannlain stated that the majority holds that while the Second Amendment may guarantee the right to keep a firearm for self-defense within one’s home, it provides no right whatsoever to bear—i.e., to carry—that same firearm for self-defense in any other place.”

“In his view, the majority’s decision undermines not only the Constitution’s text, but also half a millennium of Anglo-American legal history, the Supreme Court’s decisions in District of Columbia v. Heller, 554 U.S. 570 (2008), and McDonald v. City of Chicago, 561 U.S. 742 (2010), and the foundational principles of American popular sovereignty itself.”

Meanwhile, just two years ago, the frequently overturned 9th Circuit actually ruled that open carry was a constitutional right for the same defendant.

“Plaintiff George Young sued Hawaii in 2012 for denying his applications for permits to carry a concealed or openly visible handgun,” Courthouse News reported. “A Hawaii state law requires a license to a carry a gun in public.”

The court ruling at the time addressed the Hawaii gun law and upheld the constitutional right to open carry.

“With one judge dissenting, two circuit judges concluded that Hawaii cannot deny permits to non-security guard civilians who want to carry guns in public,” the report added.

As the Biden administration seeks to push through sweeping gun control measures, the ruling could be a signal that courts are open to rubber-stamping the restrictions on the Second Amendment.

Border Officials Release Photos And Video Of Migrant Processing Centers

The images show shelves at Customs and Border Protection (CBP) facilities in Donna and El Paso, Texas, stocked with food, clothing and hygiene items and officials monitoring migrants personally and through surveillance. Migrants are shown moving through the temporary facility in Donna, Texas, on Wednesday in a single file line and sitting in plastic cells without room for social distancing.

CBP is still prohibiting members of the media from accessing the facilities.

“We are working through, with the Department of Health and Human Services and also the Department of Homeland Security, to ensure privacy and ensure we’re following COVID protocols,” White House Press Secretary Jen Psaki said Monday. “We remain committed to transparency, and, of course, as I noted last week, we certainly want to make sure that the media has access to these sites.”

The photographs and videos were taken last week, according to the agency.

Democratic Rep. Linda Sanchez said it would be “inappropriate” to allow journalists access to CBP facilities where minors are processed because they “are not permanent places for children,” Fox News reported Sunday. Sanchez added that outside visits could jeopardize the minor’s privacy or spread COVID-19.

Resources at the processing facility in Donna, Texas, consist of eight soft-sided “pods” meant to hold 260 migrants, Democratic Rep. Henry Cuellar told Axios Monday. Cuellar said over 400 unaccompanied migrant minors were held in one “pod” as of Sunday.

“CBP continues to transfer unaccompanied minors to the U.S. Department of Health and Human Services (HHS) as quickly and efficiently as possible after they are apprehended on the Southwest Border,” the agency said in a statement.

CBP released video footage from the Donna facility taken Wednesday.

The Donna facility was constructed due to limited capacity at the permanent Centralized Processing Center in McAllen, Texas, for migrant family units and unaccompanied children, according to the agency.

It is pretty troubling how some local and State governments are assuming powers over citizens during this pandemic with absolutely no authority to do so. One ought to read the Bill of Rights. An American citizen ought to know the difference between a democracy (which many claim the USA is) and a Constitutional Republic . . . which we really are. The difference, succinctly stated, is that a Constitutional Republic is a form of government which operates under a Constitution that clearly recognizes the citizens have unalienable rights bestowed upon them by their Creator . . . and not merely given by the government. While the government may rule, there are some areas which may never be imposed upon . . . namely the right to life, liberty and the pursuit of happiness.

The use of draconian laws (harsh penalties for minor infractions) is totally un-American . . . and they violate our U. S. Constitution.

Here is an example of a long-standing U. S. Supreme Court ruling on such measures. This is NOT an opinion. This was the ruling of the United States Supreme Court shortly after the “Civil War” in Ex parte Milligan, 71 U.S. 2 (1866) which yet stands strongly to this day.

“The Constitution for the United States is a law for rulers and people equally in war and in peace . . . at all times, and under all circumstances. No doctrine . . . was ever invented . . . than that any of its provisions can be suspended during any of the exigencies [emergencies/urgencies] of government.” pp. 120-121 “. . . there is no law for the government of the citizens, the armies or the navy of the United States, within American jurisdiction, which is not contained in or derived from the Constitution.” p. 141

In 16 American Jurisprudence 2d, a legal encyclopedia of United States law, suspension of the Constitution is prohibited, as follows:

“It is sometimes argued that the existence of an emergency allows the existence and operation of powers, national or state, which violate the inhibitions of the Federal Constitution. The rule is quite otherwise. NO emergency justifies the violation of any of the provisions of the United States Constitution.” Section 71

“Neither the legislature nor any executive or judicial officer may disregard the provisions of the Constitution in case of an emergency…” Section 98

Therefore, ANYONE who declares the suspension of constitutionally guaranteed rights (to freely travel, peaceably assemble, earn a living, freely worship, etc.) and/or attempts to enforce such suspension within the 50 independent, sovereign, continental United states of America, is making war against our constitution(s) and, therefore, we, the people. They violate their constitutional oath and, thus, immediately forfeit their office and authority and their proclamations may be disregarded with impunity and that means ANYONE: Congress, the Senate, even the Governor and President! They have broken constitutional law therefore they all must step down. Or face a revolution.

There you have it! I had a fellow who does various tasks for me travel to the Coast this week to do some work. I put him up at a hotel. This morning he told me that he was stopped by a local policeman and was soon surrounded by four police cars . . . they simply wanted to know who he was and what he was doing here. I told him I hope he told them it was none of their blankety blank business!

BERLIN, March 24 (Reuters) - Chancellor Angela Merkel ditched a plan agreed on Tuesday for an extended Easter holiday to try to break a third wave of the coronavirus pandemic, apologising to lockdown-weary Germans after the hastily-conceived plan triggered a backlash.

At talks that ran into the early hours of Tuesday, Merkel and the leaders of Germany's 16 states had agreed to call on citizens to stay at home for five days over the Easter holidays, declaring April 1 and April 3 as extra "rest days".

The measure would have meant all stores, including essential ones, closing for an extra day. It was met by harsh criticism, with businesses lamenting more shutdowns and medical experts saying the new measures were not tough enough to prevent the exponential spread of more infectious variants of the virus.

"The idea of an Easter shutdown was drafted with the best of intentions. We urgently need to stop and reverse the third wave of the pandemic," Merkel told reporters on Wednesday.

But it was not possible to implement the measures so quickly, Merkel said. She apologised for added uncertainty that it had raised for Germans.

"This mistake is mine alone," she said.

Her comments came against a backdrop of growing public frustration with the conservative-led government over the slow rollout of COVID-19 vaccines and extended lockdown measures.

"No plan, no clue, no courage," ran a headline in the online edition of the mass-selling Bild daily above a picture of Merkel and two state leaders.

The HDE association of retailers welcomed Merkel's announcement on Wednesday, saying that closing stores for an extra day ahead of Easter would have led to logistical problems and prompted shoppers to rush to stock up earlier.

Creditor’s board okays four pending reviews of Pakistan’s economy and release of next loan tranche of around $500m.

The International Monetary Fund (IMF) on Wednesday approved four pending reviews of Pakistan’s economy and the release of the next loan tranche of around $500 million, reviving the $6 billion programme after it remained derailed for over a year.

In order to put the programme back on track, Prime Minister Imran Khan took some tough political decisions despite prevailing political uncertainty. These measures, which were also the prior conditions, included significantly increasing electricity prices, imposition of Rs140 billion taxes and agreeing to an unparalleled autonomy for the central bank.

The Executive Board of the IMF endorsed the staff-level agreement, reached between the government of Pakistan and the IMF team last month, a top government functionary told The Express Tribune after the board approval.

The board’s approval has paved the way for the release of $500 million third loan tranche. Out of the $6 billion, the IMF has already disbursed $1.45 billion in two tranches, bringing the total disbursements to $2 billion. Sources said that it will be very challenging to keep the reinstated programme on track, particularly due to heavy taxation of over Rs700 billion and cut in expenditures in the next budget.

Pakistan’s economy has started gradually recovering from the aftermaths of the Covid-19 but it is again struck by the third wave of the deadly pandemic. The central bank last week upward revised the growth forecast to 3% for this fiscal year.

The revival of the programme would keep external loans pipelines opened for Pakistan, as the government remained heavily dependent on the external borrowings to remain afloat.

In April last year, the IMF had postponed a board meeting for the approval of the second review after Islamabad did not honour its commitment to announce a mini-budget and increase electricity prices, resulting in the derailment of the programme.

In February, both sides agreed to club the pending second, third, fourth and fifth reviews of the programme. The separate completion of these reviews would have led to disbursements of $2.2 billion, which the IMF has now reduced to just $500 million.

North Korea fired two unidentified projectiles into the sea on Thursday morning, South Korea's military said, while Japan's government said it suspected the weapons were ballistic missiles.

Seoul's Joint Chiefs of Staff announced that intelligence authorities in South Korea and the U.S. are thoroughly analyzing the projectiles, fired from northeastern North Korea into the Sea of Japan. The Joint Chiefs said that South Korean forces had raised their level of monitoring and defense, while cooperating with the U.S. closely. "We are prepared for anything," they said in a text message to reporters.

South Korea's presidential Blue House said it would host an emergency National Security Council meeting at 9 a.m. to discuss North Korea's projectiles. Pyongyang's move comes a week after the U.S. secretaries of state and defense met with their South Korean counterparts in Seoul. In a news conference after the meeting, Secretary of State Antony Blinken demanded that China use its influence in North Korea to push the country toward denuclearization. Experts say North Korea is testing the Biden administration, gauging how far Washington will tolerate its actions.

"With its return to testing different types of missiles, Pyongyang is flirting with the limits of what it can get away with under U.N. Security Council resolutions," said Leif-Eric Easley, a professor of international studies at Ewha Womans University in Seoul. "It is also challenging the 2018 Inter-Korean Comprehensive Military Agreement, which it has threatened to scrap."

The Ninth U.S. Circuit Court of Appeals ruled 7-4 on Wednesday to uphold a Hawaii law that blocks people from openly carrying guns if they don't have a license that is available only to individuals who are able to demonstrate that they require a firearm in order to defend life or property, though the San Francisco Chronicle noted that law enforcement and military members are exempt.

"Our review of more than 700 years of English and American legal history reveals a strong theme: government has the power to regulate arms in the public square," Judge Jay Bybee remarked in the majority opinion, according to the outlet.

"There is no right to carry arms openly in public; nor is any such right within the scope of the Second Amendment," the judge said. The Ninth U.S. Circuit Court of Appeals ruled 7-4 on Wednesday to uphold a Hawaii law that blocks people from openly carrying guns if they don't have a license that is available only to individuals who are able to demonstrate that they require a firearm in order to defend life or property, though the San Francisco Chronicle noted that law enforcement and military members are exempt.

"Our review of more than 700 years of English and American legal history reveals a strong theme: government has the power to regulate arms in the public square," Judge Jay Bybee remarked in the majority opinion, according to the outlet.

"There is no right to carry arms openly in public; nor is any such right within the scope of the Second Amendment," the judge said. "It remains as true today as it was centuries ago, that the mere presence of such weapons presents a terror to the public and that widespread carrying of handguns would strongly suggest that state and local governments have lost control of our public areas."

But Judge Diarmuid O'Scannlain in a dissent joined by three other judges, pushed back against the majority's ruling.

"The Second Amendment to the United States Constitution guarantees 'the right of the people to keep and bear Arms.' U.S. Const. amend. II (emphasis added). Today, a majority of our court has decided that the Second Amendment does not mean what it says. Instead, the majority holds that while the Second Amendment may guarantee the right to keep a firearm for self-defense within one's home, it provides no right whatsoever to bear—i.e., to carry—that same firearm for self-defense in any other place."'''

Those holding warrants would be entitled to buy common shares of Skillz stock for $11.50 per share. Suez Canal: Owner of cargo ship blocking waterway apologises

The Japanese owner of the giant cargo ship that has been blocking Egypt's Suez Canal since Tuesday has apologised for the disruption to global trade.

Shoei Kisen Kaisha said it was trying to resolve the situation as soon as possible, but that dislodging the Ever Given was proving extremely difficult. The 400m-long (1,300ft), 200,000-tonne vessel became wedged across the canal amid high winds and a dust storm. At least 150 ships are now waiting to pass through the vital maritime route. About 12% of global trade passes through the Suez canal, which connects the Mediterranean Sea to the Red Sea and provides the shortest sea link between Asia and Europe. An alternative route, around the Cape of Good Hope on the southern tip of Africa, can take two weeks longer.

The vessel, which is operated by Taiwanese transport company Evergreen Marine but called the Ever Given, is currently wedged diagonally across the waterway. "In co-operation with local authorities and Bernhard Schulte Shipmanagement, a vessel management company, we are trying to refloat [the Ever Given], but we are facing extreme difficulty," the owner, Shoei Kisen Kaisha, said in a statement on Thursday. "We sincerely apologise for causing a great deal of worry to ships in the Suez Canal and those planning to go through the canal," it added. "In co-operation with local authorities and Bernhard Schulte Shipmanagement, a vessel management company, we are trying to refloat [the Ever Given], but we are facing extreme difficulty," the owner, Shoei Kisen Kaisha, said in a statement on Thursday.
