U.S. charges head of NY money manager GPB Capital with Ponzi-like fraud
The head of a New York money manager that raised $1.8 billion from investors was criminally charged on Thursday with running a Ponzi-like fraud to cover up poor performance, and diverting investors’ money to boost their pay and fund luxury expenses. Authorities said GPB Capital Holdings LLC and its principal David Gentile promised investors consistent 8% annual returns plus occasional “special” distributions. They said GPB in fact suffered big losses, used new money to repay existing investors, and diverted funds for the personal use of its executives, including a Ferrari for Gentile. Two other individuals also face criminal charges, and the U.S. Securities and Exchange Commission and several state regulators filed related civil charges.
GPB did not immediately respond to requests for comment. Lawyers for the defendants could not immediately be located.

Michael Cohn, Ex-GPB Capital Exec Pleads Guilty to Stealing SEC info
According to reports yesterday, Michael Cohn, former chief compliance officer at private equity firm, GPB Capital Holdings, pleaded guilty to a misdemeanor on Tuesday. Cohn, 61, was reportedly charged in February 2019 with stealing information about a probe into GPB Capital while he was reportedly still working for the SEC as a compliance examiner. Cohn reportedly pled guilty to theft of government property before U.S. District Judge Gary Brown in Central Islip, New York. Federal prosecutors alleged that during talks with GPB about potential employment with the firm, Cohn told GPB executives that he had inside information about an SEC investigation into the company, which they claim he shared. Cohn, who will be sentenced in January 2021, denied the allegations.
GPB Capital has been under investigation by various regulators, including the SEC, the Financial Industry Regulatory Authority and the FBI since 2018.

Antrim County Circuit Judge Kevin A. Elsenheimer is forcing Michigan election officials to produce all communications with Google, Facebook, Amazon and Apple related to the 2020 elections.
Elsenheimer has also ordered Secretary of State Jocelyn Benson and her Bureau of Elections to produce communications with Dominion Voting System and Election Source, the companies responsible for computerized voting systems in Antrim County and much of the state.

Outspoken Merck CEO Kenneth Frazier, who challenged Trump on race issues, to retire this year
Merck’s outspoken chairman and CEO, Ken Frazier, is retiring after almost 30 years at the drugmaker, the company announced Thursday.
Frazier, 66, will be succeeded as CEO on June 30 by Chief Financial Officer Robert Davis and will continue to serve on Merck’s board as executive chairman “for a transition period to be determined by the board,” the company said. Frazier, one of the few Black corporate leaders in the United States, has been Merck’s chief since January 2011. “It has been a privilege to serve as Merck’s CEO for the past decade and to work with the most dedicated and talented employees and management team in the industry,” Frazier said in the statement. “As executive chairman, I look forward to collaborating with Rob and our board of directors to help Merck achieve even higher levels of success.” Frazier’s final years at Merck were marked by his outspoken opposition to former President Donald Trump. He led a revolt among CEOs as the first to resign from Trump’s American Manufacturing Council shortly after the former president’s supportive comments of White nationalist and neo-Nazi groups at the deadly protest in Charlottesville, Virginia, in 2017.
He has called for business leaders to be a “unifying force” that can help solve many of the racial inequalities in America by creating new opportunities and jobs. He has said that education, and particularly financial literacy, is the “great equalizer.”
Frazier’s departure in June will leave only three Black CEOs at Fortune 500 companies. TIAA CEO Roger Ferguson, Jr. announced he would retire from his role at the end of March. Roz Brewer, Starbucks’ current chief operating officer, will take the top job at Walgreens Boots Alliance that same month.

SWIFT Sets Up Joint Venture With China Central Bank Ahead Of Imminent Digital Yuan Launch
It's been a long time coming, and now it's almost here.
Back in August we reported that China's Commerce Ministry had released fresh details of a pilot program for the country's central bank digital currency (CBDC) to be expanded to several metropolitan areas, including Guangdong-Hong Kong-Macao Greater Bay Area, Beijing-Tianjin-Hebei region, and Yangtze River Delta region. This was the inevitable culmination of a process which started back in 2014 when as we reported at the time, "China Readies Digital Currency, IMF Says "Extremely Beneficial""
Fast forward a few months when China's preparations to rollout a digital yuan gathered pace, and we reported in October that China was poised to give legal backing to the launch of its own sovereign digital currency, "cementing its trailblazer status in virtual currencies far ahead of other countries, after already recently experimenting with large-scale trials of actual payments by consumers, which was met with mixed results." Specifically, the South China Morning Post reported that "The People’s Bank of China published a draft law on Friday that would give legal status to the Digital Currency Electronic Payment (DCEP) system, and for the first time the digital yuan has been included and defined as part of the country’s sovereign fiat currency."
The design framework for the digital yuan had been released one year ago on the heels of Facebook's ambitious but disastrous Libra token rollout after founding corporate partners split for lack of confidence in the project and on fears US federal regulators would seek to block it just as they did encrypted-messaging company Telegram's Gram cryptocurrency.
"The draft law would also forbid any party from making or issuing yuan-backed digital tokens to replace the renminbi in the market," the SCMP said.
This in turn brought us to the so-called "Shenzhen case study" when in October of 2020, China was the first nation to hold a trial run of its digital currency, when the government in Shenzhen carried out a lottery to give away a total of 10 million yuan (about $1.5 million) worth of the digital currency (nearly 2 million people applied and 50,000 people actually "won").
The winners were required to download a digital Renminbi app in order to receive a "red packet" worth 200 digital yuan ($30), which they can then spend at over 3,000 designated retailers in Shenzhen’s Luohu district, according to China Daily. After that, they’ll be able to buy goods from local pharmacies, supermarkets and even Walmart.
The idea was to not only test the technology involved, but boost consumer spending in the wake of the COVID-19 pandemic. In short, China is not only subsidizing the centrally-planned economy by manipulating the supply-side of the question- it now can prop up demand by handing out digital currency to anyone (or everyone).
Of course, unlike traditional central bank account-based currencies such as reserves, or decentralized cryptocurrencies like bitcoin, China’s digital currency would be controlled by the country’s central bank and will be instantly made available at a moment's notice to anyone who can receive it.

Judge blocks Texas from fully defunding Planned Parenthood day before the action was to take effect
Texas was set to oust the abortion provider from its Medicaid program
A Texas judge on Wednesday temporarily blocked the state from kicking Planned Parenthood out of the its Medicaid program, a move that would have completely unhooked state taxpayers from funding the abortion provider.
The order came after Planned Parenthood filed a last-minute lawsuit Wednesday — the last day before the action was set to take effect — asking courts to step in and pause the effort. The emergency lawsuit argued that state officials did not give the state's approximately 8,000 Medicaid patients enough time to find other providers.
Travis County Judge Maya Guerra Gamble agreed that patients should be afforded more time and granted a temporary restraining order on the action, setting a hearing for Feb. 17.
Republicans in Texas have been trying to oust Planned Parenthood from the state's Medicaid program for several years, ever since an undercover video posted in 2015 by the pro-life group Center for Medical Progress purportedly showed the abortion provider illegally selling baby tissue it had obtained from abortion operations.
In 2017, a federal judge blocked the effort. But late last year, the U.S. Fifth Circuit Court of Appeals overturned the decision, clearing the way for Texas to finally go through with the effort. Following the ruling, Planned Parenthood asked Texas health officials for at least six months to help transition patients to other providers, but the state thought that excessive and offered a 30-day transition period instead.
In the lawsuit, Planned Parenthood characterized the effort as just "one more assault against the same communities that face unjust, systemic barriers to basic human rights, including access to affordable health care, education, and housing."
Now, with more time on its hands, Planned Parenthood will await potential action by the Biden administration, which has already shown urgency in reversing Trump-era policies pertaining to abortion and health care.
"This comes a week after the Biden-Harris administration made it clear it would put an end to Trump-era attacks against health care, including programs like Medicaid," Planned Parenthood Texas Votes said in a press release. "Texas's Medicaid 'defunding' offers a clear example of how critical it is for the Biden-Harris administration to stop attacks that target the reproductive health care of people with low incomes, women, and people of color."

Pompeo: China Will Use Artificial Intelligence to Harm United States
Former Secretary of State Mike Pompeo said in an interview aired on Feb. 4 that the Chinese Communist Party (CCP) will use artificial intelligence to comb through troves of personal data on U.S. citizens recovered from Chinese technology and apps and use the intelligence as a weapon to strong-arm the United States.
“They will use that information. They will use artificial intelligence to gather it up. And then they will turn around and tell us that if we don’t act in a way that’s consistent with what the Chinese Communist Party wants, they will impose real costs on the United States,” Pompeo told Fox News’ Maria Bartiromo.
Pompeo made the remarks in response to a question on whether the administration of President Joe Biden should keep in place the sanctions and other restrictions imposed on Chinese companies imposed under former President Donald Trump.
“The flip side is these technologies that infiltrate the United States and infiltrate Europe are things that our kids use, that we use, that are in our cars, that are in our television sets, that are in our handsets and phones, this information, also American information, whether it’s our personal information about where we live and who we hang out with, or information about our medical conditions and our DNA, that information goes back to the Chinese national security state,” Pompeo said.
Asked if the information could be used as blackmail, Pompeo said, “Yes, absolutely.”
“It will be used for bad intent. It will be used to harm the United States of America and those sanctions were put in place by our administration to protect the American people from these twin evils.”
The Trump administration imposed restrictions and sanctions on a variety of Chinese technology firms, including telecommunications giants Huawei and ZTE.
Pompeo went on to say that he warned U.S. allies about the dangers posed by the CCP. The regime, he said, has consistently broken its promises over the past two decades and should be treated under the motto “distrust but verify.”

The date of Ed Buck’s federal criminal trial has been moved from Nov. 26 of this year to Aug. 4, 2020. Buck, who is being held in Metropolitan Detention Center in downtown Los
Angeles, will remain in prison until then.
U.S. District Judge Christina Snyder agreed to delay the hearing, citing, among other reasons, that “the case is so unusual and so complex, due to the nature of the prosecution and the voluminous discovery, that it is unreasonable to expect preparation for pre-trial proceedings or for the trial itself within the time limits established by the Speedy Trial Act.”
Buck, 63, a white gay man known for his donations to Democratic Party candidates and successful push for West Hollywood to adopt a ban on fur sales, is facing two federal charges of providing drugs resulting in death and three counts of distributing methamphetamine. The deaths are those of Gemmel Moore, 26, a young black sex-worker, and Timothy Dean, 50, also black, who had worked at Saks Fifth Avenue in Beverly Hills.
A July 13 status conference was also set. Buck also faces state charges of running a drug den in his West Hollywood apartment, but the federal case will proceed first.

Special Forces Warned Against Using Pepe the Frog, III%ers, Other ‘Extremist’ Symbols
An Army commander recently briefed U.S. Special Forces candidates and trainees they could be detained or chaptered out of the Army if they are found affiliated with certain imagery popular on the political right that is now considered to be associated with extremism, Breitbart News can exclusively reveal.
The briefing, by Army Col. Mike Henry, MD, deputy commander of Special Warfare Medical Group (Airborne)/Joint Special Operations Medical Training Center at the U.S. John F. Kennedy Special Warfare Center and School (JFKSWCS) at Fort Bragg, came two days after President Joe Biden was inaugurated, a source familiar with the briefing said.
Henry is responsible for training over 2,500 Army and Navy Special Operations medics.
Around the time of the briefing, slides from the New York Police Department Intelligence Bureau were also posted around the Joint Special Operations Medical Training Center (JSOMTC) and distributed to soldiers. The slides, dated January 14, listed and described about two dozen symbols, ideologies, and memes considered to be “associated with or appropriated by domestic violent extremism.”
The slides said:
Recent high-profile mass-casualty attacks in the West have demonstrated the enduring threat posed by a wide range of racially/ethnically motivated violent extremists and conspiracy-driven malicious actors, including those inspired by far-right, neo-Nazis, and white supremacist worldviews. Due to his concerning trend, NYPD Intelligence Bureau advises law enforcement to maintain awareness of key symbols, icons, and graphics associated with or appropriated by domestic violent extremist movements that — in some cases — were observed during the January 6 deadly and destructive riot at the US Capitol.
Soldiers were told the list came from the Department of Homeland Security and was an updated list of what federal and local law enforcement need to be “on the lookout for,” according to the source.
Henry “told us that if anyone gets caught wearing, buying, selling, affiliated with in any way, any of those things on those list, that the first thing he’s going to do is chapter us out of the Army. The second thing is, he’s going to handle the investigation by sending it over to the DHS,” the source said. “He didn’t quite outright say that we would be arrested, he used the word ‘detained.'”
Some of the imagery on the slides clearly refer to hate symbols, such as a swastika or other Nazi-related symbols. However, also included is “Pepe the Frog” — an internet meme frequently posted by members of the political right to troll the political left. The slides, obtained by Breitbart News, said this about the meme:
While not originally meant as a hate symbol, Pepe the Frog, or the ‘sad frog meme’ was appropriated by users who post racist, anti Semitic, anti-LGBT, and other bigoted content. Individuals will also alter Pepe the Frog to show him in various costumes or as recognizable hate figures, such as Hitler.
More worrying for some soldiers, however, is the list’s inclusion of imagery popular among members of the military long before the racial unrest of the summer of 2020, such as the “Three Percenters” symbol — the Roman numeral III with 13 stars around it.
In fact, until recently, graduates of the SWMG’s Trauma III course had the option to buy a shirt with a Three Percenter logo on the front, the source said.
“Now those shirts, all of them have to be thrown away, and cannot be worn again and they have to change the logo because it’s been associated with these extremist behavior,” the source said.

How to Split Them Across Pages/Posts so Aggregators Can Pick Them Up
1. all posts have character limits of between 4700-5000 and also line length limits (200 lines?)
2. Longer than that, you get a "body too long" message when trying to post.
3. If notable bun is too long, it must be split.
The problem is that you can't just split it any old way, because aggregators can't pick it up unless correctly formatted.
See CAPS. for how this works.
First solution doesn't seem to work.
Second one should.

Former President Donald Trump’s team dismissed a request for the former president to testify under oath at the pending Senate impeachment trial.

House Democratic impeachment managers led by Rep. Jamie Raskin (D-Md.) sent a letter to Trump calling on him to testify at his second impeachment trial and said that if he doesn’t, they would use it against him during the event—a similar tactic and argument they used during the first impeachment trial.
“Two days ago, you filed an Answer in which you denied many factual allegations set forth in the article of impeachment. You have thus attempted to put critical facts at issue notwithstanding the clear and overwhelming evidence of your constitutional offense,” Raskin wrote to Trump, adding, “I write to invite you to provide testimony under oath, either before or during the Senate impeachment trial, concerning your conduct on January 6, 2021.”
But Trump lawyer David Schoen, in response, claimed Raskin was attempting a “public relations stunt” by sending the letter to the former president.
“There is no such thing as negative interference in this unconstitutional proceeding,” he added. “Your letter only confirms what is known to everyone: you cannot prove your allegations against the 45th president of the United States, who is now a private citizen.”
In suggesting that Trump will not attend the trial to testify, Schoen argued that Raskin’s “use of our Constitution to bring a purported impeachment proceeding is much too serious to try to play these games.”
The Democratic-controlled House voted last month to impeach Trump on a single article of impeachment, claiming he incited an insurrection on Jan. 6.
Trump’s lawyers have indicated that they will argue that the impeachment trial is unconstitutional because Trump has left office and that his act of speaking to a crowd on Jan. 6 was protected under the First Amendment.
Jason Miller, part of Trump’s team, told Newsmax on Thursday that he did not expect him to testify.
However, if Trump did, the former president would “knock this thing out in about 15 minutes,” said Miller.
When Trump addressed the “Stop the Steal” rally on Jan. 6 during the Joint Session of Congress, he wanted the protesters to demonstrate peacefully, he added.
“You would have to be so thick in the head to have watched President Trump over the last five years and not realize that he is the most pro-law and order president ever and that he deplores any sort of mob violence,” he said. Miller furthermore said that a timeline of the events on Jan. 6 dispute that Trump’s speech incited a mob.
“We’ve seen public reports from the police and FBI and all sorts of other outlets that much of this planning was done well in advance,” he said on the network.
The Senate impeachment trial is scheduled to start the week of Feb. 8. House Democrats wrote that the former president should respond to the letter by Friday, Feb. 5.
Last week, Sen. Rand Paul (R-Ky.) said Democrats won’t net a conviction after 45 GOP senators voted against holding the trial in January. At least17 Republicans would have to join the Democratic caucus.
