Investor Browder files Swedbank money laundering complaint in Latvia

STOCKHOLM (Reuters) - Bill Browder, an investor who campaigns to expose corruption, has taken a criminal complaint against Swedbank to Latvian authorities, alleging it was involved in a Russian money laundering scandal.
Swedish broadcaster SVT reported in March that Swedbank processed gross transactions worth up to 20 billion euros a year from high-risk, non-resident clients, mostly Russians, that passed through its Estonian branch between 2010 and 2016.
Swedbank is already being investigated by Swedish and Baltic authorities over possible links to a money laundering scandal centered around 230 billion euros ($260 billion) in suspicious payments that moved through Danske Bank’s Estonian branch from 2007 to 2015.
Browder, once the biggest foreign money manager in Russia, had previously taken the complaint against Swedbank to Swedish and Estonian authorities, alleging that the Swedish bank’s accounts were used to launder $176 million from 2006 to 2012.
The bulk of this, $117 million, went through Swedbank’s Estonian branch and Browder’s complaint lodged with Latvian authorities, dated April 5 and seen by Reuters on Wednesday, showed some $41 million had passed through Latvia.
“We cooperate with the authorities in all our home markets in order to resolve current issues. However, we have no comment on the specific cases that Bill Browder now points to,” a Swedbank spokeswoman said in an emailed response.
Browder’s complaint, filed by his Hermitage Capital Management, called on Latvian authorities to look into the allegations alongside their ongoing broader probe into Russian money laundering links.
Latvia’s Financial Intelligence Unit told Reuters it did not comment in such cases, while the Economic Crime Combat Department of the Latvian Police confirm it had received a letter from Browder and would assess the information contained within it but declined to comment.
The Financial and Capital Market Commission, which is the Latvian agency involved in a wider Baltic probe into Swedbank, declined to comment.
MAGNITSKY CASE
Browder has pushed for banks to be held accountable over links to a money laundering and tax fraud exposed by his former lawyer Sergei Magnitsky, who died in a Russian jail in 2009.
He had previously brought cases against Swedbank’s rivals Nordea and Danske Bank, which is now the subject of investigations in the United States, France, Denmark, Estonia and Britain.
Estonia is including Browder’s Swedbank complaint in its Danske Bank inquiry, but Sweden dropped its investigation saying there were limited transfers involving Swedish accounts and that the statute of limitations had expired.
Sweden, along with authorities in Estonia, Latvia and Lithuania, is set to conclude its investigation into Swedbank later this year, while a separate Swedish economic crime agency inquiry into the bank’s conduct was expanded last month.

An expansive network of “shadowy” dark money donors has grown to rival the influence of the conservative Koch network -- pumping millions into left-wing causes ranging from health care to climate change to abortion – all while flying well under the radar of public scrutiny, according to an explosive new report obtained by Fox News.
The report, by conservative watchdog Capital Research Center, describes a band of nonprofits operating under the banner of Washington-based philanthropy company Arabella Advisors. “Together, these groups form an interlocking network of 'dark money' pop-up groups and other fiscally sponsored projects, all afloat in a half-billion-dollar ocean of cash,” the report says. “The real puppeteer, though, is Arabella Advisors, which has managed to largely conceal its role in coordinating so much of the professional Left’s infrastructure under a mask of ‘philanthropy.’”
The report says the "hydra-like" network brought in $1.6 billion between 2013 and 2017 "to advance the political policies desired by wealthy left-wing interests," as the network’s revenues grew by 392 percent. The four Arabella-controlled “sister” groups brought in $582 million in 2017 alone, according to the report. If the four groups were a single entity, it would make them the 22nd largest public charity in America, with higher revenues than the American Civil Liberties Union (ACLU), Planned Parenthood or the Clinton Foundation.
“The size and scope of the Arabella network of funds demonstrates far more ‘dark money’ exists on the left side of the political spectrum than has been previously admitted,” the report says.
Arabella’s website says the company was founded to “provide strategic guidance for effective philanthropy” and is “dedicated to helping clients make a difference on the issues that matter most to them, from climate to women and girls, education, good food, and more.” All told, the company represents clients with collective assets totaling more than $100 billion.
But the report alleges the group blurs the line between philanthropy and political advocacy on issues such as ObamaCare, gun control, abortion and opposition to the confirmation of now-Supreme Court Justice Brett Kavanaugh. And it says that due to the financial arrangements and lack of donor disclosure, “it is impossible to know which organization subsidizes the various campaigns and political movements spawned by Arabella’s funds.”
A January report from Issue One, a bipartisan advocacy group, shows that liberal groups spent over half of the $150 million of dark money in the latest election. Conservative groups spent a third of the figure, while nonpartisan groups spent just 15 percent.
And Sen. Sheldon Whitehouse, D-R.I., recently said that dark money is a problem "on both sides of the aisle," though he said it "occurs mostly on the Republican side."
The Capital Research Center report warns: “Before left-of-center activists and politicians demand laws to increase transparency in the funding of campaigns and public policy advocacy, they may first wish to consider voluntarily disclosing their own funding sources.”

The Brexit Party, which only officially launched last weekend has already surged past the two main legacy parties in a new poll and is now rated as the lead party in voting intentions for the May European Union elections.
The new poll by major UK pollsters YouGov shows Nigel Farage’s Brexit Party surging by 12 points in a week, from 15 per cent to 27 per cent as of yesterday, the most recent figures available.

Polling monitoring group Europe Elects notes that if the findings were replicated in the European Elections in May, the outcome for the Conservative party would be their worst in history for a UK national election, going back to the foundation of the party in 1834.
Polls on British politics and particularly on the subject of Brexit must be taken with a pinch of salt --- pollsters failed to predict the outcome of the 2016 referendum on leaving the European Union, for instance — and the latest figures from YouGov represent a massive shift. Breitbart London reported this week on another recent poll from the weekend by Opinium which put the Brexit Party on 12 per cent.
The results nevertheless bear out predictions that the establishment parties are set to perform poorly in the European Elections if they do indeed go ahead. Anon, here is where the key issue is. America was founded as a white nation. White men (those of various European heritage) are who created the USA. For whites, by whites, if you will. Race, or common ancestry, if you prefer, has always been part of the definition of a nation. If you've heard the expression "blood & soil", that's what that means. If literally anyone can be an American, then being an American means nothing, or next to nothing.
"Blood & soil" has been replaced with "muh magic paper (the constitution) & muh magic dirt (as long as you can cross the finish line -the border- you're magically an american)". Imagine if 50% of Japan was inhabited by blacks. Or if there is a certain race of people that you don't like, insert them into the population instead. If half of Japan is not Japanese, is it really Japan anymore? What Trump & Q advocate is for civic nationalism, as opposed to the traditional racial nationalism. It can work, but racial tensions will always be present simply because we are different. The blacks know, or at least they used to know at one time that America did not represent them.
Much the same way as the modern result from racial integration in sports. Let's say you live in a city that is 95% white. Everyone is like you for the most part. But your basketball/football team is 95% black. Is that team an accurate representation of your city? Is it really? Sure you may cheer for them to win games, but they're not your team - not really. Civic nationalism is a strange thing. It's not something that happens on it's own. Several aspects of the Constitution itself had to be chipped away and eroded to make it possible. It's a bit like Frankensteins monster. It's a patchwork without a true soul. It's an abomination of sorts, but it is alive. Trump wants to remove the forces tgat have been picking at the seams trying to agitate the different pieces. It is a large order to fill, and a commendable action to take. New Jeffrey Epstein Accuser Steps Forward In Defamation Case Against Alan Dershowitz
Another woman has come forward to accuse 'billionaire pedophile' Jeffrey Epstein and his companion, Ghislaine Maxwell, of molesting her and her then-15-year-old sister in 1996 at the Ohio mansion of billionaire "Limited Brands" CEO Les Wexner, according to court documents cited by the Miami Herald.
The woman, Maria Farmer, says she was employed by Epstein in his Upper East Side New York mansion, where she frequently saw "school-age girls" wearing uniforms enter the residence and go upstairs. According to her affidavit, she was told the girls were auditioning for modeling work.
And who else did Farmer see going upstairs according to her affidavit? Epstein pal and attorney Alan Dershowitz, who has been accused of sexually assaulting Virginia Roberts Giuffre - an Epstein victim who is suing Dershowitz for defamation after she came forward with her claims.
Dershowitz claims he was never in Epstein's mansion at the same time as underage girls, but Farmer said that's not true, according to her affidavit in support of Giuffre's case.
Dershowitz has said that he has never seen any underage girls when he visited Epstein at the financier’s various homes in Palm Beach, New Mexico and New York. But Farmer, who now lives in Kentucky, claims that one of her duties working for Epstein was to staff the front door to his New York estate and to keep track of visitors.
“On a number of occasions I witnessed Dershowitz at the NY mansion going upstairs at the same time there were young girls under the age of 18 who were present upstairs in the house,’’ she said, asserting that Dershowitz was so comfortable he would walk into the mansion and go directly upstairs.

Giuffre claims in the lawsuit that Dershowitz, 80, knew about and participated in Epstein and Maxwell’s sex trafficking operation, and that she was forced to have sex with Dershowitz and other prominent, wealthy men, when she was underage.
Dershowitz has railed against the allegations for years, maintaining that he has never met Giuffre. He also says he has documents and other evidence that prove she is lying. -Miami Herald
Of note, Farmer does not say she ever saw Dershowitz with any young girls - however at least one witness, former house manager Alfredo Rodriguez, says he saw young girls in Dershowitz's presence at Epstein's Palm Beach mansion. Rodriguez was prosecuted by the FBI after he tried to sell Epstein's "black book" of friends, business associates, celebrity guests and female masseuses for $50,000. Rodriguez was fired by Epstein in 2005 and died in prison after his prosecution.

A third member of the Loughlin family - the most familiar faces in the recent college admissions scam - is now facing a criminal investigation, according to The Daily Mail. A daughter of Full House star Lori Loughlin, who recently plead not guilty to charges in "the largest ever college admissions scandal" is now the focus of a Department of Justice probe as to her involvement in the case.
Multiple sources have said that the actress’ daughter was on the receiving end of a letter from federal prosecutors in Massachusetts earlier this month regarding the investigation. The letter said that Loughlin's daughter was the subject of an investigation that could result in criminal charges.
One person who saw the letter said: "It is a not-so-veiled threat. [The US Attorney's Office for the District of Massachusetts] is making it pretty clear that they have evidence that very strongly suggests she knew of the illegal plot."
The tone of the letter was described as "ominous". A source said that these letters are an indication that prosecutors are working to obtain evidence and possibly pursue additional charges and defendants.
Another source interpreted the letter as clear telegraphing of more charges to come: "It is clear that some students are going to be charged."
Sources said that five additional people whose children received letters all refused a plea deal and filed a plea of not guilty, as Loughlin and her husband have done. Loughlin's daughters, as part of the scam, pretended they had previously been on crew teams in order to gain preferential treatment as potential athletic recruits. To sell that idea, they posed for photos on ergometers, offering the suggestion that they were aware and willing participants in their parents' plan. Loughlin daughter Olivia also reportedly had scam ringleader William Rick Singer's team fill out her college applications for her.
'On or about December 12, 2017, Loughlin e-mailed [Singer], copying Giannulli and their younger daughter [Olivia], to request guidance on how to complete the formal USC application, in the wake of her daughter’s provisional acceptance as a recruited athlete,' states the complaint.
'Loughlin wrote: "[Our younger daughter] has not submitted all her colleges [sic] apps and is confused on how to do so. I want to make sure she gets those in as I don’t want to call any attention to [her] with our little friend at [her high school]. Can you tell us how to proceed?"'
In response, Singer wrote an email 'directing an employee to submit the applications on behalf of the Giannullis’ younger daughter [Olivia].
Loughlin and Giannulli 'agreed to pay bribes totaling $500,000 in exchange for having their two daughters designated as recruits to the USC crew team - despite the fact that they did not participate in crew - thereby facilitating their admission to USC,' according to the documents.

Deutsche Bank faces action over $20bn Russian money-laundering scheme
Germany’s troubled Deutsche Bank faces fines, legal action and the possible prosecution of “senior management” because of its role in a $20bn Russian money-laundering scheme, a confidential internal report seen by the Guardian says.
The bank admits there is a high risk that regulators in the US and UK will take “significant disciplinary action” against it. Deutsche concedes that the scandal has hurt its “global brand” -- and is likely to cause “client attrition”, loss of investor confidence and a decline in its market value.
Deutsche Bank was embroiled in a vast money-laundering operation, dubbed the Global Laundromat. Russian criminals with links to the Kremlin, the old KGB and its main successor, the FSB, used the scheme between 2010 and 2014 to move money into the western financial system. The cash involved could total $80bn, detectives believe.
Shell companies typically based in the UK “loaned” money to each other. Companies then defaulted on this large fictitious debt. Corrupt judges in Moldova authenticated the debt -- with billions transferred to Moldova and the Baltics via a bank in Latvia.
Deutsche Bank was used to launder the money via its corresponding banking network -- effectively allowing illegal Russian payments to be funnelled to the US, the European Union and Asia.
The bank was entirely unaware of the scam until the Guardian and Organised Crime and Corruption Reporting Project (OCCRP) broke the story in March 2017, the report says. The first it knew was an email from the Guardian and Germany’s Süddeutsche Zeitung newspaper asking for comment.
“Only with this intelligence received is it now possible for Deutsche Bank to start global investigations,” it notes.
In the embarrassing aftermath, the bank asked two in-house financial crime investigators -- Philippe Vollot and Hinrich Völcker – to find out what had gone wrong. Their nine-page presentation was shared last year with the audit committee of the bank’s supervisory board and is marked “strictly confidential”.
The pair identified numerous “high-risk entities”. They included 1,244 in the US, 329 in the UK and 950 in Germany. These entities were responsible for nearly 700,000 transactions, the report says, involving at least £62m in the UK, $47m in the US, and €55m in Germany.
As part of its investigation, Deutsche Bank sent 149 “suspicious activity reports” to the National Crime Agency in London. Similar disclosures of potential money-laundering transactions were made to authorities in the US and elsewhere -- with 30 private and corporate Deutsche Bank clients reported. Some may have been “unknowingly used”, the report says.
The affair is a further blow to Deutsche Banks’s ailing reputation. It comes amid police raids on its Frankfurt HQ over the Panama Papers, a plunging share price and talks over a possible merger with Germany’s Commerzbank. The raid last November came after German prosecutors alleged two bank employees helped clients launder money via offshore firms.

The time of this broadcast shows as 20:48:02 (also on th tv screen).
I have not been able to find any RTVE video currently online that comes from that time period on the evening of the fire, but I’m phonefagging so maybe someone else (an anon español?!) can verify whether or not RTVE keeps archived editions of their 24 broadcasting?

Spain returns stolen material to North Korean embassy in Madrid
Authorities in Spain have returned material that was stolen from the embassy of North Korea in Madrid by a group of raiders in February, according to a source that spoke to the Reuters news agency. The unprecedented attack took place in the afternoon of February 22 in a quiet neighborhood of northern Madrid, where the North Korean embassy is located. Ten assailants, all Asian-looking men, entered the three-story building from the main gate, brandishing guns, which were later found to be fake. They tied up and gagged the embassy’s staff and some visitors to the embassy. After several hours spent inside the buildings, the assailants abandoned the building in two embassy vehicles that were later found abandoned.
A few weeks following the raid, a North Korean dissident group calling itself Cheollima Civil Defense ---also known as Free Joseon— claimed responsibility for the attack. Cheollima Civil Defense is North Korea’s first known active resistance group. Its members call for the overthrow of the Kim dynasty. Subsequent reports said that some of those who took part in the embassy raided fled to the United States and approached the Federal Bureau of Investigation (FBI) with an offer to hand over computer hardware and telephones captured in the attack. On Tuesday, the Reuters news agency reported that the FBI “returned the material [to Spanish authorities] two weeks ago”, and that Spanish police handed it over to the North Koreans. Citing “a Spanish judicial source”, Reuters said that American authorities returned the material directly to the Spanish court that is investigating the raid.
According to the news agency, Spanish authorities returned the material to the North Korean embassy without reviewing its contents, thus complying with the norms of diplomatic protocol. Data and items belonging to foreign embassies are usually off-limits to the authorities of host nations. The report did not clarify whether the FBI returned all the material that was stolen by the raiders in February, nor did it state whether the FBI reviewed its contents prior to handing it over to the Spanish court.

In Senate testimony last week, Attorney General William Barr used the word “spying” to refer to the Obama administration, um, spying on the Trump campaign. Of course, fainting spells ensued, with the media-Democrat complex in meltdown. Former FBI Director Jim Comey tut-tutted that he was confused by Barr’s comments, since the FBI’s “surveillance” had been authorized by a court.
(Needless to say, the former director neglected to mention that the court was not informed that the bureau’s “evidence” for the warrants was unverified hearsay paid for by the Clinton campaign.)
The pearl-clutching was predictable. Less than a year ago, we learned the Obama administration had used a confidential informant --- a spy — to approach at least three Trump campaign officials in the months leading up to the 2016 election, straining to find proof that the campaign was complicit in the Kremlin’s hacking of Democratic emails.
As night follows day, we were treated to the same Beltway hysteria we got this week: Silly semantic carping over the word “spying” --- which, regardless of whether a judge authorizes it, is merely the covert gathering of intelligence about a suspected wrongdoer, organization or foreign power.
There is no doubt that the Obama administration spied on the Trump campaign. As Barr made clear, the real question is: What predicated the spying? Was there a valid reason for it, strong enough to overcome our norm against political spying? Or was it done rashly? Was a politically motivated decision made to use highly intrusive investigative tactics when a more measured response would have sufficed, such as a “defensive briefing” that would have warned the Trump campaign of possible Russian infiltration?
Last year, when the “spy” games got underway, James Clapper, Obama’s director of national intelligence, conceded that, yes, the FBI did run an informant --- “spy” is such an icky word — at Trump campaign officials; but, we were told, this was merely to investigate Russia. Cross Clapper’s heart, it had nothing to do with the Trump campaign. No, no, no. Indeed, the Obama administration only used an informant because — bet you didn’t know this — doing so is the most benign, least intrusive mode of conducting an investigation.
Me? I’m thinking the tens of thousands of convicts serving lengthy sentences due to the penetration of their schemes by informants would beg to differ. (Gee, Mr. Gambino, I assure you, this was just for you own good . . .) And imagine the Democrats’ response if, say, the Bush administration had run a covert intelligence operative against Obama 2008 campaign officials, including the campaign’s co-chairman. Surely David Axelrod, Chuck Schumer, The New York Times and Rachel Maddow would chirp that “all is forgiven” once they heard Republicans punctiliously parse the nuances between “spying” and “surveillance”; between “spies” and “informants”; and between investigating campaign officials versus investigating the campaign proper --- and the candidate.
The “spying” question arose last spring, when we learned that Stefan Halper, a longtime source for the CIA and British intelligence, had been tasked during the FBI’s Russia investigation to chat up three Trump campaign advisers: Carter Page, George Papadopoulos and Sam Clovis. This was in addition to earlier revelations that the Obama Justice Department and FBI had obtained warrants to eavesdrop on Page’s communications, beginning about three weeks before the 2016 election.
The fact that spying had occurred was too clear for credible denial. The retort, then, was misdirection: There had been no spying on Donald Trump or his campaign; just on a few potential bad actors in the campaign’s orbit.
It was nonsense then, and it is nonsense now.
The pols making these claims about what the FBI was doing might have been well served by listening to what the FBI said it was doing.

There was, for example, then-Director Comey’s breathtaking public testimony before the House Intelligence Committee on March 20, 2017. Comey did not just confirm the existence of a counterintelligence probe of Russian espionage to influence the 2016 election --- notwithstanding that the government customarily refuses to confirm the existence of any investigation, let alone a classified counterintelligence investigation. The director further identified the Trump campaign as a subject of the probe, even though, to avoid smearing people, the Justice Department never identifies uncharged persons or organizations that are under investigation. “I have been authorized by the Department of Justice to confirm that the FBI, as part of our counterintelligence mission, is investigating the Russian government’s efforts to interfere in the 2016 presidential election and that includes investigating the nature of any links between individuals associated with the Trump campaign and the Russian government and whether there was any coordination between the campaign and Russia’s efforts . . .”
The FBI was spying, and it was doing so in an investigation of the Trump campaign. That is why, for over two years, Washington has been entranced by the specter of “Trump collusion with Russia” --- not Page or Papadopoulos collusion with Russia. Comey went to extraordinary lengths to tell the world that the FBI was not merely zeroing in on individuals of varying ranks in the campaign; the main question was whether the Trump campaign itself — the entity — had “coordinated” in Russia’s espionage operation.
In the months prior to the election, as its Trump-Russia investigation ensued, some of the overtly political, rabidly anti-Trump FBI agents running the probe discussed among themselves the prospect of stopping Trump, or of using the investigation as an “insurance policy” in the highly unlikely event that Trump won the election. After Trump’s stunning victory, the Obama administration had a dilemma: How could the investigation be maintained if Trump were told about it? After all, as president, he would have the power to shut it down.
On Jan. 6, 2017, Comey, Clapper, CIA Director John Brennan and National Security Agency chief Michael Rogers visited President-elect Trump in New York to brief him on the Russia investigation.
Just one day earlier, at the White House, Comey and then--Acting Attorney General Sally Yates had met with the political leadership of the Obama administration --- President Obama, Vice President Joe Biden and national security adviser Susan Rice — to discuss withholding information about the Russia investigation from the incoming Trump administration.
Rice put this sleight-of-hand a bit more delicately in the memo about the Oval Office meeting (written two weeks after the fact, as Rice was leaving her office minutes after Trump’s inauguration):
“President Obama said he wants to be sure that, as we engage with the incoming team, we are mindful to ascertain if there is any reason that we cannot share information fully as it relates to Russia.”
It is easy to understand why Obama officials needed to discuss withholding information from Trump. They knew that the Trump campaign --- not just some individuals tangentially connected to the campaign — was the subject of an ongoing FBI counterintelligence probe. An informant had been run at campaign officials. The FISA surveillance of Page was underway — in fact, right before Trump’s inauguration, the Obama administration obtained a new court warrant for 90 more days of spying.
In each Page surveillance warrant application, after describing Russia’s espionage operations, the Justice Department told the court, “The FBI believes that the Russian Government’s efforts are being coordinated with Candidate #1’s campaign[.]” Candidate #1 was Donald Trump --- now, the president-elect.
The fact that the Trump campaign was under investigation for collaborating with Russia was not just withheld from the incoming president; it had been withheld from the congressional “Gang of Eight.”
In his March 2017 House testimony, answering questions by Rep. Elise Stefanik (R-NY), then-director Comey acknowledged that congressional leadership was not told about the Trump-Russia probe during quarterly briefings from July 2016 through early March 2017, because “it was a matter of such sensitivity.” Let’s put aside that the need to alert Congress to sensitive matters is exactly why there is a Gang of Eight (comprised of bipartisan leaders of both chambers and their intelligence committees).
Manifestly, the matter was deemed too “sensitive” for disclosure because that would have involved telling Republican congressional leadership that the incumbent Democratic administration was using foreign counterintelligence powers to investigate the Republican presidential campaign, and the party’s nominee, as suspected clandestine agents of the Kremlin.

This would not have been a credible assurance if Comey had informed Trump that (a) his campaign had been under investigation for months, and (b) the FBI had told a federal court it suspected Trump campaign officials were complicit in Russia’s cyber-espionage operation.
So, consistent with President Obama’s instructions at the Jan. 5, 2017, Oval Office meeting, information about the investigation would be withheld from the president-elect. The next day, the intelligence chiefs would tell Trump only about Russia’s espionage, not about the Trump campaign’s suspected “coordination” with the Kremlin. Then, Comey would apprise Trump about only a sliver of the Steele dossier --- just the lurid story about peeing prostitutes, not the dossier’s principal allegations of a traitorous Trump-Russia conspiracy.
This strategy did not sit well with everyone at the FBI. Shortly before meeting with Trump on Jan. 6, Comey consulted his top advisers about the plan to tell Trump he was not a suspect. In later Senate testimony, Comey admitted that there was an objection from one FBI official:
“One of the members of the leadership team had a view that, although it was technically true [that] we did not have a counterintelligence file case open on then-President-elect Trump[,] . . . because we’re looking at the potential . . . coordination between the campaign and Russia, because it was . . . President-elect Trump’s campaign, this person’s view was, inevitably, [Trump’s] behavior, [Trump’s] conduct will fall within the scope of that work.”
Note that Comey did not refer to “potential coordination” between, say, Carter Page or Paul Manafort and Russia. The director was unambiguous: The FBI was investigating “potential coordination between the Trump campaign and Russia.”
Perspicaciously, Comey’s unidentified adviser connected the dots: (a) because the FBI’s investigation focused on the campaign, and (b) since the campaign was Trump’s campaign, it was necessarily true that (c) Trump’s own conduct was under FBI scrutiny.
Then-director Comey’s reliance on the trivial administrative fact that the FBI had not written Trump’s name on the investigative file did not change the reality that Trump, manifestly, was the main subject of the “Crossfire Hurricane” investigation.
Remember last year’s hullabaloo over special counsel Robert Mueller’s demand to interview the president? What need would there have been to conduct such an interview if Trump were not a subject of the investigation? Why would Trump’s political opponents have spent the last two years demanding that Mueller be permitted to complete his probe of collusion and obstruction if it were not understood that the investigation --- including the spying, or, if you prefer, the electronic surveillance, the informant sorties, and the information gathered by national-security letter demands — was centrally about Donald Trump?
That brings us to a final point. Congressional investigations have established that the Obama Justice Department and the FBI used the Steele dossier to obtain FISA court warrants against Page.
The dossier, a Clinton campaign opposition research project (again, a fact withheld from the FISA court), was essential to the required probable-cause showing; the FBI’s former deputy director, Andrew McCabe, testified that without the dossier there would have been no warrant.
So . . . what did the dossier say? The lion’s share of it alleged that the Trump campaign was conspiring with the Kremlin to corrupt the election, including by hacking and publicizing Democratic Party e-mails. This allegation was based on unidentified Russian sources whom the FBI could not corroborate; then-director Comey told Senate leaders that the FBI used the information because the bureau judged former British spy Christopher Steele to be credible, even though (a) Steele did not make any of the observations the court was being asked to rely on, and (b) Steele had misled the FBI about his contacts with the media --- with whom Steele and his Clinton campaign allies were sharing the same information he was giving the bureau.
It is a major investigative step to seek surveillance warrants from the FISA court. Unlike using an informant (a human spy), for which no court authorization is necessary, applications for FISA surveillance require approvals at the highest levels of the Justice Department and the FBI. After going through that elaborate process, the Obama Justice Department and the FBI presented to the court the dossier’s allegations that the Trump campaign was coordinating with Russia to undermine the 2016 election.

To be sure, no sensible person argues that the government should refrain from investigating if, based on compelling evidence, the FBI suspects individuals --- even campaign officials, even a party’s nominee — of acting as clandestine agents of a hostile foreign power. If all the Obama administration had been trying to do was check out a few bad apples with suspicious Russia ties, the FBI could easily have alerted any of a number of Trump campaign officials with solid national-security credentials --- Rudy Giuliani, Jeff Sessions, Chris Christie. The agents could have asked for the campaign’s help. Instead, Obama officials made the Trump campaign the subject of a counterintelligence investigation.
That only makes sense if the Obama administration’s premise was that Donald Trump himself was a Russian agent.
Note the emphasis Mr. McCarthy is putting on OBAMA. Make no mistake, President Obama had his hands all over this attempted coup of a duly elected President of the United States. The reasons for that are likely many, but perhaps a foundational reason is this---Barack Obama has never considered himself to be one required to follow U.S. law. He has always been inclined to see himself as a person of the world, not of a single nation and a single nation’s laws. Some have argued he is openly defiant of said laws, thinking them a byproduct of a deeply flawed America of which he has little if any loyalty toward. Donald Trump’s “America First” agenda is the antithesis of Obama’s “America Bad” world view and he could not abide seeing his legacy of relegating the United States to secondary world status overtaken by an outsider who was not beholden to the rules of the elite political class in D.C.
And so, Mr. Obama once again weaponized the federal government in an attempt to destroy a political opponent. The fact this was a shocking violation of the law meant little because all of America’s laws mean so little to the now former president.

Barr Clamps Down On 'Catch And Release' With Indefinite Detention For Some Apprehended Migrants
US Attorney General William Barr on Tuesday struck down a decision allowing some asylum seekers to request release on bond in front of an immigration judge - a decision that expands 'indefinite detention' for migrants, some of whom must wait months or years for their cases to be heard.
Last month, Imimgration and Customs Enforcement (ICE) said the average daily population of immigrants in detention topped 46,000 for the 2019 fiscal year - the highest level since the agency was created in 2003.
Even that figure likely understates the backlog because it doesn’t include the impact of the 35-day government shutdown in December and January. Because the system’s roughly 400 immigration judges were furloughed during the shutdown, some 60,000 hearings were canceled. Thousands were rescheduled, adding to the already long wait times.
The administration “has not only failed to reduce the backlog, but has eroded the court’s ability to ensure due process” by pressuring judges to rule “at a breakneck pace” on whether an immigrant should be removed from the United States, the American Immigration Lawyers Assn. --- a nonprofit organization of more than 15,000 immigration attorneys and law professors — said in a statement. -LA Times
Barr's decision applies to migrants who have illegally entered the United States as well as those apprehended within the country, according to Reuters.
"I conclude that such aliens remain ineligible for bond, whether they are arriving at the border or are apprehended in the United States," wrote Barr, who added that such people can be held in immigration detention until their cases are eventually heard, or the Department of Homeland Security decides to release them by granting them "parole."
Barr is delaying the effective date of the ruling by 90 days "so that DHS may conduct the necessary operational planning for additional detention and parole decisions."
According to law professor Steve Vladeck of the University of Texas, the full impact of the decision is not yet clear because it will depend on DHS' ability to expand detention capabilities.
"The number of asylum seekers who will remain in potentially indefinite detention pending disposition of their cases will be almost entirely a question of DHS’s detention capacity, and not whether the individual circumstances of individual cases warrant release or detention," said Vladeck.
