Trump will allow Americans to sue companies in Cuba

President Trump will allow U.S. citizens to sue companies doing business in Cuba, according to a senior administration official, in his latest move to ramp up pressure on the communist island nation.

National security adviser John Bolton is expected to announce on Wednesday that Trump will enforce a provision of the 1996 Helms-Burton Act that allows Americans to file lawsuits against companies that benefited from the seizure of U.S. property after the 1959 Cuban revolution.

The decision upends more than two decades of U.S. policy and could inflame tensions with allies who do business in Cuba.

Former Presidents Bill Clinton, George W. Bush and Barack Obama waived the provision out of concern that a flurry of lawsuits against European and other companies could trigger a diplomatic crisis.

The State Department telegraphed the move last month when it stopped the waivers on a short-term basis.

Bolton is scheduled to speak in Miami about the Trump administration’s efforts to counter Venezuela, Nicaragua and Cuba, a group he has labeled the “troika of tyranny.” He will address the Bay of Pigs Veterans Association on the anniversary of the CIA’s failed 1961 effort to overthrow Fidel Castro.

The administration has recently taken a number of actions to increase pressure on the countries, including new sanctions against companies transporting oil from Venezuela to Cuba. The penalties are meant to punish Cuba for its support of Venezuelan leader Nicolás Maduro, whom the U.S. and other nations say is illegitimately holding onto power.

Trump has also sought to undercut Obama’s historic rapprochement with Cuba, which ended the U.S.’s Cold War-era policy of isolating Havana.

He recently scrapped a deal allowing Cuban baseball players to sign directly with Major League Baseball teams without having to defect. The administration also pulled the vast majority of U.S. embassy staff from Havana, citing sonic attacks.

The administration in 2017 considered severing all diplomatic relations with Cuba, before settling on a series of actions that tightened trade and travel rules restrictions that were loosened by Obama, according to documents obtained by The Hill.

The White House has reportedly denied a records request by House Democrats involving the AT&T-Time Warner merger.

In a letter to Judiciary Chairman Jerry Nadler (D-N.Y.) and antitrust subcommittee Chairman David Cicilline (D-R.I.) sent Monday, White House counsel Pat Cipollone appeared to claim executive privilege, calling the documents “protected communications.” The requests came after a New Yorker report that President Trump directed aides to pressure the DOJ to try and spike the merger.

Lawmakers had requested the documents to be provided by late March.

A leading authorities on online data privacy has warned new EU copyright regulations will give US tech firms money and data from hobbled European rivals.

Yesterday the EU has adopted copyright reforms championed by the media despite opposition from Google and campaigners saying it restricts internet freedom.

The reform, which got final approval from the European Council on Monday, was loudly backed by news publishers and artists who want protection over their content being shared.

But German Data Privacy Commissioner Ulrich Kelber, who is also a computer scientist, warned before the measure passed that its Article 13 will exacerbate the problem of market concentration in the tech sector, and expose Europeans to particular risk of online surveillance and manipulation.

Article 13 requires that online communities, platforms, and services prevent their users from committing copyright infringement, rather than ensuring that infringing materials are speedily removed.

In an official statement on the Directive, Kelber warned it would lead to the use of automated filters, which would be powered by the industry's largest firms, since they have the resources to build and run the software.

Judicial Watch Sues FBI For Records of Communications and Payments to Dossier Author Christopher Steele

Conservative watchdog group Judicial Watch filed a lawsuit against the FBI on Tuesday for records of communications and payments to dossier author Christopher Steele.

Judicial Watch filed the lawsuit after the FBI failed to respond to a September 27, 2018, FOIA request (Judicial Watch v. U.S. Department of Justice (No. 1:19-cv-00572)).

Judicial Watch is seeking:

All records of communications between any official, employee, or representative of the FBI and Mr. Christopher Steele, a former British intelligence officer and the owner of the private firm Orbis Business Intelligence.

All records related to the proposed, planned, or actual payment of any funds to Mr. Steele and/or Orbis Business Intelligence

All records produced in preparation for, during, or pursuant to any meetings or telephonic conversations between any official, employee, or representative of the Federal Bureau of Investigation and Mr. Christopher Steele and/or any employee or representative of Orbis Business Intelligence

The time frame for Judicial Watch’s request is March 9, 2017 to September 27, 2018.

Former British spy Christopher Steele was paid by Hillary Clinton and the DNC [through law firm Perkins Coie and oppo research firm Fusion GPS] to compile a 35-page Russia dossier to smear Donald Trump.

The dossier, which still has not been verified was then used by Obama’s FBI and DOJ to obtain a FISA warrant and three subsequent renewals to spy on Trump campaign advisor Carter Page.

The FBI also paid Steele to be a “confidential human source” [CHS] prior to firing him as a source on November 1st, 2016 after he disclosed his relationship to the FBI to reporters.

Documents previously obtained by Judicial Watch revealed the FBI made a total of 11 payments to Christopher Steele, however, the docs were almost completely redacted.

Other heavily redacted documents recently obtained by Judicial Watch revealed that twice-demoted DOJ official Bruce Ohr acted as a backchannel for Steele to the FBI after the bureau terminated its relationship with Steele.

“How and why did the FBI pay Christopher Steele, who was already being funded by the Clinton campaign and DNC through Fusion GPS?” said Judicial Watch President Tom Fitton. “That we had to sue for this basic information shows the FBI may have something more to hide.”

Three New Jersey men have been arrested and charged with running a counterfeit drug storefront on the dark web that sold hundreds of thousands of narcotic pills nationwide in exchange for cryptocurrency, according to Manhattan District Attorney Cyrus Vance’s office.

The investigation targeted an operation advertising itself as “Sinmed” on the dark web, or darknet – an encrypted portion of the internet that is only accessible using anonymity-providing cyber tools like the Tor Browser.

Investigators seized nearly a half-million pills, the largest ever seizure of pills in the state of New Jersey, according to Vance’s office.

“Not only is this the first time state prosecutors in New York have taken down a dark web storefront, this takedown represents the largest pill seizure in New Jersey’s history,” Vance said in a press release on Tuesday. “If you are engaging in illicit activity on the dark web, you are on notice: we know how to find you, we know how to put you out of business, and we know how to hold you criminally accountable.”

Vance’s office was tipped in 2017 to noticeably large ATM withdrawals in Manhattan and across the river in New Jersey and began tracking a trio of men allegedly involved in the scheme.

Saudi Arabia, Israel, US All Sought Bashir’s Ouster: So How Real Was the Sudan Revolution?

Last week’s events in Sudan appear to be yet another example of foreign governments manipulating real dissent against an authoritarian government in order to install yet another authoritarian government more friendly to their interests but to the detriment of the people.

KHARTOUM, SUDAN — Last Thursday, the decades-long rule of Sudan’s president Omar al-Bashir came to an end, as the country’s long-time leader was ousted in a military coup that followed months of protests against his rule, which began in 1989. Bashir’s overthrow was widely hailed in the U.S. as a “revolution” brought on by a people-powered movement, in which women played a prominent role. Indeed, the symbol of this recent “revolution” has become 22-year-old student Alaa Salah, after a picture of her speaking to a crowd went viral last Tuesday, with some in international media dubbing her “Sudan’s statue of liberty.”

Given the intense news cycle that occurred last week — from Israel’s elections, to the Trump administration’s troubling declaration aimed at Iran’s military, to the recent arrest of Julian Assange in Ecuador’s London embassy — little international attention was paid to last week’s military coup in Sudan. For many, last week’s events seem simply the logical conclusion of months of protests aimed first at rising food prices and subsequently at Bashir’s nearly thirty-year rule. Yet, the reality of what has recently transpired in Sudan could not be further from that assumption.

While Bashir’s lengthy rule over Sudan has been filled with many despotic, authoritarian actions and state-sponsored violence over the years, and while many Sudanese citizens were likely all-too-eager for a change in government, powerful forces — the United States among them — had long sought Bashir’s ouster for other reasons, much of their motive linked to the country’s oil reserves.

Though the planned “quick and graceful” exit of Bashir did not materialize as planned, the Obama administration notably played an outsized role in partitioning Sudan into Sudan and South Sudan in 2011, a decision that resulted in Sudan’s government losing access to 80 percent of its oil resources as well as in the brutal civil war still raging within South Sudan. The partition undeniably weakened Sudan’s economy and government, the effects of which are still very much felt today.

A major motivator in the U.S.’ efforts to partition Sudan into two countries was the prospect of gaining a foothold in its oil sector, which China had come to dominate. Yet, China’s dominance in Sudan and South Sudan’s oil economy remains unchallenged to date.

Notably, while the U.S. has had difficulty making inroads in South Sudan’s oil sector, Israel quickly forged ties with South Sudan’s government soon after its creation and signed a major oil deal with its government in 2013. Media reports on the deal claimed that Israel’s growing ties with South Sudan were aimed at weakening the Bashir-led government in Sudan. The same year this oil deal was signed, the U.S., Israel, Saudi Arabia, and Qatar were accused of orchestrating a “color revolution” against Bashir that failed to secure his removal from power.

Since then, U.S. involvement in efforts targeting Bashir’s rule have been mostly covert and achieved through “soft power” organizations aimed at “democracy promotion,” such as the U.S. Agency for International Development (USAID) and the National Endowment for Democracy NED).

For the last several years, Dershowitz has faced allegations that his best buddy and ultimate “Florida Man” Jeffrey Epstein — a billionaire who used his wealth to lure underaged girls into a sex trafficking operation — loaned out his victims to have sex with Dershowitz.

Boies Schiller, in papers signed by Sigrid McCawley, with assistance from Meredith Schultz, has now sued Dershowitz for defamation on behalf of Virginia (Roberts) Guiffre. Dershowitz has publicly called Guiffre a liar and extortionist based on the Epstein victim’s claim that Dershowitz had sex with her as part of Epstein’s scheme.

This isn’t the first time Dershowitz has tangled with Boies over the Epstein matter. Boies has worked with Guiffre and another victim, Sarah Ransome, since 2014. Combined with the work the firm did with Legal Momentum contributing to the shutdown of Backpage for facilitating trafficking and exploitation, work on behalf of victims of sex trafficking and sex abuse has been one of Boies Schiller’s largest pro bono commitments.

Ransome previously sued Dershowitz for defamation for calling her a liar for claiming that Epstein directed her to have sex with Dershowitz while she was a minor. In that case, Dershowitz claimed that Boies was the “perpetrator” of a scheme to discredit him. That case settled on confidential terms. According to the present complaint, what that settlement did not include was any statement that the victims were even potentially mistaken in identifying Dershowitz despite the professor’s entreaties to include such a claim.

With Epstein back in the news following Alex Acosta’s elevation to Trump’s Labor Secretary — renewing focus on Acosta’s sweetheart deal for Epstein and the court’s February ruling that it was a “material omission” for Acosta and his office to mislead the victims about the nature of the deal — Dershowitz is back in the press denouncing the women who’ve identified him and, in a case of “be careful what you wish for,” earning himself a defamation suit.

Some ATL readers may remember when former federal district judge Paul Cassell and Bradley Edwards raised the prospect of Dershowitz’s involvement in Epstein’s criminality years ago as part of a Crime Victims’ Rights Act petition on the part of young women that Acosta never bothered to consult when he gave Epstein a Non-Pros for the myriad more serious charges he faced. In pursuing that petition, Judge Cassell and Edwards ultimately sued Dershowitz for defamation as the professor blasted them in the media. After the deposition where he blasted the claims as a billion-dollar extortion scheme, he settled on confidential terms. He claims, not unlike his television hero Donald Trump, that this settlement exonerated him. Judge Cassell and Edwards disagree:

he has been making public statements suggesting that he has prevailed in the lawsuit and that the terms of the settlement exonerate him of any wrongdoing. Those statements are at best misleading. It is a mistake for anyone to conclude based upon Mr. Dershowitz’s statements that the case against him was abandoned due to lack of factual support.

Undeterred by public statements like this, Dershowitz has maintained his innocence and repeatedly branded the women who have tied him to Epstein’s scheme as liars and extortionists and demanded a trial to once and for all prove his innocence.

Trump May Regret His Fed Takeover Attempt

Some things are too important to leave to politicians. One such thing: the money supply. That’s why the Federal Reserve is an independent agency, at least in theory.

Presidents like this arrangement because it lets them disclaim responsibility when the Fed does something unpopular. But that only works if the president doesn’t even try to assert control. Trying to influence the Fed, as Trump is doing, has three possible outcomes—and two of them are bad for Trump. Either…

He fails to influence the Fed and makes himself look impotent, or

He succeeds in influencing the Fed and takes blame for its mistakes, or

He succeeds in influencing the Fed and the economy grows.

Other presidents have tried this, and it didn’t end well.

Not So Independent

Trump had the chance to make a quick impact by filling several Federal Reserve Board vacancies in his first two years. He didn’t seize that opportunity. That was unfortunate. The Fed needs broader representation. It shouldn’t be all bankers and economists. And that isn’t just my personal preference.

The Federal Reserve Act orders presidents to nominate Fed governors with “due regard to a fair representation of the financial, agricultural, industrial, and commercial interests, and geographical divisions of the country.”

Presidents of both parties have long ignored this law, and senators let them do it. Now bankers run the Fed, supported by PhD-holding economics professors. We have seen the results. I think some more diversity would make the Fed work better.

Trump seems to agree, but he has a different kind of diversity in mind. He wants to add Herman Cain and Stephen Moore to the Fed board. Either would certainly bring a new perspective, but not the kind the law requires.

Cain and Moore would not represent “agricultural, industrial, and commercial interests.” They would represent partisan political interests, and specifically those of President Trump.

Again, I don’t expect saint-like neutrality. Everyone has opinions. But the US has plenty of thoughtful, well-educated people who would do their best to consider the data and make good policy decisions.

Cain and Moore aren’t in that category. They’ve already decided what monetary policy they want. And (surprise!) it’s exactly what President Trump wants: lower interest rates.

Early life and career

Pinchuk was born in 1960 in Kiev to Jewish parents[3][4][5] who moved to the industrial city of Dnipropetrovsk. He graduated from Dnipropetrovsk Metallurgical Institute with a doctorate in industrial engineering in 1987.[6] Three years later, he founded the Interpipe Company on the basis of his patented innovations, which were adopted by leading metallurgical factories in the USSR.

Interpipe is a major producer of seamless pipes and railway wheels. In 2004, Pinchuk and Rinat Akhmetov, two of Ukraine's richest men, acquired the Kryvorizhstal steel factory for about $800 million.[7] President Leonid Kuchma, who is Pinchuk's father-in-law, authorized the state asset sale, which competitors complained was far below market rate.[8] Later, the first Tymoshenko government reversed this sale, and held a nationally-televised repeat auction that netted $4.8 billion.[7] In 2006, Pinchuk founded an investment advisory company, EastOne.[9] Its portfolio includes industrial assets such as production of pipes and tubes, rail car wheels, specialty steels and alloys, machinery, as well as media.

Pinchuk was a member of the Ukrainian Parliament between 1998 and 2006 for Labour Ukraine.[10][11] He left politics after he came to the conclusion that Ukraine had reached a level of development when business and politics should be separated.

Pinchuk is a member of the Board of the Peterson Institute for International Economics, of the International Advisory Council of Brookings Institution and of the Corporate Advisory Board of the Global Business Coalition against HIV/AIDS, TB and Malaria. Pinchuk holds a share of VS Energy International Ukraine together with Mikhail Spektor and Igor Kolomoisky.[12]

In 2013, American steel makers filed a case with the United States Department of Commerce alleging that Interpipe Group was illegally dumping steel tubes into the American natural gas market.[8] In November 2013, Fitch Ratings downgraded Interpipe because of the dumping accusations and a missed $106 million debt payment.[8]

In 2015, Pinchuk brought a $2 billion civil action against fellow Ukrainian oligarchs Ihor Kolomoyskyi and Gennadiy Bogolyubov in the High Court of Justice in London over the 2004 purchase of a Ukrainian mining company. Allegations made include murder and bribery.[13][14] In January 2016, an undisclosed out of court settlement was reached just before the trial was due to start.[15]

Philanthropy

Pinchuk has supported philanthropic projects in Ukraine. In 2006, he consolidated these activities under the Victor Pinchuk Foundation, which is now considered the largest private Ukrainian philanthropic foundation.[6] Its mission is to empower future generations to become the change makers of tomorrow; the foundation is active in the fields of health, education, culture, international affairs, human rights and local communities.[16][17]
