Why Privacy Matters Even if You Have 'Nothing to Hide'
When the government gathers or analyzes personal information, many people say they're not worried. "Only if you're doing something wrong should you worry, and then you don't deserve to keep it private."
The nothing-to-hide argument pervades discussions about privacy. In its most compelling form, it is an argument that the privacy interest is generally minimal, thus making the contest with security concerns a foreordained victory for security.
In Britain, for example, the government has installed millions of public-surveillance cameras in cities and towns, which are watched by officials via closed-circuit television. In a campaign slogan for the program, the government declares: "If you've got nothing to hide, you've got nothing to fear."
I encountered the nothing-to-hide argument so frequently in news interviews, discussions, and the like that I decided to probe the issue. I received a torrent of comments:
• My response is "So do you have curtains?" or "Can I see your credit-card bills for the last year?"
• So my response to the "If you have nothing to hide … " argument is simply, "I don't need to justify my position. You need to justify yours. Come back with a warrant."
• I don't have anything to hide. But I don't have anything I feel like showing you, either.
• If you have nothing to hide, then you don't have a life.
• Show me yours and I'll show you mine.
• It's not about having anything to hide, it's about things not being anyone else's business.
To describe the problems created by the collection and use of personal data, many commentators use a metaphor based on George Orwell's Nineteen Eighty-Four. Orwell depicted a harrowing totalitarian society ruled by a government called Big Brother that watches its citizens obsessively and demands strict discipline. The Orwell metaphor, which focuses on the harms of surveillance (such as inhibition and social control), might be apt to describe government monitoring of citizens.
By joining pieces of information we might not take pains to guard, the government can glean information about us that we might indeed wish to conceal. For example, suppose you bought a book about cancer. This purchase isn't very revealing on its own, for it indicates just an interest in the disease. Suppose you bought a wig. The purchase of a wig, by itself, could be for a number of reasons. But combine those two pieces of information, and now the inference can be made that you have cancer and are undergoing chemotherapy. That might be a fact you wouldn't mind sharing, but you'd certainly want to have the choice.
For example, suppose government officials learn that a person has bought a number of books on how to manufacture methamphetamine. That information makes them suspect that he's building a meth lab. What is missing from the records is the full story: The person is writing a novel about a character who makes meth. When he bought the books, he didn't consider how suspicious the purchase might appear to government officials, and his records didn't reveal the reason for the purchases. Should he have to worry about government scrutiny of all his purchases and actions? Should he have to be concerned that he'll wind up on a suspicious-persons list? Even if he isn't doing anything wrong, he may want to keep his records away from government officials who might make faulty inferences from them. He might not want to have to worry about how everything he does will be perceived by officials nervously monitoring for criminal activity. He might not want to have a computer flag him as suspicious because he has an unusual pattern of behavior.
Privacy is rarely lost in one fell swoop. It is usually eroded over time, little bits dissolving almost imperceptibly until we finally begin to notice how much is gone. When the government starts monitoring the phone numbers people call, many may shrug their shoulders and say, "Ah, it's just numbers, that's all." Then the government might start monitoring some phone calls. "It's just a few phone calls, nothing more." The government might install more video cameras in public places. "So what? Some more cameras watching in a few more places. No big deal." The increase in cameras might lead to a more elaborate network of video surveillance. Satellite surveillance might be added to help track people's movements. The government might start analyzing people's bank rec¬ords. "It's just my deposits and some of the bills I pay—no problem." The government may then start combing through credit-card records, then expand to Internet-service providers' records, health records, employment records, and more. Each step may seem incremental, but after a while, the government will be watching and knowing everything about us.

A week after House Intelligence Committee Chairman Devin Nunes told President Donald Trump that he had seen intelligence showing that his transition team was “incidentally” monitored, it was reported that Nunes’ sources for the intelligence were three White House staffers. One of them was Ezra Cohen-Watnick, a senior director for intelligence at the National Security Council. Over four months after the strange sequence of events with Nunes, National Security Advisor H.R. McMaster finally pushed Cohen-Watnick out of the NSC.
An official told CNN on August 2 that Cohen-Watcnick was reassigned to another job in the Trump administration.
McMaster “appreciates the good work” of Cohen-Watnick, but “has determined that, at this time, a different set of experiences is best-suited to carrying that work forward,” the official told CNN. “Gen. McMaster is confident that Ezra will make many further significant contributions to national security in another position in the administration.”
The New York Times reported that the 30-year-old Cohen-Watnick and Michael Ellis, a lawyer at the White House Cousel’s office who focuses on national security issues, were identified by current American officials as the sources for Nunes’ intelligence. The White House did not comment on the Times’ report.
The Times has reported that Cohen-Watnick first found the information while searching confidential reports after Trump accused President Barack Obama of wiretapping him before the 2016 election. Cohen-Watnick then notified Ellis, who then spoke with Nunes.
Shortly after the Times’ report, The Washington Post reported that there was a third person involved. According to their sources, Cohen-Watnick first gave the information he found to John Eisenberg, the top lawyer for the National Security Council.

1. Nunes Visited The White House Grounds Before March 22 to Meet His ‘Whistleblower-Style’ Source
On March 22, Nunes, who was a member of Trump’s transition team, surprised many in Washington by telling the press that he had new information that pertained to the investigation into Russia’s meddling in the 2016 presidential election. He then met with the President, then held a second press conference.
Nunes said that the information he saw showed that that members of the Trump Transition team showed up in intelligence reports. He said the surveillance looked legal because it was picked up during “incidental collection.” That’s what happens when the intelligence community monitors a foreign target, who happens to speak with an American. Nunes even said that Trump himself possibly showed up in the intelligence, but said that the communication was not related to the Russia investigations.
The California Congressman said that many of the American citizens were identified in the reports. Usually, these names would be “masked.”
Even though Nunes stressed that nothing he saw proved Trump’s claim that President Barack Obama wiretapped him before the election, Trump still said he felt “somewhat” vindicated by Nunes’ intelligence.
Since Nunes failed to bring this intelligence to Adam Schiff, the ranking Democrat on the Intelligence Committee before he went to the president, Democrats have questioned Nunes’ ability to conduct a truly independent investigation. Those calls grew louder after it was reported that Nunes went to the White House grounds on March 21.
According to ABC News, Nunes went to a secure location on the White House grounds to view the documents because they still weren’t available to Congress. But he still could have used a Sensitive Compartmented Information Facility (SCIF) at another location to view the information without it being compromised.
Before it was known that Nunes visited the White House grounds, Press Secretary Sean Spicer said on Friday, “I don’t know where he got them from,” referring to Nunes’ documents.
While Nunes refused to say the name of his source publicly, House Speaker Paul Ryan told CBS News that Nunes described his source as a “whistleblower-type person.”
“He had told me that — like, a whistleblower-type person had given him some information that was new that spoke to the last administration and part of this investigation,” Ryan, who also told CBS News that he hasn’t seen the documents from Nunes, said. “He briefs me about it, didn’t know the content of it, only knew the nature of it and that he was going to brief others.”

Cohen-Watnick’s attorney, Mark Zaid, said that reports of his involvement in the Nunes incident were erroneous. While Cohen-Watnick was working on unmasking issues at the NSC, Zaid said in an interview, “he never showed the documents to Nunes. He never met with Nunes. He had nothing to do with Nunes.”
Zaid said that Cohen-Watnick was not fired from the White House. “There was a decision that he was going to leave the NSC to go to another federal position and he resigned on his own accord to go to Oracle,” Zaid said.
Bloomberg previously reported that former National Security Adviser H.R. McMaster had Cohen-Watnick removed from the White House agency. A White House official confirmed Wednesday he was forced out.
Zaid said that Sessions offered Cohen-Watnick a job in September. Cohen-Watnick neither accepted nor declined the position, Zaid said. “He was continuing to enjoy his time at Oracle,” he said.
Trump had thought Cohen-Watnick began working at the Justice Department in the fall, but a confidant told the president during a recent phone call that he was not, according to a person briefed on the call. Trump was displeased, and told staff to make it clear he wanted Cohen-Watnick on the job as soon as possible.

Ezra Cohen-Watnick, the senior director for intelligence on the National Security Council, has been dismissed from the White House, two senior administration officials who are not authorized to discuss personnel matters told Conservative Review on Wednesday.
Cohen-Watnick, 31, was originally brought on board by former NSC chief Gen. Michael Flynn.
National Security Adviser H.R. McMaster has, in the past, attempted to rid the council of Cohen-Watnick, but was overruled by President Trump, Steve Bannon, and Jared Kushner.
He has been described as an “Iran hawk” who wanted to revamp counter-Iran efforts in the Middle East, and sought to reform the intelligence community to rein in the “deep state” of unaccountable bureaucrats with rogue agendas.
Cohen-Watnick is the latest Trump loyalist to be fired by Gen. McMaster, whose security council continues to be overwhelmingly staffed with Obama holdovers (almost all of whom have retained their positions).
In the past, McMaster has refused to fire the Obama holdovers. Now-fired Middle East NSC director Derek Harvey compiled a list of Obama holdovers and took that list directly to the president, who requested that McMaster follow through with Harvey’s recommendations. McMaster outright refused.
Under McMaster, the National Security Council has leaked classified information at an unprecedented rate, leading Congress to issue a report warning about its ramifications.
Additionally, top Obama officials continue to come and go in and out of the White House compound as they please. One prominent official, Robert Malley (Obama’s “ISIS czar”), has continued to brief National Security Council staff.

The CIA has traditionally had control over who fills this position, and normally the job is staffed by a more experienced official. Despite his prominent, and apparently quite secure, position in Trump’s NSC, little is known about Cohen-Watnick, who had spent much of his short career as a low-ranking official at the Defense Intelligence Agency. Information about him in publicly available sources is scarce. Few higher-ups from the DIA remember him. Only one picture of him can be found online, a snapshot unearthed by Al-Monitor’s Laura Rozen.
Unlike other White House officials who have become public figures in their own right, Cohen-Watnick never speaks for himself publicly, leaving others to fill the void. Yet he hardly comes into sharper focus when you talk to co-workers, friends, and former colleagues. Ask around about Ezra Cohen-Watnick, and people get defensive. Some profess not to know him, or ask why anyone would want to write about him. Others simply refuse to discuss him.
“I won’t talk to any journalist about Ezra,” said Michael Ledeen, a Flynn confidant who knows Cohen-Watnick well.
“Is it one of your hit pieces?” asked Bannon, who didn’t respond to a further request for comment.
Bannon and Ledeen may be wary of talking about Cohen-Watnick after his first, and thus far only, turn in the national spotlight. Washington got its first real look at Cohen-Watnick when he was identified as one of two White House sources who provided House Intelligence chairman Devin Nunes with evidence that former national security adviser Susan Rice requested the “unmasking” of the names of Trump associates in intelligence documents. In the intelligence world, incidental collection refers to intelligence agencies obtaining, in the course of monitoring foreigners, communications that either refer to or involve Americans, whose names are typically “masked” unless officials request that they be “unmasked.”
The incident, coming in the aftermath of Trump baselessly accusing his predecessor of wiretapping Trump Tower, became one of the first dust-ups related to the investigations into possible Russian collusion during the 2016 campaign that have gripped the White House. The president later accused Rice of having committed a crime; for her part, Rice has denied that she ordered the unmasking for political purposes.

Records show he registered to vote in 2012 with a Miami address, as a Republican and as a Hispanic male (his mother is Colombian).

WASHINGTON — A former American intelligence official who came under intense scrutiny during a stint at the White House last year is returning to government as the national security adviser to Attorney General Jeff Sessions, according to a person familiar with the decision.
The official, Ezra Cohen-Watnick, will play an important role at the Justice Department, advising Mr. Sessions on counterintelligence and counterterrorism.
Mr. Cohen-Watnick is known to be hawkish on Russia and China, believing the intelligence community needs to take a more aggressive approach in countering their activities. Both countries conduct wide-ranging espionage in the United States that targets commercial and government secrets. Mr. Sessions is broadly viewed in the Justice Department as lacking expertise in the area. The Justice Department declined to comment.
Mr. Cohen-Watnick, 31, served briefly at the start of the Trump administration as the senior director for intelligence for the National Security Council, overseeing covert action and other intelligence programs. He was brought on by Michael T. Flynn, President Trump’s first national security adviser. But some former officials criticized Mr. Cohen-Watnick, a former clandestine officer in the Defense Intelligence Agency, as too young for the job, which is usually filled by C.I.A. veterans.
Mr. Cohen-Watnick was ousted in August 2017 as part of changes in the White House, one of several appointees of Mr. Flynn who were removed by his replacement, Lt. Gen. H.R. McMaster. National Security Council aides usually draw little public scrutiny, but Mr. Cohen-Watnick was swept up in the tumult of early 2017 when Mr. Trump accused the previous administration, without evidence, of wiretapping his phones at Trump Tower.
Mr. Trump’s allegations were bolstered by Representative Devin Nunes of California, the Republican chairman of the House Intelligence Committee, who said he had evidence that Mr. Trump’s communications were incidentally swept up in surveillance of foreigners by American spy agencies. Mr. Nunes did not divulge the sources of this information, but American officials later told The New York Times that Mr. Cohen-Watnick, at the instruction of two senior White House officials, helped print intelligence reports that later served as Mr. Nunes’s proof.
The revelation showed that Mr. Nunes and one of the aides, Michael Ellis, a lawyer in the White House Counsel’s Office, were using intelligence to advance political goals. It also undercut Mr. Nunes’s claims that his information came from whistle-blowers, and revealed that he was eager to aid the Trump administration when he was conducting what was supposed to be an independent investigation of Russian election meddling.
Mr. Cohen-Watnick did not provide the intelligence reports to Mr. Nunes.
The episode prompted Mr. Nunes to recuse himself from the committee’s inquiry, which devolved into partisan bickering and has effectively ended.
